79 Summary of Aging Programs & Services Many services are available to individuals through a variety of funding sources, including the Older Americans Act, state general revenue, dedicated state taxes, and donations made by individuals and communities. Services available are listed on subsequent pages. Eligibility for these services is determined by the offices identified with each service. In most cases, clients must be age 60 or older, unless specifically noted. Priority consideration is given to applicants with the greatest economic and social need. A copayment is not required from individuals who receive these services. However, clients are encouraged to donate if they are able to do so. Eligibility and payment criteria may change as state and federal regulations are amended or renewed. For the most current information, consult local AAAs, local Department of Human Services county offices or the Division of Aging and Adult Services Choices in Living Resource. Some services may not be available in every region or county in the State. To apply for aging services listed in the publication, please refer to the Area Agency on Aging for your county. 80 Aging Programs & Services The next few pages list services provided through local Area Agencies on Aging. In most cases, clients must be age 60 or older, unless specifically noted. Please contact your local AAA for more information regarding these services. Adult Day Care Clients must be physically or mentally impaired, and in need of care/supervision for a period of more than two hours, but less than 24 hours a day, in a location other than the client s own home. Program services include meals, transportation and recreational activities in a congregate setting. Available in AAA Regions I and V, and on a private-pay basis in some areas. Adult Protective Services, Intake Reports & Central Registry Adult Maltreatment Hotline is operational 24 hours per day, seven days per week. As required by ACA , the Department of Human Services maintains a single statewide telephone number that all persons, whether mandated or not, may use to report cases of suspected maltreatment of impaired and endangered adults. Intake Reports Allegations of abuse, neglect or exploitation of impaired and endangered adults submitted to APS for investigation, are assigned a number when keyed into the APS system and APS consultants are notified by of case assignments. The majority of Intake Reports originates from calls to the Adult Maltreatment Hotline. These reports are entered into the APS system by an Intake/Hotline Worker at the Central. Each member of the APS Unit, however, is responsible for accepting and recording allegations of abuse, neglect, or exploitation on the APS Intake Report (DHS-3310). The terms intake and referral are used interchangeably. Screen out A Screen Out is the recording of reported information that is believed to be inappropriate or beyond the authority of APS to investigate. An area manager and/or administrator reviews the Screen Out to determine if any further action is needed. APS Central Registry ACA (a)(1) stipulates there be a statewide registry for adult maltreatment. APS in conjunction with the of Long-Term Care maintains a computerized index of information relative to reports of abuse, neglect and exploitation received and investigated by this office. APS is authorized to charge a fee of $10 for processing registry check requests submitted by entities not approved as having nonprofit status. Arkansas Senior Medicare Patrol The Arkansas SMP (Senior Medicare Patrol) program receives its funding from a federal grant from the Administration on Aging (AoA) administered through the Arkansas Department of Human Services, Division of Aging and Adult Services. The ASMP recruits and trains senior volunteers to educate Arkansans about Medicare fraud prevention, and also alerts Arkansas about the latest scams targeting the senior population. 79

81 The ASMP offers group presentations and one-on-one counseling, and also distributes a variety of educational materials and tools such as: Personal Healthcare Journal; Personal Medical Record; How to Read Your Medicare Summary Notice; and a quarterly SMP Newsletter. The ASMP believes that educated consumers are empowered to protect themselves, and the Medicare trust fund, from fraud, waste, abuse. The ASMP has a toll-free HELPline for reporting suspected Medicare and Medicaid fraud, waste and abuse. The HELPline is also available to individuals who may be interested in volunteering with SMP program, scheduling a fraud presentation, or to request materials. Chore Services To be eligible, clients must be without significant social support systems that are able to perform services for them. Chore Services includes simple household tasks, running errands, preparing food, heavy cleaning, yard and walk way maintenance. These are services which the older person is unable to complete on his or her own and do not require the services of a