Department of Planning & Development Services S T A F F R E P O R T June 3, 2016 CASE NO: PROJECT: EXECUTIVE SUMMARY: REQUEST DETAILS: ZA16-043 Specific Use Permit for a commercial school, including trade school for a dance academy at 1603 Hart Street Wendy Jenkins and Laura Williams request approval of a Specific Use Permit for a commercial school, including trade school to allow a proposed dance academy at Hart Industrial Park on property located at 1603 Hart Street, Southlake, Texas. The current zoning is I-1 Light Industrial District. SPIN Neighborhood #8. The applicant is requesting approval of a Specific Use Permit for a commercial school, including trade school to allow a proposed dance academy at Hart Industrial Park. The tenant space is approximately 6,000 square feet of rentable space. The applicant proposes 5 studios in the building along with office space. Hart Industrial Park consists of six single-story buildings, including 1603, which range in size from approximately 6,000 to approximately 9,000 square feet. Total square footage for the complex is 42,220 square feet of space with a total of 115 off-street parking spaces shared among all buildings. A breakdown of existing tenants and uses is provided in Attachment A. Proposed hours of operation: Monday Thursday 3PM - 9PM (5-8PM peak) Classes/office hours will begin at 9AM on 1-2 weekdays Friday 3PM 6PM Saturday 9AM - 3PM Closed Sunday except for rehearsal The proposed average class size per studio is 10-15 with maximum enrollment of 20 students per class. Maximum enrollment would not exceed 400 students. Maximum attendance at non-peak time would not exceed 60 students; maximum at peak time (5-8PM) would not exceed 90 students. On June 16, 2015 City Council approved Ordinance No. 480-RRRR which removed Commercial schools, including trade schools as permitted uses by right from Section 26 I-1 Light Industrial District. Section 45 Specific Use Permits of the Zoning Ordinance was thereby amended under 480-RRRR to add Commercial School, including trade school to both the I-1 Light Industrial District and I-2 Heavy Industrial District, subject to requirements outlined in Sec 45.19. 45.19 IN CONSIDERING WHETHER TO GRANT A SPECIFIC USE PERMIT FOR COMMERCIAL SCHOOL, INCLUDING TRADE SCHOOL, THE CITY COUNCIL SHALL CONSIDER THE FOLLOWING: 1) Safe access for the ingress and egress of students, pedestrian, parking and vehicular traffic, including the identification of student drop-off areas. 2) Adequate illumination will be provided at night to protect the safety of those persons entering and exiting the site. Industrial I-1 Light Industrial District Commerce Business Park was annexed into the City of Southlake with the Light Industrial Zoning on October 20, 1987 (Ordinance No. 373). A Final Plat Showing for Lots 1 through 4, Block A & Lots 1 through 5, Block B, Hart Industrial Park was approved by City Council on July 22, 1988. This property was given the I-1 Light Industrial Zoning with the adoption of the Zoning Ordinance No. 480 by City Council on September 5, 1989. A Plat Revision to create Lot 3R, Block B, Hart Industrial Park from lots 3-5, Block B, including the abandonment of right of way, was approved by City Council on October 14, 1998. A permit was issued for construction of 1603 Hart Street on December 21, 1999. CITIZEN INPUT: TRANSPORTATION ASSESSMENT: A SPIN Town Hall Forum was not requested for this application. Parking Analysis The site plan shows that there are 115 parking spaces, including handicap spaces. These spaces are shared by the six buildings in the Hart Industrial Park. With the exception of building 1603, the park is fully occupied. The existing tenants are shown in the following table along with the required parking for each use. The applicant requests a dance studio with a maximum number of 90 students in attendance at any one time. Based on a ratio of 1 space per 3 students, the dance academy would require a minimum of 30 parking spaces at peak time. Current parking demand at Hart Industrial accounts for 78 of the existing 115 parking spaces, leaving 37 unallocated spaces. Case No. Attachment A ZA16-043 Page 1
