2 Please always refer to these general requirements details in combination with any specific s requirements given for each Shell Supply Location (i.e. either own Shell site, rented third party storage or third party supplier) on the website: 1. General The relevant Shell company or third party storage provider/supplier for Shell products ( Shell ) reserves the right to reject any means of transport, when in its view, the transport s equipment condition, standard of maintenance, lack of necessary equipment or (insufficiently qualified) staff would constitute an unacceptable hazard or in the event of legal non compliance or non compliance with the Life Saving Rules or site requirements. 2. Observance of Safety Regulations 2.1 Hauliers and their drivers should be advised that entry to Shell Supply Locations is conditional upon observance of these General requirements, site regulations, the Life Saving Rules and the law ( Safety Regulations ). Buyer, its hauliers and their drivers shall take notice of the relevant site regulations and the Life Saving Rules. 2.2 The 12 Life-Saving Rules are: Work with a valid work permit when required Conduct gas tests when required Verify isolation before work begins and use the specified life protecting equipment Obtain authorisation before entering a confined space Obtain authorisation before overriding or disabling safety critical equipment Protect yourself against a fall when working at height Do not walk under a suspended load Do not smoke outside designated smoking areas No alcohol or drugs while working or driving While driving, do not use your phone and do not exceed speed limits Wear your seat belt Follow prescribed Journey Management Plan Regardless of any other site specific instructions, it is always forbidden to light a fire, to possess alcohol and/or drugs on site, to bring in passengers and to film or to take photographs. 2
3 3. Road transport requirements 3.1 General road transport requirements Any vehicle sent to a Shell Supply Location for product collection may be subjected to close inspection by Shell or third party staff. Should it be determined that a vehicle, or its accompanying equipment, is defective or legally non compliant (including with Life Saving Rules or site requirements) in any respect which has a bearing on safety during transportation then it will be rejected. And, until such time as the identified faults have been rectified, the Shell Supply Locations will reserve their right to refuse entry to the vehicle or to load it. The same (inspection to the extent enforceable and remedies) applies for 'unqualified' collecting personnel (e.g. in case of invalid or missing driving licences/adr certificates/non compliance with the Life Saving Rules) The haulier employed to collect the product must operate to good professional standards and should preferably be SQAS in the EU, in the Americas a Responsible Care Audit or Shell SSE approved 3rd party contractor audit and in Asia Shell local requirements will apply (please check appropriate Shell transport website for more information). The following is a list of those particular requirements which must always be met. The list is not definitive, and it does not supersede the requirements of the relevant national or international (ADR) regulations : Safety equipment such as helmet, goggles/ safety spectacles with side protection, rubber gloves, suitable footwear (e.g. non slip soles and steel toe caps) and flame retardant protective clothing (e.g. long sleeves and long trousers) plus any specific equipment required because of the nature of the product or requested by transport regulations (e.g. ADR): must be available on the vehicle, and must be worn by the driver when so instructed at the Shell Supply Location Drivers must carry an adequate supply of numerals and plates for hazard placarding purposes, and it is their responsibility to apply said numerals and hazard labels / placards in accordance with Shell Supply Location instructions. No vehicle will be permitted to leave a Shell Supply Location until it is properly hazard placarded Bulk road vehicles/ demountable containers must be suitable for loading the product(s) concerned. Tanks must be clean, dry and free from odour OR should be empty from the same product that will be loaded. 3
4 Tank cleanliness and fitness for transport is the exclusive responsibility of the haulier, the haulier will provide a certificate of cleanliness and inspection by Shell does not detract from the haulier's responsibility. If, in the opinion of the Shell inspector the tanks are dirty and/or unfit for loading, the vehicle will be rejected and will only be re-inspected on presentation of a valid certificate of cleaning The driver should be fully informed as to the precise capacity of the tanks, containers, and be able to relay this information to the Shell staff The order quantity for all Shell products must fit in a road barrel or container conforming to the following requirement: Vehicle compartments larger than 7500 litres shall not be loaded between 20% and 80% of the max. capacity, unless they are fitted with baffle/surge plates dividing the compartment in sections of max litres. Loading will be refused if the offered equipment cannot be loaded in conformance with the above requirement Products which are incompatible should not be loaded in adjoining compartments of the tank. If requested, Shell can advise on the compatibility of products Incompatible materials which could present a serious risk of increased hazard when in contact with product(s) to be collected must not be present on the vehicle. Nor should they be subsequently loaded whilst the collected products are still on board. 3.2 Road transport policy for collecting very hazardous products The following products are not allowed for collection by road, unless there is prior approval by Shell Chemicals HSSE & Logistics: Ethylene oxide (EO) Butadiene (BD) Propylene oxide (PO) Ethylene Propylene Benzene (& Pygas) 4
5 MPG USP Toluene Di Isocyanate (TDI) 3.3 Documents to be presented ented by the driver: A written loading order specifying: Indent number Product and quantity to be loaded Destination of the goods Haulier's name Driver's name Vehicle and trailer number Way of transport (ferry, road, combined road rail) (driver s declaration) An instruction in writing for EU specific, in the form specified in of ADR in a language(s) that each member of the vehicle crew can read and understand Shell expects the driver to be fully conversant with the hazard(s) of the product(s) he has come to collect A valid certificate (tank test certificate) for both truck and trailer (where appropriate) A valid certificate of competence to drive vehicles carrying hazardous cargo Valid means: identification by bearing a photograph For hauliers contracted by any Shell company: A valid defensive driving certificate, less than 3 years old Should any vehicle arrive without the above documents OR the relevant information, then: it will not be permitted to enter the plant, and loading will not take place or will be delayed. Any resultant demurrage or additional costs will be for the account of the party who ordered the collection. 5
6 3.4 Weight limits In no circumstances will Shell Supply Locations load a vehicle in excess of the legal weight limits in application between supply point and destination. Where necessary, Shell Supply Locations will reduce the order quantity to bring the loaded quantity within these legal limits. In these circumstances any transport penalty incurred will be for buyer's account. 3.5 Pre departure labeling, placarding and documentation Prior to departure the CMR way-bill must be fully completed. For Europe, as per the relevant transport regulation (ADR/RID [please name in full]) regulations, the Party arranging the transport shall always be responsible for the proper issuance of transport documentation and accompanying documents, such as permits, licenses, notifications, certificates in line with the ADR regulations. The Party arranging the transport shall ensure that it is mentioned as consignor in the transport document and shall indemnify the Party receiving the transport for all damages and costs which arise from the fact that the Party receiving the transport is incorrectly mentioned as consignor on the transport document. In Asia and Americas shipping advise or delivery ticket are applicable documents. 3.6 Adverse weather conditions in the vicinity of the loading plant In the general interests of safety, Shell reserves the right when adverse or unusual weather conditions such as thick fog, black ice or heavy snowfall persist in the vicinity of a loading location. This policy is to reserve the right to suspend the loading and dispatch of vehicles collecting chemical products until such time as conditions improve. Shell regrets any delay or inconvenience caused. 6
7 4. Cost Disclaimer FAILURE TO COMPLY WITH ANY OF THE REQUIREMENTS OR CONDITIONS SPECIFIED ABOVE GIVES THE SHELL SUPPLY LOCATION THE RIGHT TOREJECT A VEHICLE / RAIL TANK CAR OR REFUSE TO LOAD. NO CHARGES ARISING FROM DEMURRAGE, DELAY, CLEANING OR REPAIR WILL BE ACCEPTED BY THE SHELL SUPPLYING COMPANY CONCERNED. 7
