2 Terms and Conditions for event registrations Registrations Registrations for events close 24 hours prior to the event. Registrations after this time will be limited and cannot be guaranteed. Catering confirmation requirements and the printing of resources to support events require early notification of alterations. Any registrations received after the printing of support materials will be sent a copy of any relevant resources following the event. Software and hardware requirements for webinars Software Webinar events are hosted on the BlackBoard Collaborate platform. For a list of software requirements and supported browsers, please visit the Blackboard Collaborate support website. It is strongly recommended that webinar delegates registering to attend webinars test their system and software prior to the scheduled event. Testing your system in on a live webinar configuration room prior to the event, via the Blackboard Collaborate support website is highly recommended. Hardware In order to attend a live webinar event, the following hardware is required: PC or Apple computer Microphone with headphones set This will enable you to hear audio, and ask questions during the webinar. If you do not have a microphone, you will need to ask any questions in the chat panel. Keyboard and mouse or pointing device A stable ADSL or cable internet connection ADSL or higher internet connections are recommended for accessing live webinars. Lower internet speeds may produce an interrupted webinar experience. Refunds and cancellations The Queensland VET Development Centre (QVDC) reserves the right to cancel or change the date of a scheduled event to ensure minimum participation numbers are met. Where cancellation or change of a date for a scheduled event occurs, registered participants will be contacted directly and refund options outlined. Where services or products are faulty, have been wrongly described, or are different to the services or products advertised, registered delegates may request a full refund. If you wish to advise cancellation of your attendance, substitute delegates or request a refund, contact the QVDC by ing events.qvdc@dete.qld.gov.au. The QVDC will issue an acknowledgement of your when this request has been received. 3 (vi) (vii) The intent and reason for your cancellation, request to substitute delegate(s), or request for refund The name, position title and address of any substitute delegate, if applicable The QVDC has the following policies regarding refunds and cancellations. If you are unable to attend an event for which you have registered, you may be entitled to a refund, less any administration and processing fees. The provisions for refunds and cancellations for each event mode are listed below. Webinars The QVDC offers webinars that are costed to include only administration and processing fees. For this reason, no refunds will be offered for cancellation of participation in a webinar. Cancellation of participation in a webinar does not entitle transfer of payment to any other event or activity. Substitute delegates will be accepted when written notice is provided to the QVDC, a minimum of one (1) working day prior to the event. Substitute delegates must be advised by ing the QVDC at events.qvdc@dete.qld.gov.au, providing the booking reference and event details, as well as the substitute delegate s name and address. Packaged programs Packaged programs consist of more than one scheduled event, comprising a structured program. No refunds are available for cancellation of participation in any individual element(s) of a packaged program. Substitute delegates cannot be accepted for participation in packaged programs. The following cancellation and refund policy applies to a whole packaged program: When cancellation notification is received by the QVDC less than five (5) working days prior to the first event of the packaged program: o No refunds will be offered. When notification is received more than five (5) but less than ten (10) working days, prior to the first event of the packaged program: o Full refunds, less any administration and processing fees) may be requested. Where notification is received more than ten (10) working days, prior to the first event of the packaged program:
4 o Full refunds, less any administration and processing fees may be requested. Face to face workshops The following cancellation and refund policy applies to workshops: When cancellation notification is received by the QVDC less than five (5) working days prior to a workshop: o No refunds will be offered. When notification is received more than five (5) but less than ten (10) working days, prior to a workshop: o Full refunds, less any administration and processing fees may be requested. Where notification is received more than ten (10) working days, prior to a workshop: o Full refunds, less any administration and processing fees may be requested.
