Further to your application received on 22 March 2005, Havant Borough Council as Local Planning Authority Grants Planning Permission for the above proposal in accordance with the submitted plans and particulars as detailed below. This permission is subject to compliance with: (i) (ii) The plans and other documents submitted with your application, as amended by plans and documents received on 30 June 2005, 05 July 2005, 01 August 2005 and 10 August 2005 and as supplemented by additional information and /or plans received on 20 June 2005, 01 July 2005 and 05 July 2005, and; The following conditions: Conditions: 1 The development hereby permitted shall be begun before the expiration of 5 years from the date on which this planning permission was granted. Reason: To comply with Section 91 of the Town & Country Planning Act Construction of the building(s) hereby permitted shall not commence until samples and details of all external facing and roofing materials, including the dormer cheeks, shall be submitted to and approved in writing by the Local Planning Authority. Thereafter only such approved materials and finishes shall be used in carrying out the development. Reason: To ensure the appearance of the development is satisfactory and having due
2 regard to policies and proposals UB3 and E16 of the Hampshire County Structure Plan (Review) and 7 (Part 2 and Part 4) of the Havant Town Centre Action Area Local Plan No development hereby permitted shall be commenced until a detailed soft landscaping scheme for all open parts of the site not proposed to be hardsurfaced has been submitted to and approved in writing by the Local Planning Authority. Such scheme shall specify the proposed finished ground levels in relation to the existing levels, the distribution and species of ground cover to be planted, the positions, species and planting sizes of the trees and shrubs to be planted and timing provisions for completion of the implementation of all such landscaping works. The implementation of all such approved landscaping shall be completed in full accordance with such approved timing provisions. Any tree or shrub planted as part of such approved landscaping scheme which dies or is otherwise removed shall be replaced with another of the same species and size during the first available planting season. Reason: To ensure the appearance of the development is satisfactory and having due regard to policies and proposals UB3 of the Hampshire County Structure Plan (Review) and 7 (Parts 2 and 4) of the Havant Town Centre Action Area Local Plan No development hereby permitted shall commence until a specification of the materials to be used for the surfacing of all open parts of the site proposed to be hardsurfaced has been submitted to and approved in writing by the Local Planning Authority. The development hereby permitted shall not be brought into use until the implementation of all such hardsurfacing has been completed in full accordance with that specification. Reason: In the interests of the amenities of the locality and having due regard to policies and proposals UB5 and E16 of the Hampshire County Structure Plan (Review) and 7 (Part 2) of the Havant Town Centre Action Area Local Plan No development hereby permitted shall commence until plans and particulars specifying the alignment, type, height and, where appropriate, construction materials and design of all proposed screen walls, fences, hedges and other means of enclosure, including details of the lowering of the front (east) boundary wall south of the access to a height above road level of 800mm, have been submitted to and approved in writing by the Local Planning Authority. Unless agreed otherwise in writing by the Authority, the development hereby permitted shall not be brought into use prior to the completion of the installation of all screening provision as is thus approved by the Authority. At all times thereafter, all of that screening provision shall be retained in a wholly sound and effective condition. and proposals UB3 and E16 of the Hampshire County Structure Plan (Review) and 7 (Part 2) of the Havant Town Centre Action Area Local Plan No development shall commence before full details of all new windows, doors and rainwater goods have been submitted to and approved in writing by the Local Planning Authority. These details shall include external finishes and plans and sections of the windows and doors at a scale of not less than 1:20. The development shall not be completed other than in accordance with the approved details.

All preventative measures forming part of such approved specification shall be undertaken and fully adhered to at all times when such implementation is in progress. Any such damage which does nevertheless occur shall be remedied in full accordance with such specification. Reason: To safeguard the character and appearance of the conservation Area and having due regard to policies and proposals UB3 and E16 of the Hampshire County Structure Plan (Review) and 7 (Part 2) of the Havant Town Centre Action Area Local Plan No part of the development shall be brought into use before the bin storage shown on the approved plan is provided and thereafter shall be kept available for this purpose. and proposals UB3 of the Hampshire County Structure Plan (Review) and 7 (Part 2) of the Havant Town Centre Action Area Local Plan No part of the development shall be brought into use before the external lighting hereby approved is provided and thereafter this lighting shall be maintained in good working order at all times. Reason: In the interests of site security and crime reduction and having due regard to policies and proposals UB3 of the Hampshire County Structure Plan (Review) and 7 (Part 2) of the Havant Town Centre Action Area Local Plan No development hereby permitted nor any related site clearance shall commence until plans and particulars specifying the finished levels (above ordnance datum) of both the ground floors of the proposed buildings and the surrounding ground levels in relation to existing ground levels have been submitted to and approved by the Local Planning Authority. Reason: To secure a satisfactory form of development and having due regard to policies and proposals UB3 and E16 of the Hampshire County Structure Plan (Review) and 7 (Part 2 and Part 4) of the Havant Town Centre Action Area Local Plan No development shall commence before full details of the metal of the metal entrance gates have been submitted to and approved in writing by the Local Planning Authority. These details shall include plans / sections at a scale of not less than 1:20 and colour of external finish(es). The development shall not be brought into use before the gates are installed in accordance with the approved details and shall thereafter be retained. Reason: In the interests of site security and crime reduction and character and appearance of the Conservation Area, and having due regard to policies and proposals UB3 and E16 of the Hampshire County Structure Plan (Review) and 7 (Part 2 and Part 4) of the Havant Town Centre Action Area Local Plan The gates hereby permitted shall at all times be and remain automatic and remotely operated (opening and closing) and they shall open inwards and not open over the
