Federal Cmmunicatins Cmmissin 1.0 INTRODUCTION Statement f Wrk Fr Federal Cmmunicatins Cmmissin Emergency Mass Ntificatin and Respnse System The Federal Cmmunicatins Cmmissin (FCC) is an independent United States gvernment agency, directly respnsible t Cngress. The FCC was established by the Cmmunicatins Act f 1934 and is charged with regulating interstate and internatinal cmmunicatins by radi, televisin, wire, satellite and cable. The FCC s jurisdictin cvers the 50 states, the District f Clumbia and U.S. pssessins. 1.1 Backgrund The FCC is charged with prviding the United States with Operatinal and Outreach supprt fr State and lcal public safety and healthcare entities. In additin, the FCC must meet Federal Directives in relatin t Cntinuity f Operatins (COOP), Devlutin, Pandemic, and Recnstitutin Planning, as well as day-t day emergency management. This requires a real time ability t maintain cmmunicatins and ntificatins t these entities, as well as licenses, FCC Emergency Respnse Grup members, emplyees and cntractrs that supprt these entities during times f disaster r crisis. 1.2 Acquisitin Gal This statement f wrk is fr an Emergency Mass Ntificatin and Respnse System, as well as maintenance and supprt fr that system, that will be under the directin f the Office f Managing Directr, Assciate Managing Directr, Administrative Operatins. 1.3 Scpe f Wrk The purpse f this task rder is t prvide an Emergency Mass Ntificatin and Respnse System, as well as maintenance and supprt fr that system. An Emergency Mass Ntificatin and Respnse System are critical t the FCC Natinal Outreach Prgram which must be able t cmmunicate rapidly with the public safety cmmunity, licenses and thers frm any lcatin. In additin, the FCC requires a ntificatin system fr their internal Cntinuity f Operatins (COOP), Devlutin, Pandemic, and Recnstitutin Plans, as well as the day-t day emergency management effrts. The system must be a user friendly, turn-key system capable f prviding gelcatin based alerting f FCC licensee pints as well as adhc grup alerting f FCC emplyees; the capability fr users t lad/imprt Micrsft Excel data and be able t update alerting grups at user lcatin with minimal steps; and the system shuld prvide a text t vice capability as well as real-time mnitring and be capable f generating reprts f status f the alert. Specific requirements include: The vendr shall prvide a system, maintenance and supprt that is: Lcated in at least three gegraphically diverse facilities t ensure adequate backup shuld the primary facility g dwn fr any reasn. The vendr shall prvide maintenance and supprt fr a system that is capable f: Sending a minimum f 3000 E-mail messages t the FCC email system; Sending a minimum f 3000 cmputer Pp-Up messages t cnnected FCC gvernment furnished cmputers; Sending a minimum f 3000 E-mail messages t persnal email; Sending a minimum f 1,500 text (SMS) messages t FCC gvernment furnished mbile phnes f varius vendrs Sending a minimum f 3000 messages t persnal cell phne numbers; Sending a minimum f 3000 pre-recrded r custm vice messages t FCC telephne numbers; Sending a minimum f 3000 messages t persnal telephne numbers; Displaying pre-recrded vide r still images n the FCC s clsed circuit televisin netwrk Sending messages t TTY-enabled phnes Alerting text messages and audi messages n Cisc VOIP phnes. URL re-directin with website interface. Gruping cmputer systems fr grup ntificatins. Ntifying up t 3,000 staff via the media surces listed abve, within 3-minutes f the FCC activating the system. Cntinuusly ntifying staff until each persn respnds t at least ne message n the media surce receiving the ntificatin. The ntificatin system must prvide realtime status, reprting and acknwledgement f receipt fr each media surce used and stre thse acknwledgements fr future reference and/r reuse by the FCC. The ntificatin system must be able t be activated by tw-factr authenticatin frm any internet lcatin wrld-wide. The ntificatin system must have a twenty fur-seven (24x7) 365 days live technical supprt that can respnd t requests fr assistance within 10 minutes. Hsting facilities must be able t demnstrate 99.999% availability. The vendr must prvide semi-annual cmputer based training and tw nsite classrm training at FCC HQ in Washingtn n the use f the system fr up t 25 FCC emplyees and ffer training fr significant sftware changes. Pp-up ntificatin must be supprted n Windws XP, Windws 7 and Windws 8. Cmmunicatin with pp-up client sftware must riginate frm servers lcated n the FCC s netwrk. System must supprt LDAP and/r AD grups as activatin list System must be able t exprt and imprt system cnfiguratin in XML, CSV, r ther standard frmats. System must have the ability t lad FCC public safety licensees int a systems database t allw fr gegraphical identificatin (Ge Mapping), selectin and alerting during emergency respnse situatins. Federal Cmmunicatins Cmmissin 2.0 PERIOD OF PERFORMANCE The perid f perfrmance fr this cntract is frm August 12, 2011 thrugh August 12, 2012, with tw (2) additinal ptin years. 