However, Attachment A indicates the respondents must list a minimum of two separate and verifiable clients. Please clarify how many references are required. Which volume should contain the Respondent s written plan addressing the state s objectives? If any of the state s objectives (Environmental Considerations, Certification of Drug Free Workplace Program, RESPECT, PRIDE) are not applicable due to the nature of the procured items from the Contractor, does a written plan addressing the non-applicable objective need to be provided? Submittal Requirements DEO indicates the additional costs or shared savings associated with value-added services or innovative ideas shall be included in Attachment B, Cost Response. Does DEO expect a more detailed description excluding cost to be included in the Contractor s technical response? If so, where? This section is not mentioned in the Instructions for Preparation of the Technical Proposal and the specific tabs. Should it be included in Tab 3.A under Approach since Section C.13, Transition Plan, is referenced therein? Please clarify. Section A, Part 9 states The product offered by the respondent will conform to the specifications without exception. Section B.45 states Failure to comply with the terms and conditions of this solicitation including those specifying information that must be submitted with a response, shall be ground for rejecting a response. Should the Respondent wish to clarify any terms and conditions which are not applicable to the Respondent due to the nature of the procurement or services, will the Respondent s proposal be rejected for drafting the assumption or clarification? The ITN states, The Respondent s technical response shall be packaged separately from its cost response or the response will be rejected. Can the Respondent package the Technical and Cost in separate envelopes within the same box for delivery? Please clarify. Tab 5 requests the Respondent to write a Company Profile using at least two references. Page 37, B.36 requests the Respondent to complete Attachment A, Reference Form. Will the State please clarify if its intent is for the Respondent to describe its experience for two references under Tab 5 and provide the contact information for the two projects described under Tab 5? Further, please validate that the two references cited in Tab 5 are also the ones to be cited in the Attachment A Form? The ITN states All rights, title, and interest, including copyright interests and any other intellectual property, in and to the work produced or provided by the Contract, alone or in combination with Department and/or its employees, under this Contract shall be the property of Department. Contractor agrees that any contribution by Contractor or its employees to the creation of such works, including all copyright interest therein, shall be considered works made for hire by Contractor for DEO and that such works shall, upon their creation, be owned exclusively by DEO. To the extent that any such works may not be considered works made for hire for DEO under applicable law, Contractor agrees to assign and, upon their creation, automatically assigns to DEO the Tab 5 should include all related experience in all states or governments. Attachment A and Attachment H require a minimum of two sites with completed contact information and reference questionnaire. We agree the COTS or SaaS intellectual properties remains with the Contractor, however any Florida modifications developed at DEO s expense belongs to the state. No conflict exists between the two referenced sections, thus no order of precedence is necessary.

Section D, part 9 of the Core Contract states Unless otherwise agreed in writing, intellectual property rights to preexisting property will remain with Contractor; whereas, intellectual property rights to all property created or otherwise developed by Contractor specifically for DEO will be owned by the State of Florida through DEO. 25. Page 68, Section C.24 Ownership and Intellectual Property Rights Will the State please confirm the language in Section C.24 is not applicable to the procurement of a COTS SaaS product under this ITN and the language stated in Section D, part 9 supersedes the ITN language under Section C.24? The ITN states Before production operations under the Workforce Solution delivery to DEO or to a DEO approved escrow agent, is required of a complete set of Contractor's software source programs, program object code, operations manuals, service manuals, written procedures, and any such other materials necessary for the State to operate the Workforce System. The software source, object programs, and documentation, can be delivered on mutually agreeable media. Installation packages for third party software products licensed by Contractor must be included. These materials would allow DEO to 1) continue operations in the event Contractor becomes unavailable to perform, and 2) confirm that only authorized software The system performs a critical function for the State of Florida, DEO, the Regional Workforce Boards and One-Stop Centers. The state requires the ability to maintain the system in its current working status for the period necessary for the state to procure an operational replacement system for these services upon the occurrence of any circumstance necessitating such, other than the state s termination for convenience of contractor s services or the state s decision not to renew the contract in accordance with its terms. Options can be negotiated during contract negotiations.

