9 Using this Guide Using this Guide This guide is intended for all TrueFiling users. Details are presented on how to initiate a case and how to create and submit a filing to the Court, including servicing and payment options. In addition, the processes required to request and accept an invitation to join your firm s TrueFiling Law Firm site are provided. How filers use TrueFiling is controlled by each court. Specifically, the Court determines how you ll initiate a case as well as the bundle method you ll use to create, manage, and submit filings to the Court. A bundle is the TrueFiling mechanism used to group related filings and submit them to the Court. A Legacy bundle uses a wizard to create a filing and assign it to a new or existing bundle. Each filing, although contained in a bundle, possesses their own properties such as filing attorney and servicing specifications. A Streamlined bundle is bundle-based; that is, the bundle is created first, and filings are subsequently added to it. In this bundle, properties such as filing attorney and servicing specifications are assigned to the entire bundle and are applied to all filings within it. In addition, when the bundle is submitted, and if e-servicing is specified, a single, combined Proof of Service is generated for each filing in the bundle and delivered to the Clerk upon submission. Each service recipient specified is served all the filings in the bundle. Because there are considerable differences between these two bundle types and their respective user interfaces, each type is presented separately in this guide. See Case Filings >> Legacy and Case Filings >> Streamlined. This guide presents the following information in this order: Introductory information enrolling and logging in to TrueFiling, contacting the courts, and searching for a case Initiating a case and creating / submitting filings for a Legacy bundle, includes the user interfaces specific for this bundle Initiation a case and creating / submitting filings for a Streamlined bundle, includes the user interfaces specific for this bundle Common functionality managing your TrueFiling settings, specifying firm and case contacts, attorneys, and self-represented filers, and managing payment accounts Be aware that the screen images presented in this guide reflect one court s configuration. As a result, some differences may exist between the images shown here and those you ll see when using TrueFiling. 10 What is TrueFiling? What is TrueFiling? TrueFiling is a web-based e-filing and e-service solution for law firms and pro per filers. It provides an easy to use web interface for filers to electronically initiate a case as well as file documents for an existing case from an Internet connected computer instead of filing paper copies at the Clerk s office. The TrueFiling system also enables the Court to electronically approve, route, and take action on case initiating requests and filings such as signing proposed orders or summons. TrueFiling provides a completely paperless solution from case initiation to filing submission to electronic case file management at the Clerk s office and all the processes in between. A typical filing process in TrueFiling includes: 1. The filer - an attorney, paralegal staff member, or self-represented person - prepares one or more documents to file to the Court using a word processor, such as Microsoft Word or Adobe Acrobat. 2. The filer uploads one or more filings contained in a bundle, specifying the appropriate filing document type and servicing method. 3. The filer selects their payment method and submits the bundle to the Court for the Clerk to review. 4. For each filing marked for e-servicing in the submitted bundle, the selected service recipients will be served. If required by the Court, a Proof of Service will be automatically generated and submitted to the Court. NOTE: A Streamlined bundle will generate one collective Proof of Service for all filings in the bundle. 5. The Clerk will review the incoming filings and generated Proof of Service(s) and will reject or tentatively accept each filing based on Court rules. If the Clerk tentatively accepts the filing / bundle, the credit card supplied at submission will be charged the appropriate Statutory and any Convenience Fees. If the Clerk rejects the filing / bundle or payment was declined, the filer will be notified through the TrueFiling user interface and optionally ed a reject notification. If payment is approved, the Clerk will electronically stamp the filing and update the Register of Actions for the case accordingly. 6. The filer will be notified through the TrueFiling user interface and optionally ed a filed notification when the Court has filed the filing. Setting up a TrueFiling firm and establishing an administrator involves a simple registration process. New users will request and subsequently accept an invitation from the administrator to join. The TrueFiling Administrator Guide contains detailed information on how to set up a TrueFiling Law Firm site and issue invitations to users ImageSoft, Inc. 2

11 Getting Started Getting Started TrueFiling enables each member of a law firm to share access to case information, filings, and payment information. One or more TrueFiling administrators are established for the firm and are responsible for maintaining the firm s TrueFiling site. A self-represented filer can be added to a law firm s site. They can also create their own TrueFiling site through which they can file and e-serve documents. The filer will be the site s administrator. Only the firm s TrueFiling administrator can invite other users to join. Other members of the law firm should contact their TrueFiling administrator for an invitation to join. The TrueFiling Administrator Guide contains additional information on setting up the site and inviting users to join. TIP: TrueFiling is best viewed using a minimum 1024 x 768 screen resolution. Enrolling in TrueFiling To determine if your firm already has a TrueFiling site and a TrueFiling administrator: 1. Use any modern Internet browser to navigate to The Account Logon page is displayed. 2. Click Sign Up in the upper-right corner of the page ImageSoft, Inc. 3

12 Getting Started The Welcome page, which lists the options available for determining if your firm has a TrueFiling account, is displayed. Please read all three options carefully before making a choice. If your firm is currently enrolled (Option 1), contact your firm administrator and request an invitation to join TrueFiling. Choose Option 2 only if you are certain no one from your firm has ever signed up for TrueFiling. See the TrueFiling Administrator Guide for details on how to enroll your firm. Choose Option 3 (not sure) to locate your administrator and request an invitation. Details on how to use Option 3 are presented below. Searching for your Firm s Administrator Option 3 provides instructions on how to proceed if you are unsure if your firm is already enrolled. 1. Click the click here link (circled in the above image) to launch the Firm Lookup page. Use this page to search for your firm s site in TrueFiling ImageSoft, Inc. 4

13 Getting Started 2. Input your Address in the Username field. 3. Type the characters shown in the image into the Captcha field. You can click New Captcha to display a different image, if needed. 4. Click Lookup. The Search Firm Confirmation page is displayed. This page confirms that you successfully searched for your firm s administrator and states that an message containing a link to the search results will be sent to the address you provided. You will receive the within 10 minutes. NOTE: Based on your provider, the may be directed to your spam or junk folder. Check your spam filtering rules and verify the truefilingadmin@truefiling.com is on your whitelist. 5. Click OK to close the Search Firm Confirmation page. NOTE: In the above process, TrueFiling just sends an to the selected administrator for your firm. The administrator must invite you to join the firm s TrueFiling site before you can join or log in. This administrative process, Inviting Login Users, is detailed in the TrueFiling Administrator Guide. Accepting an Invitation to Join a TrueFiling Firm TrueFiling requires all invited users to confirm the invitation request. When a TrueFiling administrator invites a user to join the firm, TrueFiling automatically sends an message to the invited user that contains a confirmation link and a temporary password. You must perform the following to complete the TrueFiling registration process. 1. Contact your TrueFiling administrator and ask to be invited to the firm. You may have already requested an invitation on the Firm Lookup page. Only a TrueFiling administrator can invite you to join a TrueFiling firm. The invitation will be sent to you in an message. NOTE: Based on your provider, the may be directed to your spam or junk folder. Check your spam filtering rules and verify the truefilingadmin@truefiling.com is on your whitelist ImageSoft, Inc. 7

16 Getting Started 2. Check your for the invitation and open it. It will resemble: The invitation is valid for seven days. If you do not respond to the invitation, after seven days you ll need to request another invitation from your firm administrator. 3. Click this link in the message. The Invitation Confirmation page is displayed in your default browser. The Invitation Code field is auto-populated with a system-generated code. 4. Verify the Username is your address. 5. Input the temporary password contained in the invitation in the Password field. NOTE: If the administrator resends an invitation, any prior confirmation links will be invalidated. Thus, every re-invitation request will generate a new temporary password. 6. Click Confirm Registration ImageSoft, Inc. 8

17 Getting Started The TrueFiling User Agreement is displayed. You can t log on to TrueFiling until you accept the terms of the user agreement. 7. Select I accept the terms in the License Agreement. 8. Click OK. You are automatically logged on to your firm s TrueFiling site. The Password Change page is displayed. 18 Logging on to TrueFiling Logging on to TrueFiling As with many web-based applications, TrueFiling requires all users to log on using a user name and password. Your TrueFiling user name is the address you provided during the registration process. To log on to TrueFiling: 1. Using any modern Internet browser, navigate to The Account Logon page is displayed. 2. Input the address you used during registration as your Username. 3. Input your password for Password. If you have forgotten your password, please see Password Change / Reset >> Reset Password Account Logon Page. TIP: TrueFiling passwords are case sensitive. Thus, uppercase A is not the same as lowercase a. 4. Click Logon ImageSoft, Inc. 10

19 Logging on to TrueFiling Invalid Login Attempt If you don t provide the correct password when you log in, TrueFiling will send an to the address you entered. This will contain a link you ll use to reset your password. The message will resemble: 1. Click the link in the . The Reset Password Verification dialog is displayed. The Username field is auto-populated with your address and is read-only. NOTE: If more than 24 hours have passed since you received the , you must request a reset through the TrueFiling Account Logon page. Refer to Password Reset Account Logon Page in the next section. 2. Enter your New Password. 3. Re-enter your password in the Re-type Password field. 4. Click Update Password. Once your username / password are authenticated, you are automatically logged on to TrueFiling ImageSoft, Inc. 11

20 Logging on to TrueFiling Password Change / Reset Within TrueFiling you can use one of these methods to modify your password. Contact your TrueFiling administrator to reset the password. Change your password from within TrueFiling. See Settings >> My Settings >> Changing your Password later in this guide. Request a TrueFiling password reset on the Account Logon page, which is detailed in the following section. Reset Password Account Logon Page If you ve forgotten your password, you can request a password reset from the Account Logon page: 1. Click the reset password link on the Account Logon page ImageSoft, Inc. 12

