INTRODUCTION The College of Law s Graduate Diploma of Family Dispute Resolution Practice will train you in the core competencies required by the Attorney-General to become an Accredited Family Dispute Resolution Practitioner (FDRP). WHAT IS A FAMILY DISPUTE RESOLUTION PRACTITIONER (FDRP)? An FDRP is an independent professional who helps people affected by separation or divorce to resolve their disputes. To become an FDRP, you must meet the requirements under the Family Law (Family Dispute Resolution Practitioners) Regulations 2008 and apply for accreditation with the Attorney-General s Department. The Graduate Diploma of Family Dispute Resolution Practice is designed to meet the educational requirements leading to accreditation by satisfying the six core competencies prescribed under the Family Law (Family Dispute Resolution Practitioners) Regulations 2008, plus a minimum of 10 hours of clinical placement. The competencies are satisfied within the four subjects of the Graduate Diploma. DELIVERY This course is designed to be intensive and to enable you to satisfy the educational requirements required to become a FDRP within six months. In addition, you must complete the clinical placement before you can apply for registration. You will need to attend faceto-face workshops on three occasions, plus complete online study. You can expect to spend around 10 hours per week on study. Completion of the Graduate Diploma of Family Dispute Resolution Practice will enable you to satisfy your CPD requirements of ethics, professional skills, practice management and substantive law. SHOULD I ENROL? Family Dispute Resolution Practitioners come from a variety of backgrounds. You do not need to practise family law or even be a lawyer to enrol. While family law is covered, the focus is on the practical realities of resolving conflicts which involve families, relationship breakdowns and family violence. It is likely that each class will consist of lawyers, social workers, psychologists and people from other backgrounds, providing an opportunity to learn from diverse experiences. To enrol, you must hold a Bachelor s degree or equivalent. Do you hold a Master of Applied Law (Family Law) or are you a Nationally Accredited Mediator or Accredited Specialist (Family Law)? If so, you may be eligible for advanced standing. The Graduate Diploma of Family Dispute Resolution Practice has been beneficial to my practice and an efficient means of gaining the necessary qualifications of becoming an FDRP. The qualification has added a new dimension to my Family Law practice and I would recommend this course to other practitioners. FREQUENTLY ASKED QUESTIONS HOW DO I BECOME A FDRP? In order to become an accredited FDRP you need to complete a course that covers the six competencies prescribed under the Family Law (Family Dispute Resolution Practitioners) Regulations 2008 and a supervised placement. The College of Law s Graduate Diploma of Family Dispute Resolution Practice satisfies the educational requirements. The four subjects: FDRP1 Mediation, FDRP2 Understanding and Working with Families in Conflict, FDRP3 Australian Family Law and FDRP4 Advanced Family Dispute Resolution cover the six core competencies outlined. In addition, you must complete a minimum of 10 hours of practicum placement, completed after you have finished the coursework. Once you have completed both the coursework and practicum you can apply to Attorney-General s Department for accreditation as an FDRP. WHAT IS THE DIFFERENCE BETWEEN AN FDRP AND A NATIONALLY ACCREDITED MEDIATOR? A family dispute resolution practitioner (FDRP) is an independent person that assists people who have been affected by divorce or separation in order to resolve their parenting disputes. FDRPs specialise in family dispute resolution. FDRPs can issues s60i certificates under the Family Law Act 1975. A nationally accredited mediator acts as a third party in order to support the participants of the mediation to reach their own decision. Mediators assist in managing the process of dispute and conflict resolution where the participants subsequently agree on the outcomes where appropriate. Mediators do not specialise in family law and may mediate across a number of areas, including family law. Nationally accredited mediators who are not FDRPs cannot issues s60i certificates under the Family Law Act 1975. It is possible to be both an FDRP and a nationally accredited mediator. HOW DO I BECOME A NATIONALLY ACCREDITED MEDIATOR? In order to be accredited, you must do the following: A mediation course that meets the requirements under the National Mediator Accreditation Standards (NMAS). FDRP1 subject is a mediation course that satisfies the NMAS requirements. Pass an accreditation assessment under NMAS Other requirements are: Evidence of good character; An undertaking to comply with ongoing practice standards and compliance with any legislative and approval requirements; Evidence of relevant insurance, statutory indemnity or employee status; Payment of the Mediator Standards Board registration fee; Evidence of membership or a relationship with an appropriate association or organisation that has appropriate and relevant ethical requirements, complaints and disciplinary processes as well as ongoing professional support Evidence of mediator competence by reference to education, training and experience

