III. Annexation/Zoning History: The approximately 1 acre subject site was annexed into the City of Greenacres as part of the 7.53 acre case ANX-05-01 on January 27, 2005 through an interlocal agreement (City Resolution 2005-02, County Resolution 2005-0160). The Future Land Use designation was changed from Palm Beach County Low Residential 1 (LR1) to City Residential-Medium Density (RS-MD) as petition CPA-09-12, through Ordinance 2009-35 on December 7, 2009. The zoning designation was changed from Palm Beach County Agricultural Residential (AR) to City Residential Medium-2 (RM-2) as petition ZC-09-11, through Ordinance 2009-36 also on December 7, 2009. The property had a single-family home on it at annexation but this was subsequently demolished on March 29, 2006 and the property has remained vacant since that time. On January 29, 2013, the Zoning Board of Adjustments and Appeals approved petition BA-12-03 granting a variance for the reduction of the landscape buffers and use of the daycare center parking requirements of the general Zoning Code. On February 4, 2013, the City Council approved a Special Exception to allow a Child Care Center/ Preschool Facility within a Residential Medium-2 (RM-2) zoning district as petition SE-12-03 through Resolution 2013-02. Subsequent to these approvals, an updated survey revealed that the parcel is actually located approximately 33 feet west of the typcial west right-of-way line of South Jog Road and clarified the site boundaries thus changing the actual site area from 43,369 sq. ft. to 43,681 sq. ft. IV. Summary of Proposed Site and Development Plan Details: The petitioner s site and development plans stamp-dated December 8, 2014 depict the following: 1. A total land area of 1 acre (43,681 sq. ft). 2. A one-story 6,369 square foot daycare building. 3. A total of 34 parking spaces, including two (2) handicapped spaces and four (4) drop-off spaces. 4. Multiple playgrounds, including covered play areas, totaling 13,647 sq. ft. 5. 130 child capacity. 6. Two vehicular and pedestrian ingress/egress points: one on Jog Road and one on Dillman Road. 7. A dumpster enclosure with recycling area; dumpster elevations consisting of block with stucco consistent with the building and opaque gates. 8. Landscape Plan, including a 6 foot high buffer wall along the west property line. 9. Building Plans and Elevations. 10. Photometric Plan. 11. Conceptual Engineering Plans. 12. Boundary Survey. Staff Analysis: Background: The petition is for Site and Development Plan approval to construct a one-story 6,369 square foot Child Care Center/Preschool Facility and associated playground and parking. The facility is proposed to accommodate 130 children and will utilize playground areas totaling 13,647 square feet. All playground areas will be enclosed with fencing for safety. The center will also include a drop off area accommodating 4 cars near the entrance. A dry detention area is located on the west side of the parcel, and landscape buffers will be included on all perimeters, as well as internal landscape within the site. There is one (1) ingress and egress point from South Jog Road and one (1) ingress and egress point from Dillman Road. A pedestrian connection will be provided to the South Jog Road sidewalk and, as conditioned below, a new sidewalk will be constructed along the project's Dillman Road frontage and a pedestrian connection provided to it. The activities and building on site have been arranged to place the playground away from Jog Road as much as possible and the drop-off area to protect the children while at the same time using the dry retention area and the landscape buffer with a 6 foot masonry wall and a 5 foot aluminum fence in the LWDD easement to separate the playground from the adjacent residential zoning district. The daycare building will also help mitigate traffic noise and activity impacts from Jog Road upon the residential zoned property to the west. The applicant has provided architectural elevations depicting equal architectural features on all four elevations, including a prominent entry porch and a standing seam metal hipped roof over the building. Air-conditioning equipment will be effectively screened in a recessed well at the center of the roof. On August 14 and August 21, 2014, the Land Development Staff reviewed this petition and recommended approval subject to the conditions of approval listed below. Water and sewer service is available from the Palm Beach County Water Utilities Department. The applicant must enter into a Standard Water and Wastewater Agreement with Palm Beach County Utilities. No objections. LWDD will require the property owner to finalize the Piping, Paving and Parking License Agreement and right-of-way conveyances prior to final Site Plan approval. Standards and Staff Findings: 1. Minimum Lot Requirements: Site area of 43,681 square feet meets the minimum area of 10,000 square feet for a Child Care Center/Preschool in the Residential Medium-2 district. 