Sealed tenders ( in single bid ) are invited from the interested bidders/parties to bid for Printing/installation/fixing/displaying advertisement of Car Free Day Campaign of Govtt. Of NCT of Delhi on the posterior panel of the low floor buses (about 3196 in no. ) as per the description given in Para (3).The details of the buses has been given in Annexure A. The sealed tender applications in the prescribed format (Annexure B ) along with the security deposit as prescribed in Para (6 )should reach in the office of Deputy Manager(A/cs)Tender Cell, Room no.207,delhi Transport Corporation, I P Estate, New Delhi 110002 within 7 days of publication of the notice in News papers. 2. The bidder/party shall quote the consolidated rates per bus for Printing/installation/fixing/displaying advertisement of Car Free Day Campaign. These rates shall be exclusive of VAT rates which shall be quoted separately. 3. SPECIFICATION OF THE ADVERTISEMENT & SPACE AVAILABLE FOR ADVERTISEMENT :. The bidder /party shall be provided the soft copy of the advertisement which shall be available on the web site of DTC along with this Tender notice. The size of the advertisement will be 7 X 1 6 which shall be displayed on the posterior portion of the low floor bus as per the drawing available as Annexure C. 4. COMPLIANCE TO RULES,REGULATIONS,INSTRUCTIONS AND STATUTORY PROVISIONS : It will be the responsibility of the successful bidder/party to ensure that all instructions/provisions issued from time to time by DTC, or any other agency of the Union Govt. or Delhi Govt., or any other authority are strictly adhered to. Any violation of any lawful provision will be treated as a violation of the terms and conditions of contract and action will be taken against the bidder as per provision of the contract. (i) In case of the advertisement policy for display of ads on buses is modified/not allowed by the Govt. /Court of Law, DTC will not be liable for any compensation for the remaining period of contract. 5. PRESENTABILITY OF ADVERTISEMENT ON THE BUSES: It will be the responsibility of the successful bidder/party to maintain the advertisement in presentable condition for a minimum upto three months. In case some advertisements are found un-presentable and spoiling the look of the bus, he will have to make such advertisement presentable immediately failing which the bidder has to replace the same at his cost.
6. SECURITY DEPOSIT: a) Within Three days from the date of provisional offer letter issued by DTC, the successful bidder/party(s) who is offering the lowest rates shall have to furnish security deposit amount equivalent to 10 % of the total amount of the tender in the form of Demand Draft/Pay order drawn on any Nationalized Bank, payable at Delhi, in favour of MD, DTC, failing which the acceptance of the contract will automatically stand withdrawn without any further notice. (b) The final contract shall be awarded by the DTC only after the deposit of security deposit within a stipulated period. (c) The security deposit shall be forfeited if the successful bidder fails to perform the awarded work within the stipulated time as per Clause 8 (1 ) (d) The security deposit shall be returned to the successful bidder/party only after the expiry of three months after the finalization of the job and no interest shall be payable on the security deposit. 7. DUTIES OF CORPORATION; DTC shall cooperate through its unit heads /depot managers to get the advertisement fixed on all the designated buses as per Annexure A who shall be submitting a satisfaction report to the Publicity department and the payment shall be made after deducting dvat and other applicable taxes. 8. DUTIES AND RESPONSIBILITIES OF SUCCESSFUL BIDDER/PARTY: (i) The fixation/mounting of display material on DTC Low Floor Buses awarded to successful bidder/party shall be carried/performed during the off duty hours/in the night shifts and not during duty timings within 10 days from the date of final award letter. (ii) The successful bidder/party shall be responsible and liable for any damages caused to the vehicles by the successful bidder/party shall be while discharging its Scope of Services and any consequential damages arising there from the successful bidder/party shall be solely responsible for the safety of his persons on the premises of the Corporation while affixing of advertisements on the buses of the Corporation. (iii) If the display/advertisement are damaged due to the negligence of the successful bidder/party, the same shall be immediately replaced free of cost by the successful bidder/party shall be. 9.. FORCE MAJEURE EVENTS: No Rebate or compensation shall extended to bidder on account of Force majeure events. For purposes of this Clause, and subject to (a),(b) (c)and(d) herein, Force Majeure Event(s) shall mean one or more of the following acts or events: (a) Acts of God events beyond the reasonable control of the affected Party which could not reasonably have been expected to occur, exceptionally adverse weather conditions, lightning earthquake, cyclone, flood, volcanic eruption or fire or landslide; (b) Radioactive contamination or ionizing radiation; (c ) Strikes/boycotts/agitations/curfew interrupting movement of buses and services. (d) Any act of war (whether declared or undeclared) invasion, armed conflict or act of foreign enemy, blockade, embargo, riot, insurrection, terrorist or military action, civil commotion or politically motivated sabotage. (e) The Corporation shall not allow any rebate on detention of buses on road on Account of breakdown, accident or any other reason beyond the control of