You can click New Captcha to display a new image, if needed. 4. Click Reset Password. The Password Reset Request Confirmation page is displayed. 5. Click OK to leave this page. NOTE: Within ten minutes you will receive an that contains a verification link you ll use to reset your password ImageSoft, Inc. 13

23 Logging on to TrueFiling Once your username / password are authenticated, you are automatically logged on to TrueFiling. Trouble with Password Reset? If the Password Reset Request - Confirmation page doesn t displayed, or you don t receive an , one of the following may have occurred. Wrong Verify the you used during your registration process is the same one you used to reset your password. If you re sure the address is the same, and you have waited more than ten minutes, contact TrueFiling support at support@truefiling.com. Blocked by Spam Filters Based on your provider, the containing the password reset link may have been directed to your spam or junk folder. Check your spam filtering rules and verify the truefilingadmin@truefiling.com is on your whitelist. Captcha Expired A Captcha Expired message is displayed (in red text) if you took too long to enter your address and/or the Captcha. For security purposes, the Captcha must be used within a short time span. Click New Captcha and try again ImageSoft, Inc. 15

24 Logging on to TrueFiling Captcha Invalid If you typed the Captcha incorrectly, a notification message indicating the Captcha entered was invalid is displayed (in red text) on the page. Captchas are used to prevent misuse of the reset password by hackers and can be hard to read. Click New Captcha and type the new characters displayed ImageSoft, Inc. 16

25 Viewing the Courts TrueFiling Supports Viewing the Courts TrueFiling Supports To access a list of the courts TrueFiling supports: 1. Launch TrueFiling. The Account Logon page is displayed. 2. Click the View Available TrueFiling Courts icon. A page is displayed that lists all courts supported by TrueFiling. Courts are organized by state, and the Court s contact information is listed. 3. Scroll down the page to view all courts. 4. Click OK to close the page ImageSoft, Inc. 17

26 Communication with the Court Communication with the Court The Court can send court-related messages through TrueFiling. Messages will vary but can include updates regarding new e-filing case types, upcoming special hours of operation, or links to online information, for example. Messages are accessed on the Court Information page, which is organized based on courts you ve identified as Favorites (see Favorites later in the guide). Once you ve read a message and acknowledged it, TrueFiling will store the message so you can access at a later date. 1. Select Resources >> Court Information in the navigation pane to access the Court Information page. NOTE: The number of unread Court messages is listed in parenthesized red text beside the Court Information link in the navigation page ImageSoft, Inc. 18

27 Communication with the Court The Court Information page is displayed: Unread messages are displayed beneath the Court identifier heading. 2. Once you ve read a message, click Don t show this message again to indicate to TrueFiling that the message has been read and can be stored as such. 3. You can click Previous Messages to access all messages you ve received from the Court AND have acknowledged as read. 4. Click Cancel to close the dialog and return to the Court Information page ImageSoft, Inc. 19

28 Communication with the Court Court Contact Information You can access information about the courts you ve identified as Favorites. For each court, information such as hours of operation, contact details, and policies regarding e-filing and e-servicing may be available. 1. Click the Court Information button for the appropriate court to launch a separate dialog that can include hours of operation and contact details. The Court may provide specific policies and procedures on what to expect when e-filing and e-servicing. 2. Click Cancel to close the dialog and return to the Court Information page ImageSoft, Inc. 20

29 Navigating TrueFiling Navigating TrueFiling The main navigation pane for TrueFiling is located on the left side of each page and is consistent throughout the site. This consistency enables you to rapidly switch from one operation to another regardless of the page currently displayed. The default page is initially set to the Case Search page but can be changed by accessing Settings >> My Settings. The navigation pane is separated into these sections and pages: Section Page Description Main Pages efile The efile page provides a starting place for creating a new filing for a case. You can also search for a case. My Recent Activity Case Search The My Recent Activity page lists your recent activity, such as filing submissions and service recipient additions. The Case Search page allows you to select a court and search for an existing case using the Case Number, Case Title, and Case Date (optional) as the search criteria ImageSoft, Inc. 21

30 Navigating TrueFiling Section Page Description History Favorites The History page lists the filings for your entire firm organized by status tabs: Unsubmitted, Submitted, Pending Payment, Filed, and Rejected. You can also view your filings based on their last activity date by selecting the Recent tab. The Favorites page contains cases and courts you ve designated as favorites. Settings Support The Support page is used to specify TrueFiling support specialists who can access your site during a support call. Resources Contacts & Attorneys My Settings Firm Settings Payment Accounts Quick Reference Guide Admin Guide The Contacts and Attorneys page is used to add contacts, attorneys, and self-represented filers to a firm. You can select some or all of the contacts and attorneys for document service for a case. Administrators can use this page to issue an invitation to join the firm s TrueFiling Law Firm site as a Login User and enable those users to submit filings. The My Settings page is used to change a user s password, default page, select notifications, and designate an assistant to receive notifications on filings. The Firm Settings page is used by administrators to specify the firm name, time zone, firm notification , servicing , payment account sharing preference, and firm Client Matter Number requirements for filings. The Payment Accounts page is used to manage payment accounts used for filing and fee payments. This link launches the Quick Reference Guide, which provides concise procedural steps for commonly used TrueFiling functionality. This link accesses the TrueFiling Administrator Guide. User Guide This link accesses the TrueFiling User Guide. FAQ Court Information This link accesses the TrueFiling Frequently Asked Questions page. The Court Information page contains details on courts that have been specified as favorites. Information can include location, hours of operation, and contact information. Training Videos The Videos page provides access to demonstrations of select TrueFiling functionality. When working in TrueFiling, use the navigation pane to access different pages instead of using your browser s Back or Forward arrows. 31 Searching for a Court Case Searching for a Court Case To file against a case in TrueFiling, you must first locate the case and access its Case Detail page. TrueFiling has a list of every case for each court that participates in electronic filing. The case list is updated every day with the previous day s newly created cases. Each court determines what case types can be filed against in TrueFiling. Thus, some courts will accept only certain case types, such as general civil, and not others, such as domestic. To determine the valid list of case types supported for a given court, contact the Clerk s office using the contact information found on the Court Information page (select Resources >> Court Information in the navigation pane). To locate a case: 1. Select Main Pages >> Case Search in the navigation pane. The Case Search page is displayed. NOTE: The text displayed in Search Description section is court specific and may differ from the text shown in the above screen image. TrueFiling provides access to cases from multiple courts. So the first step in the search process is to select the appropriate court ImageSoft, Inc. 23

32 Searching for a Court Case 2. Select the Court from the Court field drop-down list. NOTE: Only courts identified by you or your firm as Favorites are displayed in the dropdown list. Refer to Favorites >> Court Favorites for details on adding a court as a personal favorite. 3. Input search text in the Case Search field. The search is performed against both the case number and court-assigned case title. The search functionality is quite flexible and allows you to input a partial case number, a partial party name, or full values. For example, you can input CK to find all cases whose case number or case title contains those characters. 4. Click Search ImageSoft, Inc. 24

33 Searching for a Court Case The top 50 cases that match the search criteria are listed, from most recent to oldest. NOTE: If more than 50 results are returned, and your case is not listed, please refine your criteria and perform another search. 5. Locate your case and click the case number link to open the Case Detail page. You can then proceed to file against the case. Search Tips Several search techniques can be used. If you are searching for case number CK, you can input most of the case number, , in the text box. After you click Search, the results are displayed, and the case is listed ImageSoft, Inc. 25

34 Searching for a Court Case However, you can input much less detail - for example and still have the case listed in the Search Results. Similarly, you can input some of the party name such as Jessica if the case number is unknown. All cases that include Jessica in the case number or title are displayed in the results ImageSoft, Inc. 26

35 Searching for a Court Case TIP: For best results, try not to search on too many values. For instance, if you are searching for Jessica Day, you may attempt to search for the full name. However, as shown on the previous page, the case title is Day, Jessica. Searching for Jessica Day returns no matches, as shown here ImageSoft, Inc. 27

36 Searching for a Court Case Filtering by Case Date You can use the Case Date field to limit the search results to cases that were opened within a specific date range. Specifying a date range is optional. However, the Case Search text is required and must be supplied for every search. To filter a search by date: 1. From the Case Search page, select your court from the Court field. 2. Enter the search text (case number or case title / party name) in the Case Search field. 3. Select the dates for either the Case opened on or after or Case opened on or before fields, or both. 4. Click Search. The following illustrates date filtered results for the Jessica search for cases opened after Jan 3, The results no longer display the 2010 case for Jessica because it was opened prior to Jan 3, ImageSoft, Inc. 28

37 Searching for a Court Case Similarly, you can apply an additional filter using the case opened on or before date to complete a specific range. You can use filtering to help limit the results for any search where common names are used, which can produce many cases in the search results. 38 Case Filings Legacy Case Filings Legacy The Court determines whether a Legacy bundle or Streamlined bundle will be used to create filings and submit them to the Court. Refer to Case Filings Streamlined for details on using this bundle type. Understanding Bundles and Filings A TrueFiling bundle is a logical group of filings that are submitted to the Court together. A bundle is analogous to an envelope that contains multiple paper filings in the paper world. Using bundles, you can submit more than one filing at a time to the Court for review. Every filing must be part of a bundle, even if the bundle contains only one filing. A bundle can t contain filings for more than one case. In some instances, multiple filings must be filed on the same date. For example, you may need to file a Motion and a Motion Brief for the same case on the same date. Using bundling, you can prepare both the filings together. When both are complete, you can submit them at the same time. In a Legacy bundle, a filing is created using the Filing Wizard. Within the wizard you can specify an existing bundle to place the filing in, or you can create a new bundle. See Creating a New Filing using the Filing Wizard later in this section for complete details. Primary Documents and Attachments Each filing in a Legacy bundle has a Primary Document. It may also have one or more document attachments. Attachments enable you to append additional pages to a filing. After the bundle is submitted, TrueFiling automatically combines the Primary Document with all the attachments to create one, convenient PDF document for the Court. For example, if you scan a five page document as five individual files (one for each page), the Primary Document will be the first page. You will upload the remaining four pages as attachments. Ultimately, the submitted filing will be one reconstituted file containing all five pages ImageSoft, Inc. 30