2. Maximum Lot Coverage: Building lot coverage of 16.2% does not exceed the maximum allowable lot coverage of 30%. 3. Minimum Yard Requirements: Building setbacks meet all yard requirements of 25' front (Jog Road), 10' side (south), 15 street side (north), and 25 rear (west). 4. Height Restrictions: The building height of 23-8 does not exceed the allowable height of 35'. 5. Off-Street Parking & Loading: The 34 parking spaces provided meet the required parking of 34 spaces based upon the approved variance BA-12-03, which authorized Table 16-1336(b) parking rate of 1 space per 200 sq. ft. of gross floor area with an additional 2 drop-off spaces for a Child Care Center/Preschool Facility. 6. Landscaping: The landscaping plan complies with landscape code requirements. Landscape buffers comply with the landscape code requirements based upon the approved variance BA-12-03. 7. Sign Regulations: Permits shall be obtained prior to installation of any signs. 8. Utilities: The proposed water, sanitary sewer and drainage systems will meet code requirements subject to final permitting. 9. Concurrency: Project meets traffic concurrency. Water and Sewer service and capacities are available to serve the site. 10. Comprehensive Plan: The proposed development is consistent with the Residential-Medium Density (RS-MD) future land use classification. 11. Color Scheme: The color of the building shall be in accordance with the Site and Development Plans submitted: Walls Sherwin Williams - Banana Cream SW 6673 (yellow cream); Wall Base Sherwin Williams - Jonquil SW 6674 (orange cream); Standing Seam Metal Canopies - Forrest Green (dark green); Roof - Forrest Green (dark green). 12. Site and Building Design: The project layout and architectural design comply with the site and building design requirements of the code. For example, the building features a textured stucco façade and standing seam metal roof with appropriately scaled and located covered entries that connect to a perimeter walkway connecting to the sidewalk on South Jog Road, and also includes a recessed roof well to contain and screen the air-conditioning equipment in a manner fully integrated with the building architecture. VII. Staff Recommendation: Approval of SP-13-03 with the following conditions: 1. The most stringent requirements of Exhibit "A" Land Development Staff Report and Recommendation dated December 12, 2014 and Exhibit "B" Site and Development Plan stamp-dated December 8, 2014, as hereafter defined shall apply. (Planning) 2. The site shall be developed in accordance with the approved Special Exception (SE-12-03). (Planning) 3. Permits from the South Florida Water Management District (SFWMD) and Lake Worth Drainage District (LWDD) as required, for the stormwater management system must be obtained prior to the issuance of building permits. (Engineering) 4. Permits from the Health Department for the water and sewer system must be obtained prior to the issuance of building permits. 5. Driveway connection and/or right-of-way construction permits from Palm Beach County Land Development must be obtained prior to the issuance of building permits. Any existing driveway connections on site which will become redundant shall be removed and replaced with curbing, etc. to match adjacent conditions. (Engineering) 6. Complete drainage calculations addressing water quality and quantity in accordance with the requirements of SFWMD must be submitted for review along with complete paving and drainage construction plans and subsurface investigation with percolation test prior to the issuance of building permits. (Engineering and Building) 7. The site plan shall be revised as necessary to reflect all conditions of approval and resubmitted prior to the issuance of building permits. (Planning) 8. In accord with the requirements of the National Pollution Discharge Elimination System (NPDES), a Storm Water Pollution Prevention Plan, Owner/Operator Certification, and Notice of Intent shall be submitted and accepted by the City prior to the issuance of building permits. (Building and Public Works) 9. Right-of-way along the south side of Dillman Road adequate to accommodate a 5' sidewalk shall be dedicated to the City of Greenacres prior to the issuance of building permits. Said right-of-way shall extend from Jog Road westwards to the western limit of the subject site. The sidewalk shall be completed from South Jog Road westwards to the east side of the project's driveway connection to Dillman Road as part of the construction of the Child Care Center/Preschool Facility. (Engineering and Building) 10. The project shall participate in the City Tree Dedication Program per Section 16-1293; at the time of issuance of building permits one (1) tree to be donated per 1,000 sq. ft. of building area or fraction thereof, therefore seven (7) Live Oaks or equivalent cash payment shall be donated to the City subject to the following specification: Live Oak, Florida Grade #1 Container Grown; minimum 12 ft. high; 2 inch diameter trunk at 4 ft.; and 5 ft. spread. (Planning and Building) 11. The project