3 Guidelines for Self-Employed A. Occupation Permit The Occupation Permit (OP) is a combined work and residence permit that allows a non-national to work and reside in Mauritius. A non-citizen can apply for an OP under any of the following 3 categories: 1) Investor, 2) Professionals and 3) Self Employed. The non-citizen should apply for the OP under a category which best reflects his nature of activities in the country. An Occupation Permit is granted for a maximum period of three years, renewable thereafter subject to established criteria. B. Definition of a Self Employed 1) A self-employed is defined as a non-citizen engaged in a professional activity registered with the Registrar of Businesses. 2) A self-employed should make an initial transfer of 35,000 US dollars or its equivalent in any convertible foreign currency. 3) A self-employed is required to generate an annual turnover exceeding MUR 600,000. 4) A self-employed usually operates a one-person business, working exclusively for his/her own account. C. Documents required The Self Employed has to submit the following: 1) BOI Registration Form for Self Employed. 2) Application Form for Occupation Permit. 3) Original and copy of Business Registration Card. 4) A detailed Business Plan. 5) Contracts with prospective customers 6) License from professional/regulatory body 7) Original and copy of personal qualifications. 8) Evidence of transfer of funds from abroad in his/her personal account of a commercial bank registered locally. 9) Bank guarantee of MUR 100,000, issued by a local commercial bank. It is advisable not to have an expiry date on the bank guarantee. Occupation Permit Unit August

4 Guidelines for Self-Employed 10) Bank draft/cheque of MUR 15,000 as Occupation Permit fee, payable to the order of the Government of Mauritius. Personal/ company cheques are not acceptable. 11) Original and copy of Birth Certificate and Marriage Certificate if applicable. The Birth Certificate should either be in English or French. If it is not, a certified/ sworn translated copy by a competent authority should be submitted. 12) Passport and two photocopies of bio-data and last entry visa pages. Foreign nationals entering Mauritius need to be in possession of a valid travel document beyond their proposed period of stay. Self Employed are advised to request for a business visa on their arrival into the country for a minimum period of one month. Holders of passport of countries requiring a visa to enter Mauritius should apply and obtain the business visa prior to undertaking their travel. At time of submission of application, the business visa should be valid for at least fifteen days. The name on the passport should be EXACTLY the same as on the birth certificate. If it is not similar, an affidavit sworn in the country of origin/residence could be submitted certifying that the names appearing on the birth certificate and passport are for the one and same person. 13) 4 identical recent (less than six months old) colour passport size photographs of 4.5cm x 3.5cm. 14) Medical Certificate with original reports of required tests that are less than six months old. D. How to apply 1) The applicant has to be physically present in Mauritius at time of application and call in person at the Occupation Permit (OP) Unit of the Board of Investment to submit the application. The address of the OP Unit is on 4th Floor, Sterling House, Lislet Geoffroy Street, Port Louis. Please refer to the annexed site map. 2) At the time of application, all the documents mentioned in the section on Documents required should be submitted. 3) The originals and copies of documents submitted will be verified by both the Board of Investment (BOI) and the Passport and Immigration Office (PIO). 4) If the application is complete, a Document Receipt will be issued by the BOI. 5 Guidelines for Self-Employed 5) Upon approval, the applicant is registered with the Board of Investment (BOI) under the category Self-Employed and the Passport and Immigration(PIO) Office issues the Occupation Permit. 6) The applicant should personally collect the Occupation Permit at the Passport and Immigration Office (PIO Delivery Section). His/ her passport and BOI document receipt should be presented at the PIO counter at the time of collection. 7) It is advised that the applicant contacts the PIO five working days following submission of application to verify if the Occupation Permit is ready for collection. E. Turned down application In case the application is turned down, the applicant will be informed accordingly. The applicant should call in person at the Board of Investment to collect the full set of documents. F. Dependents The Dependents of a Self Employed are eligible to apply for a residence permit. Dependents are defined as spouse and children, including step children or lawfully adopted children, under 24 years of age. Common-Law-Partner may be granted a residence permit for a period of six months on a renewable basis. In case the dependents wish to work in Mauritius, they need to apply either for a work or occupation permit, as the case may be. Application is made to the Passport and Immigration Office. The following documents should be submitted: a. Application to enter Mauritius form to be filled by the Self-Employed. Common-Law-Partner and children over the age of 18 should fill the application form themselves. b. Passport details and valid visa.. If the visa is not valid, the application will not be entertained. c. Full Birth Certificate/ Marriage Certificate/ certificate of cohabitation ( Certificat de concubinage ) d. 4 identical recent (less than six months old) colour passport size photographs of 4.5cm x 3.5cm e. Bank Guarantee of MUR 20,000 per dependent. f. Medical Certificate with original reports of required tests. For children aged less than 12, only a medical certificate is required. 