Samuel Mirra Criminal Sufficiency of the Evidence Disorderly Conduct In a challenge to the sufficiency of the evidence, the Court review the evidence, presented in a light most favorable to the Commonwealth, and determine whether a fact finder could conclude that every element of the offense was proven beyond a reasonable doubt. A person is guilty of disorderly conduct if, with intent to cause public inconvenience, annoyance or alarm, or recklessly creating a risk thereof, he: (1) engages in fighting or threatening, or in violent or tumultuous behavior; (2) makes unreasonable noise; (3) uses obscene language, or makes an obscene gesture; or, (4) creates a hazardous or physically offensive condition by any act which serves no legitimate purpose of the actor. A disorderly conduct offense is a misdemeanor of the third degree if the intent of the actor was to cause substantial harm or serious inconvenience, or if he persists in disorderly conduct after reasonable warning or request to desist. Otherwise, it is a summary offense. The Court held: Appellant was convicted of summary disorderly conduct only; therefore, the Commonwealth was not required to prove substantial harm or serious inconvenience, and therefore, there was no merit to the appeal on such basis. Evidence was sufficient for Court to find Appellant guilty of disorderly conduct as a summary offense where defendant was combative with police as they attempted to secure him, was shaking the police van from side to side while the van was driving on public streets, and directed offensive language towards officer during course of investigation. Initially it must be noted that Defendant s disorderly conduct convictions were summary offenses. Neither was a misdemeanor conviction. During the jury trial, the court heard two strikingly different theories involving the sequence of events that occurred that brought this case to court. The prosecution s theory was that on May 23, 2011, Officer Daniel Fynes of the Darby Township Police Department pulled over a Ford pickup truck bearing the registration YVT6595, in the area of Bartram and Ashland Avenues. N.T 2/15/12; pp Officer Fynes testified that the reason for the stop was that the Defendant, Samuel Mirra, was driving on a suspended license. Id. at 44. The Defendant s son was a front seat passenger. Id. at Upon exiting the vehicle, Officer Fynes informed the Defendant that he was driving on a suspended license and that he was going to be arrested and taken to the police station. Id. at 54. At this point, Officer Fynes testified that the Defendant either fell or fainted and struck his head on the curb. Id. at Officer Fynes then radioed in the situation to other officers, who arrived at the scene within minutes. Officer Fynes testified that when he went over to the Defendant on the ground and put his hand on him to assist him, the Defendant started punching and kicking him. Id. at Even after other officers arrived at the scene and the Defendant was handcuffed, Officer Fynes testified that he was still being combative while handcuffed. Id. at 135. Officer Carter, a Collingdale Borough Police Officer, testified that he arrived at the scene a few minutes after he received the radio call requesting assistance from Officer Fynes. Id. at He testified that he attempted to subdue the Defendant, who was resisting his efforts. Id. at 156. It was noted that it took several minutes to get the Defendant handcuffed. Id. at 157. Officer Carter, who was in the police van that was taking the Defendant into custody, testified that the Defendant was agitated and shaking the van from side to side while being transported. He informed other officers that the Defendant was being combative. Id. at 160. After arriving at the Darby Township Police Department, the Defendant was escorted to the holding cells and the paramedics were called. Id. at 162. Corporal Lerro of the Folcroft Police Department corroborated Officer Carter s testimony describing the scene of the incident. N.T. 2/16/12; pp He testified that the Defendant was flailing around on the ground while police were trying to subdue him and stop him from struggling. Id. at Officer Lerro told the court that he, along with Officer Carter, drove the Defendant to the Darby Township Police Department. Id. at 22. The Defense offered a far different course of events. The Defendant, Samuel Mirra, testified that when Officer Fynes asked him to step out of the vehicle, he gave an excuse as to why he was driving on a suspended license. The Defendant says that the officer told him to shut the F up. Id. at 90. The Defendant testified that he said to the officer that he didn t know who the F he (the officer) was talking to and that he (Samuel Mirra) was not the officer s wife. At this point, he testified that the officer punched him in the face, causing him to fall into the truck and then onto the ground. Id. at 91. This testimony was somewhat corroborated by the testimony of Mirra s son, Nicholas. Nicholas testified that he felt something hit the truck, and when he turned around to look, he saw the police officer but not his father. Id. at 73. Finally, testimony was heard from Russell Karten, M.D. Dr. Karten reviewed Samuel Mirra s medical records from Mercy Fitzgerald Hospital from May 23, 2011 through May 27, N.T. 2/16/12; p.17. He testified that the injuries were con- 84
