1 SPECIFIC PROGRAMME CRIMINAL JUSTICE CALL FOR PROPOSAL ACTION GRANTS 2009 AWARDED PROJECTS JLS/2009/JPEN/AG/612 VICTIM SUPPORT NL Title of proposal: Capacity building for EU crime victim support (CABVIS) Requested grant: EUR ,90 Co-financing 70% The project wishes to respond to the lack of services towards victims in Europe. The primary aims are develop the flow of information and provision of support to victims and prevent victimization. The project will realise its goals through knowledge exchange, research and networking. It will engage in activities like developing a training manual, organising two interactive workshops seminars and final conference, developing a project leaflet, upgrading the website and securing media promotion. The project involves 5 MS namely, The Netherlands; Germany, Hungary; Portugal and the UK. JLS/2009/JPEN/AG/613- MINISTRY OF JUSTICE- EE Title of proposal: Interconnecting the Prison and Probation information system with the Criminal Records Register and the Efile and renewing the Prison and Probation Information System. Requested grant: EUR ,30 Co-financing 70% The project falls under the priorities of the call in terms of contributing to developing electronic tools in the context of justice -despite the project taking a more national direction-, COUNCIL DECISION 2009/316/JHA and to the plans of creating a European Index of Convicted Third-Country Nationals (EICTCN). The main priorities of the project is to connect to criminal records and enable exchange of information, develop a system to enable the electronic delivery of criminal justice procedural info, modernise the prison and probation info system, better the quality of data available to probation services. The reforms will benefit the ECRIS info exchange. The main impacts of the project would be to work towards a paper free criminal justice system and increase system efficiency (time and labour). The main European level outcome of the project is to offer higher quality information to European states when exchanging information about convicted persons. JLS/2009/JPEN/AG/615- DISTRICT COURT AMSTERDAM, CRIMINAL DIV. NL Title of proposal: Mutual Recognition: Developing a European judicial culture". Requested grant: EUR ,00 Co-financing 70% The project seeks to organise a series of EU seminars on the topic of "mutual recognition." The project will develop in cooperation with Romania and Poland to give it a more translational character and will receive support from the ENCJ, EJN, EJTN and the Dutch judicial training centre. The main objective of the project is to initiate discussion among legal practitioners on the "mutual recognition" principle to enable better understanding and overcome difficulties, thus, contributing the promotion of judicial cooperation to the development of a common European culture in line with the priorities of the call. The results of the project will be distributed to participants through the EJTN and the ECNJ. The sustainability of the project is guaranteed through the subsequent seminars in 2011 and The project has a pan European dimension since it aims to invite judges from all MS. JLS/2009/JPEN/AG/616- MINISTRY OF JUSTICE NL Title of proposal: Requested grant: EUR ,00 Co-financing 69.9% The objective of the project is to achieve the transnational use of videoconferencing in judicial proceedings at an agreed and common quality level in participating Member States. Based on the experiences and of the Dutch Ministry of Justice, a key success factor is conforming to the same trueto-life requirements in all locations involved. The aim of this project is firstly, to formulate common true-to-life requirements. Secondly, this project s aim is to install videoconferencing facilities (following these requirements) at national level locations (selected by entities from other Member States) and to test connections between facilities. The Dutch Ministry of Justice will co-operate with 1

2 the Dutch Videoconferencing Kernel team to share its best practices and expertise with entities from other Member States. JLS/2009/JPEN/AG/617- UNIVERSITY OF SASSARI-IT Title of proposal: Identification and dissemination of European best practices about Restorative Justice and evaluation of the role and application of mediation and alternative measures in the EU member states. Requested grant: EUR ,28 Co-financing 70% The project falls well within the priorities of the call in relation to exchanging best practice and Restorative Practice. The project aims to examine the impact of restorative justice and mediation in both the juvenile and normal justice systems. There is a good description of project activities (seminars, focus groups, network meetings) and target group (teenagers, young adults, mediators and restorative justice practitioners). The expected results include data collection and