1 MULTI ANNUAL WORK PLAN Translation into English: Elena Arrebola
2 1. CONTEXT a) Mandate The Council promotes the principle of equal treatment and non-discrimination of persons on racial or ethnic origin in education, health, social services and benefits, housing, the supply of and access to its products and services, access to employment, self-employment or to occupation, membership and participation in trade unions and employers organizations, working conditions, career advancement and occupational and continuing education. b) Council s functions 1. Providing independent assistance to victims of discrimination in pursuing their complaints. 2. Autonomously and independently performing analysis and studies and publish independent reports. a) Issuing on its own initiative or at the request of the competent organs of the State Administration reports regarding independent regulatory projects, plans, programs and other initiatives related to the object and purpose of the Council. b) Developing and adopting an annual report on the situation of discrimination and the principle of equal treatment and raise it to the Ministry. 3. Measures to help promote equal treatment and the elimination of discrimination, formulating recommendations and proposals that apply: a) Analyzing legislation proposing initiatives for adoption or modification. b) Presenting initiatives and making recommendations regarding the plans or programs for the promotion of equal treatment and non-discrimination. c) Advising and reporting on indirect discriminatory practices in the various areas of discrimination. d) Promoting activities of information, awareness-raising, training and other necessary actions. e) Establishing relationships for information exchange and collaboration with similar bodies and institutions at international, national, regional and local level. f) Establishing collaboration and cooperation mechanisms with other bodies, organizations and important institutions on the defence of human rights. 4. Developing and adopting the Annual Report of Council activities and raising it to the Minister of Health, Social Services and Equality. 2 de 10
3 2. STRATEGIC PRIORITIES COUNCIL S POSITION IN SOCIETY COUNCIL S OPERATION INSTITUTIONAL RELATIONS OBJECTIVES Increasing the level of knowledge of the Council, its activities and services. Constituting the Council as a leader in the fight against racism in Spain. Promoting the role of the Council as a generator of knowledge regarding the phenomenon of discrimination and particularly that which occurs in the racial or ethnic origin. Strengthening the reference position of the Council among key actors in the fight against discrimination (social and legal practitioners, political parties, public officials, union and business organizations etc.). Visualizing the Council's position in the debate on key issues affecting the fight against racism. Strengthening the work of the organs of the Council; plenaries, standing committee and working groups. Promoting and planning the work of the working groups of the Council establishing action plans and concrete and practical objectives to address racial and ethnic equality in each group. Improving the coordination of working groups. Studying and modifing the "architecture" of the Council. Improving the Council s budget. Deepening the independent exercise of Council s functions Reinforcing the Council's work with the entities involved in the fight against discrimination on racial or ethnic origin. Creating a cooperation network, involving various departments of the general state administration, as well as regional and local administrations. Better coordination with other colleges, State Council of the Roma (gypsy) people, the Observatory for the gender based violence, Forum for the social integration of immigrants, etc.. Creating a network of cooperation with stakeholders concerning this matter (bar associations, experts, ombudspersons, consumer organizations and users etc). Strengthening relationship with Equinet and other international organizations and agencies and transfer good experiences of other organs of European equality. 3 de 10
4 3. PRIORITY ACTION AREAS EDUCATION JUSTICE INTERNAL AFFAIRS Encouraging the development of awareness raising materials for young people and teenagers. Encouraging the presence of ethnic minorities in shaping the Spanish, European and world societies, educational materials and programs. Assisting teachers training activities on diversity management in the classroom. Studying the phenomenon of school segregation and concentration of immigrant and Roma (gypsy people) students. Promoting the training of legal practitioners in the field of equal treatment and non discrimination against persons on racial or ethnic origin. Setting the position of the Council on the adoption and transposition of EU legal acts, in particular Directive 2012/29/UE the European Parliament and of the Council the 25 October 2012 laying down that minimum standards are established on