2.1 Place f Perfrmance: The vendr must prvide semi-annual cmputer based training and ne (1) nsite classrm training at mutually agreed dates after cntract award n the use f the system fr up t 25 FCC emplyees at the FCC lcatin belw: FCC Headquarters 445 12 th Street, SW, Washingtn, DC 20554 Equipment, sftware and hardware will be hused and maintained by the vendr at the facility servicing the FCC. 3.0 ORGANIZATIONAL CONFLICT OF INTEREST 3.1 The prvisins f FAR 9.5, titled Organizatinal and Cnsultant Cnflicts f Interest, gvern perfrmance under this cntract. As stated at FAR 9.502, an rganizatinal cnflict f interest may result when factrs create an actual r ptential cnflict f interest under this cntract, r when the nature f the wrk t be perfrmed under this cntract creates an actual r ptential cnflict f interest n a future acquisitin. In the latter case, sme restrictins n the future activities f the cntractr may be impsed by the Cntracting Officer fr the future acquisitin. 3.2 FAR 9.505 states that the tw underlying principles are (a) preventing the existence f cnflicting rles that might bias a cntractr s judgment; and (b) preventing unfair cmpetitive advantage. It further states that rganizatinal cnflicts f interest may arise in situatins cvered by FAR 9.505, r the example in FAR 9.508, r in situatins nt cvered by thse prvisins. 3.3 Under this task rder, the cntractr may be required t perfrm services that trigger the cncerns and restrictins described in FAR 9.5. Tw examples f such situatins and related restrictins applicable t perfrmance hereunder, are set frth belw. 3.4 Under this task rder, the cntractr may be required t evaluate ffers fr prducts r services. The cntractr agrees that it will neither evaluate, nr advise the Gvernment with regard t, its wn prducts r services. In additin, the cntractr agrees it will bjectively evaluate, and advise the Gvernment cncerning, the prducts r services f its actual r prspective cmpetitrs. Page 3 f 8

Federal Cmmunicatins Cmmissin 4.0 NON-DISCLOSURE 4.1 In the curse f perfrmance pursuant t this task rder, the cntractr will access nnpublic infrmatin, including acquisitin sensitive infrmatin. The cntractr agrees that it will nt use r disclse any such infrmatin unless authrized by the Cntracting Officer. 4.2 The cntractr further agrees that it will use its best effrts t ensure that its emplyees and thers perfrming services under this cntract will nt use r disclse any such infrmatin unless authrized by the Cntracting Officer. T that end, cntractr agrees that its emplyees and thers perfrming duties under this cntract will sign the Certificate f Nndisclsure. 4.3 By agreeing t this task rder and/r any amendments, the Cntractr acknwledges, understands, and accepts the fllwing: 4.3.1 The Cntractr and any Subcntractr(s) shall presume that the FCC cmputer systems and strage media that the Cntractr r Subcntractr access have sensitive infrmatin and applicatins. The Cntractr will cmply with the cntractual security requirements. 4.3.2 Any FCC infrmatin, sftware, applicatins, cmputer systems and hardware accessed by the Cntractr in the perfrmance f the task rder remain the sle prperty f FCC. 4.3.3 T the extent that any sftware r applicatins n the FCC systems are prtected by cpyright, the Cntractr agrees that it will nt cpy r disclse them withut first btaining the FCC s prir written authrizatin, which will be prvided nly where authrized under applicable cpyright law. 4.3.4 The Cntractr, the Cntractr s emplyees, and any Subcntractr and Subcntractr s emplyees will access, r be prvided access t, the FCC infrmatin, sftware, applicatins, cmputer systems and hardware nly t the extent necessary, and nly fr the purpse f, perfrming the task rder. The Cntractr will take reasnable steps t ensure that it will allw nly thse Cntractr and Subcntractr emplyees wh need t see the FCC materials t perfrm the requirements f the task rder, t d s. This agreement als applies t any ther FCC systems r data t which the Cntractr may have access t r be disclsed t the Cntractr. 4.3.5 The Cntractr will nt authrize anyne ther than thse individuals wh require infrmatin t perfrm under the task rder t access, disclse, mdify, r destry the infrmatin, sftware r applicatins n the FCC systems prvided r accessed under this task rder withut the COTR prir written authrizatin. The Cntractr will refer all requests r demands fr prductin f r access t FCC data and systems, including curt rders, t the COTR fr respnse. 4.3.6 Except as authrized under this task rder, the Cntractr and its emplyees shall nt make any cpies f any FCC infrmatin, including sftware r applicatins that are nt cpyrighted. Any cpies made by the Cntractr r Page 4 f 8

