INTRODUCTION The Webster Place Condominium Association in Brookline, Massachusetts has been created with the objective of providing congenial, enjoyable and dignified residential living. In order to accomplish this objective, the Managing Board of the Condominium Association has adopted the Rules and Regulations to provide for the proper administration, operation and maintenance of the Condominium. Each Unit Owner shall, in addition to the obligations and duties as set forth in the Master Deed, the By-Laws or any amendments thereto, be governed by the following Rules and Regulations. In order for the Unit Owners to better understand the Rules and Regulations, the defined terms used in the Master Deed establishing the Condominium are used with the same meaning, except that, whenever these Rules and Regulations impose a duty or obligation upon a Unit Owner is to observe, obey and comply with, the term " Unit Owner" shall include in addition, when the concept so permits, all family members, guests and invitees thereof, and any occupants of Units in the Condominium. Unit Owners will be assessed for violations of their Tenants and are responsible for paying the assessments. A written letter informing the Unit Owner of violations by themselves or their tenant(s) will be mailed to the Unit Owner. RULES & REGULATIONS COMMON AREAS AND FACILITIES Unit Owners shall not obstruct any Common Areas and Facilities except as the Board may permit. No articles, including but not limited to umbrellas, boots and shoes shall be left by residents in the corridors or other Common Area and Facilities of the Condominium, nor may any decoration be attached to corridor doors or walls. Residents may place their names only in such places outside of the Unit as may be provided for them by the Board. No baby carriages, bicycles, playpens, wagons, toys, benches, chairs or other articles of personal property shall be left unattended in the Common Areas of the building, parking areas, sidewalks, or elsewhere except in those areas specifically designated by the Board. Nothing shall be altered, constructed or removed from the Common Areas and Facilities except upon the written consent of the Board. No part of the Common Areas and Facilities shall be decorated or furnished by any Unit Owner without the written consent of the Board. Any maintenance, repair or replacement of Common Areas and Facilities which is the responsibility of Unit Owners pursuant to the Master Deed shall be done only by contractors or workmen approved by the Board or the Management Company. There shall be no smoking in any common areas. CONSTRUCTION WORK The management company shall be given written notice of any and all construction to take place within a unit. The notice shall include a full description of all work to be performed. Approval from the management company is required before work can start. The management company may also seek approval from the Board before construction begins. Any building permits required are the responsibility of the Unit Owner. Subject to the provisions of paragraph 11(j) of the Master deed, no unit owner shall make any addition, alteration or improvement of a structural nature in or to his unit and no unit owner shall make any exterior alteration or addition (including painting, awnings, grills, and the like), without in each instance submitting a plan and/or drawing of such alterations or additions to the Managing Board for the Managing Board's approval of such alterations or addition, such approval not to be unreasonably withheld. (See Article V Section 13 of the Condominium bylaws for additional information). A more thorough outline of construction guidelines titled General Rules for Contractors may be obtained from the management company or from the concierge. DELIVERY OF PACKAGES The Association shall not be responsible for the loss of or damage to any package or other item which may be delivered other than directly to a resident. Please keep these guidelines in mind when you are ordering items for your home. The concierge will be available on Monday Friday 9:00am 8:00pm and Saturday 9:00am 1:00pm to sign for packages for the unit owners and occupants of Webster Place and the Mayfair. The concierge may reject a package that is larger than 3ft. x 3ft., heavier than 30lbs and exceeding $200.00 in value. The concierge may also reject a package depending on the space available for storage at the time of delivery. 5