identification of best practice, the creation of a scientific technical board to monitor the restorative and mediation developments in Europe. The project includes 3 MS and mentions that it will seek a European level dissemination of results. JLS/2009/JPEN/AG/618- MINISTRY OF JUSTICE AND LAW ENFORCEMENT HU Title of proposal: Enhancing cooperation as regards the cross-border enforcement of road traffic fines Requested grant: EUR ,70 Co-financing 70% The proposal covers a high priority area for the EU, namely, enforcement in the field of road safety. The projects main objective is to increase cooperation on cross border enforcement of road traffic fines in the EU. The project will tackle obstacles arising due to the different categorization of fines among MS - Criminal law, administrative law and minor offences- and promote the exchange of information. The project's activities include the organization of two conferences and two workshops. The main expected outcome of the project is to reveal the options on the adoption of an EU level legal instrument on the subject of the mutual enforcement of road traffic fines. The project has a clear EU dimension. JLS/2009/JPEN/AG/619- COURTS OF JUSTICE-MT Title of proposal: Interconnection between Courts of Justice, Attorney General Agency and Corradino Correctional Facilities' (Prisons) ICT systems Requested grant: EUR Co-financing 70% The project is in line with the priorities of the call, in terms of contribution to judicial cooperation and developing e-justice tools. The project will undertake the exchange of best practice and the completion of a study in order to develop a method which will enable the electronic interconnection of records between courts, the attorney general and prisons. This electronic system will allow for better exchange of information both nationally and in cooperation with foreign countries, reduce working times, better the understanding of criminal cases. The activities which the project will undertake to secure its objective include the exchange of information and best practice with the partner organization, the organizations of meetings and workshops, the development of an ICT framework to support the objectives of the project. JLS/2009/JPEN/AG/621- UNIVERSITE LIBRE DE BRUXELLES BE Title of proposal: Development of ECLAN - Phase II Requested grant: EUR ,00 Co-financing 69.79% La présente demande vise la phase II de développement du réseau ECLAN. La première phase a fait l objet du projet (JAI/2004/AGIS/129) qui s est déroulé de déc à déc Elle a débouché sur la création du réseau, l identification des points de contact, l adoption de règles de fonctionnement et la création d un site web. Les thèmes seront choisis en fonction des développements que connaîtra l espace pénal JLS/2009/JPEN/AG/624- HIGH COUNCIL FOR THE JUDICIARY-IT Title of proposal: EUROPEAN MODELS OF REPARATORY JUSTICE AND PENAL MEDIATION: POTENTIALS AND PROSPECTS IN THE COMMON SPACE OF FREEDOM, SECURITY AND JUSTICE Requested grant: EUR ,59 Co-financing 70% The project aims to contribute to the understanding of reparatory justice. The project will examine whether models of reparative justice are implemented in the EU and their impact or mutual recognition of judicial decisions and on victim-offender mediation procedures. The project will be organised around a preparatory meeting (which will include frontal lessons, workshops and the recreation of mediation practices) and a final meeting (which will include a comparative study of EU and national legislation on the topic of reparative justice and which will invite sectoral experts, social workers, prison operators as well as magistrate and lawyers to allow for exchange of experience and best practise). The project hopes that through this methods it will encourage participants to confirm the effectiveness and usefulness of applying reparative justice methods in EU MS. JLS/2009/JPEN/AG/625- HIGH COUNCIL FOR THE JUDICIARY-IT Title of proposal: Penal system, migratory flows and international cooperation Requested grant: EUR ,60 Co-financing 70% The main objective of the project is to develop effective forms of cooperation to deal with the transnational problem of human trafficking. To achieve the objective the project will engage in activities like studying different forms of penal controls of migrant flows, analyze systems of juridical and extrajudicial protection offered to victims, studying the existing legislation on the topic. The results of these activities will be summed up to form a shared protocol for cooperation. The project expects that the outcome of the activities will be to increase knowledge on the possibilities of international cooperation in regards to the trafficking of human beings. JLS/2009/JPEN/AG/626- HIGH COUNCIL FOR THE JUDICIARY-IT Title of proposal: The fight against corruption