MORE FM Great Gas Giveaway with Caltex 2012 PROMOTION TERMS & CONDITIONS PROMOTION SUMMARY 1. The MORE FM Great Gas Giveaway with Caltex gives participants the chance to win a share of $100,000 worth of Caltex StarCash being provided by Chevron New Zealand ( Chevron ) for the Beat the Intro game and Free Fuel Fridays and one of five Kiwi Family Adventures in NZ for the which Chevron is providing $5000 of Caltex StarCash and $7,500 in cash. 2. Caltex StarCash cards are purchase cards containing a magnetic strip encoded by or on behalf of Chevron that can be used at participating Caltex branded retail fuel outlets within New Zealand. The cards are pre-loaded with a nominated value printed on the card and can be used for purchases of fuel and other goods at participating Caltex sites ( StarCash ). The promotion period begins at 7am on Monday 13 th August 2012 and entries close on Thursday 16 th September 2012 at Midnight ( Promotional Period ). 4. To enter to win a share of the $92,000 Caltex StarCash prize pool available for the Beat the Intro game participants must text Gas and their Full Name to 559 within 5 minutes of the cue to text playing on air ( 5 Minute Time Limit ). There will be four cue to text played per day. 5. A contestant will then be randomly selected from all valid texts which were received within the 5 Minute Time Limit. 6. The selected contestant will then be called back by MORE FM and has the chance to play Beat the Intro. They will be played the introduction of a song down their phone line. If the contestant correctly identifies the name of the Song and Artist before the vocal starts then they will instantly win the Major Prize total at that time, being StarCash of $1000 or such greater jackpot sum as has accrued in accordance with these terms and conditions. The beginning of the vocal will be indicated by an official whistle sound effect ( Official Whistle Sound Effect ) which will be inserted into the song by MORE FM. The song will change each time the game is played. 7. The correct answer will be the official full song title and full artist name as shown on the RIANZ New Zealand Chart records. The contestant must name both title and artist in their entirety at any time prior to the Official Whistle Sound Effect. MORE FM is the sole judge of the competition and if the answer provided is deemed correct. 8. The Major Prize will jackpot by $1000 worth of Caltex StarCash each time the game is played and the contestant is unsuccessful. After each time the jackpot is won, the next time the game
is played the prize will reset to $1000 worth of Caltex StarCash. The only exception to this is on the final day of contest (Thursday 13 th September) when once the Major Prize total of $92,000 worth of Caltex StarCash has been won no further jackpotting will occur. 9. Participants may enter once only per each cue to text opportunity but may enter other cue to text opportunities as many times as they wish across the promotional period unless they win a major prize. 10. In addition, participants can also win a share of an $8,000 StarCash prize pool by visiting a participating Caltex service station when the MORE FM street team is onsite. The More FM street team will be giving away this $8,000 worth of StarCash in increments of $25 on Fridays during the Promotional Period ( Free Fuel Fridays ). The participating service stations will be announced on air during the Promotional Period, and any relevant further instructions will be provided. HOW TO ENTER KIWI FAMILY ADVENTURES 11. To enter to win the one of five KIWI FAMILY ADVENTURES Major Prizes, the participant must spend $NZ30 or more in one transaction on petrol or diesel (excluding tobacco and lotteries) at a participating Caltex service station to receive an authorised scratch card. Each separate qualifying transaction of $NZ30 or more on petrol or diesel will receive a scratch card. Each scratch card, once scratched will reveal a unique code. The unique code must be entered on the official online entry form on the MORE FM Great Gas Giveaway with Caltex competition page at www.morefm.co.nz or texted to 559 with the code word Caltex <leave a space> full name <leave a space> Unique Code <leave a space> and the destination of the participant s Kiwi Family Adventures. Participants may enter more than once but each entry must include a different unique scratch card code. Entries must be received by midnight on the Thursday prior to the Major Prize Draw (dates as below). Entries are only valid for that week s draw. 12. Winners must retain their winning scratch card to claim the Major Prize. 13. All texts cost 20cents. 14. Each week a Kiwi Family Adventure Major Prize Winner will be drawn randomly from all valid entries received, and the winner will be announced on MORE FM during the Friday Drive Show between 5pm and 7pm on Friday 117 th, 24 th and 31 st August and 7 th and 14 th September 2012. 15. Major Prize Winners of the on air Beat the Intro game may not enter to play the Beat the Intro competition again after winning, but are eligible to enter to win a Kiwi Family Adventure if they satisfy the entry criteria. Major Prize Winners of the Kiwi Family Adventure game may not enter the Kiwi Family Adventure competition again after winning, but are eligible to enter the on air Beat the Intro game. 18. Winners of the On Air Beat the Intro and the Kiwi Family Adventure are classified as Major Winners.