39 Case Filings Legacy IMPORTANT: Never use attachments to file a separate Primary Document such as a Brief, Motion, or Notice of Hearing. Improper use of attachments will cause the entire filing to be rejected. Supported File Formats TrueFiling accepts Primary Documents and attachments in these file formats: Microsoft Word (DOC and DOCX) Adobe PDF (PDF) Plain Text (TXT) Scanned Images (TIFF, JPG, and PNG) Understanding Filing Fees TrueFiling manages all billing transactions and account reconciliation with the Court. Filing fees are calculated based on the filing type. A filing may have one or more fees required for processing by the Court. Each court may impose additional fees such as credit card processing fees, technology usage fees, or convenience fees. These fees are determined by the Court and may be based on filing document type. NOTE: Certain circumstances may allow you to submit a Fee Waiver Request to the Court to waive the fees associated with the filing. See Submitting a Filing >> Fee Waivers later in this section for details. The Bundle Detail page displays a total summary of all fees based on the filings contained in the bundle. If the bundle has been submitted to the Court, the fee tabulation panel will resemble this: 2015 ImageSoft, Inc. 31

Filing Fee The filing fee is based on the case type and filing type. This fee is the same fee applied when the filing is submitted as paper. Statutory fees are usually mandated at the state level and are based on case type and filing type. Convenience Fee The convenience fee is based on the type of filing service requested by the filer during submission. Each court can specify the convenience fee amount based on the servicing selected. For example, the Court could impose a $5 convenience fee for e-filing only, an $8 convenience fee for e-filing with e-service, and a $5 convenience fee for e-service only. Each court will have a different fee schedule for the convenience fee. Bundle Discount Additionally, the Court may elect to cap the convenience fee when multiple filings are submitted in the same bundle. This is known as a Bundle Discount. Therefore, the total amount in fees for a filing may vary from court to court and from case type to case type. Processing Fee The processing fee is usually a set amount required to cover the credit card processing fee based on the statutory or other fees. Each court determines the processing fee associated with each filing based on the case type and filing type. Therefore, the processing fee for a filing may vary from court to court and from case type to case type. Usually, this fee is a fixed percentage, such as 3%, of the Statutory Fee. Some courts may elect to include the convenience fee as part of the processing fee calculation ImageSoft, Inc. 33

42 Case Filings Legacy Pages in TrueFiling These pages are used in a Legacy bundle for electronic case filing development, submission, and tracking: Case Detail page lists the filings and bundles that comprise the case, as well as the contacts / attorneys / self-represented filers associated with the case, and any electronic case files that have been purchased. Bundle Detail page lists the filings that comprise the bundle, which is a logical group of filings that are submitted to the Court together. Filing Detail page identifies the specifics of the filing, including the Primary Document, attachments, and service recipients. Case Detail Page When you execute a case search, the results are displayed in the Search Results section of the Case Search page. Click on a Case Number to launch its Case Detail page. Note: If you use the URL field on the Case Detail page instead of the Case Search page to access a case, and you enter the case number incorrectly, an error dialog is displayed. Click OK. You will be redirected to the Case Search page. We recommend using the Case Search page or specifying the case as a favorite ImageSoft, Inc. 34

You may be able to select case documents for purchase on this form. 4 View a list of the bundles and the filings in the bundles. 5 Add pages to a document type. Attachments are not used to add another document type to the current filing. 6 Add a new filing to the case. 7 View the case contacts. Filings can be from opposing attorneys / firms, as well as filings made by the Court such as Family Service or Friend of the Court. Electronic Case Files enables parties associated with a case to access all filings. 13 Purchase selected case files. 14 Refresh the case files list to its most up-to-date state. Case Filings The Case Filings section on the Case Detail page lists the bundles and filings associated with the case, as well as the document type, filing status, filer, filing submittal date, and filing fees. If the filing status is Unsubmitted, supporting documents can be attached through the Attachments link. Sorting the Case Filings You can specify how case filings are displayed by sorting one column in either ascending or descending order. The other columns in the section are re-ordered based on the sorting option selected. You can sort on any column in the Case Filings section. 1. Hover your cursor over a column heading. 2. Filtering the Case Filings You can specify a filter for a column to determine what content to display. A filter can be applied to any column in the Case Filings section. 1. See Your Firm s TrueFiling Members >> Managing Firm Members. Electronic Case Files Section Your firm has access to any documents it has filed with the Court. However, a case also has filings from the opposing attorney / firm, as well as filings made by the Court such as Family Service or Friend of the Court. Electronic Case Files enables parties associated with a case to access all filings. See Purchasing the Electronic Case File List in this section for details. Bundle Detail Page Case filings are organized in bundles, which are logical groupings that are submitted to the Court. A filing must be associated with a bundle. Each filing in the bundle is listed as a separate entry in the Case Filings section of the Case Detail page. The bundle names are displayed on the left side of the screen. The icon beside the bundle name indicates the filing s status ImageSoft, Inc. 38

From within the Bundle Detail page you can: Click on the Case Number to return to the Case Detail page. Click a filing in the Filing Name column if you want to launch its Filing Detail page. The manner in which the Bundle Detail page displays depends on whether the bundle has been submitted to the Court. 52 Case Filings Legacy Initiating a Case In select courts, certain case types can be initiated through TrueFiling. Although the Court may permit electronic case initiation, it may limit the case types that can be initiated. The process for case initiation is somewhat standard. However, the user input required is completely dependent on the Court and case type specified and will vary between courts and the cases initiated. To initiate a case: 1. Select Main Pages >> efile in the navigation pane. NOTE: You must have at least one court specified as a favorite before you can initiate a case. If no court favorites are specified, when you select efile in the navigation pane, you will be automatically directed to the Select Favorite Courts dialog where you ll add courts as your favorites. Refer to Favorites Court Favorites later in this guide for details. You can perform a case search if you re not sure the case already exists. Click Search for an existing case. The Case Search page is displayed. See the Searching for a Court Case section for details on how to perform a search and optimize the search results. 2. Click Initiate a new case ImageSoft, Inc. 44

53 Case Filings Legacy A dialog similar to the following is displayed: 3. Select the appropriate court from the Court field drop-down list. This list is populated with courts identified as favorites. If the court you need isn t listed, click the Court Lookup button to add it as a favorite. In the dialog displayed, click the Add To Favorites link beside the appropriate court. The Court is added as a favorite and will be available in the Court field drop-down list. Click Close to leave the dialog. It s important to understand that the court you select determines which fields are displayed in the case initiation dialog. In addition, the Court determines what, if any, court-specific case initiation policy information is provided in the left pane. If you select a court that does not support electronic case initiation, the following message is displayed. Click Cancel to leave the dialog ImageSoft, Inc. 45

54 Case Filings Legacy 4. Select the Case Type from the drop-down list. The case types listed here are determined by the Court. Not all case types may be listed. 5. Use one of the following options to specify the case initiating attorney. The Create button will not be enabled until an attorney is specified or the checkbox for filing without an attorney is selected. You can: Select an attorney from the Attorney field drop-down list and click Create. NOTE: When an attorney is added to a firm, the state in which their Attorney Number was issued should be specified. If no state was specified or if the state specified is not the state in which the selected Court resides, the attorney will not be in the list. Choose to file without an attorney. a. Select the checkbox beside I am filing without an attorney (Pro Per / Pro Se). b. Click Create. When you click Create with this option selected, TrueFiling will automatically use your login address and establish you as a Pro Per attorney in the firm. Your attorney number will be Pro Per, and you will be listed as a Self-Represented Filer on the Contacts and Attorneys page. NOTE: Two contacts cannot use the same address. Thus, this new Pro Per attorney can t be created if another attorney or contact with same login address exists. You must either ask your site administrator to remove the contact from the Contacts and Attorneys page or use a different login ImageSoft, Inc. 46

55 Case Filings Legacy Add a new attorney to your firm. a. Select the Add New Attorney option. The New Attorney dialog is displayed. b. Input the Contact Information for the new attorney. An asterisk (*) indicates a required field. The Role field will default to Attorney. c. Input the Attorney Number. d. Select the state where the Attorney Number was issued (State Issued field). For Administrators Only You can use this form to add a new attorney, but you can also use it to issue an invitation to the attorney to join your firm s TrueFiling site and enable them to submit filings. See the TrueFiling Administrator Guide for complete details on inviting new users to join the firm and assigning rights. If you are not an administrator, the Allow this person to login and submit filings and the Allow this person to be a firm administrator options are disabled. e. Select the checkbox to verify the attorney is a member of your firm. NOTE: You must select the box to verify this attorney is a member of your law firm and has the right to file documents to the Courts on your firm s behalf. You must not add an attorney from the opposing counsel nor one that is not a member of your law firm. If the box is not checked, the attorney cannot be added. f. Click OK to close the dialog. Once added, the attorney is available in the Attorney field drop-down list on the Court and Case Type Selection dialog. g. Select the new attorney from drop-down list. h. Click Create. For some courts and/or case types, no additional information is required in the case initiation process. In other courts and/or cases, however, additional information is needed to complete the process. This information and how it is input depends on the Court and case type ImageSoft, Inc. 47

