1.0 INTRODUCTION 1.1 OWNER OF THIS DOCUMENT The owner of this is the Project Manager for Lucas Engineering and Construction (LEC). 1.2 PROJECT DESCRIPTION AGL Energy Limited (AGL/CLIENT) is developing the Newcastle Gas Storage Facility Project (the Project) in Tomago and Hexham, near Newcastle in New South Wales. The Project is being constructed to assist AGL to meet its peak gas demand in winter and to provide additional security of gas supply during supply disruption events in New South Wales. The project involves the design and construction of a liquefied natural gas plant and storage tank in Tomago and an interconnecting pipeline between Tomago and Hexham. The interconnecting gas pipeline will be a DN400 high pressure gas pipeline connecting the Newcastle Gas Storage Facility (NGSF) to the Jemena Gas Network (JGN) in Hexham approximately 5 km in length. 1.3 PURPOSE This plan gives an overview of the actions, roles and responsibilities required for Incident management which includes the following elements: incident response; notification and communication; reporting; classification; containment, communication, reporting, investigation, analysis; and the development of and completion of corrective actions aimed at preventing reoccurrence. This plan is linked to the following plan and procedures: Emergency Management Plan [10371 HS 03 0002]; Crisis Management Procedure (T0475) where incident management requires the assistance of the Division and or Group Crisis Management Teams; Injury Management and Workers Compensation Procedure (T0102) where a person s injury involves restricted work duties and or workers compensation; Corrective and Preventive Action and Continual Improvement Procedure (T0402), where a corrective and preventive action is necessary; Motor Vehicle Policy and Procedure (T0659). 1.4 OBJECTIVES The objective of this plan is to ensure the proper management of Incidents which may occur onsite with the aim of reducing potential impacts to personnel, the community, the environment and local fauna and flora etc. 1.5 BACKGROUND LEC maintains an Emergency Management Plan which shall be implemented in crisis situations. 10371-HS-03-0003_0.docx Page 3 of 14

2.0 ROLES AND RESPONSIBILITIES Roles and responsibilities are detailed within the flowchart of section 3.0. 3.0 INCIDENT RESPONSE Whenever an incident occurs, the first priority and responsibility of the site senior person is to ensure the safety of people; the second is to protect the environment, followed by the protection of plant, equipment and the business operations. It is the responsibility of the first person on the scene, to contact trained First Aid personnel and to assist in notifying emergency authorities, where relevant. Once immediate actions have been taken to ensure the safety of all persons involved in the incident and of response personnel, the site senior person must be notified, if this has not already occurred. The site senior person must coordinate the incident response. This includes, but is not limited to: supporting the First Aid trained personnel in their efforts to assist any injured people; making a decision in regards to suspension of work; cooperate with emergency services if necessary; managing other site personnel; identifying containment measures; Identifying appropriate use of local resources to deal with incident. The site senior person must also do everything reasonable, without obstructing the provision of emergency care or risking further danger to others, to secure the incident scene and preserve any possible evidence. Examples of evidence to leave untouched may include: a piece of equipment, which was involved in an incident or injury, should be left exactly where it was last handled (eg a ladder or grinder). Chains/slings which had secured a load that was spilled/dropped, to be left untouched, until examined. Any critical situation that has the potential to escalate to a crisis will be managed in accordance with the Crisis Management Procedure (T0475) and the Crisis Management Plan (T0605). Site Emergencies will be managed in accordance with the Emergency Management Plan developed for the project site. The site senior person must coordinate the transport of injured persons, whether that be escorting an ambulance or taking a person for medical treatment. Obtaining a medical certificate and liaising with the Return to Work Coordinator, will also be the responsibility of the Site Senior person Injury Management and Workers Compensation (T0102). In the case of an environmental incident the site senior person must coordinate the clean up of spills and stoppage at the source via containment and other measures. 10371-HS-03-0003_0.docx Page 6 of 14

4.0 INCIDENT NOTIFICATION AND COMMUNICATION The senior site person is to initiate and coordinate incident notifications as described below. The risk score for the Incident (Part A, Incident Report Form F0521) will determine the maximum time for notification. The Project / Regional / Construction Manager shall ensure the names and contact numbers of individuals as per the notification hierarchy are listed in the Construction Safety Management Plan (CSMP). Note for incidents that have a high or extreme risk rating (actual or potential) and/or where the Crisis Management Team has been involved, legal support must be initiated as early in the process as possible but this must never interfere with or delay incident response. 5.0 INCIDENT REPORTING 5.1 IMMEDIATE NOTIFICATION For all incidents, immediate verbal notification must occur to the site senior person. A verbal notification must be a positive communication. That is a two way communication where it is clear the message has been conveyed. 5.2 INCIDENT REPORT FORM An incident report must be completed using the on line reporting tool on LucasNet (http://intranet.lucas.internal/ohs) or the Incident Report Form (F0521). Sections A, B & C must be completed after the incident has occurred, by the end of shift. Notifications must be undertaken in accordance with the Notification Timing listed previously. The Site Corrective Action Register (F0836) must be immediately updated by the site senior person (see section Corrective Actions). For incidents where a Root Cause Analysis (RCA) is required the end of shift time limit applies only for section A & B and is 7 days for section C. Section D must be completed within 7 days of receipt of Section C. Section D shall be signed in order to verify that the report has been completed diligently, that the investigation was appropriate, that the corrective actions assigned shall be expected to eliminate or reduce the level of risk as required. When immediate notification is required, and the on line form is not accessible, then an initial incident report can be submitted instead: Incident/Near Miss Immediate Notification (F0605). C By end of shift (if an RCA is required, within 7 days) D Within 7 days of receiving Section C Personnel involved in a motor vehicle incident are required to complete the Motor Vehicle Accident Form (F0065) in addition to the Incident Report Form. This form is to be submitted in accordance with the instructions provided in the Motor Vehicle Policy and Procedure (T0659). In the event of a significant environmental incident, LEC will be required to contact the Department of Primary Industries within 24 hours with a verbal notification and a written Incident Report Form submitted within 7 days of the incident occurring. 10371-HS-03-0003_0.docx Page 9 of 14

