3 1.0 Purpose and Background This Pollution Incident Response Management Plan (PIRMP) has been developed to satisfy obligations under the Protection of the Environment Operations Act 1997 (POEO Act) and associated Protection of the Environment Legislation Amendment Act 2011 (POELA Act). The Protection of the Environment Legislation Amendment Act 2011 (POELA Act) was introduced resulting in changes to the Protection of the Environment Operations Act 1997 (POEO Act). The intent of the POELA Act is to improve the way pollution incidents are reported and managed. Provisions include a requirement for holders of Environmental Protection Licences (EPLs) to prepare, keep, test and implement a Pollution Incident Response Management Plan (PIRMP). This PIRMP has been developed by Waterway Constructions to satisfy pollution reporting obligations under the POEO Act. This plan outlines the classification, testing, reporting, and management requirements of an environmental pollution incident. The objectives of this plan is to ensure an environmental pollution incident is communicated to all relevant groups and individuals, to prevent, minimise and control the risk of an environmental pollution incident, and also, appropriately establish and maintain the plan. This plan is a mandatory document on all NSW projects issued with an EPL. This document has been designed as a reference to existing emergency response plans and associated procedure. It also details additional supplementary site specific information as required under the POEO legislation, in respect to the relevant Environment Protection License (See attached at Appendix 1). 2.0 Scope This PIRMP covers Waterway Constructions construction of Berth 103 Stage 2 Extension. This plan applies to all activities, products and services on the site over which Waterway Constructions has operational control. 3.0 Regulatory Requirements The specific requirements for PIRMPs are set out in Part 5.7A of the POEO Act and the Protection of the Environment Operations (General) Regulation 2009 (POEO(G) Regulation). In summary, this legislation requires the following: All holders of EPLs must prepare a pollution incident response management plan (section 153A, POEO Act); The plan must include the information detailed in the POEO Act (section 153C) and the POEO(G) Regulation (clause 98C) and be in the form required by the POEO(G) Regulation (clause 98B); Licensees must keep the plan at the premises to which the EPL relates (section 153D, POEO Act); Licensees must test the plan in accordance with the POEO(G) (at least every 12 months and after a pollution incident) in accordance with the POEO(G) Regulation (clause 98E); and If a pollution incident occurs in the course of an activity so that material harm to the environment is caused or threatened, licensees must immediately implement the plan (section 153F, POEO Act). 4.0 Definition of a Pollution Incident A pollution incident means an incident or set of circumstances during or as a consequence of which there is likely to be a leak, spill or other escape or deposit of a substance, as a result of which pollution has occurred, is occurring or is likely to occur. It includes an incident or set of circumstances in which a substance has been placed or PIRMP -1.doc Page 3 of 12 Rev 1 (Dec. 14)

4 disposed of on a premises, but it does not include an incident or set of circumstances involving only the emission of any noise. 5.0 Notification of a Pollution Incident 5.1 What must be notified A pollution incident is required to be immediately notified if there is a risk of material harm to the environment, defined under section 147 of the POEO Act as: harm to the environment is material if: it involves actual or potential harm to the health or safety of human beings or to ecosystems that is not trivial, or it results in actual or potential loss or property damage or an amount, or amounts in aggregate, exceeding $10,000 (or such other amount as is prescribed by the regulations), and loss includes the reasonable costs and expenses that would be incurred in taking all reasonable and practicable measures to prevent, mitigate or make good harm to the environment. 5.2 Responsibility to notify Under Section 148 of the POEO Act, the following people have a duty to notify a pollution incident occurring in the course of an activity that causes or threatens material harm to the environment: The person carrying on the activity; An employee or agent carrying on the activity; An employer carrying on the activity; The occupier of the premises where the incident occurs. Once determined that the incident causes or threatens material harm to the environment, notification must be given immediately, i.e. promptly and without delay, after the person becomes aware of the incident. 5.3 Emergency Response If a pollution incident occurs, all necessary action should be taken to minimise the size and any adverse effects of the release. If the incident presents an immediate threat to human health or property, Fire and Rescue NSW, the NSW Police and the NSW Ambulance Service should be contacted first for emergency assistance (phone 000). The other response agencies must still be contacted after that to satisfy notification obligations. 