56 Case Filings Legacy In lower courts for example, trial courts you may need to input details about the plaintiff, the attorney information, and the nature of the case. In an appellate court, you may need to provide the original lower court and its decision, the case number, and why an appeal is warranted. In some instances, the information may be duplicated in the accompanying filings. IMPORTANT NOTE: As you leave the Case Initiation dialog, remember that the Court and case type you have selected determines how case initiation moves forward. Sample Case Initiation The following uses a civil case in an appellate court to illustrate a sample case initiation. 1. Specify the Court. 2. Specify the Case Type. 3. Specify the Attorney. 4. 59 Case Filings Legacy Case Initiation Bundle Once the case is initiated, a bundle is created that contains the case initiation form. The Bundle Detail page is displayed. Bundle Validation Errors An important aspect of case initiation is validation. Once the required case information is entered and completed, all input is validated against a set of court-specific rules. Any errors detected are listed in the Bundle Validation Errors section of the Bundle Detail page, along with information on how to correct the issue. For example, a court may require specific filing types to be included in the case initiation bundle. If these filings are not present, validation errors will be detected. As illustrated in the above screen image, this court requires that Complaint and Summons filings be included in the case initiation bundle. Also, because validation errors exist, the fee tabulation panel is displayed in red. The Submit button is disabled because the bundle cannot be submitted to the Court until all validation errors have been corrected. To correct the errors found in this example, the required Complaint and Summons filings must be added to the bundle. You would select the Add New Filing option to add these filings ImageSoft, Inc. 51

60 Case Filings Legacy Once the case initiation filing is properly created, the Bundle Detail page is re-displayed. After validation errors are corrected, the Submit button is enabled, and you can submit the case initiation bundle to the Court. It is important to remember that the validation criteria will vary from court to court and case to case. The above illustrates just one example of case initiation, how validation errors can occur, and how they can be resolved. Submitting the Case Initiation Bundle to the Court Once your documents are uploaded and no validation errors exist, you can submit the Case Initiation bundle to the Court. 1. Select the appropriate credit card from the Payment Account drop-down list. You can select the Add Account link to add a payment account; you will be directed to the Payment Accounts page. See Payment Accounts later in this guide for details on adding an account. 2. Click Submit on the Bundle Detail page to submit the bundle. A confirmation dialog is displayed. 3. Click OK to proceed; click Cancel to cancel the submission ImageSoft, Inc. 52

61 Case Filings Legacy Creating a New Filing using the Filing Wizard In order to add a filing, an attorney or self-represented filer associated with your firm must be specified as a case contact. See Your Firm s TrueFiling Members >> Managing Firm Members >> Adding a Firm Member as a Case Contact. Before you create a new filing, perform a case search and verify the case is in the court where you expect it. See Searching for a Court Case. When the search is complete, access the Case Detail page and: 1. Verify the required parties are listed in the Case Contacts section. 2. Ensure you can file against this case with the Court as a party of record. 3. Verify the attorney responsible for your firm s filings against this case is listed in the Case Contacts section as an Attorney. A filing is created using the New Filing for Case wizard, which leads you through a 6-step process. At each step, guidance is provided on how to proceed. Completed steps display on the wizard pages in light blue, the current step displays in dark blue, and uncompleted steps display in grey. This wizard can be launched through the Case Detail page or through the Bundle Detail page. If you add the filing through the Bundle Detail page, the filing is added to that bundle. A filing can be added only to a bundle that has not been submitted to the Court. If you add the filing from within the Case Detail page, you can assign the filing to any available bundle or create a new bundle. From either the Bundle Detail page or the Case Detail page: 1. Click Add New Filing. NOTE: If the wizard is launched from the Bundle Detail page, this process defaults to Step 2 because TrueFiling assumes you are adding this filing to the current bundle. When launched from the Case Detail page, the wizard begins at Step 1. For illustrative purposes, assume the wizard has been launched from the Case Detail page ImageSoft, Inc. 53

NOTE: The Filing Name can be changed only in steps 1 and 2 of the wizard. 3. Input a different Bundle name, if you wish. The new filing will be part of this new bundle. If you decide the new filing is to be part of an existing bundle, click Add to an Existing Bundle. Detailed information about the filing type selected is displayed in the scrollable pane on the left side of the screen. Click Browse (or Choose File) in the Primary Document field to search for the file to add as the Primary Document. 11. The Court may override this setting based on a Court Order. Priority - Priority documents are deemed time sensitive. The Court may override this setting based on Court rules. Confidential - Confidential documents cannot be viewed or inspected by the public unless by Order. The Court may override this setting based on a Court Order. 21. Input any additional text associated with the filing, if required, in the memo text panel. 22. Click Next. Step 6, which is used to specify the servicing type and any recipients for the filing, is displayed. NOTE: See Electronic Document Servicing later in this section for details on the servicing options available for different filing types and court requirements. Courts may not require Proof of Service for certain filing or case types; however, you can still choose to e-serve. If a court requires Proof of Service, the filing type determines if service occurs immediately after a filing is submitted to the Court or after the Court files it. These factors determine what information is displayed on this page. Carefully read the information provided to ensure that the e-service options you select are appropriate for your needs and the Court s requirements. 23. If the Court allows, you may be able to remove a case contact as a service recipient. In such cases, a checkbox is displayed beside each recipient s address. By default, the recipients are selected. De-select the checkbox beside any recipient you DO NOT WANT served for this filing. Some courts may require electronic service of all filings to all case contacts. In such instances, no checkbox is present: 24. Click Finish to complete the wizard. Clicking Finish will not file the document or perform e-service. The following dialog is displayed. If supported by the Court, you can select or modify a property: Sealed, Priority, Confidential. 3. Select the appropriate Filing Service. 87 Case Filings Legacy Submitting a Filing TrueFiling supports filings grouped in bundles. All the filings in a bundle will remain in an Unsubmitted status until the bundle is submitted to the Court. Unsubmitted indicates the bundle s associated filings have not yet been submitted to the Court or electronically served to any of the parties. Fee Waiver If the Court permits, you can request the fees associated with your case be waived. The Court determines which waiver options, if any, are available. The Court may give you a pre-approved code to apply when you submit your bundle to the Court. The Court may also allow you to submit a conditional fee waiver based on your circumstances. Specifically, you may be allowed to submit a conditional request if you: Believe the Court has waived fees for the case for example, if you are deemed indigent. Have been appointed counsel by the Court and should be exempt. Are filing on behalf of a government agency and should be exempt. NOTE: In all cases of conditional fee waivers, if the fees are not waived for the case, your filings will be rejected due to improper payment. You will have to recreate the bundle and upload your filings again. To request a fee waiver: 1. Access the appropriate Bundle Detail page. 2. In the fee tabulation panel, click Request Fee Waiver. The Fee Waiver Option dialog is displayed. NOTE: The Court determines what options are available in this dialog ImageSoft, Inc. 79

Input your Fee Waiver Code or select the applicable Conditional Fee Waiver, whichever is appropriate. Modifying the Fee Waiver Type Once you have requested the fee waiver, the Request Fee Waiver button in the fee tabulation panel changes to Change Waiver Request. When you click this button, the Fee Waiver Option dialog is redisplayed, and you can select a different waiver type to apply. Removing the Fee Waiver If you want to remove the fee waiver: 1. Access the Bundle Detail page. 2. Locate the Fee Waiver filing ImageSoft, Inc. 81

The filing is deleted, and the fee waiver amount is removed from the fee tabulation panel. Inter-Agency Transfer An inter-agency transfer enables a filing fee to be paid by another entity. Your firm must be authorized by the Court to apply an inter-agency transfer as a payment method. When so authorized, a specialized payment account is created to facilitate the transfers. This account type will be available for selection by the firm and its members when submitting a bundle to the Court. For example: 2015 ImageSoft, Inc. 82

91 Case Filings Legacy After the bundle is submitted, the fee tabulation panel is re-displayed, showing a Conditional Total of $0.00. The filing fees are applied to an alternate payment method. Escrow Account TrueFiling enables fee payment through an escrow account established between your firm and ImageSoft. Your firm will fund the account upfront on a scheduled or as needed basis. This account can then be selected as a payment method when a bundle is submitted. As long as the account remains funded, it will stay active. Once the escrow arrangement is finalized, the escrow card will be available as an option in the Payment Account drop-down list ImageSoft, Inc. 83

Court actions, which vary between courts, will determine if a charge is applied. To submit the bundle and its filings to the Court: 1. Access the appropriate Bundle Detail page. For example: A yellow information bar is present on the Bundle Detail page if the bundle has filings with the Unsubmitted status. Such filings have not yet been submitted to the Court or electronically served to any of the parties. 2. Verify the fee Total is accurate. If required, click the Request Fee Waiver button to access options for requesting a fee waiver from the Court. Refer to Fee Waivers in the previous section for details. 3. Select the appropriate credit card from the Payment Account drop-down list. You can select the Add Account link to add a payment account; you will be directed to the Payment Accounts page. See Payment Accounts later in this guide for details on adding an account. 4. Click Submit on the Bundle Detail page to submit the bundle. A confirmation dialog is displayed. 5. Click OK to proceed; click Cancel to cancel the submission. The bundle and all the filings in it will be submitted to the Court for processing. Although a bundle may contain more than one filing, and a total is listed on the Bundle Detail page, each filing will be charged individually upon Court acceptance. No credit card charges will be applied for a filing until the Court accepts it ImageSoft, Inc. 84