rights, support and protection of crime victims and amending and replaced framework Decision 2001/220/JHA. Assisting training activities of members of the Security Forces of the State relating to equal treatment and nondiscrimination, and in particular: Identification of racist incidents Ethnic profiling POLITICAL INVOLVEMENT Encouraging participation and presence of ethnic minorities in areas of public or political representation. Strengthening the channels of communication between the Council, political parties, legislatures, regional governments and local authorities. Undertaking monitoring of racist political speeches. MEDIA Raising awareness of media regarding the situation of the most vulnerable to racism Enhancing the presence of the Council on the media Improving the image transferred by the media in relation to ethnic or racial minorities. EMPLOYMENT Monitoring the impact of the economic crisis in access to and continued employment of persons belonging to ethnic or racial minorities. Promoting measures of diversity management. Studying on access to justice for victims of discrimination. HORIZONTAL PRIORITIES WOMAN: Special situation of women against discrimination / Multiple discrimination / ethnic minority women SOCIAL SERVICES Keeping tracking in cases of discrimination in access to social services by ethnic or racial minorities. Training of professionals in the social sphere (public and private) on equal treatment and nondiscrimination. Developing protocols for external social actors (public and private) in order to address situations of discrimination on racial or ethnic issues. 4 de 10

STRATEGIC OBJECTIVES AND ACTIVITIES BY LINES OF ACTION ASSISTANCE TO VICTIMS OF DISCRIMINATION OE1: Strengthening the operation and disseminate service activities to assist victims of discrimination. Activity 1: Engaging in public presentation of the network, diffusion Council website, apart from the improved service assistance to victims of discrimination in the Council's own page. Activity 2: Implementing collaborative actions with social agencies to facilitate the Council's performance against the courts. Activity 3: Studying the ways of accrediting persons by providing services to victims of discrimination. OE2: Improving support and resources for victims of discrimination. Activity 1: Creating an external protocol (s) that allows for proper assistance and protection of victims of discrimination, whatever the context in which this occurs. Its development will be agreed with the concerned ministerial departments, the Ombudperson, Prosecutors, Police and other relevant agencies in this area, including the General Council of the Judiciary. Activity 2: Reviewing the internal protocol of assistance to victims of discrimination to improve and update the CAS. Activity 3: Strengthening specific training actions aiming at better assisting victims of discrimination by key stakeholders (associations, police, judges, prosecutors, lawyers etc. ). Activity 4: Strengthening collaboration group assistance to victims of discrimination with other associations that serve victims of discrimination and support service for victims of discrimination Council. Activity 5: Developing thematic guides on assistance to victims of discrimination and its prevention in the priority areas identified above. Activity 6: Disseminating the guides / publications produced by other Council members. Activity 7: Promoting collaboration lines with specialized services for the criminal prosecution of equity and protection against discrimination. 5 de 10
6 STUDIES, REPORTS AND RECOMMENDATIONS OE 1: Studying the state and the evolution of discrimination Activity 1: Conducting study new issues of discrimination based on the biannually perception of victims Activity 2: Preparing the annual report on the state of discrimination on racial or ethnic origin in Spain, reviewing its structure and content, and enhance its dissemination to consolidate as a baseline study in this area. Activity 3: Developping a study on the impact of the crisis on discrimination on racial or ethnic origin and economic cost of discrimination. Activity 4: Developping a study on the application of the principle of equal treatment and non discrimination on racial or ethnic origin in education. Activity 5: Promoting the inclusion of questions relating to the application of the principle of equal treatment and non discrimination in the conduct of studies and surveys sector (housing, education, justice etc ). OE2. Drafting reports on legislative or planning instruments of public policies that affect the principle of equal treatment and non discrimination projects. Activity 1: Making a report on the implementation of anti discrimination directives in Spain and in particular the situation of bodies of equal treatment in relation to the proposed horizontal Directive, currently under negotiation. Activity 2: Conducting a report on the implementation of the 2012/29 Directive on minimum measures, rights, establishing the support and protection of crime victims, noting the legislative changes, if any, would be necessary to ensure the rights recognized in the Directive. Activity 3: Making a report on the current Organic Law on Penal Code. Activity 4: Conducting a report on possible organizational improvements and operation of the Council. OE3.: Making recommendations on implementing the principle of equal treatment Activity 1: Updating the recommendation to political parties ahead of the election campaigns of 2014 and 2015, on racist and xenophobic discourse. Activity 2: Making a recommendation to the political parties for their presence in electoral lists and to public office in the presence of persons belonging to 6 de 10
