In both cases, courts imposed drastic sanctions against corporate defendants accused of failing to collect and preserve electronic documents. Spoliation and document retention are now front and center. This panel will address best practices for both management and employee litigators, including the counseling of employers on records retention issues. It will also consider remedies that are available when electronic evidence has not been retained. The panel will also discuss a series of real world problems in which plaintiffs make discovery demands, employer lawyers counsel their clients, and the parties argue before the court.