93 Case Filings Legacy Electronic Document Service TrueFiling provides e-servicing for filings based on the need for service and court-specific rules and payment options. The documents are served to all service recipients through . In addition, TrueFiling tracks the transaction history to provide verification of electronic submission to a mail transfer agent. Each served party is sent a unique URL, which enables access to the served documents. Previously filed documents can be re-served to specified recipients without requiring a new filing or additional charges. Auto-Servicing Through auto-servicing you can choose to automatically e-serve filings and send a system-generated Proof of Service filing to the Court. When auto servicing is indicated, you no longer need to file a Proof of Service for the filing one will be automatically created when you submit a filing to the Court. Auto-servicing is specified when a filing is created. See Creating a New Filing using the Filing Wizard earlier in this section. NOTE: TrueFiling offers electronic service through , and the Court will accept the generated Proof of Service. However, the filer is still responsible for verifying the appropriate filings were served to opposing counsel based on Court rules. Filings, including a generated Proof of Service, should not be considered filed with the Court until the filer receives a file-stamped copy, and a docket entry is entered. Service Recipients Court rules determine servicing requirements. You can choose to e-serve a filing; some courts may require e-service. In the Servicing step (Step 6) of the filing wizard you specify the servicing method to apply to the new filing. Any case contacts are listed by default as servicing recipients if e-service is indicated. What is presented to you in step 6 is determined by Court rules. The Court may permit you to remove a case contact as a service recipient. You can de-select the checkbox beside the recipient s address The Court may, however, require all case contacts to be served. No checkbox is displayed beside the recipient, and each case contact must be e-served. After a filing has been created, case contacts subsequently added to the case can also be selected as service recipients. See Adding a Contact / Attorney as a Service Recipient. Also, you can specify an individual not associated with the case as a service recipient. See Adding an Ad Hoc Service Recipient. Service recipients may be excluded during the time of filing and added after a filing is submitted to allow it to be served to new recipients as long as they paid for servicing. 94 Case Filings Legacy Adding a Case Contact as a Service Recipient To add a case contact as a service recipient: 1. Access the appropriate Filing Detail page and locate the Service Recipients section. If e-servicing is specified for the filing, case contacts that have been selected for servicing are listed. 2. Click Add Service Recipient. This link isn t available if the Court has rejected the filing. The Add New Service Recipient dialog is displayed. The Address field drop-down list contains all the case contacts that are not already specified as service recipients. If all case contacts are specified as service recipients, the Address field displays as a text box where you can input the address of an individual not associated with the case. See Adding an Ad Hoc Service Recipient. 3. Select the appropriate address from the drop-down list. 4. Click OK to close the dialog. The selected case contact is added to the Service Recipients list. NOTE: Previously filed documents can be re-served to any recipient without requiring a new filing or additional charges. This link isn t available if the Court has rejected the filing. The Add New Service Recipient dialog is displayed. 3. Select Add New from the Address field drop-down list. The field will re-display as a text box. NOTE: If all case contacts are already specified as Service Recipients, the Address field automatically displays as a text box. 4. Input the new recipient s address. 5. Click OK to close the dialog. The new service recipient is added to the Service Recipients section. A checkbox is displayed beside the address. NOTE: Previously filed documents can be re-served to recipients listed with a checkbox beside their address; a new filing or additional charges will not be required. If required by the Court, TrueFiling will also generate a new Proof of Service and file it with the Court on the filer s behalf ImageSoft, Inc. 87

If the Court has rejected this fling, the Re-Send Servicing link is not available. Removing a Service Recipient You can remove an ad hoc service recipient. However, if the Court requires electronic servicing on all filings, the case contacts associated with the case can t be removed as service recipients. There will be no X in the Remove column beside their name. 1. Access the appropriate Filing Detail page and locate the Service Recipients section. 2. Locate the recipient to remove. 3. Click the X in the Remove column to remove the recipient. The Service Recipients list will refresh ImageSoft, Inc. 88

However, deleting a service recipient after they have already been electronically served will not retract any previously sent s. Also, any automatically generated Proof of Service document will still contain a record of the e-served recipient. Service History TrueFiling serves the documents to all of the service recipients through and also tracks the mail transaction history in order to provide verification of electronic submission to a mail transfer agent. Each served party is sent a unique URL that allows them access to the served documents. A sample for e-servicing is shown here. The service history is tracked within the Service Recipients section of the Filings Detail page. For each recipient listed, TrueFiling indicates if service occurred, as well as each time the served party clicks the link from the e-service and starts downloading the filing. After the first attempt to download the filing, the Viewed status for the recipient changes from No to Yes. The above example illustrates three service recipients each with different e-servicing statuses. Recipients drm@truefiling.com and ckl@truefiling.com were both e-served, and drm@truefiling.com clicked the link in the to download the filing. However, bkr@truefiling.com was not e-served and has not clicked any link to download the filing ImageSoft, Inc. 89

Documents include the automatically generated official file-stamped copy, payment receipts, and automatically generated Proof of Service filings. Official File Stamped Copy The official filed copy is usually a file-stamped version of the submitted document. However, each court may have a unique method for determining the official filed copy. To download the official filed copy: 1. Access the appropriate Filing Detail page. 2. In the Transaction History section, locate the line item associated with the Status Filed. 3. Click the paperclip icon beside the Filed timestamp to start the download. Your browser may prompt you to save the document locally. Though the process for obtaining Electronic Case Files is not the same for every situation, the initial step is to request a listing of all case filings from the Court. If the Court does not support access to electronic case files through TrueFiling, this message is displayed in the Electronic Case Files section on the Case Detail page. An attorney from your firm must be specified as a case contact in order to request the case file. If your firm has never requested a filing list for the case, this message is displayed in the Electronic Case Files section. Initial Case List Request To request the case list from the Court: 1. 109 Case Filings Streamlined Case Filings Streamlined The Court determines whether a Legacy or Streamlined bundle will be used to create your filings and submit them to the Court. Refer to Case Filings Legacy for details on that bundle type. Understanding Bundles and Filings A TrueFiling bundle is a logical group of filings that are submitted to the Court together. A bundle is analogous to an envelope that contains multiple paper filings in the paper world. Using bundles, you can simultaneously submit more than one filing for the Court to review. Every filing must be part of a bundle, even if the bundle contains only one filing. A bundle cannot contain filings for more than one case. In some instances, multiple filings must be filed on the same date. For example, you may need to file a Motion and a Motion Brief for the same case on the same date. Using bundling, you can prepare both the filings together. When both are complete, you can submit them together. In a Streamlined bundle, properties and actions are applied bundle-wide; that is, they are applied to every filing in the bundle. For example, the filing attorney specified for the bundle is applied to all filings in the bundle. Also, any service recipients selected will be served all filings in the bundle. See Creating a Bundle and its Filings in this section. The service recipients are specified and managed as a bundle property. See Editing the Bundle Properties in this section. When the bundle is submitted, and if e-servicing is specified, a single, combined Proof of Service is generated for all filings in the bundle and immediately delivered to the Clerk. Lead Documents and Connected Documents Each filing in a bundle has a lead document. It may also have one or more connected documents. A connected document is a separate filing that has an association with the lead document. The connected document functions as a child of the parent (lead) document. 110 Case Filings Streamlined Supported File Formats TrueFiling accepts lead and connected documents in these file formats: Microsoft Word (DOC and DOCX) Adobe PDF (PDF) Plain Text (TXT) Scanned Images (TIFF, JPG, and PNG) Understanding Filing Fees TrueFiling manages all billing transactions and account reconciliation with the Court. Filing fees are calculated based on the filing type. A filing may have one or more fees required for processing by the Court. Each court may impose additional fees such as credit card processing fees, technology usage fees, or convenience fees. These fees are determined by the Court and may be based on filing document type. NOTE: Certain circumstances may allow you to submit a Fee Waiver Request to the Court to waive the fees associated with the filing. See Submitting the Bundle to the Court >> Fee Waivers in this section for details. The Bundle Detail page displays a total summary of all fees based on the filings contained in the bundle. 111 Case Filings Streamlined Fee Types Any or all of these fees may be imposed by the Court. Filing Fee The filing fee is based on the case type and filing type. This fee is the same fee applied when the filing is submitted as paper. Statutory fees are usually mandated at the state level and are based on case type and filing type. Convenience Fee The convenience fee is based on the type of filing service requested by the filer during submission. Each Court can specify the convenience fee amount based on the servicing selected. For example, the Court could impose a $5 convenience fee for e-filing only, an $8 convenience fee for e-filing with e-service, and a $5 convenience fee for e-service only. Each Court will have a different fee schedule for the convenience fee. Bundle Discount Additionally, the Court may elect to cap the convenience fee when multiple filings are submitted in the same bundle. This is known as a Bundle Discount. A fee tabulation panel that contains the bundle discount will resemble. NOTE: The Court determines convenience fees associated with a filing based on the filing type and any bundle maximums for assessing the convenience fees. Therefore, the total amount in fees for a filing may vary from court to court and from case type to case type. Processing Fee The processing fee is usually a set amount required to cover the credit card processing fee based on the statutory or other fees. Each court determines the processing fee associated with each filing based on the case type and filing type. Therefore, this fee may vary from court to court and from case type to case type. Usually, the fee is a fixed percentage, such as 3%, of the statutory fee. Some courts may elect to include the convenience fee as part of the processing fee calculation ImageSoft, Inc. 103

