1 FACULTY BIOGRAPHIES FOR ARMA/EDI EVENTS Seattle Faculty: Patrick Oot (lead faculty, moderator, and presenter for Session 5) Partner Shook, Hardy & Bacon Patrick is a partner in the firm s General Litigation and Business Services Division where he leads the practice on e- compliance and digital investigations. He is one of the few e-discovery and compliance attorneys in the nation that possesses the tripartite experience of an in-house corporate counsel from a Fortune 16 organization; a senior attorney at a federal regulatory agency; and a partner in a large law firm. Patrick has extensive experience advising on discovery and investigative matters involving commercial litigation, compliance, regulatory requests, antitrust matters, and personnel issues. Combined with a deep understanding of forensics and enterprise technology platforms, Patrick s experience advising clients on responding to federal agency requests under the Electronic Communications Privacy Act (ECPA) is balanced by his broad-based skill in negotiating enterprise software license agreements for collaboration platforms, e-discovery software and enterprise level computer forensic tools. Before joining Shook Hardy & Bacon, Patrick served as senior special counsel for electronic discovery in the Office of the General Counsel at the U.S. Securities and Exchange Commission (SEC). Outside of work, Patrick volunteers his time as a co-founder at The Electronic Discovery Institute, a non-profit organization that conducts studies of litigation processes for the benefit of the federal and state judiciary. Patrick lectures regularly at educational events and legal conferences internationally. Martin Tuip (Session 2) Executive Director of Information Governance Solutions ARMA International Mr. Tuip has almost 20 years of IT experience in messaging and is a widely known and well-regarded technical expert and speaker on archiving and information governance. In his career he has helped organizations around the globe plan and deploy large-scale messaging and archiving environments. He is also a published author and ten-time Microsoft MVP for Exchange Server. Mr. Tuip studied and graduated in Electronics with a focus on Environmental Technology in his native Netherlands. Kathy Brown (Session 1) Russell Investments Kathy Brown is the Records Manager for Russell Investments. She provides records management expertise to Russell s global enterprise to ensure adherence to legal and regulatory compliance and best practices. Kathy consults to improve the effectiveness and efficiency of records systems by creating, advising and training on record policies and procedures. She develops and delivers training programs to assure that all company personnel with records management responsibility are provided with the appropriate information and guidance to aid in their compliance to record keeping regulations. She contributes to the strategic direction of the Corporate Records program.

2 Jason Ray (Session 3 and Case study) Managing Director FTI Technology Jason Ray is a managing director in the FTI Technology practice. Mr. Ray has over 25 years of experience in litigation support, technology services, and software development. He has deep expertise in all phases of the electronically stored information (ESI) lifecycle combined with a broad range of experience in software development, technology strategy, strategic planning and customer relationship management. In particular, Mr. Ray has focused his efforts at helping hypergrowth legal service companies implement scaleable, high quality operations that deliver superb client service. At FTI, Mr. Ray leads the ESI lifecycle and technology consulting practice on the West Coast. Those services include electronic evidence acquisition and analysis, consulting on document culling strategies, electronic evidence processing, document review systems and services, and litigation repository and evidence production. He has personally managed several multi-state and multi-national matters for companies in the pharmacology, high technology and entertainment industries. David Wallack (Case study and Session 3) General Counsel NightOwl David Wallack serves as General Counsel and Director of Managed Review at NightOwl Discovery, where he provides the company expertise in matters related to providing global ediscovery services, including managed attorney review services, meet and confer negotiation strategies on behalf of clients, EU data privacy and Safe Harbor Principles, defensibility reports on predictive coding and analytics, and strategies on defensible data remediation. His educational background is in corporate and securities law with an emphasis on structured finance. Before joining NightOwl, David worked as Associate General Counsel to a private institutional fund. He received his JD and MBA with honors from the University of Denver and frequently lectures at the University of Minnesota Law School. David lives in Minneapolis with his wife, Madeline, and three children. Jennifer Etkin (Session 4) Corporate Counsel Expedia Jennifer Etkin currently holds the position of Corporate Counsel in the advertising, marketing, and privacy law group for Expedia, Inc. in Bellevue, Washington. She focuses her practice primarily in global marketing/promotion, advertising, privacy, and other on-line marketing matters including, affiliate network marketing, loyalty marketing, sweepstakes, contests, gift cards, cause marketing, claim substantiation, social media and user-generated content. Prior to joining Expedia, Inc. in 2012, Ms. Etkin was Senior Corporate Counsel at T-Mobile, USA where she centered her practice on privacy, data breach, telemarketing/ marketing/promotion, and advertising. Additionally, Ms. Etkin practiced in the banking field for ten years, at Washington Mutual Bank, and Bank of America s Private Bank (now U.S. Trust, Bank of America Private Wealth Management). While at Bank of America, Ms. Etkin assisted in implementing, the then newly enacted, Gramm-Leach-Bliley Act (GLBA). Ms. Etkin began her career in law as a family law litigator for a small firm in Seattle, Washington. Ms. Etkin received a B.S. in Political Science, and Journalism in 1992 from Northern Arizona University. She received her J.D., in 1995 from Gonzaga University School of Law, and is licensed to practice in the State of Washington. Andrew SanAgustin (Session 2) Program Manager Microsoft Andrew J. SanAgustin has been an Information Governance professional for over 20 years. He began his career in Washington, DC, where he attended the University of Maryland. His experience spans various industries with expertise in back-end system development and front-end user interaction, global policy and compliance, solution delivery, process/operations, standardization, change management, and electronic data management. Currently he is a Program