5 Extenuating circumstances Where there are extenuating circumstances for cancellation of participation in a workshop or packaged program, consideration may be given to provide a full refund less any processing and administration fees. Such circumstances may include for example, medical conditions or natural disasters. Third parties Registrations, other information collected by this form and transactions are carried out by SwiftDigital trading as Leapfrog Publishers, Pty Ltd ABN No: Visit SwiftDigital s privacy statement for more information. Personal information In registering for an event hosted by the Queensland VET Development Centre through this form, you acknowledge that you are transacting with this third party, SwiftDigital, and consent that your personal details provided to this third party at the time of registration can be stored for the purpose of event management and the provision of the service for which you have registered. This information includes but is not limited to: your name, phone number and address details about your organisation and your role billing details This information is collected for the purpose of registration and event management. Information about your organisation and your role is used to ensure that the professional learning programs offered by the QVDC are contextualised to the audiences that participate in its events. Payment is processed through a secure gateway and your account details are not retained. A record of your transaction date and whether this has been processed successfully, for the purpose of event management and tax invoices will be retained. Surveys and feedback If you register for an event, you will be sent an evaluation survey after the event date. This evaluation survey is optional. The information collected in this survey is designed to provide the QVDC with specific participant feedback relevant to the event, to allow us to improve the services we provide to the Vocational Education and Training sector. Mailing list It is optional for you to join the QVDC mailing list at the time of registration. You may also join this list through the QVDC website, This mailing list will be used to contact you regarding the QVDC events, news and publications, as well as relevant information in regards to Vocational Education and Training. You may unsubscribe at any time. Photographs and recording of events In agreeing to the terms and conditions for attending or presenting at an event, you grant consent for the QVDC to potentially use your name, image and video or audio recording for educational, marketing and promotional purposes, including use in print, digital marketing, and on the QVDC website The consent provided by you at the time of registration is as follows: I GIVE CONSENT
6 I grant consent to and license the Department of Education Training and Employment (the Department) and any other Department or Agency of the State of Queensland (the State) to use, record and disclose the Individual s: name, image and other identifying information (personal information); and copyright material, including image, video or sound recordings (Individual work), created in connection with the QVDC event. The Individual also irrevocably and unconditionally consents to the Individual being attributed or not attributed as the author of the Individual work in a form and manner acceptable to the Department or the State. *Note: If the Individual is under 18 years of age, this permission must be granted by a parent or guardian of the Individual. FOR THE PURPOSE OF This consent applies to the Department and the State using, including recording or disclosing, the Individual s personal information or Individual work, and permitting other persons to do so, for: FOR THE DURATION OF the purposes of distribution of recorded professional learning activities the purposes of public relations, promotion, advertising, media and commercial activities concerning the event, including via the Internet and Social Media Websites; and where the material is uploaded to a Social Media Website or other website, any purposes, commercial or otherwise, required by operators of the websites as a condition of uploading the personal information or Individual work; and transfer of the personal information outside of Australia in the course of the operation of the website. This consent will continue until the Individual revokes consent by providing written notification to the Department. Despite the above, if, at the time the Individual revokes consent, the Department, the State or another person permitted by them to do so is using the Individual s personal information or Individual work, or has entered into contractual obligations in relation to that material, the consent will continue in relation to that material until the use is complete or until the contractual obligations come to an end. The Individual acknowledges that where material is uploaded to a Social Media Website or other website: I UNDERSTAND THAT the use and the contractual obligations may be perpetual and irrevocable; and it may not be possible to ensure that all copies of the material are deleted or cease to be used, and the Department and the State will not be responsible for doing so. Project means the QVDC event. Use includes: to create, make copies of, reproduce, modify, adapt or retain in any form, including by camera, video, digital recorder, webcam, closed circuit television, mobile phone or any other device; and to distribute, publish or communicate in any form, including in newsletters and other print media, television and via the Internet and Social Media Websites, in whole or in part, and to permit other persons to do so. The Signatory or the Individual will not be paid for giving this Consent or the use of the Individual s personal information or Individual work.
7 This Consent is a legally binding and enforceable agreement between the Individual and the Department or the State. Nothing in this Consent limits the rights that the Department or the State reserve in relation to the use of the Individual s personal information or Individual work, copyright or other intellectual property under any other law. The Department and the State include the officers and employees of the Department and the State engaged in performing services for the Department and the State. Social Media Website includes any website operated by a third party which facilitates the uploading and sharing of user generated content, including social and professional networking websites, web forums, blogs and wikis. The definition includes (without limitation) the following websites currently operated by the Department: o Facebook: Department-of-Education-and-Training/ o YouTube: o Twitter: o LinkedIn: Development-Centre This consent only extends to the Social Media Websites specified in the Project Details section of this Consent Form. This consent extends to the Department and the State: o disclosing the Individual s personal information and Individual work to the Department s and the State s agents, contractors and volunteers for the purpose of performing services for the Department and the State; and o permitting those persons to use, record and disclose such material to the same extent as the Department and the State are entitled to deal with the Individual s personal information and Individual work. PROJECT DETAILS Name and description of the Project: Photography and video recording of face to face and webinar events hosted by the QVDC Description of image, copyright material or other personal information: Individual s name, image and audio Description of the purpose for which the personal information or Individual work is required, and the medium of reproduction (e.g., paper, electronic or other form). Will it be made, used, retained or reproduced, and will it be distributed, published or communicated to the public (e.g. on the Internet)? The distribution of video recordings of professional learning activities (events) for educational purposes Promotion of events hosted by the QVDC These works will be made, used, retained and reproduced
