3 As in previous years, the number of members increased again in 2011 by six to a total of 82. Over the past seven years, the number of members has therefore risen by over 40%. What is pleasing to observe is the excellent mix between large international groups and around 50 Swiss companies. It has ultimately become apparent that all companies on the market are basically confronted with the same challenges in their dealings with legislators, authorities and the media. Added to this are the special concerns of importers and exporters with whom we deal in our daily work. An important novelty in 2012 is the Association's General Assembly which was brought forward from June to April. In view of the significance of the decisions adopted by the General Assembly, it was more practical to hold the Assembly in spring rather than in the middle of the year. This fact also explains why the is somewhat shorter. In effect, it only presents nine months of Association work. 4 Harmonisation of Swiss law One of our main tasks consists in avoiding technical trade obstacles from inhibiting the cross-border traffic of products. As Swiss regulations deviate from EU regulations, special packaging or formulations are required and they make products unnecessarily more expensive. Harmonising the domestic laws and implementing EU standards are therefore a very important task. Although we have managed to achieve significant improvements also thanks to support from the authorities there are still a number of issues that remain to be addressed. Dossiers 4

5 Chemicals law, REACH and GHS Throughout 2011, Swiss legislators seized the opportunity to drive forward the material harmonisation of the chemicals regulation and the chemicals risk-reduction regulation with EU regulations. However, comprehensive revisions of existing laws as well as a treaty with the EU would be required to fully harmonise Swiss law to the REACH Regulation. Both objectives cannot be achieved in the short term. We have already accomplished quite a lot for importers with regard to legislation and enforcement. We have harmonised the chemicals regulations with EU detergent legislation and the REACH and CLP Regulations (Regulation on Classification, Labelling, and Packaging of Substances and Mixtures) as much as possible. All GHSmarked products are already permitted for import. «The is a reliable partner for the FOE. We discuss problems openly and together we seek constructive solutions at an early stage.» Dr.phil. Andreas Weber, Section Leader in Waste, Substances, Biotechnology Department Industrial Chemicals Federal Office of the Environment The EU continues to consider Switzerland as a "Third Country". This results in Swiss exporters having to handle significantly greater administrative efforts in order to meet the requirements of the REACH and GHS/CLP Regulations and the EU biocide law. During the reporting year, various discussions have taken place with the respective Federal agencies (Federal Office for Public Health (FOPH), Federal Office for the Environment (FOE), and State Secretary for the Economy (SSE)) and this allowed us to present the interests of the Swiss producers. The Swiss Federal Council has granted a negotiation mandate to conclude a REACH agreement with the EU. After initial talks with the competent EU agencies, however, this option still seems to be politically remote. Swiss export firms will continue to be the butt of EU barriers which are reminiscent of protectionism, and they must expect to suffer disadvantages on the EU market. Dossiers 5

6 Cosmetics law Incentive tax on Volatile Organic Compounds «The intensity and diversity of contacts with the reflect the interests of the cosmetics and detergent industry in Switzerland and abroad. These contacts are effective and pragmatic in order to find the necessary solutions rapidly.» The Swiss Cosmetics Law is meant to harmonise with the new EU Cosmetics Directive by In the reporting year, various appendices and regulations on cosmetics products were adjusted to EU legislation. The complete revision of food safety legislation will also require adjustments at the level of the law. We commented extensively on the LMG revision draft. With importer interests in mind, we insisted that the decree should not deviate from EU legislation. We are involved in the revision work of the Federal Office for Public Health and continuously update all interested members about the most important steps. For Swiss producers, it will be important that the registration obligation foreseen by the EU Cosmetics Law can also be complied with in Switzerland. This will require a corresponding agreement with the EU. The revision will be limited to amending the exemption pursuant to Art. 9 of the Ordinance on the Incentive Tax on Volatile Organic Compounds (VOCV). In order to achieve tax exemption, manufacturers should insist on complying with "Best Practices" in addition to previous prerequisites. The lab area should also be able to benefit from tax exemption. This was not previously possible. Authorities will request audits from third companies. Any increase in the tax (CHF 3 per kg VOC until now) is currently not open to debate. However, any abolition of the tax as we advocated in addition to many companies would only be possible after a revision of the law. Since the elections will shortly take place, it will be unfortunately difficult to find politicians who will publicly advocate "less" environmental protection. 