Mary Judge Ryan, Town Attorney reported on the K E & G Court of Appeals in regards to the lawsuit filed and the Armstrong lawsuit. G. Town Clerk/Administrator's Report- Reported that a referendum has been filed against Ordinance 12-02. Seniors Center has a trip scheduled to visit the Copper Queen in Bisbee. Landfill survey is in the process. ID badges are in the process of being issued. Our Corporate filing is being updated per request from the Arizona Corporation Commission. Vehicle Lease options are being reviewed for validity. The Caselle Cash Receipting will be implemented in October. H. Unfinished Business: None I. New Business: 1. Discussion and/or action: [Town Clerk-Administrator) Air Methods Corporation's subsidiary Rocky Mountain Holdings, LLC, dba Life Net Air Ambulance is interested in continuing discussions regarding the opportunity to base an air medical helicopter in the Town of Huachuca City. The spokesman for Life Net Air Ambulance gave a synopsis of the feasibility and availability of the services offered. Motion made by Pat Woodruffto authorize a feasibility study to base an air medical helicopter in the Town of Huachuca City, 1 No- Donna Johnson Motion Carried 2. Discussion and/or action: [Attorney) Enter into Executive Session pursuant to A.R.S. 38-431.03 (A) (3). Discussion or consultation for legal advice with the attorney or attorneys of the public body regarding annexation process. Motion made at 7:20PM by Mayor Robertson to enter into Executive Session for discussion and/or action, seconded by Pat Woodruff Page 2 of7

Discussion and/or action: [Attorney] Direction as needed from Executive Session regarding the annexation process. seconded by Laura Wallace. Motion made by Mayor Robertson to have the town attorney and town clerk work together towards finalization of the plans already in place for the annexation process at a $10,000 cap, seconded by Ken Taylor. 4. Discussion and/or action: [Mayor] Use of the Community Center by Huachuca City Elementary School (TUSD #1) for a classroom pending repair of school. Discussion of Memorandum of Understanding with the Tombstone Unified School district and Huachuca City Elementary School. seconded by Laura W a/lace. Motion made by Mayor Robertson to instruct the Town Attorney and the TUSD # 1 Attorney to draw up an Authorized Memorandum of Understanding and issue it to TUSD # 1, 5. Discussion and/or action: [Town Clerk-Administrator] Request by Tombstone Schools to utilize inmate labor with supervision performed by Huachuca City. Mayor Robertson pulled agenda item # 5 until further research and more information becomes available. 6. Discussion and/or action: [Town Clerk-Administrator] Request to transfer liquor license by Dusk to Dawn. seconded by Pat Woodruff. Motion made by Mayor Robertson to recommend approval of the transfer of Liquor License with the stipulation of the business license approval, seconded by Donna Johnson. 7. Discussion and/or action: [Town Clerk-Administrator] Request for temporary special event liquor license from Animal. Page 3 of7

Discussion and/or action: [Town Clerk-Administrator] Authorization to issue a Request for Proposals pursuant to Town Code Section 3-6-6 (E) to obtain heavy vehicle maintenance services for the Town. Motion made by Mayor Robertson to open for discussion and/or action agenda items 9, 10 & 11 simultaneously, seconded by Pat Woodruff Motion made by Mayor Robertson to authorize the proposal for the request and obtain the heavy vehicle maintenance services for the Town, seconded by Pat Woodruff 10. Discussion and/or action: [Town Clerk-Administrator] Status of temporary employment Mechanic/Operator at Huachuca City Landfill not to exceed 90 days. Discussion and/or action: [Town Clerk-Administrator] Status of the temporary employment of Laborer with Huachuca City Public Works Department not to exceed 90 days. Motion made by Mayor Robertson to extend the temporary employment for another 90 day time period, seconded by Pat Woodruff 12. Discussion and/or action: [Taylor] Adopting Comprehensive Code & Rules for the Town of Huachuca City. Motion made by Ken Taylor to direct staff to research three (3) companies to provide codification, 13. Discussion: [Johnson] Reconsideration of action on Ordinance 12-02 Motion made by Donna Johnson to open for discussion, seconded by Ken Taylor. 14. Discussion: (Johnson] Rescission of action on Ordinance 12-02. Motion made by Donna Johnson to open for discussion, seconded by Ken Taylor. Donna Johnson stated that she would like to change her vote after receiving additional information in reference to the 2014 mandatory consolidated elections. Town Clerk, Louis Valdez stated in order to rescind a decision/vote, it needs to be placed on the agenda; however, the referendum will not allow for the ordinance to be rescinded. Discussion and/or action: [Town Clerk-Administrator] K E & G bid for the effluent project in conjunction with Fort Huachuca. seconded by Gene McCullough. Larry Tysiac announced that K E & G submitted the lowest bid for contract with Sierra Vista for the Effluent Project. He explained that it is a joint project Page 5 of7

with the majority of the support being with Fort Huachuca. He will also work for Town of Huachuca City in the routine inspection of the work being performed by K E & G. Motion made by Mayor Robertson to accept the bid from K E & G for the project, seconded by Pat Woodruff 16. Discussion and/or action: (Town Clerk-Administrator] Mayor and Council Retreat. seconded by Laura Wallace. Motion made by Mayor Robertson to have the Town Clerk, Louis Valdez set up the retreat for October 2012 with the location in Tucson, Arizona, seconded by Gene McCullough. 17. Consideration and/or Discussion: [Town Clerk-Administrator] to purchase six portable radios for Huachuca City Police Department from Durham Communications in the amount of $13,897.33 as part of Operation Stone Garden Grant Number 888424-02.