If the concierge rejects the package the delivery company will be instructed to use the intercom system in the lobby to contact the unit occupant directly. If the occupant does not respond to the intercom, a notice may be posted on the appropriate unit s mailbox notifying the occupant that the company attempted to make the delivery. Residents cannot request that any employees deliver their packages to their unit. Any employee (concierge, superintendent or cleaner) witnessed delivering packages will be immediately terminated. If the unit occupant is too ill to retrieve their package from the front desk, they may request the assistance of the concierge. However, the occupant must be present during the delivery of such package as employees are strictly forbidden to utilize unit keys (unless there is an emergency). EQUIPMENT COMPLIANCE All radio, television or other electrical equipment of any kind or nature installed by Unit Owners or used in each unit shall fully comply with all rules, regulations, requirements or recommendations of the board of Fire Underwriters, or similar board, and the public authorities having jurisdiction, and the Unit Owner alone shall be liable for any damage or injury caused by any radio, television or other electrical equipment in such unit. FLAMMABLE MATERIALS Neither Unit Owners nor any of their agents, servants, employees, licensees or visitors shall, at any time bring into or keep in their units or any portion of the common elements, including storage areas, any gasoline, kerosene or other flammable, combustible or explosive fluid, material, chemical or substance, except such lighting, cleaning and other fluids, materials, chemicals and substances as are customarily incidental to residential use. FINES The Board shall have the power to assess late fees on the maintenance charges and other fines for violations of these Rules and Regulations, which late fines shall constitute a lien against the unit of the Unit Owners assessed, and the Board shall also have the power to enjoin, abate or remedy the breach of any of these Rules and Regulations by appropriate legal proceedings. The fines will be $25.00 for the first offense, $50.00 for the second, $100.00 for the third offense and $100.00 for every violation thereafter. These fines do not include costs for any destruction or damage done to common areas. KEYS All residents will provide the management company with all keys necessary for access to his or her unit so that the unit may be entered in the event of an emergency. In the event that keys are not provided to the Board, the Unit Owner shall be responsible for costs associated with an emergency entrance to the unit. MECHANICAL SYSTEMS AND ELEVATORS Unit Owners shall not abuse or misuse any mechanical, plumbing, electrical or other building service system of the Condominium. In the event of such abuse or misuse, the Board may charge the responsible Unit Owner for any damage so caused. With the exception of notices from the management, no notices, signs or advertising material whatsoever shall be placed in the elevators or elsewhere in the Condominium 6

except in display cases specifically provided therefore, in which event only notices authorized by the Sward may be displayed. Any person requiring use of an elevator for transporting furniture or other large items shall make a reservation for use of the elevator in advance with the management office. MODIFICATIONS TO RULES AND REGULATIONS These Rules and Regulations may be amended from time to time or repealed by a majority vote of the Board. No addition or modified Rule or Regulation shall take effect until communicated in writing to the Unit Owners. Any Rule or Regulation adopted by the Board can he repealed or otherwise superseded by a vote of a majority of the Unit Owners MOVING IN/MOVING OUT AND FURNITURE DELIVERY Unit Owners must inform the management company about moving and furniture delivery so that proper protection for the elevators and other common areas can be arranged. A fee of $300 will be due from unit owners for each move-in and move-out. NO OFFENSIVE ACTIVITY No noxious or offensive activity shall be carried on in any unit, or in the common areas and facilities, nor shall anything be done, either willfully or negligently, which may be or become an annoyance or nuisance to the other Unit Owners or occupants. No Unit Owner shall make or permit any disturbing noises by himself/herself, his/her family, servants, employees, agents, visitors or licensees, nor do or permit anything by such persons that will interfere with the rights, comforts or conveniences of other Unit Owners. Unsanitary conditions shall be corrected by the management company at the Unit Owners expense. NOISE No resident shall make or permit any disturbing noises by himself/herself, his/her family, servants, employees, agents, visitors or licensees, nor do or permit anything by such persons that will interfere with the rights, comfort or convenience of other residents or will in any way be offensive to such residents. The volume of television sets, radios, phonographs, musical instruments and the like shall be turned down between 10:00 p.m. and 8:00 a.m. and shall, at all times, be kept at a sound level which will not annoy the residents of neighboring units. A first offense will result in a verbal and written warning. Subsequent offenses will result in fines. PARKING The parking spaces are intended to be used solely for the parking of licensed vehicles. Without the express written consent of the Board, no commercial vehicles such as buses, trucks, vans, or trailers, etc. and recreational vehicles or boa t s may be parked in any parking space. All vehicles parked on the Condominium premises shall be at the sole risk of the person so parking, and the Board shall not be liable for loss, destruction, theft or damage to such vehicles. All Unit Owners, shall observe and abide by all parking and traffic regulations as posted by the Board, the management company or by municipal authorities. Vehicles parked in violation of any such posted regulations may be towed away at the violator ' s expense. The speed limit in the garage is no more than 5 miles per hour. No item other than permitted vehicles and bicycles shall be stored or parked in a parking space. Each Unit Owner is responsible for maintaining a clean parking space. Lost garage cards will be replaced at a reasonable cost. Damaged or nonfunctioning. 7