GENERIC PROMOTION OR COMPETITION RULES Definitions MediaWorks means all companies in the MediaWorks Group including but not limited to MediaWorks NZ Limited, RadioWorks Limited and TVWorks Limited and all brands and operating companies controlled by or associated with those entities. The Promoter is MediaWorks (MORE FM).. Disqualified Participants are: (a) all MediaWorks employees, all employees of participating sponsors or promoters and/or advertising agencies and their Immediate Families; (b) all people under the age of 18 years where the prize incorporates air travel, alcohol or any other element which would be illegal to supply to a person under the age of 18 years. (c) all people who have won a prize from the station running this promotion in the last 14 days. If the previously won prize was valued at over $1000, the winner must stand-down from entering for a period of 90 days. (d) all Chevron New Zealand and its affiliate companies staff including those working for or at a participating Caltex branded sites are not eligible to enter. Immediate Families include spouses, Grandparents, Parents, Children, and Grandchildren whether by marriage, past marriages, remarriage, adoption, co-habitation or other family extension. Entry 1. These Promotion or Competition Rules ( the Rules ) apply to all MediaWorks Promotions or Competitions including for the avoidance of doubt Beat the Intro, Free Fuel Fridays and the Kiwi Family Adventure (collectively the Promotion ) conducted on or off air and by means of any medium radio, television, print, telephone or computer. The Rules may change from time to time. 2. If a particular Promotion has specific rules or terms those specific rules or terms will apply if there is any inconsistency with the Rules. 3. Unless otherwise stated in the abovementioned specific rules or terms, registration, entry or vote is limited to 1 per person. Where multiple registrations, entries or votes are acceptable, each must be made separately. 4. Entry into the Promotion is deemed to be acceptance of the Rules and confirmation that the entrant has the necessary authority (for example from the bill payer or owner of a telephone) to enter the Promotion.
5. The Promotion is open to New Zealand Residents only. Disqualified Participants may not enter in the Promotion. 6. MediaWorks reserves the right to exclude any person from participating in the Promotion on reasonable grounds. 7. MediaWorks reserves the right to refuse to award any prize to an entrant who MediaWorks decides (in its sole discretion) has violated the Rules, gained unfair advantage in participating in the promotion or won using fraudulent means. 8. By participating, entrants grant MediaWorks exclusive permission to use their names, characters, photographs, voices and likeness in connection with the Promotion and for future promotion and marketing purposes and waive any claims to royalty, right or remuneration for such use. 9. All entrant personal details must be valid and up to date and will be held by MediaWorks and may be used for the purpose of the Promotion and for future promotion and marketing purposes in accordance with MediaWorks Privacy Policy (see www.mediaworks.co.nz) unless otherwise directed by entrants at the time of entry. 10. When submitting entry via text, the telephone number from which the entry was made will be stored in a database. The participant has a two-business-day period from the time of entry to request removal from the database. If no request is made it is deemed acceptance that the information can be used at the discretion of MediaWorks and/or any other company associated with the Promotion. 11. Personal information provided at the time of entry is presumed to be true and, in the case of text or email notification active, through to and beyond the date of the Promotion s completion. 12. Where the Promotion involves texting, the following apply: a) Any form of automated text message is invalid b) MediaWorks takes no responsibility for text costs incurred after the Promotion has closed as stipulated in the Promotion Terms and Conditions. Winning the Prize 13. Only the person who originally entered the Promotion can be awarded the prize ( the Winner ). 14. The Winner will be determined in the manner set out in the Promotion Terms and Conditions if not specified then as determined by the Promoter who shall for this purpose be deemed the Judge. 15. The Judge s determination of the Winner will be final and no correspondence will be entered into. 16. The Winner will be notified by email, phone (voice or text) or mail and must be available for the preparation of all publicity that may be required by MediaWorks. Where attempts to contact the Winner fail (eg when the Winner cannot be contacted by phone after three attempts or mail sent is returned) the Judge will select another Winner. If, after successful
notification, the prize is not collected within two months of being announced it will be regarded as forfeit. (Note: 3 attempts to contact will include individual calls to any numbers provided at the time of entry. However, should the prize s total worth equal less than NZD$250 and be a live-to-air draw, only one failed attempt at contact will be acceptable before the Judge selects another Winner.) 17. The prize is not redeemable for cash or transferable. No other family members, friends, office associates or any other person will be able to participate on the Winner s behalf. In the event that the prize specified in the Promotion becomes unavailable for any reason the Promoter may substitute a prize of like or equal value. Where the prize incorporates air travel, unless otherwise specified the air travel is economy class. 18. Where the Winner is required to claim the prize in person and they must provide proper identification (eg driver s licence, passport, birth certificate). If the Winner is under the age of 18 years their parent or guardian must give their prior written consent to the award of the prize. 19. The Winner takes the prize entirely at his/her own risk and indemnifies MediaWorks and Chevron New Zealand and its affiliates in respect of any claim for any accident, injury, property damage or loss of life that may occur in connection with the prize. The Winner is responsible for all insurance, tax or other costs that may be associated with the prize. MediaWorks Responsibility 20. MediaWorks reserves the right to amend, vary, extend or discontinue a Promotion at any stage, for any reason. 21. MediaWorks takes no responsibility for any inability to enter, complete, continue or conclude the Promotion due to equipment or technical malfunction, busy lines, inadvertent disconnection, texts with a misspelt keyword, texts to an incorrect shortcode, Acts of God or otherwise. 22. To the fullest extent permitted by law MediaWorks and Chevron New Zealand and its affiliates will not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) or for personal injury as a result of Promotion entry or winning the Promotion prize. 23. Where the prize is to be supplied by an entity outside MediaWorks control and that entity fails, for whatever reason, to supply the prize, MediaWorks has no responsibility for the provision of the prize and is not obliged to provide an alternative prize or to take legal action to require the prize supplier to provide the prize. Acceptance 24. Participation in the Promotion is deemed acceptance of these Terms and Conditions.