4 highway (Brockhampton Lane). Reason: In the interests of highway safety and having due regard to policies and proposals T5 of the Hampshire County Structure Plan (Review). 13 The development shall not be brought into use until space for the loading, unloading and parking of vehicles and bicycles has been provided within the site, surfaced and marked out in accordance with the approved details. Such areas shall thereafter be retained and used solely for those purposes. Reason: In the interests of highway safety and having due regard to policies and proposals T5 of the Hampshire County Structure Plan (Review). 14 The four units within the existing public house building shall not be occupied before cycle parking has been provided in accordance with details and specifications to first be submitted to and approved in writing by the Local Planning Authority. Reason: In the interests of highway safety and having due regard to policies and proposals T5 of the Hampshire County Structure Plan (Review). 15 No development shall take place (this would be the area of the archaeological interest) until the applicant, or their agents or successors in title, has secured the implementation of a programme of archaeological work in accordance with a written scheme of investigation which has been submitted by the applicant and approved in writing by the Local Planning Authority. Reason: The site is of archaeological significance and it is important that the opportunity should be afforded to excavate the site before development commences and having due regard to policies and proposals E14 of the Hampshire County Structure Plan (Review) and 7 (Part 7) of the Havant Town Centre Action Area Local Plan No development hereby permitted nor any related site clearance shall commence until a plan and particulars specifying the provision to be made within the site and/or on other land nearby for the parking (throughout the clearance and construction period) of construction vehicles and of other vehicles delivering/removing materials and other items to/from the development site have been submitted to and approved in writing by the Local Planning Authority. Thereafter, throughout such site clearance and implementation of the development hereby permitted, all such temporary parking provision shall be provided and used only as such. and proposals T5 of the Hampshire County Structure Plan (Review). 17 No development hereby permitted nor any related site clearance shall commence until plans and particulars specifying the provision to be made for a material storage compound within the site have been submitted to and approved in writing by the Local Planning Authority. The approved compound shall be available prior to the commencement of any building works and throughout the contract period and no materials shall be stored anywhere else on the site. and proposals T5 of the Hampshire County Structure Plan (Review). 18 No development shall take place until the developer has carried out adequate investigation to assess the degree of contamination of the site and to determine its water pollution potential. The methods and extent of the investigation shall be agreed
5 with the Local Planning Authority before any work commences. Details of appropriate measures to prevent pollution of groundwater and surface water, including provisions for monitoring, shall then be submitted to and approved in writing by the Local Planning Authority. Reason: To prevent pollution of the water environment as the site may be contaminated from its previous use, and having due regard to policies and proposals E1 of the Hampshire County Structure Plan (Review). 19 No soakaway shall be constructed in contaminated ground. Reason: To prevent pollution of groundwater and having due regard to policies and proposals E1 of the Hampshire County Structure Plan (Review). 20 The method of piling foundations for the development shall be carried out in accordance with the scheme to be approved in writing by the Local Planning Authority prior to any development commencing. Reason: The site is very sensitive with respect to controlled waters and all appropriate measures must be taken to ensure pollution of controlled waters does not occur, and having due regard to policies and proposals E1 of the Hampshire County Structure Plan (Review). 21 The method of demolition and construction for the development shall be carried out in accordance with a scheme to be approved in writing with the Local Planning Authority prior to any development commencing. Reason: The site is in a very sensitive location with respect to groundwater, and in order to protect the quality of drinking water supplies the working methods will need to be carefully considered, and having due regard to policies and proposals E1 of the Hampshire County Structure Plan (Review). 6 6 (Part 3) Housing 7 (Part 2) Conservation And Townscape- New Development 7 (Part 3) Conservation And Townscape- Listed Buildings 7 (Part 4) Conservation And Townscape - Other Existing Buildings 7 (Part 7) Conservation And Townscape- Archaeology The Council considers, having regard to the objectives of these policies and proposals, that the principle of the development is acceptable in this case, and also that the impact of the development is acceptable in terms of the effect on the Conservation Area; the effect upon the Listed Building; the loss of the public house use; access and parking, fluvial flood risk; the effect on neighbouring properties; and crime reduction. Having taken into account the requirements of Section 54a of the Town and Country Planning Act 1990 and all other material considerations, the Council has determined that planning permission should be granted for the development. (1) (2) (3) (4) This notice only relates to the decision of Havant Borough Council as Local Planning Authority under the Town and Country Planning Acts. It does not relate to any other application that may be required under the Building Regulations or under any other Act, Regulation, Byelaw or Order where the Council's approval may be needed. For further guidance as to the need for consent under the Building Regulations please phone Your attention is drawn to the attached information regarding firstly your right to appeal to the Department for Transport Local Government and the Regions, if you are aggrieved by the Council's decision, and secondly the rights of an owner to, in certain circumstances serve a purchase notice on the Council. (5) Under the terms of the Water Resources Act 1991 the prior written agreement is required for discharging dewatering from any excavation or development to any controlled waters.