Requested grant: EUR ,22 Co-financing 70% The project will make a contribution to the promotion of judicial cooperation on criminal matter among EU member states and thus, meets priority priority of the call. The proposal argues that enhanced cooperation among states is an efficient way to deal with international criminality and the effects it gives rise to, namely corruption and bribery. The project will be organised around a seminar which aims to discuss and compare the existing methods of investigation, investigative protocols and best practise in this field. Through this activity the project seeks to contribute to the harmonization of national legislations and the creation of a genuine European area of justice based on the principles of mutual recognition and confidence. JLS/2009/JPEN/AG/627- ACADEMY OF EUROPEAN LAW-DE Title of proposal: New technologies in criminal proceedings Requested grant: EUR ,40 Co-financing 70% The project will be organised around three seminars whose topic of discussion will be to assess the impact of information and communication on criminal proceedings. As technology will be all the more involved in the field of justice the seminal will prepare for possible challenges occurring from this event. The first seminar will deal with e-evidence, the second with the transnational use of video 3

4 conferencing and the third with ECRIS. The seminars will include lectures and workshops led by both EU and national experts and case studies. The seminar aims to bring together a mix crowd of judges, prosecutors, civil servants, defence lawyers and academics. JLS/2009/JPEN/AG/628- EUROPEAN FORUM FOR RESTORATIVE JUSTICE-BE Title of proposal: Victims and Restorative Justice Requested grant: EUR ,00 Co-financing 70% The project aims to tackle some of the problems observes in restorative justice process in terms of some negative consequences and risks involved. The project's main objective is to secure more empirical knowledge on the needs and experiences of victims when participating in RJ processes. This knowledge should allow for improving the programs and secure better support and higher qualities. The project will be organised around two phases. The first one will be a more theoretical one (literature review and document analysis) and the second one will engage in comparative empirical research. The project aims to invite 300 victims to participate. Following the end of the project an international conference in Helsinki to present the final output of the project; a scientific research report offering conclusions and recommendations and identifying the most effective measure in the field of restorative justice. JLS/2009/JPEN/AG/629- FEDERAL PUBLIC SERVICE JUSTICE- BE Title of proposal: Preparation of the practical implementation of the framework decision on the mutual recognition of probation measures Requested grant: EUR ,76 Co-financing 70% The project aims to reinforce the Framework Decision 2008/947/JHA on the application of the principle of mutual recognition to judgements and probation decisions. The project aims to tackle disparities on probation measures and alternative sanctions in different EU MS. The main objective of the project is to create a foundation which the next EU Presidencies can use to follow up the last part of implementing the Decision. The second aim of the project is to produce good practise. The project's activities include the organisation of working groups, the preparation of national fact sheets and a main seminar which will discuss any obstacles obscuring the implementation the Framework decision and which will allow for exchange of views on national systems. The project's deliverables include the provision of precise recommendations distributed via the Council and a publication of a manual which will include the conclusions of the main seminar. JLS/2009/JPEN/AG/630- FAIR TRIALS ABROAD TRUST- UK Title of proposal: Defence Rights in Europe: From Individual Experiences to Policy Recommendations Requested grant: EUR ,16 Co-financing 70% The project will attempt to use the experiences of individuals in different European criminal systems to identify the biggest obstacles to ensuring a fair trial in Europe. The objectives of the projects are gives as: judicial cooperation and mutual knowledge and best practise. The activities of the project include the collection and analysis of data on people's experiences, publication of these cases, and assessment of the cases in collaboration with the project's partners. Organising a series of meetings in the European Parliament o discuss the issues identified through the cases and produce six notes on the main issues which will be widely distributed. The expected outputs of the project include: better awareness of the obstacles which hinder fair trials, creation of a unique pan European criminal cases database, detailed case studies, media coverage across Europe and the publication of research and summary reports. JLS/2009/JPEN/AG/632- JUDICIARY SCHOOL OF GCJ- Spain Title of proposal: Virtual Course on Judicial Cooperation in Criminal Matters Requested grant: EUR ,50 Co-financing 70% The main objectives of the project are listed as: provision of training on EU instruments of judicial cooperation, practical training in criminal cooperation, promote the mutual recognition of juridical resolution, provision of legal language training, promote personal contact between European judges to 4