trained homemaker or other specialist. This does not include medically oriented personal care tasks. Available in AAA regions I, IV, V, VI and VII and on a private-pay basis in some areas. Client Representation Provides assistance in the form of access or care coordination in circumstances where the older person is experiencing diminished functioning capacities, personal conditions or other characteristics that require the services of a formal service provider or family caregiver. Activities of client representation may include assessing needs, developing care plans, assisting with application form(s), authorizing and coordinating services among providers and providing follow-up and reassessment, as required. Client Representation excludes any service covered by Title XIX under the Targeted Case Management Program for an eligible Medicaid recipient. This service is available in all AAA regions. Congregate Meals A meal provided to a qualified individual in a congregate or group setting. Clients must be age 60 or over. Spouses are also eligible. Meals may also be available to individuals with disabilities who are under age 60, but who reside in housing facilities occupied primarily by older individuals at which congregate nutrition services are provided. Meals that are served in a group setting such as a senior center or elderly housing facility are usually associated with activities promoting social interaction and reducing social isolation. The meals served will meet all requirements of the Older Americans Act, and state and local laws. This service is available in all AAA regions. Employment Services This service provides an organized program of counseling, assessment, training and placement in employment, which may be subsidized or unsubsidized. Clients must be age 55 or older. This service is available in all AAA regions. Home-Delivered Meals A meal provided to a qualified individual in his or her place of residence. Clients must be age 60 or over. Spouses are also eligible. The meals served must meet all of the requirements of the Older Americans Act, and state and local laws. This service is available in all AAA regions, though some limitations may apply. This service may also be offered on a private-pay basis in some areas. 80

82 Homemaker Services Provides assistance such as preparing meals, shopping for personal items, using the telephone, light housework and performing household management tasks. Medically oriented personal care tasks are not included as a part of this service. All homemakers receive training in household management. This service is available in all AAA regions. Information and Assistance (referral) This service is available to all older persons and their families and friends. This service provides information about available services and benefits, and where to obtain them. It may include assistance with a referral to an agency providing needed services or benefits, and a follow-up call or visit to ensure that the referral was satisfactory. Information and Assistance is available in all AAA regions. Legal Assistance This service provides legal advice, counseling and representation by an attorney or other individual acting under the supervision of an attorney. Clients must be age 60 or older. This service cannot provide legal counsel for criminal charges. This service is available in all AAA regions. Long -Term Care Ombudsman Program The Arkansas State Long-Term Care Ombudsman Program advocates for the rights of long-term care residents. This is a statewide program comprised of both paid and volunteer ombudsmen that address complaints of nursing home, residential care and assist living facility residents. Its representatives provide information on facilities, work for systematic change and monitor the activities of the regulatory system. This service is available in all AAA regions. You may visit the program s website at or (501) for additional information. There is also a Volunteer Program throughout the state for anyone interested in volunteering a few hours a week. The term ombudsman describes someone who intercedes with government and institutions on behalf of ordinary citizens. A Long-Term Care Ombudsman advocates for residents of nursing homes and residential care facilities by receiving, investigating and resolving complaints from residents or their families. Ombudsmen regularly visit residents to hear their concerns and complaints. Ombudsmen deal with issues such as: Finances Medicaid eligibility Restraints Guardianship Food quality Transfers or discharges Room temperature Social activities Rights restrictions Care plans Anyone, including friends, relatives, facility staff or administrators, health care officials, guardians or anonymous callers, who have concerns about a long-term care resident may contact the Ombudsman. 81