WHAT IS THE PRACTICUM, OR CLINICAL PLACEMENT? After you complete the required coursework, you also have to complete a practicum placement. Practicum must be 10 hours in total and it has to be supervised by a person that is an accredited Family Dispute Resolution Practitioner under the Family Law (Family Dispute Resolution Practitioners) Regulation 2008. Your practicum must occur in the delivery of mediation services which should: Respond to domestic and family violence in family work Create a supportive environment for safety of vulnerable parties Operate in a family law environment Facilitate dispute resolution in the family law context Implement family dispute resolution strategies Facilitate family dispute resolution in an impartial manner and adhere to ethical standards HOW DO I ORGANISE IT? We suggest that you start looking for a placement as soon as you enrol in the course. However, be mindful that you cannot start your placement until all of the coursework requirements are completed. You may want to start by looking at the local Family Relationship Centres and try to approach them to have the 10 hours placement. You can check the Attorney-General s website (www.ag.gov.au) for a list of registered Family Dispute Resolution Practitioners and Family Relationship Centres. WHAT IS THE PRACTICUM, OR CLINICAL PLACEMENT? Your supervisor will need to ensure that they supervise your delivery of the mediation services that will have to meet the six compulsory units of competency. The six areas have been mentioned earlier under the practicum information. you can commence your placement and you will be under the College of Law s insurance. I HAVE DONE MY PLACEMENT, NOW WHAT? Once you have completed your placement, you will need to submit a Declaration form to the College. After you receive the confirmation that the placement has been signed off by the College, you can apply to graduate with Graduate Diploma of Family Dispute Resolution Practice. DO I HAVE TO GRADUATE BEFORE I CAN APPLY FOR ACCREDITATION AS AN FDRP? You can apply to become an accredited FDRP before you graduate if you have completed your coursework and practicum requirements. In order to apply, you will need to obtain from the College the confirmation letter and an academic transcript which you will need to enclose with your application. WHAT FORMS DO I NEED? You will need the following forms in order to complete your practicum, apply for Graduation and apply to become an accredited FDRP: Practicum approval form obtained and approved by the College Suggested form of compact Practicum declaration form Application to graduate Application for accreditation as a family dispute resolution practitioner obtained from the Attorney- General s Department Furthermore, please see enclosed the following documents that will be helpful as well: Practicum Rules List of Family Relationship Centres Working with Children Checks AM I INSURED? In order for the College of Law insurance to cover you during your practicum, the College has to approve your practicum placement before its commencement. In order to apply for an approval for the practicum, please complete and return to the College enclosed Practicum Approval form (in the back of this handbook). Once the practicum has been approved,

SUBJECTS FDRP1 MEDIATION The first subject focuses on the foundational skills of a mediator. The three-day workshop is practical and applied, giving you the opportunity to practise mediation skills through role play. This subject satisfies the requirements for a mediation course under the National Mediator Accreditation System. Additional assessment is required to become a Nationally Accredited Mediator. TOPICS INCLUDE: The dispute resolution spectrum Conciliation and arbitration Mediation Communication skills Conducting a mediation Assessment: Optional online tutorials, analysis of a case study, role plays, conducting a family mediation. Nationally Accredited Mediators are eligible for advanced standing in this subject. SUBJECTS FDRP2 UNDERSTANDING AND WORKING WITH FAMILIES IN CONFLICT An understanding of families involves an introduction to the meaning and purpose of the family system, and how the family is impacted through separation. This unit introduces the student to the nuances of working with conflicted families. We will focus on understanding how family groups function and how they are affected by conflict. In particular we will explore how children exposed to parental conflict can be impacted. TOPICS INCLUDE: Understanding families Impacts of separation on family members Family structures post-separation Individual conflict modes Children s needs Social science research: best interests of the child and post-separation parenting arrangements Assessment: Research paper on FDR models, role plays, reflective journal. SUBJECTS FDRP3 AUSTRALIAN FAMILY LAW This subject offers a thorough understanding of the family law framework. It is an important first stage subject to give context to the introduction of mediation within the family law environment. Students will learn about the family law framework relevant legislation and case studies for both property and parenting, and some drafting techniques. This is especially important for the nonlawyer students and any students who have not practised already in family law. SUBJECTS FDRP4 ADVANCED FAMILY DISPUTE RESOLUTION This unit introduces the student to the challenges of working with conflicted