INTROSUCTION I submit this monitc,ri:rg report ("Report") pursuant to my appointment as an ICTR / MICT monitor to obserye tl:e translerred case of Mr. Bernard Munyagishari ("Mr. Munyagishari") in the courts of the Republic of Rwanda.l z. J. This Report perlains to the activities in the tvxnyogis/rali case before the Rwandan judiciary and rny interactions with varior.rs stakeholders during April 2AL4 ("Reporing Period"), During the Reporting Period, I made one visit to Rwanda, n. DETAILED RtrPORT A. Pre-Tri*l *Ietring before the Higlt Court t{ Rwntl,da il &i. 5. 6. On 3 April 2014, the uhuryagishari case came up for a pre-trial healing before the I{igh Court of Rwanda. The proceedings began.,vith the court calling upon tlie of1icially appointed interpreter ibr Mr. Munyagishari to identify hirnself. The interpxeter identified himself as N'Ir. Faustin B. Murangwa, a member of the Kigali Bar Association ("KBA") and a Legal Officsr in the Rwandan judiciary dealing with international crimes and transfened cases. The High Court asked the interprster to take an oath of confidentiality, which was administered to hinr by tlie presiding judge. Mr. Munyagishari challenged the qualifications of the interpreter on the ground that the interpreter did not attend any specialized training in interpretation, The prosecution souglrt tirne to provide a trnnslation of tlie indictment to Mr. Munyagisl:ari; the defence did not object to the granting of such an extension. The lligh Court indicated that while the accused has the right to the assistance of an interpreter, the proceedings will be held in Kinyarwanda. After certain procedural discussions, the case was adjourned to 4 June 2014 witit the direction that the prosecution should provide Mr, Mui:yagishari a Frencir translatisn of the indicfinent, a week ahead of that date. B, Cottditistts of Detentiort L On?5 April 20i4, I had a rneeting with Mr. Munyagisharir:r the Nyarugenge Prissn. Mr, Munyagishari provided nle a representation he had made to the Prison Director regarding the tlming and quality of food provided to the detainees of the special enclosure of the Nyarugenge Prison where Mr. Munyagishari detained. I The appointment was nrade pursuant t0 the rnemorandurn datcd 29 May?013 from the MICT Registrar to the ICTR B"egistrar. 3l lvlay 2014 234 9" On 25 April 2014, upon the suggestion of the Prison Director, I l:ad a meeting with Ms. Janet Bugingo, the Deputy Prison Director. In this meeting Ms. Brrgingo advised thnt she was aware of the representation and that the issues it raised had been satisfu ctolily addressed. On 29 April 2014, Mr. Munyagishari senl a letter to the IC R / MICT monitot's entitled "lldplique aux conditions de ddtention (nouvelle r&glernentstiotl envisagdc par Ia direction de prison de Nyarageng3 pour les ddtenus tranjdrds)".in tlris letter, Mr" Munyagishari questions certain "new rules and regulations" created by the prison authorities, especially comparing them with the rules applied to the convicts transferred from the Special Cou* for' $ierra Leone to serve their sentences et the Mpanga Prison in Rwanda. C. Fair Trial Rigftts tl I l. t2. During my meeting rvith Mr. Munyagishari on 25 April 2014 he stated tlrat he was concerned that his "provisional" lalvyers, Mr, Jean Bapriste Niyibiei and Mr. John Hakizimana, have not been "properly paid" for their services in his case. Mr, Munyagishari stated that he will challenge the decisions of the KBA in respect of his representation and legal aid before the appropriatejudicial forurn. On 6 May 2014, Mr. Munyagishari filed an application before the High Court seeking a direction to the KBA to provide Mr, Munyagishari a copy of the complete list of advocates registered with the KBA so that he can constitute his defence team at the earliest" As the application is pending before a judicial forum, I did not consider it appropriate to query the KBA or other stakeholders on the issues articulated in the application. More details will be provided in subsequent monitoring reports once the application is fully briefed and the parties a$iculate their position before the High Court. D. Olher Mstters ]3. There is not yet a fixed date for the commencernent of the substantive trial.