83 Material Aid Provides goods or payment of bills to meet or prevent an imminent emergency. For example, purchasing necessities for someone whose home has been destroyed by fire, payment of a utility bill to prevent imminent shutoff of services, or the distribution of such items such as clothing, smoke detectors, eyeglasses or security devises. This service is available in AAA regions III, IV, VI, VII and VIII. Personal Care Services This service provides assistance with basic tasks necessary to enable the client to remain living in the community, such as personal assistance, standby assistance, supervision or cues. Clients must meet medical requirements for personal care. Services may include assistance with bathing, grooming, dressing, toileting, food preparation and feeding, performance of incidental household services essential to the client s health and comfort, transporting the client to and from medical appointments and assistance with medications, which are ordinarily self-administered by the client. This service is available in all AAA regions, and may be available on a private-pay basis in some areas. Home Repair / Modification / Maintenance This service includes home repairs essential for the health and safety of the elderly homeowner, who is unable to perform the needed work; modification to make the dwelling more accessible to owners who are frail or have physical disabilities; or, maintenance and service to basic appliances, pest control, weatherization, health features, etc. Clients must own or be purchasing the home. This service is available in AAA regions IV and VII. Respite Care Services which offer temporary, substitute supports, or living arrangements for care recipients in order to provide a brief period of relief or rest for caregivers. Respite Care includes: In-Home Respite, which may include personal care, homemaker and other in-home respite services. Respite provided by attendants of the care recipient at a senior center or other nonresidential program. Institutional respite provided by placing the care recipient in an institutional setting, such as a nursing home for a short period of time as a respite service to the caregiver. Summer camps for grandparents caring for their grandchildren. This service is available in all AAA regions. Socialization This service is generally associated with senior center activities. Facilitating the client s involvement in activities to reduce social isolation and promote social interaction and well-being through ongoing programs of physical and mental activity. This service is available at senior centers in all AAA regions. Telephone Clients must live alone, temporarily alone or be homebound in isolated areas. Service consists of telephone calls at appointed times to check the client status. A completed call is one to the client s household, one call placed to the client s emergency contact if the client does not answer the phone at the appointed time or there is a continual busy signal. If contact is not made, the AAA is expected to follow-up to verify the status of the client s health and obtain necessary assistance. This service is available in AAA regions V and VI. 82

84 Transportation This service transports clients from one location to another so the client has access to supportive or nutrition services, and other services provided by an Area Agency on Aging. 87 Support Services for Seniors Supplemental Nutrition Assistance Program (SNAP) SNAP is designed to provide food assistance to eligible households to cover a portion of their food expense. SNAP benefits are authorized through an Electronic Benefits Transfer (EBT) card. The EBT card may be used in a grocery store or other outlet where EBT cards are accepted. SNAP benefits may help qualified older Americans on fixed incomes stretch their food purchasing power. For more information, visit Home Energy Assistance Program (HEAP) Regular & Crisis Intervention This is a one-time assistance toward heating cost annually for the month of January. HEAP Crisis Intervention is one-time assistance for heating costs in an emergency situation. For more information, visit Weatherization Assistance Program (WAP) The Weatherization Assistance Program provides funds to conserve energy in the homes of low-income people with an emphasis to assist the elderly population, handicapped, and families with children. An automated energy audit by the National Energy Audit (NEAT) is used to determine the most cost effective measures on single framed homes. The Mobile Home energy Audit (MHEA) is used to determine the most effective measures to be installed on mobile homes. For more information, visit Commodity Distribution Program The Commodity Supplemental Food Program (CSFP) is designed to improve the health of low-income persons by supplementing their diets with nutritious USDA commodity foods. It is administered through the Arkansas Department of Human Services. Commodities donated by the U.S. Department of Agriculture (USDA) are distributed to schools and other eligible recipient agencies in Arkansas that participate in the National School Lunch Program (NSLP), The Emergency Food Assistance Program (TEFAP), and Summer Food Service Program. The TEFAP program is further administered through local community Assistance Program (CAP) agencies and food Banks using mass distribution, food pantries, and soup kitchens to reach citizens throughout the state. For more information, visit Electricity Sales Tax Exemption Low-income electric utility customers may be eligible for a state sales tax exemption on the first 500 kilowatthours of use each month. 