2 INDIVIDUAL STATE LEGISLATION BACKGROUND - GEORGIA Source: National Conference of State Legislatures ( Kennesaw State University Student 2010 Board of Regents Inquiry found 501 (out of 310,000 total) undocumented students at USG institutions all paying out-of-state tuition Verifying Lawful Presence for tuition and enrollment purposes Verification of Lawful Presence-Each University System institution shall verify the lawful presence in the United States of every successfully admitted person applying for resident tuition status Admission of Persons Not Lawfully Present in the United States- A person who is not lawfully present in the United States shall not be eligible for admission to any University System institution which, for the two most recent academic years, did not admit all academically qualified applicants. BACKGROUND - TEXAS What is House Bill 1403 (passed by the 77th Texas Legislature in 2001)? House Bill 1403 granted certain non-immigrant students, including undocumented students, access to in-state tuition rates at Texas public institutions of higher education and state financial aid. To qualify, the bill required students to have: resided in Texas with a parent or guardian while attending high school in Texas, graduated from a public or private high school or received a GED in Texas, resided in Texas for the three years leading to graduation or receipt of a GED, and provided their institutions a signed affidavit indicating an intent to apply for permanent resident status as soon as able to do so. The bill passed and was codified as Texas Education Code (TEC) (j). 2

3 BACKGROUND - TEXAS What is Senate Bill 1528 (passed by the 79th Texas Legislature, Regular Session, in 2005)? Senate Bill 1528 amended the provisions of House Bill 1403 so that they applied to all individuals who had lived in Texas a significant part of their lives. Citizens, Permanent Residents and certain non-immigrant students could establish a claim to residency fol-lowing its provisions. To qualify, the individual must have: lived in Texas the 3 years leading up to high school graduation or the receipt of a GED; and resided in Texas the year prior to enrollment in an institution of higher education (which could overlap the 3-year period). In addition, if the student was not a U.S. Citizen or Permanent Resident, he/she had to file an affidavit with his/her institution, indicating an intent to apply for Permanent Resident status as soon as able to do so. 4 RETENTION On-Campus Services Cohort/Living Learning Communities Regent Scholars Program International student services Registration blocks Regional Prospective Student Centers TASFA renewals Budgeting Resources on campus Connecting with current student leaders and student groups Ex: Armstrong Atlantic State University DEFERRED ACTION FOR CHILDHOOD ARRIVALS (DACA) On June 15, 2012, President Barack Obama announced that, under a policy that s now called Deferred Action for Childhood Arrivals, the U.S. Department of Homeland Security (DHS) would no longer deport certain young undocumented people. DACA has two important parts: PART 1: Under DACA, DHS will not deport certain undocumented people and will give them temporary permission to stay in the United States. This temporary permission to stay in the U.S. is called deferred action. PART 2: People who are granted deferred action through DACA will be eligible for an EAD or work permit, meaning they can work legally in the U.S. In other words, they can work with papers. (NOTE: Though people often refer to the employment authorization document, or EAD, as a work permit, in this FAQ it will always be called EAD. ) As of now, each part of DACA the grant of deferred action and the EAD will be good for two years. At the end of the two-year period, DACA recipients can apply to renew deferred action and their EADs. DISCUSSION Please share challenges and/or ideas from your institution 4
