3 1. INTRODUCTION All payments made in respective of overtime working are covered by Agenda for Change pay and conditions. (See extract in Appendix 1) 2. SCOPE The principles of the scheme are based on a need to ensure a fair system of pay for NHS employees which supports modernised working practices. The provisions recognise that modern forms of health care rely on flexible teams of staff providing patient care 24 hours a day, 7 days a week, 365 days a year. The policy covers overtime payments made in respect of hours worked in excess of 37.5 per week (or current standard full time hours for the post if the individual has hours protection). The policy does not cover payments made for other work e.g. on call, work in unsocial hours. 3. ELIGIBILITY FOR OVERTIME All staff in pay bands 1 7 will be eligible for overtime payments. There will be a single rate of time and a half for all overtime with the exception of overtime on general agreed Public Holidays which will be paid at double time. Senior staff paid in pay bands 8 and 9 will not be entitled to overtime payments. 4. STAFF WORKING ROSTERED OVERTIME Where staff work shifts which always include a fixed amount of overtime (rostered overtime) the hours worked outside normal hours should be calculated as if they were working non-standard hours in excess of 37.5 hours a week (or current standard full time hours for the post if the individual has hours protection). 5. CALCULATION Overtime payments will be based on the hourly rate provided by basic pay (plus any long term recruitment and retention premia).the single overtime rate will apply whenever excess hours are worked over full time hours unless time off in lieu is taken. Part-time employees will receive payments for the additional hours at plain time rates (Plus any unsocial hours payments due for these hours as appropriate) until their hours exceed standard hours of 37.5 a week (or current standard full time hours for the post if the individual has hours protection). Time off in lieu of overtime payments will be at plain time rates. Page 3 of 5 Date of Review: January 2012

4 6. AUTHORISATION The appropriate manager (usually budget holder) must agree to work being performed in addition to standard hours. Any time off in lieu of overtime payments will be at plain time rates. It is expected that overtime will only be granted to meet the unpredictable and emergency needs of service provision. Staff may request to take time off in lieu as an alternative to overtime payments. This must be agreed with the manager but if for operational reasons this is unable to be taken within 3 months then it must be paid at the overtime rate (see extract in Appendix 1). If the staff member does not exercise their right to request time off in lieu they must then be paid for the additional hours at the overtime rate. Page 4 of 5 Date of Review: January 2012

5 Appendix 1 OVERTIME PAYMENTS 1. All staff in pay bands 1 to 7 will be eligible for overtime payments. There is a single harmonised rate of time-and a-half for all overtime, with the exception of work on general public holidays, which will be paid at double time. 2. Overtime payments will be based on the hourly rate provided by basic pay plus any long-term recruitment and retention premia. 3. Part-time employees will receive payments for the additional hours at plain time rates until their hours exceed standard hours of 37½ hours a week. 4. The single overtime rate will apply whenever excess hours are worked over fulltime hours unless time off in lieu is taken, provided the employee s line manager or team leader has agreed with the employee to this work being performed outside the standard hours. 5. Staff may request to take time off in lieu as an alternative to overtime payments. However, staff who, for operational reasons, are unable to take time off in lieu within three months must be paid at the overtime rate. 6. Senior staff paid in pay bands 8 or 9 will not be entitled to overtime payments. 7. Time off in lieu of overtime payments will be at plain time rates. Page 5 of 5 Date of Review: January 2012