P E T S Animals are not permitted except as provided for in the Master Deed. Pet owners must adhere to the following guidelines: Animals may be kept in any Unit or in the Common Areas and Facilities only upon prior written consent of the Managing Board of the Condominium Association; provided than any such animal causing or creating a nuisance or unreasonable disturbance or noise shall be permanently removed from the Property upon three (3) days written notice from the Managing Board. In no event shall any animal be permitted in any portion of the Common Areas and Facilities unless carried or on a leash (including but not limited to elevators and courtyard). Any damage or destruction caused by the animal shall be repaired by the Managing Board at the expense of the Unit Owner, but the Unit Owner shall remove any feces of the pet from the Common Areas and Facilities. Residents who would like to have a pet must submit a request in writing (see Pet Application) to the Managing Board, including a photograph of the proposed pet. In no case shall the number of animals exceed one (1) per Unit. At no time are pets allowed to be off the leash in the common area courtyard. On the last page of this packet you will find a pet application form. Please fill out the application and forward it to the front desk concierge at 20 Webster Street. Please note: Failure to fill out the application and adhere to the pet rules and regulations will result in fines. PEST CONTROL The Board, the management services company and any contractor or workman authorized by them, may enter any unit in the Condominium at any reasonable hour of the day after notification (except in the case of an emergency) for the purpose of taking such measures as may be necessary to control or exterminate vermin, insects, or other pests. Due consideration shall be given to the medical requirements of the occupants in regard to methods of extermination. PROPERTY DAMAGES Any damage caused by one Unit Owner to the common areas or to other Unit Owners' units is the sole responsibility of the Unit Owner causing the damage. RENTALS Article 11(f) of the Master Deed specifies the conditions and restrictions which apply to the tenanting, renting or leasing of all Units. Each Unit Owner is personally responsible and liable for the actions of tenants and all other occupants. These rules and regulations shall be incorporated into any and all lease or tenant at will agreements before occupancy. The Managing Board, through the managing agent, must be provided with a copy of the lease or tenant at will agreement before the occupancy. STORAGE AREAS No items shall be stored in common areas except as provided for in the Master Deed. All personal property placed in any portion of the common areas shall be at the sole risk of the Unit Owners, and the Board shall not be liable for loss, destruction, theft or damage to such property. 8

SWIMMING POOL, EXERCISE ROOM & PATIO The pool is generally opened for the season on memorial day and closed on labor day. The Board of Managers reserves the right to amend pool opening and hours as dictated by weather conditions. Use of the pool is subject to the rules and regulations that are established by the Town of Brookline Health Department to ensure the pleasure and safety of all swimmers. Residents must accompany their guests, and they are responsible for the conduct of guests at the pool. Safe use of the pool is paramount. The Board of Managers and any persons appointed by them to supervise the pool may at any time require that people cease any activities that are dangerous to themselves and others. Scheduled Pool Hours: Monday - Friday 2:00 PM - 8:00 PM Saturday & Sunday 10:00 AM - 8:00 PM People with inflamed eyes, infections, bandages or open skin abrasions may not use the pool. We encourage all swimmers to shower at home before entering the pool. Use of the pool area is restricted to residents and invited guests. Due to the limited space in the pool area, residents are asked to limit the number of guests they invite to the pool, especially on weekends and holidays. Each resident is responsible for the conduct of his/her guests and any damage caused by their guest. Running, pushing, splashing, diving as well as loud noises and unruly behavior is strictly prohibited in the pool area. Ball playing or water pistols are not allowed in the pool area. Radios, CD Players, MP3 players etc. are to be played only with earphones or headphones. At the recommendation of the