5 Attachment 3 Proposed Incorporated Document (DRAFT) Ballarat Planning Scheme Incorporated Document Ballarat Base Hospital New Facilities Project April INTRODUCTION This document is an Incorporated Document in the Schedules to Clause and Clause 81 of the Ballarat Planning Scheme. This document contains specific controls to facilitate use and development of new medical and health facilities and services at Ballarat Base Hospital. The new facilities include a helipad for patient transfer, multi-level car park and a new building on Drummond Street North that will provide additional hospital beds and new medical facilities to serve the Ballarat community and the Grampians Region. 2. ADDRESS OF THE LAND The Incorporated Document applies to the Ballarat Base Hospital at 1 Drummond Street North, Ballarat. The subject land is generally bounded by Mair Street, Drummond Street, Sturt Street and Anticline Lane Ballarat. The land comprises Crown Land- Reserved for Hospital Purposes Permanent or Temporary Reserve. The four parcels in the Township of Ballarat Parish of Ballarat and the Crown Description is CA36A, Sec.40, CA38 Sec. 40, CA1A Sec. 39 and ; CA1 Sec. 39. The subject land also includes freehold land owned by Ballarat Base Hospital in several different institutional names. These parcels are: v269f720, v 0401f 130; v 6744f616, v4936 f185, v 6567f236, v 8646f927, v4425f927, v4425f985, v10676f047, v9260f113, v8178f916, v 4296f617, v0547f264 and v8195f010. The legal description of all the land included in the Incorporated Document has been checked by a licensed land surveyor. 3. THIS DOCUMENT ALLOWS This Incorporated Document allows the use and development of land at Ballarat Base Hospital for the New Facilities Project April The New Facilities project includes, but is not limited to construction of a multi-level car park to the east of Anticline Lane and south of Mair Street; development and use of a deck structure above the multi- level car park as a helipad for patient transfer by helicopter; demolition of Yuille House, Sloss House and the Eildon Building and the construction of a new building on Drummond Street North as shown on the Ballarat Base Hospital Proposed Site Plan March 2013 prepared by Billard Leece Partnership Pty Ltd. Pursuant to Clause of the Ballarat Planning Scheme the land identified in this Incorporated Document may be developed and used in accordance with the controls specified below, despite any prohibition, restriction or any other requirement including a planning permit requirement that would otherwise apply under any provision of the Ballarat Planning Scheme. Where there is any inconsistency between the specific controls and the general provisions of the Ballarat Planning Scheme, the specific controls will prevail. 4. SPECIFIC CONTROLS 1. Before demolition commences, a demolition plan must be submitted for approval to the responsible authority

Before construction commences for a stage of development, a proposed site plan showing new buildings and works for the stage of development must be submitted for approval to the responsible authority. 3. Before construction of the multi- level car park commences, details of the architectural treatment of the west elevation must be submitted for information to the responsible authority. 4. Before construction of the helipad commences, details of the helipad structure must be submitted for information to the responsible authority. 5. Before construction of the helipad commences, the flight paths including height, distance, direction and boundaries must be submitted for information to the responsible authority. 5. CONSULTATION The Department of Health (Victoria) is required to consult with the responsible authority in relation to the detailed plans, sections and elevations for the proposed buildings and works at Ballarat Base Hospital authorised by this Incorporated Document. 6. EXPIRY This Incorporated Document will expire if one of the following circumstances applies: The development is not commenced within two years of the approval date The development is completed within four years of the commencement of the development. The responsible authority may extend the periods referred to if a request is made in writing before these controls expire or within three months afterwards. END OF DOCUMENT - 6 -
7 Attachment 4 Proposed DDO19 (DRAFT) SCHEDULE 19 TO THE DESIGN AND DEVELOPMENT OVERLAY Shown on the planning scheme map as DDO19 BALLARAT BASE HOSPITAL HELICOPTER FLIGHT PATHS PROTECTION AREA (INNER AREA) 1.0 Design objectives To ensure that the height of all buildings and works are constrained within specified limits to avoid creating a hazard to aircraft in the vicinity of the helipad at the Ballarat Base Hospital and to facilitate safe helicopter operations. To ensure that flight paths associated with the helipad at Ballarat Base Hospital are protected from the encroachment of inappropriate obstacles which may affect the safe and effective operation of the helipad. 2.0 Buildings and works - A planning permit is not required to construct a building or to carry out works provided the maximum height of the buildings or works does not exceed meters above the Australian Height Datum (AHD). This AHD is equivalent to 11.8m above ground level measured from the centre point of the helipad located at Ballarat Base Hospital. For the purpose of this clause buildings and works includes radio masts, television antenna and flagpoles and any construction equipment associated with the buildings and works. 3.0 Referral of applications - An application must be referred in accordance with Section 55 of the Act to the referral authority specified in Clause or a schedule to that clause. Planning permit applications will be assessed against the Department of Health (Vic) guidelines for helicopter landing sites which incorporate the relevant requirements of the International Civil Aviation Organisations Standards and Recommended Practices Annex 14 Volume 11 Helicopters (as amended). 4.0 Decision guidelines Before deciding on an application, the responsible authority must consider: The views of the Department of Health (Vic) Whether the height and design of any proposed buildings and works will have an impact on the flight paths associated with the helipad at the Ballarat Base Hospital
