1 New South Wales Road Transport (General) (Short Descriptions and Notice under the Road Transport (General) Act 1999 His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Road Transport (General) Act CARL SCULLY, M.P., Minister for Roads Explanatory note The objects of this Regulation are: (a) to prescribe certain offences to be penalty notice offences and to prescribe the short descriptions, authorised s and penalties for certain offences, and (b) to clarify the circumstances in which an offence of a specified kind or committed in specified circumstances will be a penalty notice offence for the purposes of the Road Transport (General) (Short Descriptions and Notice Offences) Regulation 1999 (the Principal Regulation), and (c) to prescribe a penalty of 44 for certain penalty notice offences under the Australian Road Rules that involve the use of a vehicle other than a motor vehicle, and (d) to increase the amounts of certain penalties listed in Schedule 2 to the Principal Regulation. This Regulation is made under the Road Transport (General) Act 1999, including sections 15 and 71 (the general regulation-making power) and, in particular, section 71 (2) (b). 3 Amendments Schedule 1 Schedule 1 Amendments (Clause 3) [1] Clause 3 Definitions Insert in clause 3 (1) in alphabetical order: Australian Road Rules has the same meaning as it has in the Road Transport (Safety and Traffic Management) (Road Rules) Regulation Olympic period means the period from 2 September 2000 to 29 October 2000, inclusive. [2] Clause 5 Short descriptions of offences Insert after clause 5 (1): (1A) If the reference to a provision in Column 1 of Schedule 2 is qualified by words that restrict its operation to specified kinds of offences or to offences committed in specified circumstances, an offence created by the provision is a penalty notice offence only if it is an offence of a kind so specified or is committed in the circumstances so specified.
