7 EUROPEAN Toy Safety Standards The new European Toy Safety Directive (2009/48/EC) was published on 30 June 2009 in the Official Journal of the European Union. The purpose of the new directive is to enhance existing toy safety regulations and improve the quality of toys. 8 In addition, EU New Toy Safety Directive defines that toys shall meet all EU general chemical regulations including REACH directives, which provides legal basis for the future adding of new chemical substances. In respect of market supervision, the New Directive emphasizes on the responsibilities of manufacturers, importers and distributors in product certification, adding clauses related to the member countries enforcement power over market supervision and their punishments arising from the breach of the directive. Organic Compounds in Toys: EN 71-9, 10 and 11 Besides correspondent test standards for the content of heavy metal and other substances in toys for children, EN 71-9 is a new requirement adding to the existing EN 71 series of standards. EN focuses on the possible hazardous consequences caused by some organic compounds in toys, such as cancer, organic mutation, damages to reproductive system, etc. To minimize these hazardous consequences, EU issues EN 71-9 to limit the content of hazardous organic compounds in toys and toy materials. EN 71-9: A1: 2007 Organic Compounds Requirements EN 71-10: 2005 Organic Compounds Sample Preparation and Extraction EN 71-11: 2005 Organic Compounds Methods of Analysis EN 71-9 clearly defines the content and migration of hazardous compounds contained in toys and toy materials. The related requirements are classified according to the following ways of exposure: Lick Swallow Skin Contact Eye Contact Inhale In normal and visible use conditions, special attention shall be paid to children s behaviors, and the designs and functions of toys. EN 71-9: Organic Compounds Requirements These requirements only cover certain materials used in the following toys or toy materials such as Toy intended to be placed into mouths of children under 3, such as teether; Toys and component exposed to children under 3; Mouthpiece components of mouth-actuated toys; Solid toy materials or others intended to leave a trace The table below lists highlights of these requirements, including detailed limitation of different substances, Organic Compounds in Toys: EN 71-9, 10 and

11 EN N-nitrosamines and N-nitrosatable substances To determine migration of N-nitrosamines and N-Nitrosatable substances from toys intended for use by children under 36 months or in other toys and parts of toys intended to be placed in the mouth. To describe analytical methods to be used for the following types of toys: (a) Migration of N-nitrosamines and N-nitrosatable substance from elastomeric toys and parts of toys. E.g. balloons, teethers (b) N-nitrosamines and N-nitrosatable substances content in finger paints. 12 EU Labeling Requirement Traceability labeling Toy shall bear i) the name and address of Manufacturer and/or Importer*, ii) identification number. Identification number can be a type, batch, serial or model number or other element allowing their identification. If it is technically or economically not feasible to be marked on the toy, it shall be marked on the packaging or accompanying documents. * The contact point should be at least within the EU community, i.e. an EU domestic manufacturer or EU importer. Hygiene i) A toy intended for use by children under 36 months must be able to be cleaned. ii) A textile toy shall, to this end, be washable, except if it contains a mechanism that may be damaged if soak washed. The manufacturer must provide instructions on how the toy has to be washed. CE Mark CE Marking shall be fixed to the toy, a label or to the packaging. It is sufficient for the CE mark to be on the packaging if it is visible at the point of sale. 13 ASTM F963 Labeling Requirements Packaging, literature accompanying toys shall provide the safe use or assembly of a toy. No words, statements or graphics that illustrating a dangerous situation and inconsistent with the safety labeling instructions for use. TABLE-7: Summary of the labeling requirements to comply with this specification Safety Labeling Requirements for Certain Toys Safety labeling shall consist of: i) an alert symbol (an exclamation mark within an equilateral triangle), ii) a signal word (CAUTION or WARNING), iii) text that describes the hazard that is present. iv) may contain text about what to do or not to do to avoid injury (for example, Keep out of baby s reach ). 6) Toys with functional sharp edges or points (age between 48 and 96 months) [packaging] Shall contain following or equivalent text: This toy contains functional sharp edges / points. 7) Art materials - Items that are determined to contain hazardous materials must have appropriate warnings based on the advice from a toxicologist who conducted the formulation review. - If item does not contain hazardous material, it needs to label: Conforms to ASTM D4236 8) Magnets [packaging and instructions] Hobby and crafts items and science kit-type items for hcildrne over 8 years of age which contain a loose asreceived hazardous magnet or a loose as-received hazardous magnetic component shall carry following or equivalent text: This product contains (a) small magnet (s). Swallowed magnets can stick together across intestines causing serious infections and death.