88 Medicaid Medicaid is a joint federal and state program that provides limited medical services and contributes toward the costs of medical care for eligible persons. In Arkansas, Medicaid is administered by the Department of Human Services, Division of Medical Services. The following Medicaid categories apply to Arkansans who are elderly and have disabilities. Visit or for additional information. Supplemental Security Income A person who is eligible for SSI is automatically eligible for Medicaid. See page 99. Medically Needy Spend Down A person who is over the income limit for regular Medicaid but has unusually high medical expenses may receive Medicaid coverage for a limited time. See page 90. Qualified Medicare Beneficiary (QMB) Medicare recipients who are over the regular Medicaid income limit may be eligible for QMB to pay their Medicare premiums, deductible, and co-insurance. See page 88. ARSeniors For QMBs aged 65 and older who have lower income. ARSeniors provides full Medicaid coverage. It is the only coverage group in the Medicare Savings categories that provides the full range of Medicaid benefits. See page 88. Workers with Disabilities A category of Medicaid for individuals with disabilities and disabling medical conditions, supporting themselves by working rather than by disability benefits such as SSI and Social Security Disability. See page 92. Specified Low-Income Medicare Beneficiary (SMB) Medicare recipients that are over the income limits for regular Medicaid and QMB may be eligible for SMB. SMBs are eligible for the payment of Medicare Part B premiums only. No other Medicare cost sharing charges are covered. See page 88. Qualified Individual 1 (QI-1) Medicare recipients that are over the income limits for regular Medicaid, QMB, and SMB may be eligible for QI-1. These individuals may be eligible for the payment of Medicare Part B premiums only. See page 88. Pickle Amendment (COLA) Medicaid Former SSI Recipients may re-qualify for Medicaid by disregarding their Social Security cost-of-living adjustment or COLAs. The Pickle Amendment is a federal law that helps former SSI recipients qualify for 87

89 Medicaid, disregarding all of the Social Security cost-of-living-adjustments since SSI ceased. This adjustment helps some low-income Medicare beneficiaries regain Medicaid coverage, which assists in paying medical services not covered by Medicare. See page 88. 90 Medicare Savings Programs Since 1988, several laws have been passed requiring states to provide savings to certain Medicare recipients through the state s Medicaid program. The categories enacted are: Qualified Medicare Beneficiaries (QMB), which includes ARSeniors Specified Low-Income Medicare Beneficiaries (SMB) Qualifying Individuals -1 (QI-1) Qualified Disabled and Working Individuals (QDWI) The categories listed above provide Medicare Savings by paying the Medicare premium (s) or a portion of the Medicare premium, and possibly the Medicare deductibles and coinsurance. Except for ARSeniors, the categories listed above do not pay for the full range of Medicaid Services. ARSeniors For aged QMBs equal to or below 80% of the federal poverty level and provides full Medicaid coverage. It is the only coverage group in the Medicare Savings categories that provides the full range of Medicaid benefits. ARSeniors is also available to seniors not entitled to Medicare. If applicants for ARSeniors Medicaid are eligible in the month of application, they can also receive retroactive coverage for the three months prior to application, of otherwise eligible. Qualified Medicare Beneficiary (QMB) Pays all Medicare premiums, deductibles, and coinsurance. There is no retroactive coverage for QMB participants. Coverage of Medicare premiums, deductibles, and coinsurance will begin on the first of the month following the month of approval in the QMB category. SMB are eligible for the payment of Medicare part B premiums only. No other Medicare cost sharing charges will be covered. SMB s are however, eligible for retroactive benefits for up to three calendar months prior to application, if the individual meets all SMB eligibility requirements in the retroactive period. Coverage must begin on the first day of the month. Individuals who qualify for SMB will not receive a Medicaid card. Qualified Individual 1 (QI-1) Eligible for payment of their Medicare part B premiums only. QI-1 participants are eligible for retroactive benefits for up to three calendar months prior to application if the individual meets all eligibility requirements. Coverage must begin on the first day of the month. Retroactive coverage cannot begin before January 1 of the current calendar year. QI-1 participants will not receive a Medicaid card. 89