3 Manager at Microsoft LCA (Legal and Corporate Affairs, Office of the General Counsel) where he is working to implement global RIM strategies in line with professional business partners, and all up retention management through O365 and SharePoint tools. Daniel Lim (Moderator, Sessions 1, 3 and 4) LIM Legal, PLLC Daniel is a recognized advisor and commentator on legal issues relating to e-discovery, cybersecurity, privacy, and records management. He has assisted numerous Fortune 100 multinational corporations and some of the largest public sector entities (IRS, Treasury, SEC, EPA) on their technology initiatives. He is a frequent speaker and commentator, with insight into complex commercial litigation and government investigation challenges. He is a Senior Advisor for the Electronic Discovery Institute, and has participated in several industry thought-leadership forums, such as the Sedona Conference Working Groups 1 and 6, the Georgetown E-Discovery Institute, and Legal Tech. Daniel currently serves as a Council Member for the Computer & Technology Section of the Texas State Bar. Daniel is a former chair of the Litigation Section of the Association of Corporate Counsel. Daniel is a graduate of Columbia Law School and former law clerk to the Honorable Vanessa Gilmore, U.S. District Court, Southern District of Texas. He holds both a Bachelors of Arts in English and a Bachelors of Science in Economics with Finance Applications from Southern Methodist University, where he graduated magna cum laude, with Honors and Departmental Distinctions in both of his degrees. Greg Buckles (Sessions 1 and 4) Co-founder and Principal Consultant edj Group Greg Buckles is the co-founder and principal consultant of the edj Group, covering the the Information Governance and ediscovery markets. He research and consulting focus on the intersection of enterprise technology and discovery. He has over 24 years in discovery and consulting. Greg s career roles span law enforcement, legal service provider, corporate legal, law firm and legal software design. This deep and diverse background combines with constant exposure to the discovery challenges of Fortune 500 clients to provide a unique industry perspective. He also provides market and product research services to top tier software and venture capital companies. He blogs and manages the edjgroupinc.com online research engine, a discovery knowledge portal focusing on independent perspective and expert opinion.

5 Mr. Buckles has been on the cutting edge of electronic discovery and compliance. He started in the legal field as a forensic criminalist for the Houston Police Department and was recognized as an expert witness in federal court in He has participated in the Sedona Conference, EDRM Committees, the Ledes Oversight Committee and other industry organizations. He has been a guest speaker and panelist at numerous discovery conferences, webinars, forums and other public venues including LegalTech, ILTA, and the Symantec Visions. He has published research papers on many different aspects of electronic discovery, enterprise search and corporate defensibility. Jeffery C. Sharer (Session 3, Moderator Session 2) Partner Sidley Austin, LLP JEFFREY C. SHARER is a partner in the Chicago office of Sidley Austin LLP, where he concentrates in matters at the intersection of law, technology, and digital information, including information governance, privacy and data protection, and preservation and discovery of electronically stored information, as well as in securities and professional liability litigation and enforcement work on behalf of accounting firms and their members and internal and governmental investigations on behalf of clients generally. He has advised and advocated on behalf of clients at all stages of the Electronic Discovery Reference Model, with particular emphasis on the development and implementation of best practices and on the use of machine learning, statistical sampling, and related tools and techniques to reduce costs and burdens and increase quality of results and defensibility of process throughout the discovery phase of litigation and at all stages of internal and governmental investigations. Jeffrey counsels clients on matters such as the legal and regulatory aspects of electronic communications, social media, cloud computing, bring your own device or BYOD policies, litigation preparedness, and defensible disposition of data stores that have outlived retention schedules, are not subject to legal hold, and have no ongoing business value. Jeffrey is a member of Sidley s Electronic Discovery Resource Group; the Sedona Conference Working Group on Electronic Discovery; the Electronic Discovery Institute s Leadership Committee; ARMA International; and the Seventh Circuit Electronic Discovery Pilot Program, and is a frequent writer and speaker on these topics. Donna Rose (Sessions 1 and 4) Manager, Records & Information Breitburn Energy Donna Rose, Manager, Records and Information Management, is responsible for Enterprise Records Management (ERM) and Enterprise Content Management (ECM) strategies and programs for BreitBurn Energy Partners. Her areas of expertise include RIM strategies, records retention, technical records program development, records storage operations, information capture, document control, business process analysis and business process management (BPM). Donna has a BA from SE Oklahoma State. She has presented various RIM topics at ARMA Houston conference and Chapter meetings; ARMA Internationals conferences and web-seminars and served on ARMA s standing committees. Donna has also presented topics at various conferences such as Department of Energy RIM Topics, IBM s Information on Demand, several Geotechnical and Digital Plant conferences. Donna is a Past President of ARMA Houston, served as a Trustee for ARMA International Educational Foundation, past board member for the National Association of Legal Support Professionals (ALSP) and is currently serving as a board member for the AIIM Southwest Chapter.
