Arizna Revised Statutes Title 28 - Transprtatin Laws Chapter 1. Definitins and Penalties Article 1. Definitins 28-101. Definitins... 6. "Bicycle" means a device, including a racing wheelchair, that is prpelled by human pwer and n which a persn may ride and that has either: (a) Tw tandem wheels, either f which is mre than sixteen inches in diameter. (b) Three wheels in cntact with the grund, any f which is mre than sixteen inches in diameter. 56. "Vehicle" means a device in, n r by which a persn r prperty is r may be transprted r drawn n a public highway, excluding devices mved by human pwer r used exclusively n statinary rails r tracks. Chapter 3. Traffic and Vehicle Regulatin Article 6 - Speed Restrictins 28-704. Minimum speed limits; requirement t turn ff radway A. A persn shall nt drive a mtr vehicle at such a slw speed as t impede r blck the nrmal and reasnable mvement f traffic except when reduced speed is necessary fr safe peratin r in cmpliance with law. B. If the directr r lcal authrities within their respective jurisdictins determine n the basis f an engineering and traffic investigatin that slw speeds n any part f a highway cnsistently impede the nrmal and reasnable mvement f traffic, the directr r lcal authrity may determine and declare a minimum speed limit belw which a persn shall nt drive a vehicle except when necessary fr safe peratin r in cmpliance with law. C. If a persn is driving a vehicle at a speed less than the nrmal flw f traffic at the particular time and place n a tw-lane highway where passing is unsafe, and if five r mre vehicles are frmed in a line behind the vehicle, the persn shall turn the vehicle ff the radway at the nearest place designated as a turnut by signs erected by the directr r a lcal authrity, r wherever sufficient area fr a safe turnut exists, in rder t permit the vehicles fllwing t prceed. Article 7. Driving n the Right Side f the Radway, Overtaking, and Passing

28-724. Overtaking n the right A. The driver f a vehicle may vertake and pass n the right f anther vehicle nly under the fllwing cnditins: 1. When the vehicle vertaken is making r abut t make a left turn. 2. On a street r highway with unbstructed pavement that is nt ccupied by parked vehicles and that is f sufficient width fr tw r mre lines f mving vehicles in each directin. 3. On a ne-way street r n a radway n which traffic is restricted t ne directin f mvement and if the radway is free frm bstructins and f sufficient width fr tw r mre lines f mving vehicles. B. The driver f a vehicle may vertake and pass anther vehicle n the right nly under cnditins permitting the mvement in safety. The driver shall nt make the mvement by driving ff the pavement r main traveled prtin f the radway. 28-735. Overtaking bicycles; civil penalties A. When vertaking and passing a bicycle prceeding in the same directin, a persn driving a mtr vehicle shall exercise due care by leaving a safe distance between the mtr vehicle and the bicycle f nt less than three feet until the mtr vehicle is safely past the vertaken bicycle. B. If a persn vilates this sectin and the vilatin results in a cllisin causing: 1. Serius physical injury as defined in sectin 13-105 t anther persn, the vilatr is subject t a civil penalty f up t five hundred dllars. 2. Death t anther persn, the vilatr is subject t a civil penalty f up t ne thusand dllars. C. Subsectin B f this sectin des nt apply t a bicyclist wh is injured in a vehicular traffic lane when a designated bicycle lane r path is present and passable. Article 8. Turning, Starting and Signals n Stpping and Turning 28-756. Methd f giving hand and arm signals A. Except as prvided by subsectin B, a persn shall give all hand and arm signals required by this article frm the left side f the vehicle in the fllwing manner, and the signals shall indicate as fllws: 1. Left turn. Hand and arm extended hrizntally. 2. Right turn. Hand and arm extended upward. 3. Stp r decrease speed. Hand and arm extended dwnward. B. A persn perating a bicycle may give a right turn signal by extending the right hand and arm hrizntally and t the right side f the bicycle. Article 11. Operatin f Bicycles 28-811. Parent and guardian respnsibility; applicability f article