92 Medically Needy Spend Down Medically Needy Spend Down is a Medicaid category that provides temporary coverage for individual s medical expenses who would not normally qualify for Medicaid because of income. Apply at the local DHS county office. Visit for additional information. 91

93 Workers with Disabilities Medicaid Workers with Disabilities is a category of Medicaid for individuals with disabilities and disabling medical conditions, who support themselves by working rather than by receiving disability benefits such as SSI and Social Security Disability. Eligibility Criteria 1. Aged 16 to Meet the Social Security / SSI definition of disability, except fulltime employment is permitted. 3. Work and have work income reported to the IRS. 4. Non-work income such as Social Security, workers compensation, VA benefits, or pension cannot exceed the SSI benefit plus the $20 general exclusion, or $730 ($710 + $20 = $730) per month for Net personal income (Half of the work income plus all non-work income) cannot exceed 250% of the Federal poverty level for the individual s family size, or $2, per month for a single person. Only about half of work income is considered, so individuals may earn much more than $2,000 from working. In addition, income of the spouse and other family members are not considered. 6. Resources cannot exceed $4,000 for a single person and $6,000 for a couple. The home, vehicle, household contents, personal possessions, and most burial plans are not considered as resources. If married and both spouses work, a second vehicle is not considered a resource. There will not be a penalty imposed for a transfer of resources. In addition, an applicant may have up to $10,000 in a separate approved account, to be used for education, job training, a home, or vehicle, or out-of-pocket health care costs. How Much Can I Earn? A single person without any non-work income may earn over $4,000 per month from work, because only about half of his/her income will be considered. A single person with $500 of non-work income, such as a small Social Security check, could earn at least $3,000 per month from working. The limits on net income are higher if you are married or have children under the age of 18 living at home. Incomes of spouse, parents, or children are not considered. Examples: 1. Jimmy has a serious medical condition, but still works when he is able. He is uninsured and needs assistance with medical bills. He has applied and been approved for Workers with Disabilities, and begins receiving Medicaid in a few months. If he applied for Social Security Disability instead, he would be denied if he was working and earning over $980 per month. Even if he qualified for Social Security Disability, he would have a two-year waiting period of Medicare health coverage. 2. Martha has a disability and works part-time. She lost her SSI benefits and Medicaid when she got married. She may qualify for Workers with Disabilities because her husband s income is not counted. 3. Joe has a disability and works. He earns $3,000 per month from work. Joe qualifies for Workers with Disabilities because only half of his salary is considered. 92

94 4. Bobby is 17 years of age and lives with his parents. He has a disability and works. He is not eligible for SSI because his parents earn too much. He is able to qualify for Workers with Disabilities because his parent s income is not considered. 5. Jerry has a disability and works. His Social Security benefits ceased due to earnings but he still has Medicare. He also qualifies for Workers with Disabilities Medicaid, which pays his Medicare premiums, deductibles, co-pays, and may include some services not covered by Medicare. What services are included in Workers with Disabilities Medicaid? Eligible recipients will receive the full range of Arkansas Medicaid benefits. It will also supplement Medicare by paying Medicare premiums, deductibles, co-pays, and includes some services not covered by Medicare. How to Apply Apply for Workers with Disabilities at the local Arkansas Department of Human Services. It is considered Medicaid Category 10. 