5.4 Contaminated Land Persons whose activities have contaminated land and owners of land who become aware, or ought reasonably to be aware, that the land has been contaminated must notify the EPA as soon as practicable after becoming aware of the contamination, if the contamination meets certain criteria. The duty to notify is a requirement under section 60 of the Contaminated Land Management Act 1997 (CLM Act). 6.0 Hazard Assessment and Management The likelihood of environmental hazards occurring at the site has been assessed via consultation with personnel on site, and the development of Safe Work Method Statements (SWMS). Through the use of SWMS assessments, significant impacts and PIRMP -1.doc Page 4 of 12 Rev 1 (Dec. 14)

5 the risks they pose to the environment and personnel can be assessed and controls implemented to mitigate possible impacts to human health and the environment. The risk assessment process includes: Identifying possible hazards associated with day to day procedures; Assessing the risks to human health or the environment associated with procedures, taking into account other conditions or events that may increase its likelihood; and Implementing safety controls to minimise or prevent risk of harm to human health or the environment. Other pre-emptive actions taken to minimise the likelihood of potential environmental hazards include: The implementation of a site-specific Environmental Management Plan (C) (CEMP); Project Risk Assessment Site Specific Emergency Procedures Onsite inductions for employees, contractors and suppliers; 6.1 Description of Potential Hazards An environmental hazard is a term for any situation or state of events which poses a threat to the surrounding environment. Potential environmental hazards specific to Waterway Constructions Port Kembla operations include: Hydrocarbon Spills Chemical Spills/Leaks Dust Generation 7.0 Pollution Incident Response Procedures Hydrocarbon or Chemical spill Where possible, and safe to do so, isolate the source of the spillage. Move any personnel not involved in the clean-up or public from the scene to the muster point. Access the Spill Response Kit and appropriate Personal Protective Equipment (PPE). Block inlets to any nearby surface water drains and sewers with a physical barrier such as: -spill sorb /spill pack from the Spill Kit; -absorbent boom from Spill Kit; or -a mound of dirt (diesel spills) Notify the Project Manager or Project Supervisor. If spill is too large or dangerous for localised clean up, Project manager or Project Supervisor will call New South Wales Fire Service (HAZMAT) 000. Working on the windward side of the spill and wearing PPE (consult SDS for correct PPE for the substance), scoop or pump as much pooled substance as possible into a container for appropriate disposal, label container as containing hazardous waste. Upon removal of the majority of the spill, apply the spill absorbent product from the spill kit or other absorbent material (sawdust) onto the contaminated area. With a stiff-bristled broom, mix the absorbent material into the spill until all spillage is absorbed. Once all hydrocarbon/chemical spillage has been absorbed, immediately scoop or shovel the saturated absorbent material into a weather proof container and label as contaminated waste. 6 Dust Generation A water tanker will be available on site for dust suppression as well as hand held hoses. Hazardous Substance Register A Hazardous Substance Register is kept in the site office with a hard copy of all required SDS. Safety Equipment Under Waterway Constructions Safety Management Program, minimum Personal Protection Equipment (PPE) requirements are in place for all employees, subcontractors, visitors and transport operators. Minimum PPE includes high visibility clothing, steel cap boots, hard hats and safety glasses. Other onsite safety-related equipment includes: Emergency stop/shut down on plant; Eye wash stations/showers; Spill kits Online SDS Register; Appropriate process and chemical identification signage; First aid facility and kits; 8.0 Notification Procedure and Contact Details In response to requirements under changes to 5.7 of the POEO Act regarding pollution incident notifications, the following specific information and contact details are provided for Waterway Construction, in the event of an environmental incident. Excerpt from EPA Website - Protocol for Industry Notification of Pollution Incidents: Recent changes to Part 5.7 of the Protection of the Environment Operations Act 1997 (POEO Act) specify new requirements relating to the notification of pollution incidents. The changes take effect from 6 February 2012 and require the occupier of premises, the employer or any person carrying on the activity which causes a pollution incident to immediately notify each relevant authority (identified below) when material harm to the environment is caused or threatened. The following information and procedures may assist those responsible for reporting a pollution incident. If the incident does not require an initial combat agency, or once the 000 call has been made, notify the relevant authorities in the following order. The 24-hour hotline for each authority is given when available: the appropriate regulatory authority (ARA) for the activity under the POEO Act (usually the EPA or local authority) the local authority is a local council of an area under the Local Government Act 1993), the Lord Howe Island Board for Lord Howe Island, or the Western Lands Commissioner for the Western Division (except any part of the Western Division within the area of a local council) the EPA, if it is not the ARA phone Environment Line on the Ministry of Health via the local Public Health Unit see the WorkCover Authority phone the local authority if this is not the ARA Fire and Rescue NSW phone 000. Complying with these notification requirements does not remove the need to comply with any other obligations for incident notification, for example, those that apply under other environment protection legislation or legislation administered by WorkCover PIRMP -1.doc Page 6 of 12 Rev 1 (Dec. 14)

7 If, under application of internal incident classification procedures, an environmental incident is determined to have caused or threatened material harm to the environment at the Waterway Constructions Port Kembla site, the following notification procedures must be undertaken immediately, and in alignment with internal notification and escalation procedures. Firstly, call 000 if the incident presents an immediate threat to human health or property. Fire and Rescue NSW, the NSW Police and the NSW Ambulance Service are the first responders, as they are responsible for controlling and containing incidents. If the incident does not require an initial combat agency, or once the 000 call has been made, notify the relevant authorities in the following order. the appropriate regulatory authority (ARA) the EPA, if it is not the ARA the Ministry of Health via the local Public Health Unit the WorkCover Authority the local authority if this is not the ARA Fire and Rescue NSW. RELEVANT INFORMATION TO BE GIVEN WHEN NOTIFYING THE INCIDENT The relevant information to be given according to section 150 of the POEO Act (1997) when notifying the incident to the regulatory authorities is as follows: Time, date, nature, duration and location of the incident Location of the place where pollution is occurring or is likely to occur The nature, the estimated quantity or volume and the concentration of any pollutants involved, if known The circumstances in which the incident occurred (including the cause of the incident if known) Action taken or proposed to be taken to deal with the incident any resulting pollution or threatened pollution, if known When the information relating to items c), d) or e) is not known at the time of verbal notification, this information must be provided once it becomes available 9.0 Management Responsibilities and Contact Details Contact Name, Position, 24 Hour Contact Details Peter Bramich, National HSE Manager, Internal Notification Responsibility Responsible for authorizing the PIRMP and all future updates. This will include all SWMS relevant to the work to be undertaken and general information relating to emergency response procedures. As part of the site orientation procedure staff are provided with information relating to routine EPA requirements, including this document. Current staff undergo numerous training programs and certificates to minimise the likelihood of a pollution incident. These include a comprehensive site induction focusing on safety issues related to day to day activities on site, along with all existing protocols relating to chemical handling. A training exercise designed to test the adequacy of emergency preparedness and response will be conducted at least quarterly Testing, Review and Maintenance This plan will be tested routinely once every 12 months and the accuracy of the information contained and consistency with other procedures developed in the preceding 12 months will be carried out. This plan will also be tested, within one month of the occurrence of any pollution incident, or at the discretion of WWC, to incorporate improvements to the effectiveness and workability of the plan as well as changes to responsibilities of the persons implementing this plan, for example, within one months of the occurrence of any pollution incident for incorporating improvements to the effectiveness and workability of the plan; changes to responsibilities of the persons implementing the plan; changes in contact details PIRMP -1.doc Page 8 of 12 Rev 1 (Dec. 14)

9 14.0 PIRMP Availability The PIRMP will be accessible in a written form on site for all personnel responsible for implementing the plan, and to an authorized officer (as defined in the POEO Act) on request.