7 Swissness Template (Brand Protection and Coat of Arms Law) International integration The label "Switzerland" continues to be a driving force in advertising supporting the purchase of Swiss products and services. The Swissness Template should sustainably create the basis to secure and maintain added value for the "Switzerland" brand in the long term. To achieve this objective, there should be increased protection of the "Switzerland" indication of origin and of the Swiss Cross in Switzerland and, in view of legal enforcement, also abroad. We generally welcome the proposed legal formulation for the revision of the Brand Protection and Coat of Arms Laws ("Swissness"). It creates clarity for the use of the Swiss Cross on products. It specially supports the concerns of Swiss producers in protecting the "Made in Switzerland" label abroad. It is important that industry-specific interests, such as the origin of raw materials, and the definition of costs for R&D and commercialisation can be specified in individual industrial guidelines. Please refer to the section " Swissness workgroup" (page 9) for details on our activities on this issue. As full member of the European umbrella organisations A.I.S.E. (International Association for Soaps, Detergents and Maintenance Products) and Colipa (The European Cosmetics Association), we are very well networked at European and international levels. We co-operate particularly closely with the German Cosmetic, Toiletry, Perfumery and Detergent Association (IKW) and the Association of the Austrian Chemical Industry (FCIO). We discuss and coordinate topics ranging from legislation to communication and technical innovation. «As member of the "Swissness" workgroup, I experienced at close quarters how the Association works with a key topic dealing with Switzerland as an industrial location and the objectives which can be achieved. Formulating the Swissness Industry Ordinance is akin to pioneering work and has active support from other industrial associations and the Federal authorities in Berne. 8 Compliance with antitrust law Managing Board ee s For our members we provide a unique platform for the mutual exchange of information and experience in a neutral context. Any association and its members are extremely interested in adhering to the stringent anti-trust and competition laws. We therefore do not miss any occasion to point out the written " Compliance Rules" to participants and provide a copy at events. The Managing Board met on 25 May and on 16 November In addition to the usual statutory agenda items (finances, General Assembly preparations, elections), the main points of discussion included statistics and objectives. General Assembly The General Assembly took place on 23 June 2011 at the Restaurant Acqua in Zurich. In addition to the statutory agenda items, the elections for three outgoing members of the Managing Board took centre stage. The following members were newly elected to replace the retiring representatives of the various companies: Markus Reinhard, Colgate-Palmolive Markus Solinger, Diversey Thomas Früh, intracosmed The public part with invited guests was assumed by Dr. Phillipp Gut fr o m t h e weekly journal «Die Weltwoche» who presented a talk on the subject of «Media and Politics Who controls whom?» Meetings and events 8

9 Branded Product workgroup Swissness workgroup This workgroup comprises national and international cosmetics companies of various sizes. The group met on 10 May and 2 November It mainly focused on discussing the new elements in Swiss and European laws as well as technical issues and media topics ( statements and test system). The group additionally discussed sales statistics, various publications and the Brand and Product Index. Both events were well attended. It became evident that domestic and international companies face almost identical challenges in day to day business and have similar requests of their various industrial associations. Technical Commissions Experience Symposium An experience exchange between members of the Technical Commissions took place on 5 July 2011 at the Volkshaus in Zurich. The Cosmetics Technical Commission focused on topics such as various revisions to laws (Cosmetics Law, Chemicals Law, VOC), initial experience with the "Cassis de Dijon Principle, ingredients (ethanol, parabens, substances with endocrine disruptive properties), nanotechnology and issues relating to raw materials from Japan after the nuclear reactor accident. The Detergent Technical Commission also supplied information on legislative revisions (Chemicals Law) and issues concerning ingredients. The aim of the Swissness workgroup which started its work in 2010 is to formulate an industrial ordinance for the