Federal Cmmunicatins Cmmissin Subcntractr shall be identified as FCC prperty and handled as sensitive infrmatin under this nn-disclsure agreement. 4.3.7 Except t the extent necessary t perfrm the task rder, any infrmatin that the Cntractr and its emplyees learn frm and abut FCC data and FCC cmputer systems shall nt be recrded and such infrmatin, whether recrded r nt, shall be handled as sensitive infrmatin under this agreement. The Cntractr may nt use r disclse this data except as the Cntractr is permitted t use r disclse FCC sensitive infrmatin under the task rder and this nndisclsure agreement. 4.3.8 Upn cmpletin r terminatin f the task rder fr any reasn, the Cntractr will immediately deliver all nn-public FCC recrds, data, cpies f FCC recrds and data, sftware and equipment, and infrmatin abut FCC data and systems recrded r dcumented by the Cntractr, in its pssessin r the pssessin f any Subcntractrs t the COTR. 4.3.9 The Cntractr will be respnsible fr the actins f all individuals prvided t wrk fr FCC -OMD under this task rder. 4.4 Remval frm Duty Clause The Cntracting Officer (CO), with input frm the COTR and designated FCC Persnnel Security Officer, may request that the Cntractr immediately remve any cntractr persnnel frm wrking n the cntract shuld it be determined that individual(s) are unfit t perfrm n the cntract. The FCC will prvide the Cntractr, in writing, the specific reasns fr remval f an individual. Disrderly cnduct, use f abusive r ffensive language, quarreling, intimidatin by wrds r actins, r fighting. Als, participating in disruptive activities that interfere with the nrmal and efficient peratins f the Gvernment. Theft, vandalism, immral cnduct, r any ther criminal actins. Selling, cnsuming, pssessin f, r being under the influence f intxicants, drugs, r substances, which prduce similar effects. Imprper use f fficial authrity r credentials. Unauthrized use f cmmunicatins equipment r Gvernment prperty. Misuse f equipment used in the perfrmance f this cntract. Unauthrized access t areas nt required fr the perfrmance f the cntract. Unauthrized access f infrmatin fr persnal gain, (including, but nt limited t mnetary gain) r with malicius intent. 5.0 GOVERNMENT ROLES AND RESPONSIBILITIES Belw are specific rles f gvernment persnnel that can direct Cntractr resurces 5.1 Cntracting Officer The Cntracting Officer has respnsibility fr ensuring the perfrmance f all necessary actins fr effective cntracting; ensuring cmpliance with the terms f the cntract and safeguarding the interests f the United State in its cntractual relatinships. Accrdingly, the Cntracting Officer is the nly individual wh has the authrity t enter int, administer, mdify, r terminate this cntract. In additin, the Cntracting Officer is the nly persn authrized t apprve changes t any f the requirements under this cntract, and ntwithstanding any prvisin cntained elsewhere in this cntract r representatin made by any FCC emplyee, this authrity remains slely with the Cntracting Officer. 5.2 Cntracting Officer Technical Representative (COTR) The Cntracting Officer may designate ther Gvernment persnnel (knwn as the Cntracting Officer Technical Representative) t act as his r her authrized representative fr cntract administratin functins, including technical directin, that d nt invlve changes t the scpe, perfrmance, price, schedule, r terms and cnditins f the cntract. The COTR will be named in the rder when awarded. Such designatin will nt cntain authrity t sign cntractual dcuments, rder cntract changes, mdify cntract terms, r create any cmmitment r liability n the part f the Gvernment different frm that set frth in the cntract. 5.3 Alternate Cntracting Officer Technical Representative (A-COTR) The Cntracting Officer may designate ther Gvernment persnnel t act as Alternate Cntracting Officer Technical Representatives (A-COTR) t assist the COTR and act as the Cntracting Officer s authrized representative fr cntract administratin functins, including technical directin, that d nt invlve changes t the scpe, perfrmance, price, schedule, r terms and cnditins f the cntract. The A-COTR may be named t assist with the administrative functins f the cntract. The A-COTR will be named in the rder when awarded. Such designatin will nt cntain authrity t sign cntractual dcuments, rder cntract changes, mdify cntract terms, r create any cmmitment r liability n the part f the Gvernment different frm that set frth in the cntract. 6.0 SECTION 508 COMPLIANCE Cmpliance with sectin 508 f the Rehabilitatin Act f 1973 (as amended) is mandatry fr all Page 6 f 8