8 These works will be distributed, published and communicated, via newsletters, publicly on the QVDC website, and on the QVDC LinkedIn group. Description of the timeframe during which the Individual s name, image or Individual work is required: Three years Name of the departmental position/person responsible for the making, usage, storage, reproduction, distribution, publication or communication of the Individual s personal information or Individual work: Senior Project Officer, Innovation for Learning, Queensland VET Development Centre. events.qvdc@dete.qld.gov.au Name that should be used in association with the Individual or the Individual s image or Individual work: Full name Please note, the Individual s name will only be evident on publication if he/she: o o self identifies by voice/audio in a filmed recording of an event, or; self identifies by using his/her name when logging into a webinar. Will the Individual s personal information or Individual work be published on a Social Media Website (i.e. permanently published to the public)? Yes If yes, which of the Department s Social Media Websites will the Individual s personal information or Individual work be published on: The QVDC LinkedIn group The QVDC LinkedIn group is a publicly accessible by all Internet users who apply to be a group member. The Department may share information, photographs and videos related to the Department s programs, activities and initiatives (including the Project) with users through its LinkedIn Group. Details Your name, address and organisation is supplied at the time of registration. In registering for events hosted by the QVDC you provide the above consent. FURTHER INFORMATION What is this consent for? This Consent authorises the Department and the State to use the Individual s personal information and copyright material, together with information about the Individual s participation in Departmental and State initiatives, for the purposes specified in the Project details. This consent covers the entire or partial use of the Individual s personal information and copyright material in conjunction with other words and images. For example, the Individual s personal information and copyright material may appear in
9 school or TAFE newsletters, magazines, websites (including Social Media Websites) and other school, TAFE, departmental or State publications, as well as in television advertising, videos, brochures, forms, public relations displays, annual reports, press advertising, internal documents such as manuals, websites, certificates and strategic plans, and posters and other promotional material. There may also be occasions on which the Department may approve the media, such as local newspapers and television stations, using information and copyright material in relation to the Individual (for example, where the Individual is involved in dramatic or musical performances, sporting activities or award ceremonies). Social Media Websites Individuals should be aware that publication of their personal information and Individual work on Social Media Websites is similar to publication in newsletters, magazines, brochures, etc; however publication on Social Media Websites effectively constitutes publication of that material to the world at large. Further, Individuals should be aware that the publication of an Individual s personal information and Individual work, by the Department or the State, on a Social Media Website typically constitutes a permanent and publicly available record of that material. This means that third parties may be able to copy and use an Individual s personal information and Individual work that has been published on a Social Media Website for any purpose and without the consent or knowledge of the Department, the State or the Individual. Individuals should not grant their consent to the Department or the State to use the Individual s personal information or Individual work in connection with a Social Media Website if the Individual does not agree to the material being permanently available to the public. If an Individual s personal information or Individual work is published on a Social Media Website, then that material will be governed by the privacy policy and terms of use of the relevant Social Media Website. The Department or State cannot reasonably control how an Individual s personal information or Individual work is used by third parties once the material has been published on a Social Media Website. What is copyright material? An Individual s copyright material may include written work (e.g. stories and poems), paintings, pictures, drawings, designs, photographs, videos, films, music, performance, recordings, computer programs, websites, sculptures, fashion, metal- or wood-works made by them or to which they contributed. In the case of students, it includes, but is not limited to, work that they create in the course of their studies during the time they are enrolled at a State school. These materials may form part of their academic assessment or be part of their studies generally and may attract copyright. The Department understands that students and volunteers generally own the intellectual property rights in the material they create and that this Consent is not meant to transfer the Individual s ownership of the intellectual property in their copyright material. This Consent does not provide for copyright consent in relation to copyright works an Individual creates in the course of employment (whether or not the material is created in normal work hours or using departmental facilities or equipment). Where copyright material is created by a State employee while performing their duties under the terms of their employment, the copyright is owned by the State as the employer (section 35 Copyright Act 1968). There are limited exceptions to this including, for example, where the copyright material is created by an employee pursuant to a prior agreement with the employer. Generally, the deciding factor is whether the employee is performing their official duties. In addition, section 176 of the Copyright Act 1968 applies where the work was created by or under the direction or control of the State. However, moral rights may still apply to copyright material created by an employee. The Queensland Public Sector Intellectual Property Guidelines provide further information on intellectual property. If as an employee you have any further queries about the ownership of the intellectual property in respect of the works
10 you create you should contact the Legal and Administrative Law Branch. What is personal information? Personal information includes information or opinions, whether true or not, about an individual whose identity is apparent or can reasonably be ascertained from the information or opinion. This includes the Individual s name, recording or image. It also includes the Individual s educational information such as the Individual's assessment and results, and health information and court orders provided to the Department, where such information may enable the Individual to be identified. What if I give my consent and later change my mind? The consent will be in effect until withdrawn. The consent can be modified or withdrawn at any time by writing to the Department. However, any changes will apply only from the date that the Department receives any consent withdrawal. Any existing material will not be withdrawn from use if the Department or the State is currently using the material or where the Department or the State has entered into contractual obligations in relation to this material. In such cases the withdrawal will be effective after the Department or the State s use is complete or after the contractual obligations come to an end. Where the Department or another person uploads material to a Social Media Website or other website, it may need to accept contractual obligations that are perpetual and irrevocable. It may not be possible to ensure that all copies of the material are deleted or cease to be used, and the Department and the State cannot take responsibility for doing so. Privacy The consent to the recording, use and disclosure of the Individual s personal information and Individual work is required in accordance with the Copyright Act 1968 (Cth), the Education (General Provisions) Act 2006 and the Information Privacy Act Personal information will be stored securely. The Department will only disclose the Individual s personal information in accordance with the consent, except where authorised or required by law. If you wish to access or correct any of the personal information on this form or discuss how it has been dealt with, or if you have a concern or complaint about the way the Individual s personal information has been collected, used, stored or disclosed, please contact the relevant organisation.