7 ethnic minorities. Activity 3: Development of a recommendation on the treatment of ethnic minorities in the media. Activity 4: Developing periodically Council positions on current issues affecting their powers. 7 de 10
8 COMMUNICATION, AWARENESS-RAISING AND TRAINING OE.1: Improving the level of awareness of the Council and its activities in society. Activity 1: Developing a communication plan for the Council. Activity 2: Organizing public events in more media coverage dates (March 21, December 10, etc..). Activity 3: Implementing or taking part in awareness raising activities developed by their members. Activity 4: Strengthening the Council website as a platform for dissemination of the activities of the Council and its members. Activity 5: Developing the Council's presence in the media. Activity 6: Organising an Annual Conference. OE.2: Promoting treatment and content of news, programs etc related to ethnic or racial minorities. Activity 1: Establishing channels of information and communication with the media. Activity 2: Developing, in collaboration with the media, a guide with good practices for the treatment of minorities, ethnic or racial, in the media. Activity 3: Holding conferences on equal treatment and non discrimination in the media. Activity 4: Developing a guide for preventing the spread of content, in any medium, including social networks, to incite or provoke discrimination, hatred or intolerance. OE.3: Improving the training of key players on equal treatment and non discrimination. Activity 1: Implementing specific collaboration tools training on equality of equal treatment and non discrimination for judges and magistrates / as, prosecutors, police officers, lawyers / as and staff associations, trade unions and employers as well as media professionals at national and regional level, and public and private social agents. Activity 2: Commissioning of a study center on equal treatment and non discrimination on racial or ethical in collaboration with a university source, so that 8 de 10
9 provides a platform for the dissemination of knowledge in this area. Activity 3: Conducting training activities on speech and hate crimes. OE.4: Developing contents on equal treatment and non discrimination in education from an integrative perspective Activity 1: Including appropriate content related to ethnic and racial issues that would curb the dissemination of traditional and exclusionary stereotypes, both in textbooks and in the relevant educational materials. Activity 2: Incorporating training and awareness programs in teacher training centers, especially in places where there is an increased presence of ethnic minorities, both nationally and in third countries, or racial. 9 de 10
10 INSTITUTIONAL RELATIONS OE1.: Improve and deepen relationships with key players in the fight for equal treatment and discrimination. Activity 1: Opening a round of Chairman's contacts with the Ombudsman, responsible for the Ministry of Justice, Internal Affairs, the General Council of the Judiciary, the General Attorney, etc. Activity 2: Creating a network of inter agency cooperation between agencies of different levels of government and other key actors. Activity 3: Encouraging the participation of representatives of the Council on events, activities, etc..launched by other agents. Activity 4: Strengthening the presence of the Council of the European Network of Equality Bodies Deal (EQUINET), European Agency for Fundamental Rights (FRA). Proposing, inter alia organizing a seminar in Spain Equinet. Activity 5: Encouraging the individual distribution of the Council's work among key actors. COUNCIL S OPERATION OE1. Strengthening and streamlining the operation of the Council. Activity 1: Establishing a schedule for parting sessions, Standing Committees and Working Groups of ordinary character. Activity 2: Implementation of an E Room, where it is possible to hold virtual meetings, facilitates access to Council documents tool. Activity 3: Setting up a coordination group of the different working groups. Activity 4: Allowing the presence of the coordinators of the various working groups in the Permanent Commission. Activity 5: Establishing a new composition of the Standing Committee. Activity 6: Defining the number of working groups and their operating rules. 10 de 10
