RIGENA IMICUNGIRE Y IBIZA EXPOSE DES MOTIFS CONTEXTE EXPLANATORY NOTE BACKGROUND ISOBANURAMPAMVU INKOMOKO La gestion des risques de catastrophes englobe un continuum complet incluant la préparation, la mitigation, la prévention, la réponse, le redressement et la réhabilitation. Cette Loi vise à maintenir et accroître la résilience des communautés vulnérables face aux risques grâce à la diversification de leurs moyens de subsistance et de leurs mécanismes d'adaptation. Ceci implique ainsi un changement des plans à court terme vers des mécanismes de planification durable. Cette Loi vise à renforcer la gestion des catastrophes au Rwanda, afin de préserver la vie et de minimiser les souffrances, les pertes et les dommages en lançant en temps opportun une alerte précoce et diffusant les informations pertinentes à la population sur les dangers potentiels. The Disaster Risk Management encompasses a full continuum of aspects including preparedness, mitigation, prevention, relief, recovery and rehabilitation. This Law aims to increase and sustain the resilience of vulnerable communities to hazards through the diversification of their livelihoods and coping mechanisms. This entails a shift from short term plans to sustainable planning mechanisms. 2 La gestion des catastrophes vise finalement à reduire les souffrances en fournissant des réponses rapides et appropriées aux populations sinistrées. Les questions juridiques sont souvent peu visibles en situation d'urgence ; mais, des Lois efficaces en cas de catastrophe assurent la sécurité des foyers, l'efficacité des services d'urgence et le succès des efforts de reconstruction. La Politique Nationale de gestion des catastrophes a été adoptée afin de donner un fondement légal à certaines des fonctions et des organismes essentiels en définissant leurs rôles, fonctions et responsabilités dans les trois phases de la gestion des catastrophes. Il est à noter que plusieurs éléments de la Loi sont décrits dans la Politique Nationale pour la gestion des catastrophes (révision de 2012) ; la Loi donne une base juridique aux provisions de la politique nationale. La Loi sur la gestion des catastrophes doit être adoptée pour devenir le cadre juridique de la politique nationale de gestion des catastrophes et doit comporter: Disaster Management ultimately aims to alleviate suffering by providing timely and appropriate responses for disaster affected populations. Legal issues are often invisible in emergencies, but effective disaster laws underpin the safety of our homes, the efficiency of emergency responders and the success of recovery efforts. The Rwanda National Disaster Management Policy was adopted in order to give statutory backing to some of the essential functions and agencies by defining their roles, duties and responsibilities in all the three stages. It is noted that several elements of the law are described in the Disaster Management Policy (2012 revision); the law provide a legal basis to the policy articles. The Disaster Management Law needs to be enacted as a legal framework for the national Disaster Management policy with provision for: Imicungire y ibiza igamije byimazeyo kugabanya ubukana bw ingaruka ziterwa n ibiza hakorwa ubutabazi bwihuse ku bahuye n ibiza. La facilitation de l'assistance internationale en cas de catastrophes i.measure undertaken by Government for disaster Management ii. Role and responsibilities of Disaster Management bodies iii.facilitation of international assistance for disaster relief and recovery i. Ingamba zafashwe na Leta mu bijyanye n Imicungire y ibiza; ii. Inshingano z inzego zitandukanye zifite aho zihuriye n Imicungire y ibiza, iii. Ingingo zorohereza abafatanyabikorwa mpuzamahanga gutabara mu gihe habaye ibiza. La Loi présentée est l'élément central du cadre institutionnel pour la gestion des risques de catastrophes. En particulier, cette Loi: i. Donne une existence légale aux différents comités de gestion des catastrophes au Rwanda et décrit leurs rôles et responsabilités ; ii. établit et décrit les mécanismes de coordination avec les partenaires en cas de catastrophe (rôle et responsabilités) en créant un cadre juridique pour une coordination efficace des partenaires. Un ensemble d'articles renforce la capacité juridique du Gouvernement à traiter avec les partenaires internationaux ; The presented law is the central element of the Disaster Risk Management Framework. In particular, this law: i. Gives a legal existence to the different Disaster Management committees in Rwanda allocating tasks and responsibilities ii.establishes and describes coordination with partners for disaster assistance (role and responsibilities) giving legal power for efficient coordination of partners. 