Bose, Secretary Federal Energy Regulatory Commission 888 First Street, NE Washington, DC Re: Southeast Supply Header, LLC, Docket No. RP Dear Ms. Bose: Pursuant to Section 4 of the Natural Gas Act 1 and Section of the regulations of the Federal Energy Regulatory Commission ( Commission ) promulgated thereunder, 2 Southeast Supply Header, LLC ( SESH ) submits herewith for filing as part of its FERC Gas Tariff, First Revised Volume No. 1 ( Tariff ) the tariff record listed in Appendix A to be effective on September 1, For the reasons stated below, SESH requests that the Commission grant the necessary waivers described herein and accept this tariff record as filed and without condition to be effective on September 1, STATEMENT OF NATURE, REASONS AND BASIS On August 14, 2014, the Commission issued SESH an Order Issuing Certificate in Docket No. CP14-87 ( August 14 Order ) 3 which authorized, among other things, SESH to increase the design capacity of the SESH mainline system between Delhi, Louisiana, and Coden, Alabama. Ordering Paragraph (F) of the August 14 Order directed SESH to file a tariff record proposing an incremental fuel percentage that would apply to Rate Schedule FTS shippers that contract for the additional capacity approved in the order. On September 11, 2014 ( September 11 Filing ), SESH filed with the Commission a tariff record reflecting SESH s proposed initial incremental fuel percentage, which also included a footnote indicating the specific contract number(s), including maximum daily quantities, to which the incremental fuel percentage would apply. At the time of the September 11 Filing, SESH had only one service agreement that would be subject to the incremental fuel percentage. The Commission accepted the tariff record to be effective on October 1, 2014, as requested. 4 On October 29, 2014 ( October 29 Filing ), SESH filed with the Commission a tariff record to update the footnote to include South Mississippi Electric Power Association s ( SMEPA ) executed Rate Schedule FTS service agreement, Contract No , for service utilizing a portion of the additional capacity between Delhi, Louisiana and Coden, Alabama. Bose, Secretary Federal Energy Regulatory Commission August 31, 2015 Page 2 SMEPA became effective on November 1, The Commission accepted the tariff record to be effective on November 1, 2014, as requested. 5 On August 31, 2015, SESH awarded an additional 10,000 dekatherms of available capacity to SMEPA. To subscribe the newly awarded capacity, SMEPA s currently effective FTS service agreement (Contract No ) was amended, effective September 1, 2015, to include the additional capacity. Pursuant to the August 14 Order, the incremental fuel percentage effective on October 1, 2014, applies to the newly subscribed SMEPA capacity. Accordingly, SESH is filing the tariff record enclosed herewith solely to update the footnote approved in the October 29 Filing to include the updated SMEPA contract quantity. PROPOSED EFFECTIVE DATE Firm transportation service under the SMEPA service agreement will commence on September 1, Accordingly, SESH proposes that the tariff record filed herein become effective on September 1, SESH respectfully requests waiver of Section of the Commission s regulations, 18 C.F.R , and any other waivers that may be required for the Commission to accept the tariff record filed herein to become effective on September 1, IMPLEMENTATION Pursuant to Section 157.7(a)(9) of the Commission s regulation, 18 C.F.R (a)(9), SESH files this motion to place the tariff record filed herein into effect at the expiration of any suspension period set by the Commission, provided that the tariff record is approved as filed and without condition. In the event the tariff record filed herewith is not approved as filed and without condition, SESH reserves the right to file a later motion to place such tariff record into effect.
