COSMO-SkyMed (CSK) Applications COSMO-SkyMed is a high resolution radar dual system, based on a separate civil and Defense component, with the capability to serve, at the same time, both civil and military users. CSK has been developed by ASI in cooperation with the Italian Ministry of Defence, to provide products/services for the following purposes: environmental monitoring surveillance applications for the management of exogenous, endogenous and anthropogenic risks; commercial purposes
COSMO-SkyMed Data Policy Legal Framework -COSMO-SkyMed data policy has been drawn up by elaborating the relevant principles contained in the Intergovernmental Agreement between Italy and France for a cooperation in the field of the Earth Observation signed in 2001 (ratified under Law n. 20, of January 10th, 2004), under the framework of which the program has been originally developed, and within the collaboration between ASI and the Ministry of Defence, At national level, three main documents has been approved: a) the Interministerial Decree n. 32, dated December the 1 2006, issued by the Ministry of Research, the Ministry of Foreign Affairs and the Ministry of Defence; b) the COSMO-SkyMed National Data Policy and Resource Sharing (DPRS), approved on March 7, 2007, elaborated by ASI and the Ministry of Defence c) the Guidlines for the Utilization of the COSMO-SkyMed system, approved by the OICI (Commite for the Guidance and Coordination with the Institutions) in 2009, which applies to the civil component products with a resolution equal to or above 1 meter
Governance of CSK Under the 2006 Interministerial Decree, ASI assures the interface with civilian Data and Products users of CSK (Institutional and commercial),both National and International; ASI is in charge of programming, processing, promoting the use of CSK and distributing Data/Products to Civil Users; ASI and IT-MoD are granted the Intellectual Property Rights (IPR) of CSK Products deriving from their respective programminig of the Satelites; ASI has been authorized by IT Ministry of University and Research to assign the e-geos company (partecipated by ASI and Telespazio Spa) the commercial distribution of CSK civil Products;
COSMO-SkyMed Data Policy (1) National Data Policy and Resource Sharing- DPRS, (*) lays down general principles of National Data Policy of COSMO-SkyMed system distribution data : COSMO-SkyMed System is owned by Italian Space Agency and IT MoD COSMO-SkyMed System User categories may be diveded into three main groups: owners of the System: the Italian Space Agency and the Italian Ministry of Defence; institutional, national and international users, including also scientific users; generic (or commercial) users, including all other users; Raw data generated by the CSK system are not available for commercial users; (*) Approved on March 7th, 2007 by the Head of General Military Staff, Head of the relevant National Security Authority, and the President of ASI
COSMO-SkyMed Data Policy (2) Standard and high level products may be distributed for commercial purposes according to the D.P.R.S.; IT MoD has the priority in the satellite daily planning; IT relevant governmental security organizations have the Right of Veto over the CSK System at Programming of requests and distribution of product (Shutter Control); A specific Committee is established (OICI**) composed of representatives of ASI, the MOD and the NSAs, with the tasks of defining the Guidelines for the use of the System civil component and coordination with other Italian Ministries and Governmental Bodies in order to harmonize the distribution of data and products according to the national security, foreign and other national policies. IT Regulatory approach (1) a) Dissemination of data ASI may distribute under the terms of specific agreements and licences to use products to national and international institutional users Standard and High Level products are distributed by e-geos, under the terms of a specific Convention with ASI, which has the right of exclusive commercialization of CSK products generated by civl component of the System; e-geos,, distributes civil products on the bases of contracts and LICENCE to USE, which include security relevant provisions for the users; ASI - for institutional purposes - may use raw data (including data with a resolution below 1 meter) on the basis of a specific Agreement with IT-MoD; The use of raw data for Institutional Users (Civil Protection Authority, Research Centers, Universities.) is subject to prior ASI and IT-MoD consultation and on specific Licence tof Use. Requests from NON National Defence Users to Civil Provider (e-geos) will be satisfied provided relevant NSA assessment;
IT Regulatory approach (2) The Steering Committee Organo di Indirizzo e Coordinamento con le Istituzioni (OICI), formed by representatives appointed by ASI, IT MoD, IT Security Organizations and Ministry of Foreign Affairs is in charge of: Analyzing potential implications connected with the distribution of Earth Observation Data/Product to commercial and Institutional Users; Define guidelines for the utilization of the civil component of the system; Assure the coordination with other Italian Ministries and internal Governmental Bodies in order to harmonize the distribution of data and products according to the national security, foreign and other national policies, civil protection, research and development as well as commercial needs.
IT Regulatory approach (3) To implement Data Policy and Resource Sharing (DPRS), O.I.C.I. has finalized and approved the Guidelines for the use of CSK system (Linee guida per l utilizzo del Sistema COSMO-SkyMed) where: Data from SPOLIGHT2 functional-mode of the system with a resolution 1 meter and above (best information contribution available for civil users) will be provided only to Bodies, Organization or Companies, excluding the distribution to private persons on the basis of specific contracts; Products distribution is controlled, applying a CONTROL TABLE, annexed to the Guidelines for the use of CSK
CONTROL TABLE CONTROL TABLE is connected to the annexes of which include: A reference to a list of physical persons and Entities to which no products or services may be transferred according to European Community provisions (EU Regulations no. 2580/2001 and no. 423/2007 and to the document Common Position no.140/2007/pesc), adopted in the framework of the international antiterrorism policy; A classified list of Countries to which only products of their territory may be released; Applicant coutries-requested areas combinations for which an evaluation on a ase by case basis is required by OICI to deliver 1 meter resolution products.