the Corporation. 10. THE MANAGING DIRECTOR S AUTHORITY TO RECOVER THE COST IN CASE OF ANY DEFAULT: If the successful bidder/party neglects or fails to do anything which he has agreed to do so under the agreement, the Managing Director or any other authorized person may serve a 02 days notice on the successful bidder/party asking him to do the thing agreed upon and bear the cost thereof. This will be without pre-judice to any other rights the Managing Director may have on account of such default. 11. INSOLVENCY OF SUCCESSFUL BIDDER/PARTY In the event of the successful bidder/party and if successful bidder/party is a firm any partner of the successful bidder/party firm, is adjudged insolvent or bankrupt or make an assignment for the benefit of creditors, the Chairman or Managing Director, DTC or his authorized representative will have a right to give 2 days notice to the successful bidder/party for terminating his contract and their-upon at the expiry of such period of 10 days, the contract shall stand terminated with the same force and effects as if such date was the date for the expiry of the original contract 12. PERMISSION FOR SUCCESSFUL BIDDER S EMPLOYEES TO ENTER THE CORPORATIONS S PREMISES. Maximum four persons authorized by the successful bidder/party, shall be permitted to enter into a depot premises for the purpose of fixing of advertisement or for any other reason connected with their lawful business. Such persons must carry Identity Cards with their photographs. The fixation/mounting of display material on Rear Panel of Low Floor Buses awarded to successful bidder/party shall be carried/performed during the off duty hours/in the night shifts and not during duty timings. 13. WRITTEN AGREEMENT. The successful bidder/party will have to enter into an agreement with the Corporation for the proper fulfilment of the contract on lines similar to terms of the tender or as modified or added by Chairman-cum-Managing Director, DTC. Such successful bidder/party shall have to furnish two non-judicial stamp paper Rs.100/- each within two days on receipt of intimation of acceptance of the tender and agreement shall be executed only on furnishing of Security in the shape of Demand Draft/Pay order as stated above and after completion of all other formalities as per requirement of the Corporation. 14. SUBMISSION OF STATEMENT. The successful bidder/part will maintain a record of fixing of advertisement displayed by him on the buses and shall submit to DTC a soft copy of the photographs of the rear portion of the buses (in the form of CD) depicting therein the registration no. of buses along with the advertisement of all the depots.. 15. DISQUALIFICATION OF SUCCESSFUL BIDDER/PARTY: Non-compliance/deviation from the above referred terms and conditions/procedure relating to award of contract shall disqualify the successful bidder/party. 16. COUNTER OFFER: No counter request/offer will be acceptable to the Corporation once the tender process is initiated. 17. SUCCESSFUL BIDDER S RESPONSIBILITY FOR PUBLIC LIABILITY AND AGAINST ALL CLAIMS, ACT LOSSES ETC.:
The successful bidder/party shall indemnify the Delhi Transport Corporation against all claims, actions, demands, losses, charges, cost of expenses which the Corporation has to incur or which may occur on account of infringement of any of these conditions by the bidder or on any other account whatsoever. The successful bidder/party shall obtain a public liability policy of insurance in respect of all Buses allotted to him in the awarded zone 18. DISPUTE SETTLEMENT COMMITTEE: There shall be a Dispute Settlement Committee, which shall try to settle all disputes at the first stage. The Dispute Settlement Committee shall consist of the senior officers of the Corporation as nominated by the MD representing inter-alia the Accounts, Law, Publicity, and the Depots/Units managing the publicity contracts. The authorized representative of the successful bidder/party will be allowed to participate in the Dispute Settlement procedure. If the Committee fails to resolve the issue, the parties will be free to redress it in the Court of Law in accordance with law. 19. JURISDICTION OF COURT. The Courts located in Delhi shall only have jurisdiction to try and decide the matter/dispute between the parties.