cosmetics industry to regulate the precise conditions for application of the «Swissmade» indication of origin or similar. The workgroup members were all in agreement from the outset that this ordinance should lay down stringent rules for production in Switzerland and compliance with Swiss quality standards. The occasion for this was afforded by the ongoing revision of the Brand and Coat of Arms Law which, among other things, will precisely regulate this issue at legislative level. The partly differing concerns of some industrial and retail trade sectors have practically brought parliamentary debate to a standstill. It is still completely open at present whether and when crucial key issues regarding export can be finally regulated; they are not covered by prevailing law. In numerous meetings in 2011, representatives of various companies worked on all the fundamentals of this industrial ordinance so that a suitable draft was finally submitted to the Swiss Federal Institute for Intellectual Property (IIP) at the end of the year. After discussions in January 2012 and the necessary corrections to the draft, the IIP will submit an application for approval to the Swiss Federal Council. We expect the industrial ordinance to come into force by the beginning of In essence, it will provide better protection for the «Switzerland» brand, especially in export countries. 10 Professional Hair Care workgroup (PHP AG) On 13 January 2011, a total of eleven companies from the Professional Hair Care sector decided to dissolve the previous LICOPHA association and join the. The meeting on 30 June 2011 discussed current issues from the fields of legislation, planned activities, projects relating to communication, market surveys and joint projects with coiffuresuisse. Professional Building Cleaning workgroup (AGR) The meetings of the Professional Hair Care workgroup (AGR) took place on 13 April and 26 October These focused on information regarding Federal and technical developments, the future of AGR statistics and questions regarding public procurement. 11 Meetings with Federal authorities REACH and GHS symposia The concerns of industry regarding various issues regarding legislature and execution were discussed and justified in a number of meetings with Swiss authorities such as the Federal Office of Public Heath (FOPH), the Federal Office for Environment (FOE) and the State Secretariat for Economic Affairs (SECO). During these meetings, we experienced that the Swiss authorities are more than willing to listen to industry concerns. They are highly co-operative and transparent and are committed to achieving tolerable general conditions wherever possible. Meetings with associations and NGOs The Managing Director of the attended a number of meetings with various «economiesuisse» workgroups, for example with regard to anti-trust law, the free trade agreement and consumer issues. In addition, informative meetings took place with industrial associations with similar interests, such as "scienceindustries" (chemicals, pharmaceuticals, biotechnology) and VSLF (lacquers and paints). There were also consultative meetings with consumer and environmental associations. On 9 November 2011, the organised a REACH/GHS information event in Zurich on the latest developments in the chemicals law in Switzerland and the EU. The event was attended by over 50 people. Presentation s were given by Dr. Christian Gründling, FCIO, on the "Developments in the EU Chemicals Law and the impacts of the CLP on cosmetic products". Olivier Depallens, FOPH, on the state of revision work on Swiss chemicals legislation. Dr. Andreas Weber, FOE, on the revision of the ORRChem. Dr. Paul Vesel, scienceindustries, on how to handle the extended Material Safety Data Sheet for downstream users. Since the EU treats Switzerland as a "Third Country" in these matters, this issue concerns both importers and exporters. In addition to the agenda items, the events provided participants with a welcome opportunity to exchange information on technical and regulatory issues and to represent the concerns of industry to the authorities. «The close co-operation between the and the IKW is beneficial to both sides. 12 Communication Media enquiries In 2011, the main enquiries we received from the media and other stakeholders referred in particular to trends, legislation and market figures. Statements We supply our members with useful statements intended as a response to critical enquiries from the media or third parties as a preventive measure. During the reporting year, we issued statements on the following topics: Nanotechnology in cosmetics. Hair straightening products containing prohibited concentrations of formaldehyde. Parabens in cosmetic products are safe. Cosmetic substances with supposedly endocrine disruptive effects. New warning label for hair dye products for young people. Publications After the brochures «Washing today», «Machine Dishwashing» and «Bleaching Agents what they are and what they do» were published, the Communication Department focused its attention on the topic of «Cosmetics». In collaboration with