A. The parent f a child and the guardian f a ward shall nt authrize r knwingly permit the child r ward t vilate this chapter. B. Except as therwise prvided in this article, this chapter applies t a bicycle when it is perated n a highway r n a path set aside fr the exclusive use f bicycles. 28-812. Applicability f traffic laws t bicycle riders A persn riding a bicycle n a radway r n a shulder adjining a radway is granted all f the rights and is subject t all f the duties applicable t the driver f a vehicle by this chapter and chapters 4 and 5 f this title, except special rules in this article and except prvisins f this chapter and chapters 4 and 5 f this title that by their nature can have n applicatin. 28-813. Riding n bicycles A. A persn prpelling a bicycle shall nt ride ther than upn r astride a permanent and regular seat attached t the bicycle. B. A persn shall nt use a bicycle t carry mre persns at ne time than the number fr which it is designed and equipped. 28-814. Clinging t vehicle A persn riding n a bicycle, caster, sled r ty vehicle r n rller skates shall nt attach the bicycle, caster, sled, ty vehicle r rller skates r that persn t a vehicle n a radway. 28-815. Riding n radways and bicycle paths; prhibitin f mtr vehicle traffic n bike paths A. A persn riding a bicycle n a radway at less than the nrmal speed f traffic at the time and place and under the cnditins then existing shall ride as clse as practicable t the right-hand curb r edge f the radway, except under any f the fllwing situatins: 1. If vertaking and passing anther bicycle r vehicle prceeding in the same directin. 2. If preparing fr a left turn at an intersectin r int a private rad r driveway. 3. If reasnably necessary t avid cnditins, including fixed r mving bjects, parked r mving vehicles, bicycles, pedestrians, animals r surface hazards. 4. If the lane in which the persn is perating the bicycle is t narrw fr a bicycle and a vehicle t travel safely side by side within the lane. B. Persns riding bicycles upn a radway shall nt ride mre than tw abreast except n paths r parts f radway set aside fr the exclusive use f bicycles. C. A path r lane that is designated as a bicycle path r lane by state r lcal authrities is fr the exclusive use f bicycles even thugh ther uses are permitted pursuant t subsectin D r are therwise permitted by state r lcal authrities. D. A persn shall nt perate, stp, park r leave standing a vehicle in a path r lane designated as a bicycle path r lane by a state r lcal authrity except in the case f emergency r fr crssing the path r lane t gain access t a public r private rad r driveway. E. Subsectin D des nt prhibit the use f the path r lane by the apprpriate lcal authrity. 28-816. Carrying article n bicycles A persn shall nt carry a package, bundle r article while perating a bicycle if the package, bundle r article prevents the driver frm keeping at least ne hand n the handlebars. 28-817. Bicycle equipment A. A bicycle that is used at nighttime shall have a lamp n the frnt that emits a white light visible frm a distance f at least five hundred feet t the frnt and a red reflectr n the rear f a type that is apprved by the department and that is visible frm all distances frm fifty feet t three

hundred feet t the rear when the reflectr is directly in frnt f lawful upper beams f head lamps n a mtr vehicle. A bicycle may have a lamp that emits a red light visible frm a distance f five hundred feet t the rear in additin t the red reflectr. B. A persn shall nt perate a bicycle that is equipped with a siren r whistle. C. A bicycle shall be equipped with a brake that enables the peratr t make the braked wheels skid n dry, level, clean pavement. 28-818. Bicycle safety fund A. A bicycle safety fund is established. The department shall administer the fund. The fund cnsists f mnies received frm: 1. The federal gvernment r any agency f the federal gvernment fr any purpse authrized by this sectin. 2. Dnatins. 3. This state r any agency f this state fr any purpse authrized by this sectin. B. The department: 1. May designate mnies depsited in the bicycle safety fund fr use nly fr specified purpses cnsistent with this sectin and nly fr use in specified plitical subdivisins f this state. 2. Shall spend mnies cntributed by a plitical subdivisin t the bicycle safety fund and any dnatin t the fund designated fr use in a plitical subdivisin and any matching mnies depsited in the fund as a result f the cntributin r dnatin nly fr use in the plitical subdivisin. 3. Shall nly spend mnies frm the bicycle safety fund as fllws: (a) Fr planning, engineering, cnstructing and maintaining bicycle paths and bicycle lanes. (b) As matching mnies t be used with federal r lcal mnies spent fr planning, engineering, cnstructing r maintaining bicycle paths and bicycle lanes. (c) As matching mnies t be used with federal r lcal mnies spent fr planning and implementing safety prgrams. C. Mnies in the bicycle safety fund are exempt frm the prvisins f sectin 35-190 relating t lapsing f apprpriatins. The department may spend mnies in the fund fr purpses authrized by this sectin subject t legislative apprpriatin. 28-947. Special restrictins n lamps... Article 16. Equipment D. A vehicle may have lamps that may be used t warn the peratrs f ther vehicles f the presence f a vehicular traffic hazard requiring the exercise f unusual care in appraching, vertaking r passing. The vehicle may display these lamps as a warning in additin t any ther warning signals required by this article. The lamps used t display the warning t the frnt shall be munted at the same level and as widely spaced laterally as practicable and shall display simultaneusly flashing white r amber lights r any shade f clr between white and amber. The lamps used t display the warning t the rear shall be munted at the same level and as widely spaced laterally as practicable and shall shw simultaneusly flashing amber r red lights r any shade f clr between amber and red. These warning lights shall be visible frm a distance f at least ne thusand five hundred feet under nrmal atmspheric cnditins at night.

Chapter 8. Mtr Vehicle Driver Licenses Article 4. General Licensing Prvisins 28-3164. Original applicants; examinatin A. The department may examine an applicant fr an riginal driver license r the department may accept the examinatin cnducted by an authrized third party pursuant t chapter 13 f this title r dcumentatin f successful cmpletin f a driver educatin curse apprved by the department. The examinatin shall include all f the fllwing: 1. A test f the applicant's: (a) Eyesight. (b) Ability t read and understand fficial traffic cntrl devices.
