6 FACULTY FACULT Y Pamela M. Andrews is a founding and senior partner at Andrews Skinner PS in Seattle. With over 30 years of trial experience in state, federal, and appellate courts, Ms. Andrews concentrates her practice on defending professionals, with an emphasis in long-term care. She has been honored nationally as one of AIG s top 10 litigation counsel, and is a founding and continuous member of the Bar Register of Preeminent Women Lawyers. Joyce Benton, RN, MSA, ARM, DFASHRM, CPHRM, LHRM, is risk control director for CNA HealthPro in McDonough, Georgia. She is a licensed risk manager and a registered nurse. She is a member of the American Society for Healthcare Risk Management (ASHRM) and a faculty member of its certificate and certification programs. Ms. Benton is an award winning ASHRM speaker and frequent speaker on health care risk management, and has authored several articles. Caroline J. Berdzik is an AV-rated partner with Goldberg Segalla LLP in Princeton, New Jersey, chair of the firm s health care practice group, and co-chair of its labor and employment practice group. She specializes in employment defense, professional liability, risk management, and outsourced general counsel services for long-term care providers and ancillary senior care businesses. Ms. Berdzik is a frequent speaker and author on timely employment, social media, and risk management issues facing long-term care facilities. Timothy J. Cesar, vice president of legal at Brookdale Senior Living Inc. in Milwaukee, manages all litigation and claims for the company and assists in the creation of additional risk management programs. Prior to joining Brookdale, Mr. Cesar practiced as a plaintiffs attorney, and subsequently as defense counsel at one of Wisconsin s oldest law firms. He is an adjunct professor at Marquette University School of Management, and has spoken at several national health care seminars. Gretchen Dougherty, RN, is the current president of Health Systems Inc. in Atlanta, and consults as corporate risk manager and corporate compliance officer for Guardian Foundation Inc., a nonprofit, long-term care group. Ms. Dougherty possesses 45 years of diverse nursing, risk, and management experience, including medical, surgical, intensive care, psychiatric, pediatrics, long-term care, and administrative management. She also has served as a nurse consultant for a large medical malpractice insurance company. Joel I. Fishbein, a partner in Litchfield Cavo LLP s Philadelphia office, is an AV-rated attorney whose practice focuses on defending long-term care facilities. He also handles a variety of employment, professional liability, and commercial litigation. In addition to his membership in DRI and his assistance in helping plan this seminar, Mr. Fishbein is a member of the Philadelphia Bar Association and is active on its Professional Guidance Committee. Drew Graham joined Hall Booth Smith PC in 1992, and is currently a shareholder in the Atlanta office. He leads the aging services practice group, focusing on the defense of hospitals, nursing homes, and assisted living communities in liability, regulatory, and compliance matters. Recent engagements include representing a nursing home operator in a False Claims Act case, defending a high exposure assisted living wrongful death case, and coordinating a complex internal investigation at a facility. Alex J. Hagan, a partner with Ellis & Winters LLP in Raleigh, North Carolina, focuses on medical, hospital, and commercial laboratory defense, as well as business and product liability litigation. He represents software manufacturers, automobile manufacturers, pharmaceutical companies, and medical device manufacturers. Mr. Hagan has been selected by Best Lawyers in America in medical malpractice and personal injury defense. He is the vice chair of DRI s Medical Liability and Health Care Law Committee. Mark L. Hammond, M.D., is vice president and founding member of Inpatient Physicians of the Mid South in Memphis, Tennessee, one of the nation s largest independent hospitalist groups. Dr. Hammond s 26-year practice focuses on longterm care, including serving as medical director for over a dozen facilities. He was one of the first physicians certified in hospice and palliative medicine, and has served as an expert in numerous medicolegal cases over the past 15 years. Nicholas T. Hariton, managing director and general counsel of Imaging Presentation Partners Inc. in Los Angeles, is a dynamic force in developing strategically superior jury consulting services, including modern techniques for observing and analyzing juror reaction to testimony and evidence presentation. He crafts juror friendly presentations for trial teams nationwide such as his 2012 engagement with Monsanto, resulting in a $1 billion jury verdict and has contributed to several $0 verdicts for the defense in skilled nursing trials. Brynda Rodriguez Insley is a principal in the Atlanta law firm of Insley and Race LLC. She specializes in insurance defense litigation, with an emphasis in medical, hospital, and nursing home malpractice liability and medical device defense. Prior to starting the firm in 1998, Ms. Insley practiced law with a wellknown insurance defense law firm in Atlanta for 12 years. She is a member of DRI s Drug and Medical Device Committee. Alexandra Jackson-Rieser is a senior health care claims specialist with OneBeacon Professional Insurance in Chicago. 4