our technical consultants we produced a «Cosmetics brochure». The target group for this brochure includes end-consumers who are interested in receiving background information and tips on the subject of cosmetics. website We have now facelifted our website. Besides a new improved presentation, the website contains a fresh touch and news about subjects such as the Association, cosmetics and detergent products. What has changed compared to the previous website is that there is a greater visual distinction between the Cosmetics and Detergent sections. The page layout is user-friendly and is displayed in German, French and English. Of course we have retained the Extranet for our members. Crisis PR Crisis PR is applied in cases of critical media topics and places all members at the same level. This results is a joint communication position to the outside world. Background discussions During the reporting year, we familiarised NGOs with the interests of our industry regarding the following topics: Services Swissness Cosmetics/ Food Safety legislation revision "Laundry Sustainability Projects", "Charter for Sustainable Cleaning" "Fair Test System" initiative 12

13 Sustainability Our position The topic of sustainability is of major significance both in the cosmetics and the detergent industries. We consider sustainability as a symbiosis of business success, social justice and environmental protection. Any sustainability commitment is dependent on economic success. Only when a company enjoys such success can it meet these important obligations. Our members are well aware of their responsibilities and commit voluntarily to sustainable actions. The companies are themselves responsible for the project engineering, design and implementation of sustainability goals as well as the associated communication. «We are very grateful for the work done by to steer the sustainability agenda in Switzerland and promote these projects to the Swiss industry and the Swiss consumers.» Valérie Séjourné, Director Sustainability & Communications A.I.S.E. As an association, we promote the exchange of experience among members and support the sustainability goals of European umbrella organisations such as the A.I.S.E. "Charter for Sustainable Cleaning". We also inform consumers, environmental associations and businesses regarding projects and goals of the industry. We thus promote dialogue so that they too can contribute to sustainability. A.I.S.E. sustainability projects We support the A.I.S.E. sustainability projects. For the purposes of promoting the "Laundry Sustainability Project 2" and the "Laundry Sustainability Project for Heavy Duty Liquids", we published a press release for the Swiss media in August. We forwarded an A.I.S.E. publication, the "Charter for Sustainable Cleaning", to our members. We also presented the projects during talks with agencies and NGOs. Services 13

14 Notifications to our members We constantly inform our members regarding new technological and legislative developments at Swiss and European levels. The main topics in legislative notifications were the Swiss Cosmetics Law, the Swiss Chemicals Law, the Federal Law on Technical Trade Obstacles and the revision of the Ordinance on the Incentive Tax on Volatile Organic Compounds. Other general topics included nanotechnology, biocide products, Swissness and media enquiries. At international level, the main topics focused on information about REACH (Registration, Evaluation, Authorisation of Chemicals), GHS (Globally Harmonised System of Classification and Labelling of Chemicals), CLP ordinances (Regulation on Classification, Labelling and Packaging of Substances and Mixtures), the EU Cosmetics Directive and the EC Cosmetics Ordinance. 15 Information FCOS industry solution by ECO SWISS In addition to member enquiries, we receive diverse enquiries from around the world every day. Enquiries come from consumers, the media, companies, students, other associations and agencies. Since Swiss legislation continuously features particularities in its laws, we answer many direct enquiries from the head offices of foreign international companies since they no longer have their own departments to deal with legislation and technology in Switzerland. In short, we issued information on: ECO SWISS supports companies and associations in complying with legal stipulations for environmental protection, occupational safety and health protection. As members of the, manufacturers based in Switzerland can join the FCOS industry solution "Arbeitssicherheit und Gesundheitsschutz der chemikalienverarbeitenden KMU und Biotechfirmen" (Occupational safety and health safety in medium and small-size chemical processing companies and biotechnology firms). 20 Members We have achieved a strong increase in the number of members over recent years - from 59 in 2005 to 82 members in The reach of the organisation has now achieved over 90 percent. This high level of reach serves as an important argument in favour of association work, otherwise politics, public agencies, stakeholders and the media would not pay any serious attention.