85 DELAWARE COUNTY REPORTS (2012).] Com. of PA v. Mirra sistent with blunt force trauma. Id. at 59. He further testified that it was unlikely that the injuries were caused by a fall on the curb, but were consistent with being punched and/or kicked. Id. at 34-35, 59. On February 16, 2012, the jury returned a verdict of not guilty on Aggravated Assault and Resisting Arrest. However, the court found the Defendant guilty of the three remaining summary violations; two disorderly conduct charges and a driving on the suspended license charge, DUI related. Id. at 198. The Defendant filed a timely notice of appeal on April 26, The 1925(b) Statement of Matters Complained of on Appeal was filed on May 17, In that document, the Defendant raises two issues: 1) Whether the court erred in convicting the Defendant of misdemeanor and summary disorderly conduct charges because the defendant lacked the requisite intent to commit the crimes; and 2) whether the court erred in convicting the Defendant of misdemeanor and summary disorderly conduct charges because the Defendant did not engage in conduct that was a substantial harm to the public. Because the Defendant is claiming that an element of the crime of disorderly conduct is not met, the court is treating this as an appeal challenging the sufficiency of the evidence. A challenge to the sufficiency of the evidence, if granted, would preclude retrial under double jeopardy provisions of the Fifth Amendment of the United States Constitution and Article I, Section 10 of the Pennsylvania Constitution. Commonwealth v. Widmer, 560 Pa. 308, 744 A.2d 745, 751 (2000) citing Tibbs v. Florida, 457 U.S. 31, 102 S.Ct. 2211, 72 L.Ed.2d 652 (1982); Commonwealth v. Vogel, 501 Pa. 314, 461 A.2d 604 (1983). A challenge to the sufficiency of the evidence is a question of law. The Court must determine whether the evidence was sufficient to permit the fact-finder to conclude that each and every element of the offense charged was proven beyond a reasonable doubt. Commonwealth v. Kaufman, 849 A.2d 1258, 1259 (Pa.Super.2004); See also Widmer at 751. Where the evidence offered to support the verdict is in contradiction to the physical facts, in contravention to human experience and the laws of nature, then the evidence is insufficient as a matter of law. Widmer at 319, citing Commonwealth v. Karkaria, 533 Pa. 412, 625 A.2d 116 (1993). When considering a challenge to the sufficiency of the evidence, the reviewing court must review the evidence presented in a light most favorable to the Commonwealth (the verdict winner), and draw all reasonable inferences therefrom. Commonwealth v. Kaufman, 849 A.2d 1258, 1259 (Pa.Super.2004). The fact-finder, when evaluating the credibility and weight of the evidence, is free to believe all, part, or none of the evidence. The reviewing court may not re-weigh the evidence or substitute its judgment for that of the fact-finder. Commonwealth v. Stevenson, 894 A.2d 759, 774 (Pa.Super.2006). A person is guilty of disorderly conduct if, with intent to cause public inconvenience, annoyance or alarm, or recklessly creating a risk thereof, he: (1) Engages in fighting or threatening, or in violent or tumultuous behavior; (2) Makes unreasonable noise; (3) Uses obscene language, or makes an obscene gesture; or (4) Creates a hazardous or physically offensive condition by any act which serves no legitimate purpose of the actor. 18. Pa.C.S.A. 5503(a). In this case, the court convicted the Defendant under 18. Pa.C.S.A. 5503(a)(1) and 18. Pa.C.S.A. 5503(a)(4). 85
86 132 DELAWARE COUNTY REPORTS Com. of PA v. Mirra [100 Del. The court can dispose of the Defendant s second challenge immediately. A disorderly conduct offense is a misdemeanor of the third degree if the intent of the actor is to cause substantial harm or serious inconvenience, or if he persists in disorderly conduct after reasonable warning or request to desist. Otherwise disorderly conduct is a summary offense. 18 Pa.C.S.A. 5503(b). The defense argues that the Commonwealth is required to prove that the Defendant intended to cause substantial harm to the public or serious public inconvenience. This is an incorrect reading of the law. As previously stated, Samuel Mirra was convicted on two summary disorderly conduct charges. He was not convicted of misdemeanor disorderly conduct. Because these charges were graded as summary offenses, the public harm and/or inconvenience that is caused does not have to be deemed substantial. The Defendant is contesting a ruling that the court did not make. As such, his second challenge fails. The first challenge is whether the Defendant possessed the requisite intent necessary to commit a disorderly conduct. Again, the defense incorrectly states the law. It must be noted that, in accordance with the statute, disorderly conduct can be proven through intentional or reckless actions. Specific intent is not required. See 18. Pa.C.S.A (A person is guilty of disorderly conduct if, with intent to cause public inconvenience, annoyance or alarm, or recklessly creating a risk thereof ) Viewing the evidence in the light most favorable to the Commonwealth, the court believes that the following actions satisfy the reckless state of mind required under the statute: The Defendant, by his own admission, addressed the officer by telling him that he did not know who the F he was talking to. He also told the officer not to speak to him the same way the officer speaks to his wife. The Defendant, after being arrested, and regardless of whether he was punched or whether he fainted, was combative with police as they attempted to secure him. Several officers testified that it took several minutes to subdue the Defendant, who was flailing around on a public street. Further, Officer Carter and Corporal Lerro testified that while transporting the Defendant to the Darby Township Police Department in a police van, the Defendant was shaking the van from side to side at a time that the van was driving on public streets. This evidence is sufficient to show that the Defendant recklessly created a public inconvenience, annoyance or alarm through violent or tumultuous behavior, satisfying 5503(a)(1). It is also sufficient to show that the Defendant recklessly created a public inconvenience, annoyance or alarm through creating a hazardous or physically offensive condition by any act which serves no legitimate purpose of the actor, satisfying 5503(a)(4). The Defendant s actions in using offensive language towards Officer Fynes and speaking about Officer Fynes wife in a negative manner, combined with the combative actions he took flailing around on the ground while the police officers were attempting to secure him and the actions he took attempting to shake the van while it was transporting him to the police department all support the court s decision to find the Defendant guilty of committing two counts of disorderly conduct.
