3 ICA Single Window: the legal basis Law No. 350/2003 (art. 4 par. 57 and 58) Decree of the Prime Minister having regulatory nature (DPCM n. 242/2010). In the Italian Single Window system the Customs administration acts as a coordinating and monitoring body. It collects all information and data required for clearance and exchanges them with economic operators and the other administrations involved through the electronic dialogue. 3

4 Implementing Regulation: DPCM 242/2010 Immediately Transparency and certainty for businesses: synthesis of the documents required for import and export operations (annex A and B of DPCM); maximum deadlines for certificate issuing - art. 2; Transitional phase: start-up of the single window (by 27 July 2011) - art. 6. Decision-making meetings have been promoted by the Regional Customs Directorates in order to: identify solutions to harmonize opening hours; facilitate and standardize the implementation of controls. 4

5 DPCM 242/2010 Within 3 years from start-up(27 July 2014): Certificates/authorizations will be requested and controlled electronically (single window) - art. 3 The controls by customs and other public administrations will be unified (same place, same time) (one stop shop) - art. 4 The customs single window implements the electronic coordination of the administrations, according to the Digital Administration Code (D. 9 The methodology This is the 4-step approach used within the Functional-procedural Interoperability sub-committee working groups. 10 The methodology The AS-IS modeling is carried out through: 1. The review of the certificates listed in annexes A and B of the decree: Checking of the validity of the certificates listed in annexes A and B; Verification of the need to introduce new certificates in annexes A and B. Communication to the Monitoring Committee if variations are needed (in this case legislation shall be amended). 2. For each certificate, the competent administration (the administration issuing the certificate) should indicate: The certificate code (if available in TARIC); The Competent DG within the Administration; Legislation references; Description of the current issuing process and of the use of the certificate (AS IS); Information System description (if available). 10

In case of difformity the declaration is rejected (admissibility check). 6. If everything is ok the declaration is registered and the AGRIM quantities are simultaneously updated online by the Ministry of Economic Development. 16

The project started in June 2011 and ended in December Results: Global licences available in the system. Data exchange between systems. 17

17 Working in progress Ministry of Health 7 certificates in annex A and 12 in annex B certificates issued by the Ministry of Health each day. The project started in June 2010 (before DPCM) and is still running. Results: Consultation of Manifest of Incoming Goods (since November 2011); Formal controls of the certificate code declared in box 44 of the SAD (since March 2012); Data exchange between Customs Agency and Ministry of Health via web services (soon). 19

18 Previous situation: health check + customs check 1 check: Common Veterinary Entry Document (CVED) is requested to the health authority. The goods must be available for the inspection (if required by the vets at BIP - Border Inspection Point). Only when the CVED is issued by vets at BIP, the economic operator can send the custom declaration stating the number of the certificate in box 44 of the SAD. 2 check: customs, on the basis of risk analysis, can perform additional physical inspection of the goods. How to unify controls? 20

Shipping company Sends the Manifest of Incoming Goods Receives the reference number of the temporary storage (A3 numbers) Declarant Submits an application for the CVED to the competent authority Keys in MMA and A3 numbers Declarant Lodges the customs declaration and includes the booking reference number / the number of the CVED certificate in box 44 of the SAD AIDA Notifies to the declarant if goods can be released. If not, notifies the type of control: A3 Customs Check; Health Check; Customs and Health Check (UNIFIED). 20 Interoperability design : Annex B This model has three main goals: Reducing time for customs clearance (always); One single moment for controls (one-stop-shop approach); Reducing time and costs for goods inspection. 22

21 Revision of Annex A and B of DPCM 242/2010 The list of certificates included in tables A and B of the Italian Decree on Single Window ( Sportello Unico Doganale ) has been reviewed: some certificates have been canceled, others have been combined and others have been added (changes have occurred in the legislation ). For each certificate, the Ministry of Health has provided a text document containing: the description of the process for issuing the certificate; the regulation supporting the process; the time required; information about the computer system supporting of the process. 23 Copyright

22 AS IS Analysis Three different information systems have been identified: Nuovo Sistema Informativo Sanitario NSIS - PIF, for the management of national certificates, used by vets at Border Inspection Points; Nuovo Sistema Informativo Sanitario NSIS - USMAF, for the management of national certificates, used for goods related to human health; TRACES, managed by DG SANCO at EU level, for the management of CVED-P and CVED-A, used by vets at Border Inspection Points. DG SANCO will be involved in the Italian Single Window in the next months. 24

23 TRACES TRACES (TRAde Control and Expert System) is managed by the European Commission (DG SANCO) and is used by all MSs to manage the import / transit of live animals, animal products and certain vegetable foods throughout the EU. Working in progress on the interoperability (Single window + one stop shop) between AIDA and TRACES The adopted solution can be reused for other certificates, e. g. for Fishery Products and Cultural Goods. 25 Copyright
