2 Since 2003 there have been over 27,000 mobilisations from the Navy, Army and Air Force where Reservists have been mobilised to serve alongside their regular counterparts on operations, both overseas and in the United Kingdom. The support of employers has played a vital role in enabling these Reservists to contribute in the crucial way they have.
3 About SaBRE SaBRE (Supporting Britain s Reservists and Employers) is an organisation created by the Ministry of Defence (MOD) to advise UK employers on the employment of Reservists. To date we have helped over 40,000 of those employers better understand the advantages and implications Reservist employment brings. By demonstrating the skills and motivation Reservists bring to the workplace, we are securing a growing number of Reservists who are both supported and valued by their employers. SaBRE provides support and advice to employers through a network of Regional SaBRE Campaign Directors (RSCDs), a national helpline, as well as a comprehensive website which provides detailed guidance and information. Employers are encouraged to use these same communication channels to feed back to the MOD any views or suggestions they might have about the employment of Reservists. 4 Important points to consider if your employee has been called out for mobilisation: The Armed Forces use a process by which it seeks to understand individuals ability to be mobilised known as Intelligent Selection. In all cases of mobilisation, the Chain of Command will assess a Reservist s ability to be mobilised, which includes an assessment of their personal circumstances and willingness, their employment status, the views of their employer and family, and welfare considerations. In all cases, mobilisations are compulsory and impose legal obligations upon employers. If your Reservist employee is being considered for mobilisation, he/she is responsible for keeping you informed and representing your views to the military command chain in the first instance. It is important therefore to make sure your Reservist employees feel comfortable and able to discuss their Reserve Service aspirations with you. Statutory regulations only permit reimbursement for costs incurred during the mobilisation period. Therefore SaBRE strongly recommends that employers do not employ replacement staff until after their Reservist employee confirms they been formally accepted into military service.
5 Rights and legislation to protect both employer and employee: An employer can claim for financial assistance and does not have to continue to pay a Reservist employee whilst they re mobilised as they ll be on a military salary. This assistance covers additional salary costs incurred, including overtime to other employees or the additional salary costs of a temporary replacement if they exceed the usual cost of the Reservist employee s salary. The maximum amount an employer can claim for additional costs is currently set at 110 per day; roughly equivalent to 40,000 a year. The Safeguard of Employment Act 1985, places a legal obligation on employers to hold a Reservist s job and reinstate the Reservist on completion of mobilised service if it s reasonable and practical to do so. Callout notices will indicate the expected duration of any mobilisation. This legislation also protects a Reservist from dismissal solely because of their liability to be mobilised. An employer has the right to apply for exemption or deferral if their employee is called up for mobilisation. Details on how to apply are sent to employers with the call-out notices.
