Oella HOA Board Meeting Notes Meeting Date: May 21, 2012 Call to order: 7:08 Attendees: Raina Rath (President), Bruce Elliott (ACM Liaison), Dan Hood (Director), Cynthia Roth (Landscape Committee Lead), Shirley McMonigle (Treasurer), Wendy Watt (ARC Director), Briana Wilson (Secretary), members of the community (748 Oella, 776 Oella, 768 Oella, 766 Oella, 756 Oella, 754 Oella, 738 Oella, 746 Oella, 752 Oella, 703 Pleasant Hill, 734 Pleasant Hill) 1. Meeting Minutes Approved as revised 2. Treasurer s Report (See April Financials) Office (Admin) expenses - should be $2655 - will discuss with Amber Last year's budget - lawn maintenance was under 'ground maintenance'. Amber added a line with zero funds for 'lawn maintenance' but grounds has a fund (shrub, tree maintenance, etc). Everything else was fine minus those two discrepancies. Shirley will discuss these two with Amber ACM - 2012 personal property tax return came to Bruce - will need a signature from Treasurer to be processed. Bruce passed off to Shirley for signature 3. ARC Update Removal of storm door or submission of application for approval for storm door 745 Oella - application received will be looked at in June 800 Charles James - approved application to remove dead shrubs 783 Oella - repair porch - approved with comment (match paint to 781) 748 Oella - repaint door and steps - comments on this - disapproved - not consistent with palette
736 Oella Ave - door replacement - application submitted - will look at the next meeting in June 4. Landscaping & Common Areas Kurtis completed mulching (lighter in some areas due to mild winter) Mary Jo way - will be reseeded and neighbor will keep watered Mold on trees in this area was confirmed by a local nursery Kurtis will cut shrubs back but Cynthia will check on who will do the fungicide - will compare prices ACM will need to send a letter regarding dumping of garbage/compost on HOA propery- we will need to draft Timber Point- newly mulched (residents contributed plants) Request from members to have Weed whacking of mill race trail done Cynthia will ask Kurtis how much this would cost. 5. Old Business Refuse storage on a property at Pleasant Hill - Resolved Shutters at 745 Oella (maintenance issue) - ACM was given letter to to send regarding shutter replacement. Owners were informed they will need ARC approval for these shutters. Status of asking HOA lawyer to clarify 3 yr statute of limitations for architectural violations (from January mtg) - HOA Attorney will render a written opinion. Encroachment at Timber Point- HOA Attorney will write a letter to these owners for next steps Status of filing of new easement on Race Road before settlement of sale -- Tom did not require buyer to sign an easement Since on-going violations effectively have the 3-year clock
continually restarted so statute of limitations doesn t run out Discussed whether we needed formal opinion on Statute of Limitations from HOA Attorney Long/Short brick row parking Jan 1 policies - full compliance with exception of 780/781 Oella properties but since letters went out, 780 in compliance. 781 still has ongoing violations. Priority should be increasing parking spaces - don't have enough now for units 19 houses with 27 spaces from LBR- would removing some of the green spaces give enough spaces that would assist residents in this area If islands are removed, where will snow be put in winter? Options include: Revise blue book Requires community approval Redraw plat lines To redraw plats, would require involving the county Engage contractor/engineer to see what else can be done - (get cost estimates) Axiom did survey for encroachments for around $900 DS Thaler & Associates From Baltimore County, did Board Reserve study Board agreed that Anne should consult with a contractor/ engineer to see what our options are. Board considered voting on setting an amount to spend on
this but decided to wait to see what options we have after consultation. Board did not authorize funds be spent on this at this point. Duplexes on Oella Ave- parking violations issue Stickers ordered 3-4 years ago, have had these in the past Letters have gone out to these residents Hanging Tags - usually last 2 years - none sent out for 2012 When house is sold, parking hangers should be given over along with blue book Will need to update spreadsheet of who has what tags Suggestion to color code these tags by region What is process for violation? 1st step - Violator is sent a letter 2nd - follow up letter sent 3rd - Fine hearing set 4th - Towing Can also Removing voting rights for 60 days Assess inventory of tags - who has what. Anne and Briana will work on the inventory and tag redistribution Management company doesn't dealing with enforcement because it's not currently in the 'package' we have now with ACM - we would have to pay more for this Question brought up of paying more to have a management company deal with the enforcement Could increase overall citation of violations ACM works during business hours, no 'hotline' for resolving
issues outside business hours - would fall on board members to call during these 'off' hours Instead of involving ACM, Board agreed to have the HOA Attorney send a letter (vs from Board) to repeat violators requiring cease and desist Anne will provide information to Attorney to draft letter - tell Attorney we will set a fine hearing Resend hanging tags - color coded - tracking in spreadsheet - reissue within the next 2 months Sellers burden to request new (pay for) if they are lost (will need to include as part of resale package agreement) 6. New Business 748 Oella Resident appeal of ARC decision (regarding Long brick row door color selection) Currently red door, needs to be repainted. Requested different shade of blue and gray than palette. ARC denied color selection. Owner is appealing decision to the Board. Owner is questioning appropriateness of having specified palette when no one on long brick row was consulted Board/ARC wanted palette colors to be points of reference, not meant as required colors ARC suggests not approving appeal, as the rules followed appropriately. ARC suggests having Board direct ARC to reopen color palette and consult LBR residents to determine palette LBR residents would like to participate in choosing colors Possible for smaller group to choose palette as representatives
from the community Consider having palettes rolled out to all other locations over time (not all at once) 748 Oella Ave owner withdrew appeal if ARC would consult with LBR residents on new palette Board moved and approved directing the ARC to reconsider the palette colors with consultation from LBR residents (two residents chosen were Jeff Hensley and Joann McClurg) ARC will work with selected LBR represenatives to define new color palette Repaving HOA roadways and parking lots Both estimates came in at around $40,000 Both proposed digging up of potholes and fixing - rest would be a 'sealed' over - would look like entire area was repaved To completely repave all, would add $70,000 or more Bruce will send out summaries of two proposals to Board and we can vote on this Moving forward, Board will need to consider how we clear parking lots to do this Will need to communicate with community Will need to consider using mill lot Will need to consider doing in 'pieces' vs all at once Bruce will cheek with Amber on amount we have available in limited assessment fund Owner of 929 Oella Ave would like to move parking sign from where it's at as it's blocked by plants, and relocate to retaining wall, which is HOA
property. Board approved moving of sign Bruce will let her know to do this Concerns regarding bee keeping activities (Pleasant Hill) - Beekeeping - Raina will send 2nd 'cease and desist' letter 783 Oella - Concern over brush that was cleared but adjacent property was accidentally crossed Bruce will send out response to owners questions If brush is being cleared, no ARC/landscaping application needed 7.