Brookline Health Department, children under the age of three are allowed in the pool only if they are using special waterproof/swimming-approved diapers. Children under the age of twelve are not allowed in the pool without adult escorts. Food is permitted at the pool, but proper cleanup is required. Alcohol is no permitted. Glass containers, bottles and breakable objects are not allowed in the pool area. Beverages in plastic containers and/or cans are permitted. Refuse must be deposited in appropriate receptacles. All persons entering the pool must wear bathing suits; no cut-off shorts, shorts or jeans are allowed in the pool. Smoking is prohibited in the pool and wooden deck areas. Water wings and life vest are allowed. Kickboards may be used when the pool is not crowded as long as they do not create a disturbance. If people use suntan lotion, they must put towels on the chairs to prevent discoloration. In the event that there is no lifeguard available for duty, the pool will be closed without notice. No pets are allowed in the pool area. Infractions of the pool rules will result in fines and may result in being prohibited from using the pool. Children under the age of 12 are not allowed in the exercise room. The patio may be reserved for birthdays and special events. These guidelines must be followed for private gatherings in the common areas: 9

The event will be limited to a maximum of two hours, beginning no earlier than 10:00am and ending no later than 9:00pm. The residents who request the use of common areas for private functions will be responsible for any damage that might be caused by during that event. Residents reserving the common area must clean up the space after the event. The event needs to be supervised by Igor Gerzon, who will attend the event to ensure that no damage is done to the property and make sure that it is appropriately cleaned by the resident. No alcoholic beverages are allowed under any circumstances. No other activities are permitted that may damage the premises or that may incur liability to the association. The cost for the supervision ($50 per hour) will be paid by the resident hosting the event (a bill will be provided at the end of the event and the bill must be paid in full at that time). Residents may not reserve the common area more frequently than once a month. Reservation for such events will be taken by Igor Gerzon, in advance, on first come first serve basis. The request to reserve the common area will be reviewed by the board and approved on a case-by-case basis. TRASH ROOMS A trash room is located on each floor of the building. All trash must be bagged or wrapped and thrown down the trash chute. Any trash too large for the trash chute shall be kept in the Unit Owner's unit until arrangements with the building's staff can be made for its removal. It shall be the resident's responsibility to dispose of any trash articles too large to be disposed of by normal commercial trash pick-up. At no time is trash or garbage to be left on the floor of the trash room or in the hallways and stairwells. Cans, bottles and newspapers should be placed in the appropriate recycle bins in the trash rooms or the garage. WINDOWS, BALCONIES AND TERRACES Unit Owners shall at their own expense, keep the balcony or terrace, if any, of which the unit has the exclusive right and easement, clean and neat at all times. In no event shall the balconies or terraces be painted or otherwise altered to change their uniform, appearance with the other balconies and or terraces of the Condominium. No enclosures may be erected without the written permission of the Board. No awnings, antennae, aerials, signs, wind chimes or other alterations or projections shall be attached to the outside walls of the buildings or railings, or hung or displayed from any windows, balconies or terraces without written permission of the Managing Board. Balconies and terraces shall not be used for the storage of furniture or other articles. No laundry, rugs, drapes, mops or other items shall be shaken from or hung outside any window, balcony or terrace, nor shall any dirt or other substance be swept or thrown from such structure. Residents shall not be permitted to install any additional heating or air conditioning equipment from any windows, balconies or terraces. All draperies, window treatments and window coverings in each unit shall be lined with a white material or shall be white on the facing visible from the exterior such that when closed or drawn the appearance of the window from the exterior of the Unit shall be white. Immediate access to balconies and/or terraces is acceptable in cases of emergency. In all other situations notification must be made at least 24-hours in advance. 10

WEBSTER PLACE CONDOMINIUM ASSOCIATION PET APPLICATION Dog owners must include a copy of the annual Town of Brookline Dog License, rabies vaccination and a photograph of their pet. All other pet owners must include a copy of the rabies vaccination and a photograph of their pet. Please forward this application form along with the required documents to the front desk concierge at 20 Webster Street.