8 and procedures are employed with the Workforce System. In this regard, access by DEO to the escrow (if escrowed) shall be at DEO's discretion for auditing its contents, or for preparation to assume operations of the Workforce System. As system changes are implemented, both the change and change documentation shall be provided to the DEO (or escrow) to continue the State's protection. Changes to DEO's (escrow's) copy of these materials must be effected within one (1) week of installation in production operations. Throughout the ITN, the State indicates its intent to procure a COTS SaaS solution. A COTS SaaS system is based off an existing solution, previously developed by the Respondent at private expense. As such, ownership of the source code is not conveyed nor placed into escrow because ownership will not change hands. Will the State please confirm this section is not applicable to the procurement of a COTS SaaS product? 26. Page 36, Tab 5 Company Profile and Experience 27. Page 80, Attachment G Can the Respondent use past performance for one of its Subcontractors? Attachment G requests the Respondent to list the License # for each Subcontractor. Will the State please clarify what the License number is? Is the State requesting the Subcontractor to list their Duns and Bradstreet number? Yes, clearly identified. 9 28. Page 69, Section C.26 Performance Bond 29. Page 69, Section C.26 Performance Bond Will DEO please provide the State s definition of Commercial Product as referenced in Section C.26? In addition, will DEO please clarify the applicability of services in support of a Commercial Product in relation to Section C.26? The State is requesting a performance bond worth 20% of the Contract Value to be renewed on an annual basis. Will the Contract Value be reduced to the remaining term as each year is renewed or will the annual value represent 20% of the 5 year base period, year over year? The commercial product would be the value of the base product not including any hosting fees, any cost options selected by Florida and any custom development for the State of Florida. This will be negotiated at the time of contract. The performance bond would be calculated based on 20% of the contract value minus any base commercial product. This will be negotiated at the time of contract. It will be reduced to the remaining terms of the contract.

Attachment B Part Page 50, Section C.2 Objectives/Ge neral Systems Expectations The ITN requires the delivery of a Commercial off the Shelf (COTS) Software as a Service (SaaS) solution model (as stated on Pages 22, 30, 35, 49 and 61). Page 69 of the ITN states Contract value will not include pricing associated with the option years, or the value of any commercial products Based on the requirement for a Commercial-off-the-Shelf product and the Performance Bond exception noted on page 69, please confirm that a Performance Bond is not required for this procurement. The Rate Information sheet requests the Respondents to provide labor categories for the services described in Section C.15 and references a rates sheet from the dms.florida website. Is the rate sheet simply a reference point, or will the respondent be required to map its labor categories? If the Respondent is required to map labor categories, will the State please provide the qualifications for each labor category? The Workforce Solution shall provide the state with an integrated, adaptable and scalable web-enabled system to support the services required to be provided by the Wagner-Peyser Act and Veteran s Services programs, the Workforce Investment Act, Trade Adjustment Assistance, the Reemployment and Eligibility Assessment, and other federal, state and local programs. Do you want the capability of tracking participants associated with the Trade See Question 28. It is a reference point, if the vendor is not on state contract. DEO is not expecting respondents to create specific functionality to track TAACCCT participants.

Does this requirement include the need to collect data in Haitian (Creole)? Is there any requirement for administrative screens to display Haitian (Creole)? What level of NAICS does DEO want businesses classified under, (e.g., 2-digit, 3-digit, etc.)? Additionally, what method for determination is expected (self-reported, provided by DEO or other state system, other)? You mention TAA grant and TAA funding stream. It is our understanding that states receive funds for TAA training, but case management, etc. is typically done utilizing WIA Dislocated Worker funds. Can you clarify how DEO wants TAA participants tracked, (e.g., by TRA receipt, training, etc.)? See Question 1 Six (6) Digit level. Self Reported initially, though interface options may become available in the future. Tracking is wanted only to the extent of creating an association of each activity to the utilized funding stream.

Are they required to provide subject matter experts to describe the data to be transferred? Are there any other requirements for their participation? 48. General Please list all fields captured in the current solution s job seeker profiles, resumes, and job postings, specifying which elements are optional and required as enforced by the interface. Please list values for all enumerated entries. 49. Is it the intention that the exported data be imported into a SQL Server 2012 database without conversion or transformation? If this is the case, then can other compatible database software be used? The ITN states that the Respondent shall not include any footnotes, notations, and exceptions under Attachment B. Would the inclusion of a narrative in the Cost Volume, containing relevant content and details around what is or is not included in the pricing be considered footnotes, notations or exceptions or would this be acceptable content to be included within the Cost Volume? Per the current contract; Upon the effective date of termination of the Contract, Contractor shall transfer, assign and make available to the Department all property and materials belonging to the Department. Section B.17 presumes a go-live date of 1/1/2015. However, Attachment B, Part 1 assumes a project start date of 1/1/2015 with 60-month duration thereof. Please note that a start date and golive date of 1/1/2015 does not allow for an implementation period. Will the State please confirm the anticipated Start Date, the end date of 60 months thereof and the anticipated go-live date? The estimated contract start date is 4/15/2014 The estimated timeframe from 4/15/2014 thru 1/1/2015 is for transition and implementation No contract payments will be made until after implementation, 1/1/2015 For purposes of cost comparison, the Attachment B assumes a 60 month duration starting on 1/1/ General Question Can the State provide counts on the current users interacting with the existing case management solution broken out by count per functional group as well as a total number of distinct users? We are interested in the number of workforce staff that has a login to the system, which might include state administrators, local administrators, service providers, etc. and would not include job seeker or employer accounts. Does the state expect any significant increase to administrative (staff) user counts and/or additional administrative functional groups engaging the case management solution within the solution going forward? If so, please provide insight to future function and/or user counts additions. See question 14. Staff numbers may expand or contract due to workload or budgetary issues. Users are not currently separated into specific functional groups as individual system privileges are currently assigned on a per user basis. DEO is seeking respondents in this area to provide best in class functionalities relating to system security.