5 promote the development of a European culture and use new methods of training through the technologies of info. The project will be organised around an online first phase. Successful participants will be invited to the second phase to share their conclusions and shape the final assessment. At the end of the project there will be the online publication of a manual with the course material in three EU languages. JLS/2009/JPEN/AG/633- FAIR TRIALS ABROAD TRUST- UK Title of proposal: Discrimination against Non-National Defendants within the European Union Requested grant: EUR ,36 Co-financing 70% The project aims to test the hypothesis whether non nationals are at a disadvantage when standing for trial in a state beyond their own compared to nationals facing similar charges. The project will use existing data (and if necessary it will gather more), contact qualitative analysis of defendants and carry interviews with offenders carrying custodial sentences. If the hypothesis tests positive in the test the project will proceed to make recommendations on legislation measures that could better the situation. The results of the project will be disseminated through the publication of a research report which will also be made available on the website of Fair Trails' and the monthly newsletter. JLS/2009/JPEN/AG/635- UNIVERSITY OF STUDIES OF INSUBRIA IT Title of proposal: Training action for legal practitioners: fundamental rights, European Union and judicial cooperation in criminal matters through law and language Requested grant: EUR ,80 Co-financing 63.31% The project falls under priority 3.1 of the call. The main objectives are: to promote mutual knowledge on MSs legal and judicial systems contributing to the development of a European culture, increase knowledge of EU legal instruments in the field of criminal justice. The activities the project will undertake include the study of different legal traditions, discussion with actors involved in judicial cooperation processes. The project expects to improve the legal and linguistic knowledge of European legal practitioners, exchange best practices and increase awareness on a common European legal culture. JLS/2009/JPEN/AG/639- GHENT UNIVERSITY BE Title of proposal: Custodial Sentences & Mutual Recognition: Assessing The Need For & Potential Of EU Flanking Measures With Regards To Detention Conditions Requested grant: EUR ,29 Co-financing 69.03% The project aims to reveal the need for harmonisation in the area of custodial sentences and detention conditions. It will build its argument using the principles of mutual recognition, mutual trust and a commitment to human rights. The project aims to identify problems emerging from the recent European Framework Decision on the Mutual Recognition of Judgements involving Custodial Sentences/Deprivation of Liberty and their impact on judicial confidence. The project will carry out 2 exercises (the collection and analysis of legislation and analysis of MS/practitioners perspectives). The project will produce a final report which will reveal the differences in custodial sentence and detention legislation in different MS. The report will be disseminated through the e-justice portal. JLS/2009/JPEN/AG/640- ESCUELA JUDICIAL DEL CGPJ SP Title of proposal: E-crimes seminar Requested grant: EUR ,68 Co-financing 70% The course aims to touch on a number of subject areas like the adoption of other countries practices and standards and the study and comparison of the various models, on crucial questions: investigating authority, principle of opportunity, pursuit of civil lawsuits, penal mediation, etc. It will also analyze instruments of coordination that could facilitate judicial cooperation within the European Union. The Project has as a main event a seminar of 2,5days The seminar will promote the objectives of the project. It will promote the exchange of information among participants from different countries, facilitate discussion and produce a number of final documents for publication which will contain conclusions, standards, practices and recommendations. 5

