Particulars of Sale Location The land is located within the village of Leamside, Houghton le Spring. The village of Leamside is located just off the A690 dual carriageway. It is situated approximately 5 miles to the North East of Durham City and approximately 15 miles to the south of Newcastle upon Tyne. Directions To reach the land, from Durham, take the A690 towards Sunderland. After passing over the A1 motorway roundabout, continue on the A690, taking the next exit, signposted Leamside and West Rainton. Take your first left signposted Finchale Priory and continue on this road, over the railway bridge. The land is located on your left down a single track road. Description of Land The land is located within the village of Leamside and is well situated just off the A690 and has good access to the A1. The land extends to approximately 5.97 hectares (14.75 acres) and is currently in arable production. It is not believed there is any water to the land. The land is shown verged with red on the attached plan. It is accessed via a single track lane off Station Road. The lane is owned by a third party; however the current owners of the land have rights to use this lane to access their land. The lane is shared with other users and marked on the attached plan. Access is shown on the attached plan with a red cross. Tenure The land is believed to be Freehold. The land is sold subject to a 1 year non-secure Farm Business Tenancy from 6 th October 2014 1 st October 2015. This agreement can be terminated by giving no less than 4 weeks notice. The annual rent is 1,106.25. If the agreement is terminated prior to the end of the term, compensation payable to the Tenant shall be limited to:- 1. the reasonable cost of cultivations and seeds on the land to be taken incurred by the Tenant to date since the last harvest or the beginning of the tenancy whichever is the later and 2. the repayment of a pro-rata apportionment of the rent for the part of the Holding taken excluding the proportion of the rent attributable to that part of the Holding in respect of which any previous crop has been harvested under the Agreement.

Single Farm Payment There are no Single Farm Payment Entitlements included in the sale. Sporting & Mineral Rights It is unknown whether the sporting rights are included. The mineral rights are not included in the sale. Restrictive Covenant & Clawback The sale will be subject to a restrictive covenant limiting the use to agricultural and noncommercial equestrian uses only. In the event that the Buyers or their successors in title obtain planning consent to carry out any form of development (other than for agricultural use) they will pay 50% of the net uplift in value to the Sellers. This provision will run for 25 years from the date of purchase. Burdens The property is sold subject to all rights including rights of way, whether public or private, rights of light, support, drainage, water and electricity supplies and other rights, obligations and easements, quasi easements and restrictive covenants and all existing and proposed wayleaves for masts, pylons, stays, cables, drains and water, gas and other pipes, whether or not constituted in the title deeds or referred to in these particulars.