Attachment B, Cost Sheet, Part 2, Item 1 What "social media" functionality is currently in place, and what functionality is envisioned for seekers, employers, and staff? The Estimated Calendar of Events states the anticipated contract start date is 4/15/2014. Attachment B - Cost Instructions, #2, states "Assume a project start date of January 1, 2015." Please clarify the contract start date and/or clarify the terms contract start date and project start date being used in these two different areas. On page 18 of Section B, the anticipated contract start date is indicated as 4/5/2014. The Cost Sheet in Attachment B has pricing starting on 1/1/2015. Where do we enter costs for the period 4/5/2014 to 12/31/2014? Can you please confirm that Item 1 for "additional languages" should be used to address pricing for optional languages above and beyond the Spanish and Creole translations required by the ITN. In other words, please confirm that the pricing for Spanish and Creole translations should NOT be included in Item 1. DEO is seeking respondents in this area to provide best-in-class functionalities relating to social media integration. See question 52. See question 52. Correct.

Are you looking to interface with the existing Initial Skills Review system or are you looking to replace it? Can you provide more details on what you are looking for here regarding E-Verify? Specifically, are you looking for staff to verify individuals on behalf of employers or employers to be able to do this directly via the new system? How do we add additional items to the space provided in Attachment B, Part 4? Can you please confirm that you are looking for a manual translation of the system's web pages rather than a software-based, on-the-fly automated translation? In the current Employ Florida Marketplace, all the data the system references are translated into Spanish: O*NET occupational titles and definitions are translated, as are O*NET skills, detailed work activities, tasks, interests, and work values. NAICS industries and titles also are translated. Please confirm that you want maintain this level of translation for the new system's translations into Spanish and Creole. Section F.S. requires applicants on Reemployment Assistance to complete an initial skills review and report the results to DEO and Regional Workforce Boards. The cost option is seeking a separate cost to perform this function on the system Employers doing this via the new system. The spreadsheet is expandable. Yes Yes

Page 52, Section C.3.1, Functional Design The total monthly figures for the last calendar year are requested. Can you confirm that this is for jobs in the state of Florida? Are these transition and transfer plans designed to cover transfers and transition from the current contractor to the new contractor or from the respondent to DEO? This section says the contractor will provide "a conceptual system design and design documentation." Can you confirm that this is to be provided after contract execution? This is for the state of Florida. Both A conceptual design and design documentation should be provided in the response for evaluation and negotiation purposes.

19 66. Page 30, Section D, Project Plan also Page 57, Section C.6, Project Plan The instructions on page 30 for section D. Project Plan indicate that the respondent shall submit a Project Plan as part of its response and that the Respondent should carefully review Section C.6 in preparing the response. Respondent will provide comprehensive narrative statements that set out the proposed Workforce Solution and how it meets the requirements of this ITN. The instructions on page 57 for C.6 Project Plan indicate that the Project Plan shall include 16 subcomponent plans (identified on page 57 as bullets). However, it further indicates that the Contractor shall provide these subcomponent plans during the planning phase of the Contract as part of the overall Project Plan to be used as the baseline document. Besides the requirement for comprehensive narrative statements regarding these subcomponent plans in the proposal response, are there any specific subcomponent plans which must be provided in detail, in the ITN response, prior to them being provided during the planning phase of the contract? For example, is a full Project Schedule required as part of the response? The Respondent should propose the narrative and provide a high level plan(s) for evaluation and negotiation purposes. The final detailed plan will be submitted after negotiation and or contract award for DEO approval.

Please clarify how many times to provide these plans and when they should be provided. Page 27, Section B.32, Submittal Requirements The ITN is calling for a COTS solution yet this section indicates that the deliverable will be the property of the Department. Can you please confirm that the solution will remain the property of the contractor? Regarding the following statement: "Part 2 of the Cost Response includes all costs associated with the Workforce Information System. The Grand Total of Response at the bottom of the form is the total cost the Vendor is submitting in their response for all project costs through implementation of the proposed Workforce Information System." The supplied form does not include an area at the bottom of the form where a Grand Total of Response can be submitted. Can you please clarify these instructions or provide the correct form? Regarding the submission requirement that "a signed original cost response and fifteen (15) copies thereof shall be bound, enclosed and sealed individually," does sealed individually mean enclosed in separate envelopes or will separate binders suffice? See question 24. Cost Options will be considered separately. Please ignore the instruction for a Grand Total. Separate binders will suffice.

Does the requirement for online modules or lessons that include simulations mean that there is a requirement for training videos? While there are over 4400 staff which will need more in depth training, the training plan should also include strategies for providing ongoing online training/tutorials for over 500,000 jobseekers and employers annually. Staff training will need to be made available for system administrators, security officers, and as many roles of case managers as appropriate by functional separation of the proposed solution.
