1 Merchant Facility Application - Australia Important Notes 1. If this application is incomplete, or we have not received all of the required supporting documents, we cannot begin to process your application. If you have any questions about completing this application please call us; IBO Card Services Support: (option 3) 2. This application document is only valid for 90 days from the day you sign and date it. If your Merchant Facility is not approved and activated within this time you may be required to submit a new application, and you may be liable for any expenses incurred by Xplore Capital; 3. All IBOships applying must have at least one active address as all transaction reports and Merchant correspondence will be via ; and 4. This Merchant Facility accepts Bankcard, MasterCard, Visa and American Express cards only and is operated online in real-time via a telephone service (fixed or mobile) or the Internet. There is no Merchant Terminal or device supplied with this facility.

2 Information Required to Complete this Application ALL applicants are required to provide the following information: 1. Current registered IBO number; 2. Contact details for all individuals/company directors/trustees applying for this facility; 3. Drivers Licence details (non drivers to supply a photocopy of one of the following: current passport, telephone account or rates notice in their name); 4. Registered business trading name & ABN or registered company name, ACN & ABN (if applicable); 5. Active address; 6. Your Xplore Capital loan number/s (if you are a current mortgage loan client); and 7. Existing Merchant Facility details (another Provider) and photocopies of the previous 6 months statements (if applicable). Merchant Facility Application & Establishment Process The establishment of your Merchant Facility is a three (3) step process that will take approximately twentyone (21) days to complete provided the required information is provided in full and in a timely manner. Step 1: Application 1. 1.Complete the online application, print and forward the Application (this form) with required supporting documentation to: XPLORE CAPITAL 46 Carrington Road Castle Hill NSW The application is checked and processed. If necessary, you will be contacted via to request additional information; and 3. On approval, a Merchant Facility Offer is sent, which will include the Merchant Facility Agreement. Step 3: Registration 1. Complete and forward the Agreement (with supporting documentation) to the above address; 2. The agreement is checked and processed. If necessary, you will be contacted via to request additional information; 3. Your Merchant Account is created and the Annual Merchant Account Fee is direct debited from your nominated bank account; and 4. A Welcome is sent which includes your Merchant Account number, initial Security Code and instructions on how to activate your Merchant Account. Step 4: Activation 1. Your Merchant Account must be activated online within 14 days of receipt of the Welcome via the Xplore Capital website 2. Follow the instructions outlined in the Welcome ; and 3. Once activated, you are ready to commence processing credit card payments via the website or telephone service. Page 2 of 7

3 Privacy Acknowledgement and Consent I/We acknowledge that I/we have made an application for Credit Card Merchant Facilities from Xplore Capital. Xplore Capital may use the personal information I/we provide for the purpose of providing credit and subject to the provisions of the Privacy Act, I/we may have access to personal information collected and held by Xplore Capital, and the 3rd Party Service Providers noted in the Schedule. I/We may contact these companies for access to my/our personal information held (if any) by contacting the Privacy Officer at the address or in the manner disclosed in the Schedule. Authority to Exchange Information with other Credit Providers In accordance with Section 18N(1)(b) of the Privacy Act, I/we authorise Xplore Capital to give and obtain from credit providers that may be named in a credit report issued by a credit reporting agency, information about my/our credit arrangements. I/We understand this information can include any information about my/our credit worthiness, standing, history or capacity that credit providers are allowed to give or receive from each other under the Privacy Act The 3rd Party Service Providers will be collecting any such personal information about me/us for the purposes of: Assessing the risk of me/us being unable to meet a liability that might arise under a guarantee entered into, or proposed to be entered into, in respect of Credit Card Merchant Facility given (or to be given) by the 3rd Party Service Provider to another person; Risk assessment and management involving credit scoring, portfolio analysis, reporting and fraud prevention and claim recovery; and Complying with legislative and regulatory requirements. By signing the acknowledgment, I/we agree and consent to the 3rd Party Service Providers using and disclosing the personal information it collects about me/us for the purposes set out above (subject to any restrictions imposed on the 3rd Party Service Providers by Privacy Act 1988). The 3rd Party Service Providers will usually or may disclose personal information of the kind it collects about me/us to: its related companies; insurers; credit reporting agencies; its service providers; its agents, contractors, and external advisers; government and other regulatory bodies; ratings agencies; payment system operators; and other financial institutions, securitisers and credit providers.
