LDPB(12)14: Learning Disability Programme Board - Proposals 1. Following the DH Review of Winterbourne View and the programme for change developed for the final report, this paper sets out proposals to revise the Learning Disability Programme Board to act as the governance body holding delivery organisations to account. The programme for change includes actions to transform care and support for people with learning disabilities/autism and challenging behaviours. Background 2. As part of the Winterbourne View programme for change, what is needed is a robust Programme Board having a prominent role in monitoring actions coming out of the DH Review and being able, through its membership, to hold organisations to account. The draft Concordat (to be confirmed) says: The revised Learning Disability Programme Board will hold partners to delivery. Chaired by the Minister for Care and Support, membership will include the key partners critical to delivery, including the NHS Commissioning Board, Care Quality Commission (CQC), the Association for Adult Social Services (ADASS) and the Local Government Association (LGA) as well as professionals and people with learning disabilities and their families. The Board will measure progress against milestones, monitor risks to delivery, and challenge external delivery partners to deliver to plan. 3. The Learning Disability Programme Board (LDPB) was set up under Valuing People Now (VPN) to oversee implementation of the strategy. 4. Since the first Panorama programme uncovering events at Winterbourne View in May 2011 the Programme Board has had a strong emphasis on issues arising from Winterbourne View and the DH review. Holding people to account for delivering change following on from the Winterbourne View Review will be a key focus for the Programme Board.

5. Alongside this work, the Board will continue to have an ongoing and very important role in ensuring work takes place across Government to improve outcomes for all people with learning disabilities and their families, and in particular focus on issues around improving health outcomes, employment and choice about where (and with whom) people live. 6. People with learning disabilities and family carers will continue to play a central role on the Programme Board both in contribution to work, for example the good practice project and in challenging statutory and public bodies in how they are delivering against the commitments in the DH final report on Winterbourne View. Proposition for the Board 7. We propose that the LDPB meets three times a year with a core membership and that other delivery partners are invited to attend to account for progress on actions for which they are responsible. 8. The agenda for the Board will largely be driven by the timescale for delivery of key Winterbourne View actions. We also envisage building Board meetings round themes (eg commissioning for quality, improving the workforce and clinical leadership). 9. The Board would not only look at issues coming out of the final report on Winterbourne View. We would expect it, for instance, to continue to lead work nationally on improving health outcomes for people with learning disabilities in liaison with key partners chiefly the NHS CB and Public Health England. 10. The proposed changes would mean some alterations to the current membership to ensure we have the right people there to account for progress and challenge delivery. A proposed list of members and others to be invited to particular meetings to report on specific actions is attached at Annex A. We have already made three additions to our current membership. These are to invite the NHS Commissioning Board (Ivan Ellul), the Care Quality Commission (David Behan/Philip King) and the Learning Disability Professional Senate (Chair, Alick Bush)

Involving people with learning disabilities and families 11. An important part of the current Board, and which we would wish to continue, is ensuring a strong presence of learning disability self-advocates and family carers at the heart of policy and review. DH provides funding to support both the National Forum of People with Learning Disabilities and the National Valuing Families Forum in order to enable them to participate fully at the Board and represent their members views. Both send two representatives to Board meetings; for the National Forum it is usually their co-chairs, currently Gavin Harding and Karen Flood and for the NVFF it is Vicki Raphael and Viv Cooper (who also represents the Challenging Behaviour Foundation (CBF) as their founder member). Stakeholder seminar 12. In addition, we propose that there is a stakeholder seminar to capture the broader LD base, hosted by the Minister for Care and Support, including for instance advocacy organisations, such as Dimensions, Changing our Lives, Action 4 Advocacy, and VoiceAbility as well as a range of provider organisations. We would like to give their members the opportunity to have their voice heard at the heart of government. Recommendations 13. We recommend to Board members the following proposals: (i) (ii) (iii) the Programme Board meets three times a year; the membership is as set out in the attached document with other delivery partners invited when needed; there is an annual stakeholder seminar including people with learning disabilities, learning disability organisations and provider organisations.

The Mandate: A mandate from the Government to the NHS Commissioning Board: April 2013 to March 2015 November 2012 Later in the autumn of 2012, the Government will issue a full and detailed response to the appalling abuse that was witnessed at Winterbourne View private hospital. The NHS Commissioning Board s objective is to ensure that CCGs work with local authorities to ensure that vulnerable people, particularly those with learning disabilities and autism, receive safe, appropriate, high quality care. The presumption should always be that services are local and that people remain in their communities; we expect to see a substantial reduction in reliance on inpatient care for these groups of people.