7 Ms. Jackson- Rieser manages long-term care cases, as well as claims involving community care and other settings. For the past 10 years, she has handled professional liability claims for insurance companies. Prior to that, she spent 10 years as inhouse counsel for physician groups, home health care providers, and hospitals, and spent 10 years in private practice. Kenny Williamson Keith is a shareholder in the law firm of Gilpin Givhan PC in Birmingham, Alabama. She routinely represents clients in all areas of senior housing law, including health care liability litigation, medical malpractice defense, regulatory compliance and appeals, and professional licensure matters. Ms. Keith is a member of DRI, the American Health Lawyer Association, and the State Bar of Alabama. Bradley L. Kelly, founder of the Law Office of Brad Kelly PC in the Washington, D.C., area, specializes in defending longterm care providers in civil, criminal, and regulatory matters. He is a former Assistant United States Attorney for the District of Columbia, and current general counsel for the Methodist Home of Washington. Mr. Kelly is an active member of DRI, and the Maryland, District of Columbia, Kentucky, Pennsylvania, and West Virginia Bars. Sarah E. Lovequist, director of thought leadership at Litigation Management Inc. (LMI) in Cleveland, is the program vice chair for this seminar and active in DRI s Women in the Law Committee. She cultivates client relationships to ensure expectations are met and provides education on current legal trends. Prior to joining LMI, Ms. Lovequist litigated subrogation and insurance defense cases, handling matters ranging from insurance bad faith and contract disputes to product liability and long-term care claims. Vincent A. Maeder practices as CNA staff counsel with the Law Offices of Linda M. Libertucci in Brea, California, handling elder neglect and medical malpractice matters throughout Southern California. He is a board- certified trial attorney with 25 years of experience. From 1989 to 2001, he worked as a plaintiffs attorney and since 2001 he has represented medical and facility defendants in elder neglect and medical malpractice cases. Tracey A. Maw, RN, MSN, is a nurse paralegal with Damon Morey LLP in Buffalo, New York, focusing on nursing home litigation. She has 20 years of nursing home experience, including director of nursing and director of risk management. She served as a consultant regarding clinical best practice, survey preparation, training/development, and reimbursement. Ms. Maw is a member of the American Association of Legal Nurse Consultants and American Association for Long Term Care Nursing. Andrew R. McCumber is a founding shareholder of McCumber Daniels Buntz Hartig & Puig PA, with offices in Tampa, Florida, and Philadelphia, Pennsylvania, offering litigation defense services focusing on nursing home, assisted living facility, hospital, and medical malpractice work. Mr. McCumber served for 10 years as tort consultant to the Florida Health Care Association, and serves as Florida s representative on LeadingAge s National Legal Committee. Rosevelie Márquez Morales is a partner at Harris Beach PLLC in New York City and co-chair of its diversity council. He is a member of DRI s Law Institute and a former chair of DRI s Medical Liability and Health Care Law Committee. Mr. Plunkett is admitted to practice in Minnesota and Wisconsin. He has been recognized by his peers as a Top 100 Lawyer and Super Lawyer in Minnesota Law & Politics. Frank Russo, vice president of risk management and privacy officer for Silverado Senior Living Inc. in Irvine, California, is responsible for all aspects of Silverado s company- wide risk management program, including legal, professional insurance, and employee and resident safety. Under his supervision, the risk and legal department has received numerous local and national awards. Mr. Russo previously worked for a predominant Fortune 200 insurance company and leading third-party administrator. Todd W. Smyth, a founding partner of Smyth Whitley LLC in Charleston, South Carolina, focuses on the defense of the health care industry. He represents physicians, drug and medical device manufacturers, pharmacies, nursing homes, and assisted living facilities. Albert Barclay Wong, an AV-rated partner at Drewry Simmons Vornehm LLP in Carmel, Indiana, is the program chair for this seminar. His practice focuses on defending nursing facilities and other health care providers from negligence claims. 8 GENERAL INFORMATION GENERAL INFORMATION CLE/CLAIMS ADJUSTERS ACCREDITATION This seminar has been approved for MCLE credit by the State Bar of California in the amount of 12 hours, including 1 hour of ethics credit. Accreditation has been requested from every state with mandatory continuing legal education (CLE) requirements. Certificates of attendance will be provided to each attendee. Attendees are responsible for obtaining CLE credits from their respective states. Application has been made for continuing education for claims adjusters. Credit availability and requirements vary from state to state; please check the DRI website at dri.org for the latest information for your state.