families where high complexity is present, such as drug and alcohol issues, mental health issues, or family and domestic violence. The focus of this unit is on understanding the complexities of vulnerability, with particular focus on the management of domestic and family violence in family dispute resolution processes. Understanding the nuances of power and control, followed by strategies for the management of such cases will be outlined and practiced through role play. PRACTICUM APPLICATION PROCESS FAMILY DISPUTE RESOLUTION PROGRAM Once you have completed FDRP4 and have reached the final stages of your Graduate Diploma of Family Dispute Resolution you are able to undertake your practicum placement. You may secure your placement before you complete the coursework but you cannot undertake it until all coursework is complete. As part of this pack, please find in this handbook the following documents/forms: Practicum Rules Suggested Form of Compact Practicum Declaration form List of Family Relationship Centres Application to Graduate Application to become a Family Dispute Resolution Practitioner FINDING A PLACEMENT Once your coursework is completed, you can start your practicum placement. You are responsible for finding your own placement and must have it approved by the College before you start. We recommend you approach Family Relationships Centres (FRCs) or registered Family Dispute Resolution Practitioners to complete your practicum. You can check the Attorney-General s website (www.ag.gov.au) for a list of registered FDRPs and FRCs. If you have not done this already, you need to ensure that you complete a Working with Children Check and Police Check before you commence your practicum. Links to the various state agencies that conduct these checks is in the enclosed document, Working with Children and Police Checks. Once you found a suitable placement, you will need to complete and submit an Approval of Placement form to the College. We also suggest that you draft a set of guidelines with your practicum supervisor. We have enclosed a Suggested Form of Compact. COMPLETION OF PLACEMENT Once you complete your approved practicum placement, you will need to submit the Practicum Declaration form which: Confirms and outlines the details of the practicum undertaken; Confirms that you have been supervised by an appropriate supervisor (ie an accredited FDRP); Includes an acknowledgement signed by the approved supervisor. You can also submit your Application to graduate form at the same time as you submit your Practicum Declaration form. BECOMING AN ACCREDITED FAMILY DISPUTE RESOLUTION PRACTITIONER Once you complete all the required coursework and the practicum requirement, you are then eligible to apply to become an accredited Family Dispute Resolution Practitioner. In order to apply, you will need to complete an enclosed form and submit it to Attorney-General s Department. If you will apply before the conferral of your award, you will need to contact the College so that we can provide you with a completion letter and your academic transcript which you will need to enclose with your application. ENROLMENT INFORMATION GRADUATE DIPLOMA OF FAMILY DISPUTE RESOLUTION PRACTICE ENROLMENT DATE Applications should be received by the Monday before the intake starts. Late applications can be accepted but there may be a short delay providing access to the learning portal. SUBJECT FEES The 2016 subject fee is: $2,790 (GST exempt). The College s fees are reviewed annually and may be varied during your period of study. PAYMENT OPTIONS Fees must be paid in full before the start of each subject. Payment may be made by cheque, EFT or credit card. Australian citizens and holders of permanent humanitarian visas may elect to defer their tuition fee payment through the Commonwealth Government s FEE-HELP scheme. If you elect to pay with FEE-HELP, you must include a completed Request for FEE-HELP Assistance Form with your completed Application and Enrolment Form. For further details, please visit www.studyassist.gov.au WITHDRAWALS, DEFERRALS AND REFUNDS If you enrol and become aware of a circumstance which will prevent you from completing the semester, you may withdraw before the Census Date. Please see census dates for each subject in the subject information under Important Dates. Notice of withdrawal in writing must be received by the College on or prior to the Census Date. Refunds will not be made after the Census Date, other than in exceptional circumstances and at the College s discretion. Where a refund is made a $200 administration charge will apply. If you have applied for FEE-HELP assistance, you may withdraw from the Program on or prior to the Census Date without incurring a Commonwealth debt. The College will charge an administration fee of $200. After the Census Date, you become liable to repay the tuition fee via the tax system. (See the FEE-HELP information booklet or visit www.studyassist.gov.au). If you do not withdraw before the Census Date, you may apply to defer your studies, meaning that you will complete your studies in another intake. You will not receive a refund and if you have applied for FEE-HELP assistance, you will incur a Commonwealth debt in the intake in which you originally enrol. However, you will not be required to pay an enrolment fee again when you return to study. If the subject fee has increased, you will need to pay the difference.
