European Patents In Morocco From March 2015 RABAT- Starting March 1 st 2015, anyone filing a European patent application will be able to request validation for Morocco. European applications and patents validated for Morocco will have the same legal effects there as Moroccan ones and will be subject to Moroccan patent law. This means that Morocco is the first nonmember country of the European Patent Organization (EPO) to validate the legal effects of a European patent on its territory. With Morocco included, patent protection can be obtained simultaneously for 41 countries with a single European patent application. Previously, Tunisia has signed a similar agreement with the EPO. New Cybercrime Law Enacted In Bahrain MANAMA- The new law on cybercrime, approved by His Majesty King Hamad bin Isa Al Khalifa and enacted recently, seeks to reduce crimes by establishing penalties to protect public interest. Under the law, illegal access to an IT system or part of it carries a maximum of one year jail sentence or a maximum fine of BD30,000, or both, while tapping carries a jail term or a maximum of BD100,000 fine, or both. Anyone threatening to cause damage for personal gains will face a jail sentence or a maximum of BD30,000 fine, or both, according to the Gulf Daily News (GDN). Anyone convicted of entering, damaging, disrupting, cancelling, deleting, destroying, changing, modifying, distorting or concealing IT device data concerning any governmental body will face a maximum of 10 years in jail. Anyone convicted of embezzlement of funds, receiving favors for oneself or others, forging documents by impersonation or interfering in IT system work will face a prison sentence. DED Issues Over 59,000 Commercial Permits in 2014 DUBAI- The Department of Economic Development (DED) in Dubai issued 59,130 commercial permits during the year 2014, 13% higher than licenses issued in 2013, according to the annual report on business activity in the emirate of Dubai released by DED. The number and categories of permits issued reflect the increasing ease of licensing procedures at DED, as well as an overall economic dynamism and upward momentum in key activities such as retailing and promotions. Permits for banner advertisements accounted for 57% of the total permits issued in 2014, a three per cent growth over the 33,341 commercial permits issued in 2013. The banners permitted included brand name advertising, print and electronic media advertisements, billboards and trademark-related announcements. The report points to a significant rise in advertisement spending during 2014, which in turn confirms rising confidence among investors and traders in Dubai on the one hand and an upswing in overall competitiveness in the emirate on the other hand, largely due to DED s efforts to facilitate commercial activities economic development. DED offers a package of permits to enable company owners and shop owners to promote their products competitively and with due regard to the principles of transparency and credibility. The permits are issued in accordance with the prevailing commercial laws and regulations on doing business and are aimed to enhance retail sector performance and sustainable economic growth. OAPI Joins TMclass YAOUNDE - L organisation Africaine de la Propriété Intellectuelle (OAPI) has joined recently TMclass, the global and free goods and services classification tool. OAPI represents 17 African member states: Benin, Burkina Faso, Cameroon, Central African Republic, Chad, Comoros, Congo, Côte d Ivoire, Gabon, Guinea, Equatorial Guinea, Mali, Mauritania, Niger, Guinea Bissau, Senegal and Togo. OAPI registers trademarks in both French and English. OAPI s integration into TMclass means that a total of 42 national and regional IP offices, including OHIM and WIPO, have now incorporated their data into the tool. TM5 ID List Tool is Available BEIJING- As announced on the 19th January, the TM5 Partners has launched the TM5 ID List Search Tool on January 26. This tool allows users to quickly and efficiently search the shared ID database known as the TM5 ID List. The list is composed of some 14,000 pre-approved descriptions of goods and services (IDs) associated with the trade marks for which protection is sought. Applicants can be assured that IDs in the list will be accepted at all TM5 partner offices (JPO, KIPO, OHIM, SAIC and USPTO), thus increasing the predictability and consistency of decisions and legal certainty among the participating offices. All IDs are available in English and the list is currently searchable in English only. However, translations of some IDs are also available in other TM5 languages (Chinese, Japanese, Korean and 23 EU languages) and work is ongoing both to extend the translations to the complete list and to make ID List searchable in the other languages. Qatar s Emir Signs Law on Wage Protection DOHA- As part of a promised labor market reform, Qatar issued a law making it mandatory for private companies to pay all their workers their wages through electronic transfer system. The law is to be published in the Official Gazette and only after which it would be implemented. The implementation is expected soon. Companies will be given a grace period of six months to apply the new mode of workers salary payments, popularly known as the Wage Protection System (WPS). However, the Minister for Labor and Social Affairs will have the authority under the new law to extend this grace period to another six months or more. The Law (No. 1 of 2015) amends some provisions of the Law No. 14 of 2004, known as the Labor Law. The new legislation was issued by the Emir HH Sheikh Tamim bin Hamad Al Thani on February 18th, reports Qatar News Agency (QNA). Needless to say that until the new law has been brought into effect, provisions of the existing legislation (No. 14 of 2004) will apply. From the provisions of the new law it is clear that not only banks but also other financial institutions such as exchange houses will be brought within the network of the WPS. Actually, the new law incorporates amendments only of two main articles of the previous law (Articles 66 and 145). Article 66 which talks of wage payments to company workers. The amended portion says that the wage must be transferred into a worker s account with one of the financial institutions in the country within a specified period. Article 145 of the previous law, which stipulates punishments for not complying with its provisions, has almost been retained. The articles says company owners not transferring workers wages electronically in time will be liable to face a jail term not exceeding a month or a fine of QR2,000 ($549.2) to QR6,000 ($1,647.6) or both. The law suggests that not only wages but all types of payments, including allowances and perks, must be paid to workers only electronically. The labor ministry said earlier that this will allow it to create a national database that would record wage payments in the private sector and guarantee timely and full payment to workers their agreed-upon wages. The WPS, once in force, will end workers woes regarding delayed or non-payment of their wages and perks. Source: The Peninsula Qatar 8 TAG-Legal tag-legal.com