6 JLS/2009/JPEN/AG/641- S-H VERBAND F. SOZIALE STRAFRECHTSPFLEGE DE Title of proposal: Improving knowledge in practice of restorative justice (in criminal matters) by international comparative research Requested grant: EUR ,92 Co-financing 67.71% The project will carry out research on the different restorative justice measures which exist in Europe. It aims to increase knowledge on the topic of restorative justice, identify good practise, identify which RJ programs are best suitable for which situations and strengthen judicial cooperation through RJ. The project will be arranged around 3 conferences which will see to the establishment of an internet based network, study visits and the creation of a database which will aim to improve interoperability. The expected results of the project include identification of good practice, identification of obstacles and strategies to overcome them, assessment of the different strengths of different RH measures. The outcomes of the project will be disseminated through the publication of the final report. JLS/2009/JPEN/AG/644- MOVEMENT AGAINST INTOLERANCE SP Title of proposal: STOP HATE CRIMES IN EUROPE Requested grant: EUR ,14 Co-financing 70% The project tackles the problems of hate crime in the European Union and argues that there is insufficient legislation to effectively deal with it. The project aims to bring to the awareness of MS the legal tools which can help deal with hate crimes and initiate a debate on the needs of the victims of such crimes. The project will be completed through 8 phases ranging from the completion of comparative studies, to identification of best practise and the developments of an online database to provide free consultation for legal practitioners. In the final phase of the project a transnational conference will be held in Madrid to present the results. The results will be disseminated through the internet, publication of articles, press conference and leaflets. JLS/2009/JPEN/AG/645- CENTER FOR THE STUDY OF DEMOCRACY BG Title of proposal: TRACKING PROGRESS IN STRENGTHENING CRIMINAL JUSTICE INDICATORS FOR INTEGRATED CASE MANAGEMENT Requested grant: EUR ,67 Co-financing 70% The project aims to identity best practice in more experienced MS and transfer it to newer MS (Bulgaria and Poland) to enhance the application of e-tools and case management indicators. The activities of the project will include comparative analysis of different record keeping methods. The expected results of the project include the identification of European best practice on e-tools, a basket of indicators and a final report on the possible transfer of the e-tools system. The project will be organized around two workshops in Bulgaria and Poland and a final conference in Brussels. The project will set up a multilingual website through which it will disseminate its main results. JLS/2009/JPEN/AG/646- ACADEMY OF EUROPEAN LAW DE Title of proposal: Using EU Criminal Justice Instruments Requested grant: EUR ,99 Co-financing 70% The project aims to provide training for judges on mutual recognition instruments to effectuate better cross border cooperation. The project will offer four two-day seminars to the four partner countries and will have a total number of around 176 participants. The seminars will include practical training and case studies, and workshops which will aim at discussion. The main objectives of the seminars will be to provide in depth training on the applicability of the major mutual recognition principles in criminal matters and illustrate to participants the main differences among legal systems. The main results of the project will be to raise awareness on using such tools and allow for the development of mutual trust. JLS/2009/JPEN/AG/647- JUDICIARY SCHOOL OF GCJ SP Title of proposal: Seminar of comparative study on European legal system and international judicial cooperation through legal language. Requested grant: EUR ,54 Co-financing 70% 6

7 The project seeks to provide language training to European judges. The specific objectives include practical training in criminal cooperation instruments, training of EJN members, legal language training, the promotion of mutual recognition, the promotion and development of a common euro pan judicial culture. The training will be completed through first a theoretical and then a practical phase. The project will train 24 Spanish judges and another 12 European judges. The results of the project will be disseminated through the publication of a cd. JLS/2009/JPEN/AG/648- UNIVERSITY OF ST ANDREWS CSTPV UK Title of proposal: Assessing support initiatives for victims of terrorism in the United Kingdom and Spain: Lessons for the European context Requested grant: EUR 288, Co-financing 69.71% The project's objective is to asses support initiatives for victims of terrorism. The project will be organised around four areas: case studies of victim organisations, analysis of EU and national public policy on victims of terrorism, creation of a