4 iii. crée le Cadre institutionnel pour la gestion des catastrophes; iv. établit les principes et les normes pour la gestion des catastrophes v. établit les mécanismes, pour les entités Gouvernementales, pour conseiller le Président de la République sur la déclaration de l'état d'urgence ; mais aussi établit les mécanismes pour l'assistance et la déclaration d'urgence locale en cas de catastrophe; vi. crée un cadre juridique pour la facilitation de l'assistance internationale en cas d'urgence ; vii. établit les mécanismes pour l'offre et de l'acceptation de l'aide internationale; viii. fixe un calendrier pour la gestion des urgences (réponse et de récupération). Avec cette Loi relative à la gestion des catastrophes, le Rwanda sera mieux préparé pour gérer une catastrophe, pendant, avant et après. Cette Loi est le pilier de la gestion des risques de catastrophes au Rwanda ; elle crée un cadre juridique pour toutes les activités liées à la gestion des catastrophes. Iii.Establishes the Disaster Management Framework; Iv.Establishes principles and standards for Disaster Management; V.Establishes mechanisms for the Government entities to advise the President of the Republic on the declaration of the state of emergency but also mechanisms for the declaration of local emergency and disaster assistance; Vi.Creates a legal window for the facilitation of international assistance in case of emergency; vii. Establishes mechanisms for the offer and acceptance of international assistance; Viii. Establishes a timeframe for emergency management (response and recovery periods). With this law relating to Disaster Management, Rwanda will be better prepared in case of disaster but also before and after a disaster. This law is the foundation of Disaster Risk Management in Rwanda providing a legal framework for all Disaster Management related activities. 4 iii. Rishyiraho uburyo bw imicungire y ibiza; iv. 5 Importance d une Loi unique sur la gestion des catastrophes Sur la base de l'expérience internationale, il est recommandé de regrouper toutes les règles et les réglementations internationales facilitant les opérations de réponse aux catastrophes à venir dans un seul projet de Loi. Une large part de ce projet de Loi est consacrée à l'aide internationale pour s assurer que le Gouvernement du Rwanda reste le Coordinateur principal pendant une situation de crise de grande ampleur ; et pour que les acteurs internationaux respectent les règles et des normes de qualité comme prescrit par cette Loi. I. NOTE EXPLICATIVE CHAPITRE PAR CHAPITRE Chapitre 1: provisions générales Ce chapitre fournit un ensemble de définitions devant être utilisées par tous les organismes Gouvernementaux et non Gouvernementaux travaillant dans la gestion des catastrophes au Rwanda, tel querecommandé par le Cadre d'action de Hyogo (HFA 1 ). The importance of a single Law on disaster management Based on international experience, it is advisable to consolidate all rules facilitating and regulating international disaster response operations coming into the domestic sphere, reason why the draft has given a wide space to the international assistance. Because it makes it easier for the Government of Rwanda to stay in the driver s seat during the chaotic situation of a large disaster and easier for foreign Disaster Management Actors to follow the rules and live up to the quality standards this law prescribes. I. EXPLANATORY NOTE PER CHAPTER Chapter One: General Provisions This chapter provides a set of definitions to be used by every Government and non- Governmental entities working in Disaster Management in Rwanda, as recommended by the Hyogo Framework for Action (HFA). 6 Ce chapitre préconise que tous les acteurs impliqués utilisent un vocabulaire commun afin d éviter toute confusion ou incompréhension et afin d augmenter l'efficacité en matière de la gestion des catastrophes au Rwanda. Il est à noter qu'un grand nombre de définitions sont extraites du cadre d'action de Hyogo. Quelques définitions spécifiques ont été fournies par les ministères concernés (santé, les douanes, etc.). It ensures that all involved actors use a common vocabulary to avoid confusion or miscomprehension and increases efficiency when addressing Disaster Management in Rwanda. It is noted that a large number of definitions are extracted from that Hyogo Framework for Action Specific definitions were provided by line-ministries (i.e. health, customs, etc ). Chapitre II: Les comités de gestion des catastrophes Chapter II: Disaster Management Committees Umutwe wa kabiri: Komite zo Gucunga Ibiza Ce chapitre établit la structure de gestion des catastrophes au Rwanda (CNEGC), le Comité de gestion des catastrophes au niveau du (DDMC), le Comité de gestion des catastrophes au niveau du Secteur de la (SDMC) et décrit les rôles, les responsabilités et les pouvoirs de chacun des comités dans chacune des phases de la gestion des catastrophes (préparation, réduction des risques de catastrophes, réponse et reconstruction). Ce chapitre créé également la plate-forme nationale pour la This chapter establishes the Disaster Management structure of Rwanda (NDMEC), District Disaster Management Committee-(DDMC), Sector Disaster Management Committee (SDMC) and describes roles, responsibilities and powers of each committee for each phase of Disaster Management (preparedness, Disaster Risk Reduction (DRR), Response, Recovery). Ce chapitre créé une base juridique pour une gestion efficace des catastrophes au Rwanda. Des rôles et responsabilités clairs permettent une gestion rapide et efficace des situations d'urgence. Chapitre III: Principes et normes pour la gestion des catastrophes Ce chapitre rappelle les normes et les principes directeurs de l aide d'urgence et établit les normes minimales pour les opérations de secours au Rwanda. Il oblige tous les acteurs (y compris les partenaires internationaux) à atteindre un certain niveau de qualité lors de la provision de secours d'urgence. Ce chapitre est la traduction en termes juridiques des normes internationales (reconnues et utilisées) pour les réponses d'urgence. Il protège le Rwanda contre des réponses de mauvaise qualité ou les malversations pour les services au peuple du Rwanda touchées par des catastrophes. It creates a legal basis for an efficient and well-designed Disaster Management structure in Rwanda. Clear roles and responsibilities allow rapid and efficient management of emergencies. Chapter III: Principles and standards for disaster management This chapter recall the standards and principles guiding emergency assistance in Rwanda and also establishes minimum standards for relief operations. It binds all actors (including partners) to reach a certain level of quality when providing emergency relief. This chapter is the translation in legal terms of the International Standards for Emergency Relief (internationally recognized and used). 