95 Medicaid Long-Term Services and Supports Medicaid provides an array of programs for individuals in need of long-term services and supports (sometimes referred to as long-term care). Long-term Services and Supports (LTSS) is assistance with daily activities such as bathing, eating, dressing for older people and persons with disabilities who cannot perform the activities themselves. LTSS have traditionally been provided in facilities like nursing homes. Today services are available in facilities as well as in the individual s home and other community settings. The goal is for persons in need of LTSS to receive the services in the best possible setting for the individual. Individuals in need of LTSS and who qualify for a Medicaid program may receive the services: At home through: o ElderChoices o Alternatives for Adults with Physical Disabilities (AAPD) o PACE o Personal Care o IndependentChoices In an Adult Family Home if enrolled in ElderChoices In a Level II Assisted Living Facility In a Nursing Facility The following is a description of each of these choices. ElderChoices LTSS is provided to individuals age 65 or older living at home or in an Adult Family Home. Individuals enrolled in ElderChoices are eligible to receive the full-range of Medicaid services plus the following: Adult Day Care Adult Day Health Care Homemaker Services Chore Services Home-Delivered Meals Personal Emergency Response System Respite Care Adult Companion Services Adult Family Homes Note: ElderChoices participants living in an Adult Family Home will receive these services from their Adult Family Home provider. Alternatives for Adults with Physical Disabilities (AAPD) LTSS is provided to individuals under age 65, but at least age 21, who have a physical disability and live at home. Individuals enrolled in AAPD are eligible to receive the full-range of Medicaid services plus the following: 94

96 Attendant Care Services Environmental Accessibility Adaptations/Adaptive Equipment Case Management Program of All-Inclusive Care for the Elderly (PACE) A comprehensive health and social services program that provides and coordinates primary, preventive, acute and long-term services and supports for individuals age 55 or older in need of nursing facility care. Services are provided in PACE s, in the home and in inpatient facilities. Individuals eligible for PACE must live in an area served by a PACE program and are able to live in a community setting without jeopardizing health or safety. Personal care may be provided by a personal care agency aide or by a friend, family member or other individual of choice through the IndependentChoices program. IndependentChoices A Medicaid service that allows Medicaid recipients age 18 and older who have a medical need for: Personal Care, ElderChoices Homemaker, and/or ElderChoices Adult Companion Services, to self-direct care by hiring and supervising a personal assistant. Participants receive a monthly allowance based on need that can be used to pay a personal assistant of choice as well as purchase items that support 95

97 the participant s care and independence. Personal Assistants may be family members (excluding spouses), friends or other trusted employees. Individuals who choose IndependentChoices accept the responsibilities of being an employer and supervising care. A participant may choose a representative to supervise the care. For more information, call toll-free at Adult Family Home A family-style living environment for ElderChoices clients who cannot live independently. Each home is limited to a maximum of three residents who are not related to the Adult Family Home provider. Homes are certified by the Arkansas Department of Human Services, Division of Aging and Adult Services. Adult Family Home providers must complete regular training in health, nutrition, care giving and related subjects. Providers must also be First Aid and CPR certified. Each Adult Family Home is inspected regularly to ensure that required standards are met. Each home is unique, but all homes provide basic care services, including: Activities of Daily Living o Bathing o Dressing o Grooming o Feeding Meals and snacks Housekeeping and laundry services Living Choices LTSS is provided to individuals living in a licensed Level II Assisted Living Facility (ALF) that has agreed to provide services to enrollees of Living Choices, which are age 65 or older, or age 21 or over and meet the Social Security definition of blindness or disability. Individuals enrolled in Living Choices are eligible to receive the full-range of Medicaid services plus the following: Attendant Care Therapeutic Social and Recreational Activities Medication Oversight Medication Administration Periodic Nursing Evaluations Limited Nursing Services Non-Medical Transportation Three Prescription Drugs beyond the Medicaid limit for participants who are not entitled to Medicare. Those enrolled in Medicare must receive all prescription drugs through Medicare Part D. Living Choices participants are responsible for paying for their own room and board in the ALF. Medicaid sets limits on what the ALF may charge for room and board based on the SSI Federal Benefit Rate so that all residents can afford the rate. Nursing Facilities Institutions that provide medically necessary care 24 hours per day for residents who require skilled nursing care, rehabilitation services or health-related care and services above the level of room and board and not primarily for the care and treatment of mental diseases. Recipients receive the full range of Medicaid 96