Standards can be viewed at: http://www.sectin508.gv. 7.0 SUITABILITY AND SECURITY PROCESSING 7.1 General 7.1.1 All task rder persnnel are subjected t backgrund investigatins fr the purpse f suitability determinatins. Based n their prpsed duties, sme task rder persnnel may als be required t have security clearance determinatins. N task rder persnnel may be assigned t wrk n the task rder withut a favrable initial review f the OF 306, Declaratin fr Federal Emplyment (http://www.pm.gv/frms/pdf_fill/f0306.pdf) r a written waiver frm the FCC Security Operatins Center (SOC). 7.1.2 Suitability, waiver, and security clearance determinatin investigatins are currently cnducted thrugh the FCC SOC (202-418-7884). Individual Cntract persnnel will be prvided with a review prcess befre a final adverse determinatin is made. The FCC requires that any task rder persnnel fund nt suitable, r wh has a waiver cancelled, r is denied a security clearance, be remved by the Vendr during the same business day that the determinatin is made. 7.1.3 If the task rder persnnel is re-assigned and the new psitin is determined t require a higher level f risk suitability than the task rder persnnel currently hlds, the individual may be assigned t such psitin while the determinatin is reached by the SOC. A new A-600 shall be necessary fr the new psitin. 7.1.4 Task rder persnnel wrking as temprary hires (fr ninety (90) days r less) must cmplete and receive a favrable initial review f the OF 306 and cmplete the task rder persnnel sectin f the FCC Frm A-600, FCC SOC Cntract Persnnel Recrd frm. If during the term f their emplyment they will have access t any FCC netwrk applicatin, they must als cmplete and sign the FCC Frm A-200, FCC Cmputer System Applicatin Access Frm. 7.2 At Time f Task Order Award 7.2.1 The FCC SOC must receive the cmpleted, signed OF 306 fr each prpsed individual member f the cntract persnnel (i.e., cntract emplyee ) at the time f task rder award. Resumes fr all persnnel prpsed fr assignment n the task rder shall be prvided t the SOC prir t the time f in-take prcessing (see belw, 3.2). The FCC SOC requires up t five (5) wrking days (frm the date they are received) t prcess the OF 306 befre any emplyee is allwed t begin wrk n the cntract. A written waiver frm the SOC may be btained in special circumstances. All task rder persnnel, regardless f task descriptin, must cmplete this frm. Withut an apprved, cmpleted OF 306 n file at the SOC, n Cntract persnnel may begin wrk n the Cntract. An apprved OF 306 is ne that has passed initial review by the SOC. During the curse f the SOC review f the OF 306, the task rder persnnel may be interviewed by SOC staff regarding infrmatin n their OF 306. 7.2.2 In additin, the Vendr is respnsible fr submissin f cmpleted, signed cmputer security frms fr Cntract persnnel prir t the individual beginning wrk n the Cntract (See Attachment N. 4, FCC Instructin 1479.2, FCC Cmputer Security Prgram Directive Page 7 f 8

These frms shall be submitted t the FCC Cmputer Security Office. 7.2.3 The COTR shall begin prcessing their Sectin B f the FCC task rder FCC SOC Cntract Persnnel Recrd frm (FCC Frm A-600) prir t Cntractr award ntificatin. This frm, with the COTR and CO prtins cmpleted, will be distributed at the time f task rder award and the Cntractr must submit the cmpleted A-600 frms fr all Cntract persnnel t the SOC within ten (10) wrking days f cntract award executin. 7.2.4 The Office f Persnnel Management (OPM) will issue a Certificate f Investigatin (CIN) fllwing the apprpriate backgrund investigatin. The SOC ntifies the CO and COTR and task rder persnnel wh have received a favrable adjudicatin s they may receive their permanent access credential. 7.3 Identity Prfing, Registratin and Checkut Requirements Cntractr shall cmply with the Identity Prfing, Registratin, and Checkut Requirements. 8.0 Additinal Terms, Cnditins, Obligatins Under this Order 8.1 Invices Invices may be submitted via email t: FO-Einvices@fcc.gv. In additin, cpies f the emailed invices shall als be sent t the CO and COTR.