8 Chapitre IV: Etat d'urgence, d'urgence local et de l'aide en cas de catastrophe En conformité avec la Constitution du Rwanda et son article régissant la déclaration de l'état d'urgence, le présent chapitre établit un mécanisme national pour permettre aucomité National Exécutif de Gestion des Catastrophes de conseiller rapidement le président de la république pour la déclaration de l'état d'urgence en cas de catastrophe. Il détaille également les principales étapes à suivre après la déclaration de l'état d'urgence par le Président de la République du Rwanda. Il définit enfin le niveau de catastrophe. La définition du niveau de catastrophe est un outil essentiel permettant au Gouvernement du Rwanda de continuer à développer des mécanismes de réponse basé sur des niveauxreconnus(niveau de catastrophes). La déclaration de l'état d'urgence et l'appel à l'aide internationale sont essentiels en cas de catastrophe. Ces deux mécanismes sont de part la constitution sous la responsabilité du Président de la République du Rwanda. Chapter IV:State of emergency, local emergency and disasterassistance In line with the Constitution of Rwanda and its article governing the declaration of state of emergency, this chapter establishes a mechanism for the National Disaster Management Executive Committee (NDMEC), based on evidences to advise rapidly the declaration of state of emergency in case of disaster. It also details the main steps to be taken after the declaration of state of emergency by the President of the Republic of Rwanda. It finally defines level of disasters. The categorisation of level of disasters is an essential tool allowing the Government of Rwanda to further develop response mechanisms based on recognised triggers (level of disasters). The declaration of state of emergency and the call for international assistance are critical in case ofdisaster. This two mechanisms fall by constitution under the responsibility of the President of the Republic of Rwanda. 9 Ce chapitre explique comment le CNEGC peut conseiller le président sur les mesures qui doivent être prises. Ce chapitre est un élément essentiel et central de cette Loi. Chapitre V: Admissibilité aux facilités juridiques Sans limitation ou réduction des droits existants, privilèges ou les immunités des acteurs internationaux, le présent chapitre établit un mécanisme pour les acteurs internationaux qui fournissent une aide au Rwanda puisse accéder à certains privilèges. Ce chapitre vise à faciliter l'assistance internationale en, à l'avance, fournissant des facilités juridiques à certains acteurs. C'est un mécanisme de contrôle pour le Gouvernement du Rwanda permettant à certains acteurs de fournir de l aide. Ce chapitre augmente le contrôle sur les acteurs prêtant assistance. Ce chapitre définit qui peut être admis comme un acteur prêtant assistance pour éviter la répétition et la dispersion qui caractérisait le comportement sur le terrain de certaines ONG après le génocide. This chapter details how the NDMEC can advise the President and what steps shall be taken afterwards. This chapter is a critical and central element of this law. Chapter V: Eligibility for Legal Facilities Without limitation or reduction of the existing rights, privileges or immunities of international actors, this chapter establishes a mechanism for international actors providing assistance in Rwanda to access some privileges. This chapter aims at facilitating international assistance by, in advance, providing legal facilities to certain actors. It is ultimately a control mechanism for the Government of Rwanda to allow certain actors to assist. It will increase the control on assisting actors. 10 Chapitre VI: Facilités juridiques pour les acteurs admissibles Ce chapitre décrit, ce que les acteurs éligibles (tels que définis dans le chapitre cidessus) peuvent accéder concrètement en cas d'urgence (visa, la reconnaissance des qualifications professionnelles, la reconnaissance des permis de conduire, la facilitation des procédures douanières, l'entrée de certaines marchandises, transport de marchandises, etc.). En cas de sinistre, le Gouvernement du Rwanda devra faciliter l'aide internationale pour assurer une réponse rapide et efficace. Chapitre IX: Mesures spéciales en cas d'urgence Ce chapitre décrit les mesures spécifiques en cas d'urgence: exemption limitée de la confidentialité des données personnelles, pouvoir de réquisition pour des opérations de sauvetage, paiement de l'indemnité de réquisition, gestion des médias pour la communication de l alerte, etc. Ces mesures spécifiques sont décrites par la Loi afin de faciliter et de mieux guider le Gouvernement du Rwanda pour faire face aux catastrophes.