98 benefits. Medicaid also pays all or a portion of monthly facility vendor payment depending on the monthly income of the resident. Additional LTSS Medicaid Services The following are some additional services for Medicaid recipients that may assist individuals in meeting Long- Term Services and Supports needs: Targeted Case Management: Medicaid clients age 60 or older who have limited functional capabilities and need assistance with the coordination of multiple services and/or resources may be eligible for this service. Case management services will assist Medicaid recipients in gaining access to needed medical, social, educational and other services. Home Health: Medicaid clients may receive assistance with periodic nursing care to preserve life or to prevent or delay the necessity of inpatient care. These services include part-time or intermittent care provided by a registered professional nurse, licensed practical nurse, student nurse or home health aide. Hospice: Terminally ill Medicaid clients may receive a continuum of care services under this category. Services may include routine home care, continuous home care, inpatient respite care, and general inpatient care. Transportation: Medicaid clients may receive assistance with obtaining transportation to a medical facility. This may include ambulance services. Medical Need Eligibility All Medicaid programs described above require that the individual be in medical need of the services provided in order to participate. ElderChoices/Adult Family Homes, Alternatives for Adults with Physical Disabilities, PACE, Living Choices and Nursing Facilities require that the individual meet the nursing home level of care as determined by the of Long-Term Care. Personal Care and IndependentChoices require that the individual s attending physician authorizes the need for personal care services. Financial Eligibility Personal Care and IndependentChoices are Medicaid services available to Medicaid recipients in a program that covers personal care. An individual must be eligible and enroll in a Medicaid program that covers personal care in order to receive the service. ElderChoices/Adult Family Homes, Alternatives for Adults with Physical Disabilities, PACE, Living Choices and Nursing Facilities are Medicaid programs that an individual must apply for and enroll in to receive the services. These programs have the same financial eligibility requirements, except for a few criteria that will be noted. 97

99 Income Limit: $2, per month (Effective January 2013, may increase in January 2014) Only the individual s gross monthly income is counted. The spouse s income is not considered. Individuals applying for PACE, Living Choices and Nursing Facilities who are over the income limit may be income eligible if an Income Trust is established. When applying, the caseworker should explain how to establish an income trust if you are over the income limit. Resource Limit: $2,000 for an individual; $3,000 when a married couple both apply A home, car and certain burial arrangements are disregarded from resource consideration. When an individual who is married applies and the spouse does not apply, a portion of the couple s resources can be protected for the ineligible spouse and not counted toward the applicant s resource limit. If the couple s total countable resources are: Under $23,184, the ineligible spouse gets all of the resources $23,184 to $46,368, the ineligible spouse gets $23,184 $46,368 to $231,840, the ineligible spouse gets one-half. Over $231,840, the ineligible spouse gets $115,920 (the maximum that may be protected for the ineligible spouse) The amount that is not protected for the ineligible spouse is counted toward the applicant s resource limit of $2,000. Individuals who have transferred resources in the past five years and didn t receive full compensation may be ineligible to enroll in these LTSS programs during a penalty period determined by the value of the resource, compensation received and when the transfer was made. Estate Recovery These Medicaid programs are subject to Estate Recovery provisions. Money Follows the Person Money Follows the Person is a demonstration grant for individuals who are Medicaid eligible and live in a nursing facility. The individual must have a strong desire to move back into the community and receive home and community-based services in the setting of their choice. Eligibility Criteria: Populations served by MFP are the aged, individuals with physical disabilities, individuals with developmental disabilities, and individuals with mental illness. An individual must have been in a qualified residence for a minimum of 90 consecutive days and receive Medicaid. Where Will I Live? A case manager will be assigned to assist you in determining where you want to live and assist with developing a plan to transition into the setting of your choice. If you do not have an existing home, or family arrangements are unavailable, the case manager will have a listing of available housing options in your community from which you may choose. 98