112 Case Filings Streamlined Pages in TrueFiling A Streamlined bundle uses these pages for electronic case filing development, submission, and tracking: Case Detail page lists the bundles, filings, and connected documents that comprise the case, as well as the contacts / attorneys / self-represented filers associated with the case. Bundle Detail page lists the filings that comprise the bundle, any connected documents, and related fees. Case Detail Page When you execute a case search, the results are displayed in the Search Results section of the Case Search page. 1. Click on the Case Number to launch the Case Detail page. If the bundle has been submitted, the filing s status can be Submitted, Accepted, Paid, Rejected, or Filed. 9 View the fees associated with the filing (which may include convenience and processing fees). 10 Access the Connected Documents dialog, where existing connected documents can be viewed and additional connected documents can be added. 11 View and access bundles (and filings) that have been submitted to the Court. 12 View the connected documents of a filing that is part of a submitted bundle. 13 Navigate through multiple page lists. 14 Access the Case Contacts section to view and manage case contacts. Attorneys, contacts, and self-represented filers associated with a case are listed in this section. 15 Remove a case contact from the case. 16 Add a new or existing firm member as a case contact. A contact can be an attorney or a firm staff member, an employee, or a client. 17 Add a member of opposing counsel as a case contact. 18 Add a new or existing self-represented filer as a case contact. Submitted and Un-submitted Bundles The Case Detail page displays all bundles associated with the case. Each bundle and the filings in it are listed. For each filing, the filing title, type, status, and fee are shown. In addition, access to a history of actions associated with the filing is available. Bundles are divided into two sections - those that have been submitted to the Court (Previous Bundles section) and those that have not. Un-submitted bundles are highlighted in yellow. An unsubmitted bundle can be edited, and connected documents can be added to a filing. See Creating a Bundle and its Filings later in this section for complete details on creating a bundle, adding a filing, uploading connected documents, and specifying servicing requirements and recipients. Case Contacts Section Attorneys, contacts, and self-represented filers associated with a case are listed in the Case Contacts section. For example, the filing attorney specified for a bundle is applied to all filings in that bundle. In addition, any service recipients selected will be served all filings in the bundle. See Creating a Bundle and its Filings in this section. Service recipients are specified and managed as a bundle property. See Editing the Bundle Properties in this section. To access the Bundle Detail page from the Case Detail page: 1. Locate the appropriate bundle on the Case Detail page. 2. Click the Bundle Name to launch the Bundle Detail page. If a bundle has been submitted to the Court, its properties cannot be edited. 5 View the filing fees that are expected to be charged when the Court files the bundle s filings. 6 View a list of the bundle s filings. 7 View / download / save the filing s lead or connected documents. 8 Launch a dialog containing fee disclosure details for a filing or a connected document. 9 View a list of the filing s connected documents. A connected document is a filing associated with another filing. The connected document can be considered a child of a parent filing (lead document). It is important to remember that when a bundle is submitted to the Court, each filing in the bundle must be individually reviewed and stamped as Filed by the Court. For an unsubmitted bundle, the page displays as: On this page you can: 1 Be informed that the bundle has not yet been submitted to the Court. 2 View the Bundle Name. 3 Launch the Case Detail page by clicking the case number link. 4 Delete the bundle, and by default, all filings in the bundle. 5 Edit the bundle properties as well as the service recipients and servicing method. 6 View the total fees of all the filings in the bundle. 7 Select the payment account to use. 8 Submit the bundle and its filings to the Court. 9 Request a fee waiver from the Court. See Submitting the Bundle to the Court >> Fee Waiver later in this section for details. If a fee waiver has already been requested, this option displays as Change Fee Waiver to allow you to modify the request. 10 Add a new filing to the bundle. Bundle Validation Errors TrueFiling will validate a bundle against court-specific rules when the bundle is created or updated. Any issues are reported in the Bundle Validation Errors section on the Bundle Detail page. For example: In a Streamlined bundle, the text detailing the validation error incorporates a link to access the means to correct it. In the above example, the original filing attorney has been removed as a case contact and is no longer associated with the case. You must add this attorney as a case contact, or add a different attorney to the case and edit the bundle properties to assign them as the filing attorney. When the text for the correction is selected, the appropriate page or dialog is displayed. For example, if you click the link to add the attorney back to the case, the Case Detail page is displayed. There, you can click the Add Attorney option to re-add the original attorney as a case contact. The Submit button will remain disabled until all errors are corrected ImageSoft, Inc. 110

119 Case Filings Streamlined Initiating a Case In select courts, certain case types can be initiated through TrueFiling. Although the Court may permit electronic case initiation, it may limit the case types that can be initiated. The process for case initiation is somewhat standard. However, the user input required is completely dependent on the Court and case type specified and will vary between courts and the cases initiated. To launch case initiation: 1. Select Main Pages >> efile in the navigation pane. NOTE: You must have at least one court specified as a favorite before you can initiate a case. If no court favorites are specified, when you select efile in the navigation pane, you will be automatically directed to the Select Favorite Courts dialog where you ll add courts as your favorites. Refer to Favorites Court Favorites later in this guide for details. You can perform a case search if you re not sure the case already exists. Click Search for an existing case. The Case Search page is displayed. See Searching for a Court Case earlier in this guide for details on how to perform a search and optimize the search results. 2. Click Initiate a new case ImageSoft, Inc. 111

This list is populated with courts identified as favorites. If the court you need isn t listed, click the Court Lookup button to add it as a favorite. In the dialog displayed, click the Add To Favorites link beside the appropriate court. The Court is added as a favorite and will be available in the Court field drop-down list. Click Close to leave the dialog. It s important to understand that the Court you select determines which fields are displayed in the case initiation dialog. In addition, the Court determines what, if any, court-specific case initiation policy information is provided in the left pane. If you select a court that does not support electronic case initiation, the following message is displayed. Click Cancel to leave the dialog ImageSoft, Inc. 112

121 Case Filings Streamlined 4. Select the Case Type from the drop-down list. The case types listed here are determined by the Court. Not all case types may be listed. 5. Use one of the following options to specify the case initiating attorney. The Create button will not be enabled until an attorney is specified or the checkbox for filing without an attorney is selected. You can: Select an attorney from the Attorney field drop-down list and click Create. NOTE: When an attorney is added to a firm, the state in which their Attorney Number was issued should be specified. If no state was specified or if the state specified is not the state where the selected Court resides, the attorney will not be in the list. Choose to file without an attorney. a. Select the checkbox beside I am filing without an attorney (Pro Per / Pro Se). b. Click Create. When you click Create with this option selected, TrueFiling will automatically use your login address and establish you as a Pro Per attorney in the firm. Your attorney number will be Pro Per, and you will be listed as a Self-Represented Filer on the Contacts and Attorneys page. NOTE: Two contacts cannot use the same address. Thus, this new Pro Per attorney cannot be created if another attorney or contact with same login address exists. You must either ask your site administrator to remove the contact from the Contacts and Attorneys page or use a different login ImageSoft, Inc. 113

122 Case Filings Streamlined Add a new attorney to your firm. a. Select the Add New Attorney option. The New Attorney dialog is displayed. b. Input the Contact Information for the new attorney. An asterisk (*) indicates a required field. The Role field will default to Attorney. c. Input the Attorney Number. d. Select the state where the Attorney Number was issued (State Issued field). For Administrators Only You can use this form to add a new attorney, but you can also use it to issue an invitation to the attorney to join your firm s TrueFiling site and enable them to submit filings. See the TrueFiling Administrator Guide for complete details on inviting new users to join the firm and assigning rights. If you are not an administrator, the Allow this person to login and submit filings and the Allow this person to be a firm administrator options are disabled. e. Select the checkbox to verify the attorney is a member of your firm. NOTE: You must select the box to verify this attorney is a member of your law firm and has the right to file documents to the courts on your firm s behalf. You must not add an attorney from the opposing counsel nor one that is not a member of your law firm. If the box is not checked, the attorney cannot be added. f. Click OK to close the dialog. Once added, the attorney is available in the Attorney field drop-down list on the Court and Case Type Selection dialog. g. Select the new attorney from drop-down list. h. Click Create. For some courts and/or case types, no additional information is required in the case initiation process. In other courts and/or cases, however, additional information is needed to complete the process. This information and how it is input depends on the court and case type ImageSoft, Inc. 114

123 Case Filings Streamlined In lower courts for example, trial courts you may need to input details about the plaintiff, the attorney information, and the nature of the case. In an appellate court, you may need to provide the original lower court and its decision, the case number, and why an appeal is warranted. In some instances, the information may be duplicated in the accompanying filings. IMPORTANT NOTE: As you leave the Case Initiation dialog, remember that the Court and case type you have selected determines how case initiation progresses. Sample Case Initiation The following uses a civil case in an appellate court to illustrate a sample case initiation. 1. Specify the Court. 2. Specify the Case Type. 3. Specify the Attorney. 4. 126 Case Filings Streamlined Case Initiation Bundle Once the case is initiated, a bundle is created that contains the case initiation form. The Bundle Detail page is displayed. Bundle Validation Errors An important aspect of case initiation is validation. Once the required case information is entered and completed, all input is validated against a set of court-specific rules. Any errors detected are listed in the Bundle Validation Errors section of the Bundle Detail page, along with details on how to correct the issue. Also, if a validation error exists, the fee tabulation panel displays in red. The Submit button is disabled because the bundle cannot be submitted to the Court until the validation error has been corrected For example, a law firm may require a Client Matter Number for each case initiation, and one wasn t specified when the case was initiated. As a result, a bundle validation error is detected and displayed, as shown in the above screen image. In a Streamlined bundle, the text detailing the validation error acts as a link to access the means to correct it. In the above example, if you click the client matter number link the Update Bundle dialog is displayed ImageSoft, Inc. 118

127 Case Filings Streamlined To correct the error using this example. 1. Input the Client Matter Number as required. 2. Click OK to close the dialog and return to the Bundle Detail page. After all validation errors are corrected, the Submit button is enabled, and you can submit the case initiation bundle to the Court. It is important to remember that the validation criteria will vary from court to court, case to case, and firm to firm. The above illustrates just one example of case initiation, how validation errors can occur, and how they are resolved ImageSoft, Inc. 119

128 Case Filings Streamlined Specifying the Case Initiation Bundle Properties Once the case initiation bundle is created, you can edit the bundle properties and specify service recipients. 1. On the case initiation Bundle Detail page, click the Edit Bundle Properties option. 2. Make any required changes to the Bundle Name, Filing Attorney, Filing Options, and Client Matter Number. For case initiation bundles, the Serve Only Filing Option is not available ImageSoft, Inc. 120

