8 GENERAL INFORMATION ENGINEERING SERVICES Consult the Sales Engineering Department for other than standard designs. Custom design and detailing can be provided on a time and material basis. For more detailed information, individual data sheets are available for each standard model. Please request this data by model number from the Sales Engineering Department. PRICES Suggested list prices, payable in United States dollars, are F.C.A., Hemet, CA. Prices are subject to change without notice. Quotations are subject to final acceptance at the home office, Hemet, CA. Sales taxes and tariffs will be added where applicable. TERMS Open account, net/30 days on approved credit only. New accounts shall be C.O.D. or cash with order, please. DELIVERY/EXPEDITING Delivery of custom designs and specials are quoted by the Sales Engineering Department. Rush orders may be subject to an expediting fee. Check with the Sales Engineering Department. BACKCHARGES McCrometer will not approve or accept returns or backcharges for labor, materials or other costs incurred by the purchaser or others in modifying, adjusting, servicing or repairing the materials furnished by McCrometer unless such return or backcharges are in accordance with the McCrometer warranty. PROPRIETARY INFORMATION All information submitted by McCrometer is furnished for purchaser s consideration only and shall not be used by the purchaser nor disclosed to any third party without written consent of McCrometer. Charges will be made on delays, changes or additions to the scope of the work. McCrometer reserves the right to incorporate improvements or substitute materials equal or superior to that specified. SHIPPING INFORMATION WEIGHT Shipping weights are in pounds and are approximate. SPECIAL HANDLING When special handling is requested, an applicable handling fee will be added to your order. CLAIMS Damaged shipments or shortage claims should be made directly to the transportation company delivering your order. Shipments via Parcel Post or United Parcel Service that are lost or damaged should be referred to the shipper or branch where shipment originated. Inspect your order promptly for damage or shortage. Claims against McCrometer must be made within 15 days after receipt of shipments, as the factory cannot assume this liability after the time period has elapsed. RETURN GOODS Arrangements for returning merchandise for credit must be made before McCrometer can accept such goods or issue credit. Contact the factory explaining the reasons for returning any equipment and obtain a Return Authorization Number. Written instructions MUST accompany all returns. Overstocking Products returned in original, unopened container due to overordering are credited at 75% of the original invoice value. Freight charges are paid by the Buyer on any return shipment. All credits are subject to McCrometer inspection determining that there has been no damage or other alteration made to the product. Warranty Replacement All claims of defective quality are subject to test and examination at the McCrometer plant. Copies of McCrometer Warranty policy are available upon request and it is published in McCrometer product literature. Custom Designed Units A product manufactured in compliance with a specification required by the Buyer may not be returned for credit. Any product proven defective in workmanship or materials will be repaired. Advanced approval for return shipment must be obtained from McCrometer or the shipment will not be accepted. 7

9 WARRANTY Manufacturer warrants all products of its manufacture to be free from defects in workmanship and material under normal use and service. The warranty for the Mc Mag 3000 extends for a period of twenty-four (24) months after date of shipment, unless altered by mutual agreement between the purchaser and manufacturer prior to the shipment of the product. If this product is believed to be defective and is within its warranty period, purchaser shall notify the manufacturer, and will return the product to the manufacturer, postage paid, within twenty-four (24) months after date of shipment by the manufacturer. If the purchaser believes the return of the product to be impractical, manufacturer shall have the option, but will not be required, to inspect the product wherever located. In any event, if the purchaser requests the manufacturer visit their location, the purchaser agrees to pay the non-warranty expenses of travel, lodging and subsistence for the field service response. If the product is found by the manufacturer s inspection to be defective in workmanship or material, the defective part or parts will either be repaired or replaced, at manufacturer s election, free of charge, and if necessary the product will be returned to purchaser, transportation prepaid to any point in the United States. If inspection by the manufacturer of such product does not disclose any defect of workmanship or material, manufacturer s regular service repair charges will apply. Computing devices sold but not manufactured by McCrometer, Inc. are covered only by the original manufacturer s written warranty. Hence, this warranty statement does not apply. THE FOREGOING WARRANTY IS MANUFACTURER S SOLE WARRANTY, AND ALL OTHER WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE NEGATED AND EXCLUDED. THE FOREGOING WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, GUARANTEES, REPRESENTATIONS, OBLIGATIONS OR LIABILITIES ON THE PART OF THE MANUFACTURER. Purchaser s sole remedy and manufacturer s sole obligation for alleged product failure, whether under warranty claim or otherwise, shall be the aforestated obligation of manufacturer to repair or replace products returned within twenty-four months after date of original shipment. The manufacturer shall not be liable for, and the purchaser assumes and agrees to indemnify and save harmless the manufacturer in respect to, any loss or damage that may arise through the use by the purchaser of any of the manufacturer s products. BATTERY GUARANTEE: The Mc Mag3000 main power batteries will be replaced at no charge should they fail within 5 (five) years from the date of purchase with the meter. Guarantee is not valid for replacement batteries. Guarantee is limited to the a one-time replacement of the main power batteries. McCrometer is not responsible for any lost data or any other direct or indirect losses resulting therefrom. The batteries and their configuration are specific to the Mc Mag3000 flow meter and only McCrometer batteries can be used. Any use of batteries other than those supplied from McCrometer will void the above Warranty.