shall be required to pay the City s impact fee of $2.25 per square foot of gross floor area per Section 16-201. The amount of $14,330.25 shall be paid at the time of issuance of building permits. (Building) 12. Utilities shall be provided underground and sufficient in size to properly serve the site. Appurtenances to these systems which require above-ground installation must be effectively screened from view. (Planning, Engineering and Building) 13. All utilities and services to the site shall be provided by entities holding valid franchise agreements with the City. (Engineering and Building) 14. The building must be provided with an automatic fire sprinkler system and a monitored fire alarm system. In addition, the building shall have a Knox box keyed for the City of Greenacres at the entrance. The order form shall be obtained from the City s Fire Marshal. 15. All roof top equipment shall be screened on all four sides consistent with the architecture of the building; no equipment shall be taller than the proposed screening. All ground mounted mechanical equipment (air conditioning, backflow preventer, etc.) shall be screened on all four sides; no equipment shall be taller than the proposed screening. (Planning and Building) 16. Building wall signs shall be internally illuminated individual channel letters or reverse channel letters. No raceways or box signs will be permitted. (Planning) 17. All freestanding signs shall be consistent in color with those on the building, shall feature decorative architectural elements and colors consistent with the building, and shall include the numerical street address with minimum 6 high numbers in a contrasting color on both faces. (Planning) 18. A bicycle rack accommodating a minimum of 4 bikes shall be provided at the building. (Planning) 19. The dumpster enclosure walls shall match the finish, color and design elements of the building walls and trim. At a minimum, the dumpster enclosure gates shall be solid 3/4" deep galvanized corrugated 22 gauge steel matching the building color. (Planning) 20. A masonry wall shall be installed along the entire west property line outside the LWDD easement (approximately 138 linear feet) and shall be finished with stucco on both sides. The stucco shall be painted to match the existing stucco wall to the south of the property. The wall shall be a minimum of 6 feet tall measured from the highest adjacent grade. Maintenance of the wall is the responsibility of the property owner. 21. The hours of operation shall be limited to 6:30 a.m. to 7:00 p.m. Monday through Friday. No deliveries shall take place prior to 7:00 a.m. or after 10:00 p.m., 7 days a week. (Planning and Building) 22. No outdoor speakers shall be permitted. (Building) 23. A site clearing and tree removal permit shall be required prior to any clearing activities on site. This permit shall demonstrate protection of existing trees to remain. Additions to the landscaping plan may be necessary to meet Code requirements if existing material to remain is unsuitable for buffer purposes. (Planning) 24. All existing trees shown to remain on the approved landscape plans shall be maintained in perpetuity. In the event they should die, they shall be replaced with like species of a size and quantity in accord with the tree credits in Table 16-1271 of the City of Greenacres Code. (Planning) 25. All existing invasive non-native plants shall be removed from the property. It shall be the responsibility of the property owner to maintain the site free from invasive plants. 26. In accord with the determination of compliance with the Traffic Performance Standards by Palm Beach County Engineering, no building permits shall be issued after the build-out date of December 31, 2016 unless a revised traffic study with a later build-out date has been approved by the County and a copy of the approval provided to the City of Greenacres. (Planning and Building) 27. The Child Care Center/Preschool Facility shall be limited to 130 children. (Planning and Building) 28. All advertisements and legal addresses on insurance policies and business correspondence shall clearly state that the project is located within the City of Greenacres. (Planning) 29. Non-compliance with any of the conditions of approval will result in withholding of the issuance of building permits or a Certificate of Occupancy. (Planning and Building) 30. The property owner and their successors and assigns shall assume all responsibility for the periodic inspection, engineer's certification, and maintenance of the L-6 Canal pipe from South Jog Road westwards to the pipe's western end just west of Cholee Lake Elementary in accord with the terms and conditions of the Piping License Agreement (LWDD Project No. 98-4964P.01) between the City of Greenacres and the Lake Worth Drainage District dated January 26, 2007 as recorded in Official Record Book 21356, Page 1744. The next inspection is due January 21, 2016 and shall occur every 5 years or as otherwise required by the Lake Worth Drainage District.
