Sobieskiego 7, dated 31 March 2009 no. Ldz. 188/2009 on a change of the permit for generation of waste at the Industrial Waste Processing Plant in Myszków, -/-. -- I decide as follows: -- with the consent of the party I hereby change the decision of the Voivode of Silesia, dated 15 July 2004 no. SR.X /6/04 changed with a decision of the Marshal no OS/2008 dated 19 September 2008 ref. OS.Cz.WG.76360/3/3/08 annulling the decision of the Starost of Myszków: dated 26 May 2004 with ref. OŚR.7647/67-3/2003/04 and dated 26 May 2004 with ref. OŚR.7647/30/04 and granting to the Przedsiębiorstwo Produkcyjno-Usługowo-Handlowe "VIG" Sp.z o.o. at ul. Sobieskiego 7 in Dąbrowa Górnicza a consent to generate waste at the Industrial Waste Processing Plant at ul. Partyzantów 4 in Myszków, generated in connection with the performed activity regarding waste recovery and collection as follows: -/-. 1. Under item II. 1. the words: "Installation type and parameters" read as follows: At the Industrial Waste Processing Plant in Myszków at ul. Partyzantów 4, of the collected waste 72, Mg of waste other than hazardous is recovered annually and 3,650 Mg of hazardous waste (the remaining is collected and stored till the time of transferring it for recovery or disposal, to the entities licensed to run business within that scope). For that purpose the Plant is equipment with two waste-recovery installations: -/-. 1) Waste other than hazardous (plastics, textiles, rubber, package waste, plant-tissue waste and other) allowed for recovery. -/-. The installation consists of: a feeder, a metal separator, loading feeder, crusher granulator of various fractions of waste, feeder receiving the spoil, metal separator and a heaping feeder. -/-. The maximum daily capacity of the installation is 240 Mg. -/-. 1

The installation consists of: loading feeder, crusher, conveyor outfeeding the crusher fraction, centrifuges with oil discharge, receiving feeder, vibrating conveyor belt and magnetic separator of metals. -/-. Item II.9. the wording "Place and allowed methods of waste recovery" reads as follows: The waste recovery will be performed at the Industrial Waste Processing Plant in Myszków at ul. Partyzantów 4, and the storage-production hall of the usable area of 2,950 m 2, - by means of the R15 process (processing the waste to prepare it for further recovery, including recycling) in two installations: -/-. A. in the installation of non-hazardous waste consisting in a mechanical crushing in a waste crusher non-hazardous waste, admitted for recovery, coded as follows: , , , , , , , , , , , , , , , , , , , , , , , , , , , , , , , , , , , , , , , , and then in a separator metals are separated and the remaining crushed material as alternative fuel will be forwarded for recovery in installations and facilities in which their thermal processing is allowed, i.e. in compliance with the regulations issued on the grounds of article 47 of the waste act quoted at the beginning, -/-. B. in the hazardous waste installation four interchangeable recovery processes are applied: -/-. 1. Mechanical crushing of end-of-life tyres coded , and then separating the rubber fraction coded from the steel fraction coded /-. 2. Mechanical separation from the waste coded *, * and * - oil filters and fuel filters of three fractions for further use, i.e. metal elements coded and , filtering cord coded and and oil coded *. 3

Mechanical crushing of used packages in which the filters are delivered to the plant, contaminated with oils, coded *, and then mechanical separation of metal elements coded and oil coded *. -/-. 4. Mechanical crushing of used metal packages coded /-. Technology of the tyres recovery process -/-. The end-of-life tyres stored in the production and storage hall, by means of a forklift truck [FOURTH PAGE OF THE DOCUMENT] are placed into a basket, feeder and then crushed in a granulator. Afterwards a metal separator separates the crushed material dividing the rubber fraction from steel fraction. By means of a conveyor belt the crushed rubber and textiles are piled and the steel scrap is collected in replaceable containers. -/-. Technology of the filters recovery process -/-. Used filters are delivered to the recovery plant in tight 200-litre metal barrels and unloaded in the hall in a dedicated spot. By means of a forklift truck with special fittings the barrels are emptied to the basket of the feeder, from where the filters with oil are transported to the crusher which cuts the filters. Crushed to the required fraction (0-30 mm), mixed material is forwarded to another conveyor which transports it to the centrifuge. -/-. In the centrifuge, thanks to the centrifugal force oil is separated from the remaining material and directed with tight conduits to the oil storage tank. Dried (with oil removed) material being a mixture of the filtering cord, crushed rubber gaskets and crushed metal is transported with a belt feeder to the iron metals separation station. -/-. By means of an overhead magnetic separator placed crosswise over the conveyor transporting belt the crushed small parts of the metal casings of the filters are pulled out and brought to the metal storage container. -/-. The filtering cord and crushed rubber gaskets that are free from oil and metal are placed directly into the container assigned for their storage. -/-. The containers for: oil, metal and filtering cord are emptied as needed. -/-. The oil from the storage tanks is transported directly to cisterns and forwarded to refinery while the containers with metal and filtering cord are replaced by means or a forklift truck and the material is prepared for further transportation (metal to steelworks, and the textile cord to a mixing station). Technology of recovery process of packages contaminated with oil -/-. Metal packages from oil filters (barrels, containers) are delivered with a forklift truck to the basket of the feeder and then transported to the crusher which cuts them and crushes to the required fraction (0-30 mm). From the crusher the material is transported through a feeding screw to the centrifuge where the oil is separated from the other material and directed with tight conduits to the oil storage tank. The dried material being crushed metal, is transported by means of a belt feeder to the iron metal station, from where by means of an overhead -/-. 4

Technology of the metal package recovery process -/-. Metal barrels, containers and cans are delivered with a forklift truck to the basket of the feeder. Next, the packages are transported with a feeder to the crusher. After crushing the entire material is intercepted by means of an overhead magnetic separator placed crosswise over the conveyor transporting belt and pulled out and brought as steel scrap to the metal storage container. -/-. 4. 6 [SIXTH PAGE OF TRANSLATION] -/-. -- Justification -- The Przedsiębiorstwo Produkcyjno-Usługowo-Handlowe "VIG" Sp. z o.o. at Sobieskiego 7 in Dąbrowa Górnicza lodged a motion dated on changing the decision of the Voivode of Silesia, dated 15 July 2004 no. ŚR.X /6/04, changed with a decision of the Marshal, no OS/2008 dated 19 September 2008 ref. OS.Cz.WG.76360/3/3/08 granting a consent to generate waste at the Industrial Waste Processing Plant at ul. Partyzantów 4 in Myszków, generated in connection with the performed activity within the scope of waste recovery and collection. -/-. The changes requested by the Plant concerned extension of the assortment (with the waste coded , , , , , , , , , , , , and ) and increase of the volume of nonhazardous waste for recovery in a year from 18,200 Mg to 72,000 Mg. -/-. Incorporation of the scope of the requested changes in the subject decision will allow the Plant to manage the waste coming out to the market, resulting in a lower volume of waste [SIXTH PAGE OF THE DOCUMENT] for disposal at the landfill sites. -/-. The motion has been given a positive opinion by the Myor of the Town of Myszków (decision dated 5 May 2009 no. IM-7060/11/09). In consideration of the above it has been ruled as stated above. -/-. -- Instruction -- The party can appeal against this decision to the Ministry of Environment in Warsaw through the mediation of the Marshal of the Voivodeship of Silesia within 14 days of the date of service. -/-.
