5 PhD thesis summary Abstract CHALLENGES OF A JURISDICTION WITH NO SOVEREIGNITY The Juridical Protection of the Antarctic Environment This thesis will analyze the juridical protection of the Antarctic environment as a case of jurisdictional exercise on a territory without sovereignty. It will try to probe that the solution means for controversies considered in the Antarctic Treatise System are inadequate to confront the juridical problems that could be produced in front of a potential ecological disaster in the Antarctic territory. It will support in Law by means of an international court with an exclusive competence for environmental matters, an international court with a character of permanent, autonomous and exclusive of that system. This court will be acting as an alternative mechanism that guaranties a due protection of the Antarctic environment. A court which resolutions are entailable, that practices jurisdiction over states and privates, being they part of the Antarctic Treatise system or not. In order to confirm the viability and justification of the proposed international court and its distinctive characteristics, the historical and juridical antecedents of such international subsystem will be analyzed, the documentation of the integrating organizations will be revised, as the international pertinent norms and the specialized studies about the subject.