5.3 SAFETY & ENVIRONMENT ALERTS After becoming aware of an incident rated high or extreme risk, the Division HSET Manager shall issue an Internal Safety/Environment Alert (F0522) following the Safety/Environment Alerts Procedure (T0263). Regional / Project / Construction Managers and or Rig Managers / Site Senior Persons are responsible for ensuring all employees under their direction receive all Alerts via weekly toolbox meetings and that this communication is recorded in the minutes of these meetings. 5.4 INCIDENT CLASSIFICATION Each incident shall be classified by the site senior person based on the most serious outcome that resulted due to the incident. Only one classification shall be selected on the Incident Report Form. The incident classifications are: Personal Injury (PIN) First Aid Injury (FAI) Medical Treatment Injury (MTI) Restricted Work Injury (RWI) Lost Time Injury (LTI) Infrastructure/Utilities Damage (IUD) Occupational Illness (OI) Vehicle Incident (VEH) Plant / Equipment Damage (ED) Environmental Harm (ENV) o Large Chemical spill / Contaminated soil spills o Cultural Heritage Damage o Significant Fauna death o Dumping of waste Public Impact (PI) Compliance / Procedural Breach (PB) Near Miss (NM) Report Only (RPO) 6.0 INVESTIGATION AND ANALYSIS The site senior person shall assess the risk of the underlying hazards which gave rise to the incident. In doing so that person must consider the actual and potential consequence of the incident. The Lucas Risk Assessment Matrix (K0505) shall be used to determine risk score. The Risk Matrix lists the actions required for each level of risk. 6.1 ROOT CAUSE ANALYSIS An overview of the management steps for Root Cause Analysis is contained in Chart below. The Business Unit Manager is responsible for commissioning a formal investigation, in accordance with 10371-HS-03-0003_0.docx Page 10 of 14

the Root Cause Analysis Guide (K0983) of high and extreme risk incidents, with the assistance of the Division HSET Manager. Use the Root Cause Analysis Report Form (F0927) to provide a structure to the root cause analysis investigation. Division HSET Manager establishes a recognised root cause analysis methodology incident actual or potential risk score indicates an RCA is required Business Unit / Project Manager instigates an RCA that includes the people involved in the incident Division HSET Manager provides functional support for RCA process Root cause (s) and corrective action (s) are identified BU Manager reviews RCA outcomes and endorses corrective action plan BU Manager directs and is accountable for completion of corrective actions and updates Div HSET Manager on status Division HSET Manager updates incident report records CEO and Division GM review incident report and request additional information or corrective actions if required Chart Root Cause Analysis 6.2 CORRECTIVE ACTIONS Corrective actions to prevent reoccurrence must be designed to address the root or underlying causes of the incident. These actions shall be aimed at implementing the highest practical level of risk control using the Hierarchy of Controls. Note that corrective actions that are assigned to people (including line, maintenance and functional management) must be agreed to by that person before insertion in the incident report. In order to ensure continual improvement of outcomes, additional corrective actions shall be allocated to enhance the associated management systems as per the Corrective and Preventive Action and Continual Improvement Procedure (T0402). All incidents must be recorded in the Site Corrective Action Register (F0836) this then funnels medium/high level risks into the on line Corporate Risk Register. Review of corrective actions once completed shall be conducted to ensure they have been effective, and have not introduced any new risks. 10371-HS-03-0003_0.docx Page 11 of 14

7.0 STATUTORY REPORTING Statutory reporting requirements are determined by the Division HSET Manager, once advised of the incident. These requirements may change hence it is the responsibility of the Division HSET Manager to stay abreast of what these requirements are and ensure compliance. Refer to the Incident Notification Guide(s) as referenced in 6.0 for advice on what is reportable, and timeframes for reporting. A written record of statutory notification must be filed with the Incident Report, including file notes to record conversations and emails. The record must show the date, time, name of the inspector spoken with and a summary of the conversation. 8.0 RECORDS The Division HSET Manager shall retain Incident Reports and all associated records in an electronic file for 30 years. A summary of all incidents shall be maintained on the Incident Register which shall be released to the Business Unit Managers weekly to allow them to follow up and respond to incidents diligently and promptly. All details from documented evidence collected as a result of the incident must be recorded electronically using the on line electronic system. Some documents may require scanning in to the records system. All requests for copies of incident reports, investigations and associated documents and evidence should be referred to the Division HSET Manager who may involve legal support in responding to such requests. 9.0 INSPECTORATE INVESTIGATIONS The Division HSET Manager shall be responsible for facilitating investigations conducted by statutory bodies.