best practise document, knowledge transfer across victim groups, academia and policy arenas. Through these activities the project will attempt to understand the position of victim organisation in relation to issues like victimisation, restorative justice, role of the government, compensations. The results of the project will be disseminated to all victims groups through the Terrorist Victims Network to read and provide feedback. In its final phase the project will hold two workshops which will bring together victim groups, academic experts and government to create a forum for discussion. The very final results of the project will be disseminated through the distribution of a white paper, the creation of a victims' of terrorism portal, and the organisation of a conference. JLS/2009/JPEN/AG/651- JUSTICE UK Title of proposal: Developing best practice amongst defence lawyers and access to justice in European Arrest Warrant Cases Requested grant: EUR ,20 Co-financing 69.82% The project aims to reveal that dual representation should be included in the European Arrest Warrant Scheme to ensure better representation. The project will be organised around five phases which will employ different methods; questionnaires will be given out to practitioners to identify problems emerging in different EAW cases, 6 th month reviews of the pilot program, seminars, research, and production of final report. The project will disseminate its findings through the organisation of a conference in Brussels in 2012 where the results of the project will be presented to EU institutions and other organisations interested in the idea of dual representation in the EAW scheme. The project expects that the date that will emerge out of the research will provide empirical prod the having the assistance of lawyers in both the requesting and surrendering state will improve the representation of the client. JLS/2009/JPEN/AG/652- PORTUGUESE ASSOCIATION FOR VICTIM SUPPORT PT Title of proposal: Project CARONTE Requested grant: EUR ,00 Co-financing 70% The project aims to bring to the surface a victim groups that is often marginalised, namely, the families and friends of victims of murder. The project aims to introduce support measures for the families and friends of murder victims. The activities of the project will include the creation of a procedures manual on the support for family members, the organisation of a workshop and study visit in the UK and Portugal, the organisation of a European seminal in Lisbon, the production an information leaflet for the general public and the development of a project website. JLS/2009/JPEN/AG/662- GENERAL COUNCIL OF SPANISH BARS ES Title of proposal: PenalNet Plus: a step forward in online networking for the criminal law practice Requested grant: EUR ,00 Co-financing 70% 7

8 The current project aims to develop videoconferencing which is a priority in the call. It aims to show to lawyers that video-conferencing can guarantee the same results that would be achieved through a personal meeting in full security and increased efficiency as the time and cost related to travelling would be removed. Developing this practise aims to comply with the EU directives on data protection and electronic signature. The targeted groups will be the nine interested bars Belgium, Holland, Luxemburg, Poland, Austria, Germany, Check Republic, Greece and the UK. The project aims to involve the Criminal Law and IT Law Committees and also the CCBE's permanent Delegation in Luxemburg. The project has a good dissemination strategy. The campaign will be communicated to relevant parties through press releases, presentations, articles, and a public presentation in Brussels. The project expects a high impact in the criminal law community. It will increase the number of lawyers participating in PenalNet and will provide with new tools which will increase effectiveness, efficiency and security. The project aims to be integrated in the E- justice portal therefore the results will have long term use JLS/2009/JPEN/AG/667- UNIVERSITY OF TERAMO IT Title of proposal: MASTER OF LAWS IN INTERNATIONAL COOPERATION AGAINST TRANSNATIONAL FINANCIAL ORGANISED CRIME Requested grant: EUR ,00 Co-financing: 69.32% The project aims to promote means to combat translational crimes. The project will include a task group and will provide trainings. The thematic areas will include trafficking, criminality, environment, bribery, forgery, money laundering, terrorism and cybercrime. The project will be completed indifferent phases (establishment of the thematic classes, conduct of the seminars, planning the final event and publishing the results. The project expects that its results can be used to develop and improve legal education, help in bettering training activities and in-service training, and enable the comparison of legal cultures. 8