129 Case Filings Streamlined If the Court permits, you can add an ad hoc service recipient for the bundle. a. Click the Add Service Recipient option in the Service Recipients section. This dialog is displayed. b. Input the recipient s contact information. Once you click OK and close this dialog, the contact information can t be edited. If you want to e-serve this recipient, you must provide an or the e-service option won t be available in the drop-down list on the Update Bundle dialog. c. Click OK to return to the Update Bundle dialog. The recipient is added to the Service Recipients section. 3. Select the box beside Include? to indicate the recipients to be served ImageSoft, Inc. 121

130 Case Filings Streamlined 4. For each selected service recipient, specify the appropriate servicing method from the dropdown list. NOTE: The Court may not allow e-servicing for ad hoc recipients. In such an instance, e- service will not be available in the drop-down list. In order to e-serve, the recipient will have to be added as a case contact and selected for service. 5. Click OK to save your changes and return to the Bundle Detail page. Submitting the Case Initiation Bundle Once your documents are uploaded and no validation errors exist, you can submit the Case Initiation bundle to the Court. 1. Select the appropriate credit card from the Payment Account drop-down list. If the account you need is not listed, select Settings >> Payment Accounts in the navigation pane to launch the Payment Accounts page. You can add an account here. See Payment Accounts later in this guide. 2. Click Submit on the Bundle Detail page to submit the bundle. A confirmation dialog is displayed. 3. Click OK to proceed; click Cancel to cancel the submission ImageSoft, Inc. 122

131 Case Filings Streamlined Creating a Bundle and its Filings On the Bundle Detail page, you will create your bundle, add filings (and upload the lead document), upload any required connected documents, and specify servicing requirements. In order to create a new bundle and create a filing, an attorney or self-represented filer associated with your firm must be specified as a case contact. See Your Firm s TrueFiling Members >> Managing Firm Members >> Adding a Firm Member as a Case Contact. Before you create a new bundle, perform a case search and verify the case is in the court where you expect it. See Searching for a Court Case earlier in this guide. When the search is complete, access the Case Detail page and: 1. Verify the required parties are listed in the Case Contacts section. 2. Ensure you can file against this case with the Court as a party of record. 3. Verify the attorney responsible for your firm s filings against this case is listed in the Case Contacts section as an Attorney. To create a new bundle: 1. Access the appropriate Case Detail page. 2. Click the Create New Bundle button. The Create New Bundle dialog is displayed. In addition to the bundle properties, this dialog also contains a Service Recipients section, which lists all case contacts (attorney, contact, self-represented filer) segregated by firm. Use this section to select or de-select service recipients, specify the servicing method, and add ad hoc service recipients ImageSoft, Inc. 123

132 Case Filings Streamlined 3. Edit the default Bundle Name, if required. 4. Select the appropriate Filing Attorney from the drop-down list. The attorney selected here is applied to every filing in the bundle. 5. Input the Client Matter Number, if one is required. 6. Select the appropriate Filing Option. The option selected is applied to each filing in the bundle. Serve Only the filing will be served when you submit the filing s bundle to the Court File and Serve the filing will be submitted to the Court and served to the specified recipients. Service may occur immediately after the bundle is submitted or once the filing is officially filed by the Court. File Only the filing will not be served to any party when the filing s bundle is submitted to the Court. If you select this option, the Service Recipients section is disabled. 7. Ensure the checkbox beside Include? is selected for each required service recipient. 8. For each selected service recipient, specify the appropriate servicing method from the dropdown list: e-service, Mail, Personal. The Court determines what servicing options, if any, are required. If the Court requires one specific servicing method, that method is auto-specified for each selected service recipient and cannot be edited. You can add an ad-hoc service recipient for this bundle. See Adding an Ad-Hoc Service Recipient to a Bundle later in this section for details. 9. Click OK on the Create New Bundle dialog. A new Bundle Detail page is created ImageSoft, Inc. 124

If the bundle has not been submitted, you can edit the properties: 1. Access the appropriate Bundle Detail page. 2. Click the Edit Bundle Properties option. The following dialog is displayed. 3. Make any required changes. If you change the Filing Option to File Only, the Service Recipients section becomes disabled, and the Add Service Recipients option is removed. 4. 141 Case Filings Streamlined Adding an Ad Hoc Service Recipient to a Bundle You can add an ad hoc service recipient for the bundle. Be aware that this recipient won t be added as a case contact: 1. Click the Add Service Recipient option in the Service Recipients section. The following dialog is displayed. 2. Add the recipient s contact information. Once you click OK and close this dialog, the Contact Information can t be edited. If you plan to specify e-service for this recipient, you must provide an address. A dialog is displayed to confirm that you want to delete the filing completely, not just remove it from the bundle. 4. 145 Case Filings Streamlined Submitting the Bundle to the Court All filings in a bundle will remain in an Unsubmitted status until the bundle is submitted to the Court. This status indicates the bundle and the filings contained in it have not yet been submitted to the Court or electronically served to any of the parties. Fee Waiver If the Court permits, you can request the fees associated with your case be waived. The Court determines which waiver options, if any, are available. You may be allowed to submit a conditional fee waiver based on your circumstances if you: Believe the Court has waived fees for the case for example, if you are deemed indigent. Have been appointed counsel by the Court and should be exempt. Are filing on behalf of a government agency and should be exempt. NOTE: In all cases of conditional fee waivers, if the fees are not waived for the case, your filings will be rejected due to improper payment. You will have to recreate the bundle and upload your filings again. To request a fee waiver: 1. Access the appropriate Bundle Detail page. For example: 2. In the fee tabulation panel, click Request Fee Waiver ImageSoft, Inc. 137

Select the Requesting Attorney. 5. Click Request to submit your fee waiver request. The Bundle Detail page is re-displayed. The fee tabulation panel indicates the requested fee waiver amount. The fees will be tentatively zeroed out pending approval from the Clerk. If the waiver is approved, the Conditional Total of $0.00 is applied to the bundle. Modifying the Fee Waiver Type Once you have requested the fee waiver, the Request Fee Waiver button in the fee tabulation panel changes to Change Waiver Request. Your firm must be authorized by the Court to apply an inter-agency transfer as a payment method. When so authorized, a specialized payment account is created to facilitate these transfers. This payment account type will be available for selection by the firm and its members when submitting a bundle to the Court. For example: After the bundle is submitted, the fee tabulation panel is re-displayed, showing a Conditional Total of $0.00. 149 Case Filings Streamlined Escrow Account TrueFiling enables fee payment through an escrow account established between your firm and ImageSoft. Your firm will fund the account upfront on a scheduled or as needed basis. This account can then be selected as a payment method when a bundle is submitted. As long as the account remains funded, it will stay active. Once the escrow arrangement is finalized, the escrow card will be available as an option in the Payment Account drop-down list. Submitting the Bundle to the Court To submit the bundle and its filings to the Court: 1. Access the appropriate Bundle Detail page. For example: The yellow information bar indicates the bundle has not been submitted. The filings have not yet been submitted to the Court or electronically served to any of the parties. 2. Verify the fee Total is accurate. Although a bundle may contain more than one filing, and a total is listed on the Bundle Detail page, each filing may be charged individually. 151 Case Filings Streamlined Related Documents Related Documents are created by the Court or TrueFiling during the submission, review, and filing process. Documents include the automatically generated official file-stamped file copy, payment receipts, and automatically generated Proof of Service filing. Official File Stamped Copy The official filed copy is usually a file-stamped version of the submitted document. However, each court may have a unique method for determining the official filed copy. Access and download the file stamped copy through the filing history. 1. On either the Case Detail or Bundle Detail page locate the filing. 2. Click the appropriate Document Title. The Filing History dialog is displayed. 3. Locate the line item associated with the Filed status. 4. Click the paperclip icon beside the Filed timestamp to start the download. Your browser may prompt you to save the document locally. The following is an example of how Internet Explorer 10.0 will display the download and save prompt. 5. If enabled by the Court, your notification will include a Download link. The message will resemble: NOTE: You must be logged on to TrueFiling in your default browser in order to download the document using the download link. If you re not logged on, your default browser will launch, the TrueFiling Account Logon page will display, and you ll have to log on to TrueFiling. You ll then need to perform the manual process to download the official filed copy as described in the previous section. To download the official filed copy. 1. Therefore, the receipt is not guaranteed to match the total amount listed on the filing s Bundle Detail page. However, the sum of all accepted and paid filings should be equal to or less than the amount listed on the Bundle Detail page. The sum may be less if a filing in the bundle was rejected. Generated Proof of Service If you elect to serve a bundle s parties of interest through e-servicing, and if the Court requires a Proof of Service, TrueFiling will automatically generate a single Proof of Service for the entire bundle and submit it to the Court. If a filing requires service, TrueFiling enables e-servicing capability when the filing is submitted. The Court may impose an additional convenience fee for e-servicing; however, the fee amount is based on the filing type and service type. To download the filed copy of a Proof of Service for a filing: 1. Open the appropriate Bundle Detail page. 2. Select the Filed Proof of Service option. Your browser may prompt you to save the document locally. The following is an example of how Internet Explorer 10.0 will display the download and save prompt. 3. To view the filings, you ll select the appropriate tab on the page: Tabs include: Tab Unsubmitted Submitted Pending Payment Filed Rejected Description The filing is still being created by the filer and has not been submitted to the Clerk for review. The Court can t see and has no knowledge of these filings. The filing was submitted to the Clerk for review. The Clerk will either conditionally accept the filing - pending payment - or reject it. The filing has been conditionally accepted by the Clerk and is pending payment. The filing has been accepted by the Clerk, paid for (when applicable), and filed as part of the official case record. The filing has been rejected by the Clerk. To view the reason for rejection, click on the Filing Name. For filings in a Streamlined bundle, the Filing History dialog is displayed. The Rejected line item entry contains a comment that specifies the rejection reason. For filings in a Legacy bundle, when you click the Filing Name, the Filing Detail page is displayed. The Transaction History section on that page lists the reason for rejection. Recent Filings are listed based on the last activity date. The History page defaults to this tab when it s launched. Viewing your TrueFiling Activities You can view your recent TrueFiling activity. Summary information is available for cases, filings, and user updates. 159 Favorites Favorites The Favorites page lists cases and courts that you have identified as favorites. Adding a Case to your Favorites To locate a case and add it to your Favorites: 1. Launch the appropriate Case Detail page. You can perform a case search, if needed, and select the Case Number from the search results to launch the Case Detail page. 2. Click the Add to Favorites link to add this case to the list of your favorite cases. The Case Detail page is refreshed. Viewing your Favorite Cases To view cases you ve specified as favorites: 1. Select Main Pages >> Favorites in the navigation pane (located on the left side of the page). Your firm s Favorites page is displayed. You can specify how you view your favorite cases. When All Courts is specified in the drop-down list, your favorite cases in all courts are displayed. A court must be identified as a favorite in order for you to be able to file in that court. Any TrueFiling login user can specify their own personal court favorites. Adding a Court as a Favorite You can add or remove a court as a favorite from the: Favorites page Case Search page Case Initiation page Using the Favorites page to illustrate how to add a court as a personal favorite: 1. 164 Settings Settings On the TrueFiling user interface, the Settings section in the navigation pane provides access to these pages: The Support page is used to contact TrueFiling support through or phone, as well as grant support specialists access to your firm s site. See TrueFiling Support later in this guide for details. The Contacts and Attorneys page is used to add contacts, attorneys, and self-represented filers to your firm. You can select some or all of the contacts and attorneys for document servicing for a case. Administrators can use this page to issue an invitation to join the firm s TrueFiling Law Firm site as a Login User and enable those users to submit filings. See Your Firm s TrueFiling Members later in this guide. The My Settings page is used to change your password, set your default page, designate an assistant to receive s regarding your filings, and select notifications. See My Settings in this section for details on changing your password and specifying your TrueFiling default page. See Notifications in this section for details on specifying your notification settings and assigning assistants. The Payment Accounts page provides credit card information for the payment of filings and fees. See Payment Accounts later in this guide for details. The Firm Settings page is used by administrators to specify the firm-wide settings. See Your Firm s Settings in this section. My Settings Access the My Settings page through the Settings option in the navigation pane. Changing your Password If you ve forgotten your password and can t log on, you can request a password reset from the Account Logon page. 172 Settings Firm Name Specify how your firm s name is to display throughout the TrueFiling site. NOTE: Be aware that if the firm name is changed, it is not updated in the Case Contacts section on the Case Detail page. Time Zone Select the time zone to be used by the TrueFiling website for your firm. All times displayed in TrueFiling (for example, the Timestamps listed in a filing s history) default to the time zone specified. Notification All TrueFiling notifications sent to filers will be copied to the addressed specified here. Servicing All servicing s sent to a member of the firm will be copied to the address specified here. Payment Account Sharing Specify if all users can share all payment accounts or if they cannot share and must use their own payment account information. Client Matter Number Specify if a Client Matter Number is required when a new filing is created. Main Office Address Your firm s administrator specifies the following contact information for the firm: Address address Website (if any) Phone and fax numbers NOTE: The State specified in the firm s address will become the default state shown in the State field in all forms within TrueFiling. That is, whenever a TrueFiling form (for example adding a new attorney) requires a state to be specified, the State field is auto-filled with this state as a default in the form ImageSoft, Inc. 164