6 Guidelines for Self-Employed g. For lawfully adopted children, the document certifying adoption and for step children, a certified letter of consent from biological parent should be submitted. h. The Common-Law-Partner should provide a letter certifying that he/she would not undertake any employment in Mauritius as well as a letter from both partners stating that they are living together and the self-employed will meet all the financial expenses G. Second application (Renewal) After three years and subject to the annual turnover of MUR 600,000 being met, the Self-Employed may apply for a renewal of his/her Occupation Permit to BOI. If the annual turnover is over MUR 3 million for three consecutive years, the self-employed is eligible to apply for the Permanent Residence Permit, valid for ten years. Application is made to the Prime Minister s Office. The second application should be submitted at least 15 days prior to expiry of the permit and the following documents are required: 1) Application form for Occupation Permit 2) Passport details and last entry visa 3) Bank draft/ cheque of MUR 15,000 (Occupation Permit fee) 4) Bank guarantee (if the initial one is no longer valid) 5) Copy of Business Registration Card 6) Certificate from the Mauritius Revenue Authority 7) Copy of current Occupation Permit 8) 4 identical recent (less than six months old) colour passport size photographs of 4.5cm x 3.5cm H. Monitoring The Board of Investment in collaboration with the Passport and Immigration Office may carry out monitoring exercise to ensure that the Self Employed is compliant with established rules and guidelines. Site visits may also be carried out at regular interval. A Self-Employed should submit his/her annual return to the Mauritius Revenue Authority and Companies Division. Non-compliant Self-Employed could be deregistered by the Board of Investment (BOI) as per Section 15 of the Investment Promotion Act and their Occupation Permit would subsequently be cancelled by the Passport and Immigration Office. 7 Guidelines for Self-Employed I. Cancellation of Occupation Permit If at any time, the Self Employed decides to cease his activities in Mauritius, he/she should inform the Board of Investment in writing and return to the Passport and Immigration Office the originals of the Occupation Permit and Occupation Permit Card and to the Board of Investment, the Registration Certificate. The Passport and Immigration Office may at any time cancel the permit without giving any reason. J. Other important information 1) No application for Occupation Permit will be accepted if there is evidence that the applicant is suffering from any infectious or contagious disease. 2) The Self-Employed should ensure the company obtains the relevant permits and licenses prior to starting his/her business activity. He/ She should also comply with conditions of regulated activities. 3) Only those applications which are deemed complete will be accepted for processing.. 4) A Post Office Box address is not acceptable as a residential or business address. 5) The Occupation Permit is not transferable in respect of registered business activities or employer. 6) Applicants should immediately notify the Passport and Immigration Office and the Board of Investment in writing of any change in their particulars inclusive of business and residential address. 27 Template Business Plan Template Business plan In order to start a business in Mauritius, a foreign investor/self employed applying for a permit must provide the Board of Investment (BOI) with a document describing the venture he/she intends to create. This Business Plan is required to present a certain amount of information about the business divided into sections. It must be able to be read in 5 minutes. Company Overview This section presents a vision, the history and the current status of the business. It also outlines the strategy and mission, as well as the goals and objectives set to realize it. Products or Services Presents the key features, technology, benefits, stage of development, intellectual property and competitive advantages of the products or services the business offers. Market Analysis Explains the industry trends and drivers, the target markets of the business and assesses the competitive environment. Management Team This section presents the organizational structure of the company along with the staff needs. It also includes a presentation of the top management team, with their CVs and roles, and the team history and dynamics. This section should highlight the adequacy of the team s skills and the objectives of the business.

28 Template Business Plan Operating Strategies In this section, the operating strategies are laid out: marketing, production, R&D, personnel, administrative and financial strategies. Critical Risks Identifies the major internal and external critical risks (financing, market, execution ), and viable plans to address them. Cash Flow Statement Plans out cash flows over a projected 5 year period, consistent with the strategies outlined above. Income Statement Expose a realistic and attractive income potential of the business activity. This projection has to be detailed for the first 2 years, then quarterly for years 3 to 5. Balance Sheet This section must include a projected balance sheet for 5 years, including working capital and fixed asset requirements and detailing the capital structure of the business.