173 Your Firm s TrueFiling Members Your Firm s TrueFiling Members You can add a member to your firm s TrueFiling Law Firm site. A site member can be specified as a case contact and selected for document service. When a member is added, they re assigned a role: Attorney, Firm Staff / Client / Employee (also known as a Contact), or a Self-represented Filer. An attorney or self-represented in your firm can be specified as the filing attorney. In TrueFiling, the Contacts and Attorneys page is used to add and manage contacts, attorneys, and self-represented filers in your firm. A site administrator can also use this page to invite users to join the firm s TrueFiling Law Firm site, which allows the user to log on to TrueFiling and submit filings. Administrative activities are detailed in the TrueFiling Administrator Guide. To launch the Contacts and Attorneys page, in the navigation pane, select Settings >> Contacts and Attorneys ImageSoft, Inc. 165

174 Your Firm s TrueFiling Members Firm members on this page are arranged by their role. Each member is listed on a placard, which will identify them as one or more of the following: Attorney: An attorney is responsible for the filings submitted for a case. An attorney from your firm must be associated with a case in order for you to file against it. Self-Rep: A self-represented filer is someone who chooses to represent themselves instead of hiring an attorney. Contact: A contact is someone that can be selected to be served a case filing (assuming service has been specified for the filing or bundle). Contacts may include employees, clients, and firm staff. Login User: A login user is someone who can log on to a firm s TrueFiling site and submit filings. Admin: A firm site Admin is responsible for: Creating their firm s TrueFiling Law Firm site Inviting / managing Login Users Managing payment accounts Managing firm settings The Unclassified section lists any existing Login Users whose roles and responsibilities must be updated by an administrator. See the TrueFiling Administrator Guide for details on managing Login Users. Managing Firm Members When managing firm members you can: Add a member to your firm Add a new member to your firm and simultaneously add them as a case contact Add an existing firm member as a case contact Add opposing counsel as a case contact Remove a case contact Associate a court-ordered contact to a Case. Select Settings>> Contacts & Attorneys in the navigation pane to launch the Contacts and Attorneys page. 2. Review the page to make sure the person you want to add isn t already a member of your firm s TrueFiling site. To illustrate this process we ll add an attorney. For the most part, the process to add individuals is the same for all roles. Any differences will be noted. 3. In the Attorneys section, click Add New Attorney ImageSoft, Inc. 167

Select the checkbox in the gray panel to verify this person is associated with you or your firm. NOTE: You must select the box to verify this individual is associated with you or your law firm and is not an attorney from the opposing counsel. Adding a New Member through an Existing Case You can add a new member to your firm and simultaneously associate them to a case. We ll use an attorney to illustrate. 1. Perform a case search and select the appropriate case from the results returned. The Case Detail page is displayed. Attorneys associated with the case are listed in the Case Contacts section. 2. Ensure the attorney you want to add is not already a member of your firm: a. Click Add Attorney in the Firm Contacts area. The Add Attorney dialog, which lists your firm s attorneys who are not associated with this case, is displayed. If the attorney you want to add is in the list, that attorney already exists, and you don t need to add them to your firm. Proceed to Adding a Firm Member to a Case later in this section. b. If the attorney is not in the list, click Cancel to close the dialog. The Case Detail page is re-displayed. You can add the new attorney to your firm through this page. In addition, the Contacts and Attorneys page - accessed through Settings >> Contacts and Attorneys - is updated with the new attorney. This attorney can now be associated to other cases. See Adding a Firm Member to a Case. Adding a Firm Member to a Case as a Case Contact You can add an existing firm member to a case as a case contact. We ll use an attorney to illustrate. 1. Perform a case search and select the appropriate case from the results returned. The Case Detail page is displayed. 2. Review the Case Contacts section to ensure the member is not already associated with the case. 3. In the Firm Contacts section, click Add Attorney. A dialog lists all firm attorneys who are not associated with the case. NOTE: If you re adding an attorney as a case contact, and no attorneys have yet been added to the firm, a message is displayed indicating you must first add an attorney to the 2015 ImageSoft, Inc. 171

See Adding a Member through an Existing Case earlier in this section. 4. Select the checkbox beside the attorney to add. More than one can be selected. 5. Click Add Selected. The Case Detail page is re-displayed. The selected attorney is added to the Case Contacts section, which indicates they are associated with this case. Adding Opposing Counsel as a Case Contact If allowed by the Court, you can add opposing counsel from another firm as a case contact. This attorney can then be selected for servicing. 1. Perform a case search and select the appropriate case from the results returned. The Case Detail page is displayed. 2. In the Opposing Counsel section, click Add Opposing Counsel. The following dialog is displayed. 3. Input the search criteria needed to locate the attorney attorney name, attorney number, firm name, or address. 4. If you want to include Contacts and Pro Per filers in the search results, select the checkbox beside Include Contacts and Pro Per. 5. Click Search. All instances of the search criteria are listed in the search results ImageSoft, Inc. 172

181 Your Firm s TrueFiling Members NOTE: Search results are limited to the state in which the Court resides. 6. Select the checkbox beside those you want to add as case contacts. 7. Click Add Selected. The individuals selected are added to the Case Contacts section on the Case Detail page. A dialog is displayed that indicates opposing counsel added as a case contact can be removed from the case only by the opposing counsel firm. Click OK to add the selected attorney to the case; click Cancel to cancel the operation. Because this person can only be removed from the case by their firm, the Remove from Case option will not be available for this person in the Case Contacts section of the Case Detail page ImageSoft, Inc. 173

182 Your Firm s TrueFiling Members Associating a Court-added Attorney or Contact to a Case An attorney or contact (staff member, client, or employee) can be added as a case contact by the Court or another law firm. If this person s address is identical to the address of a member of your firm s site, they will be listed in the Case Contacts section of the Case Detail page in yellow highlight: In such instances, you ll want to link this person to your firm for this case. Linking will update the person s contact information ON THE COURT SIDE with the contact information that already exists within your firm s site. This process will ensure that the Court has the most up to date contact information for a case contact. 1. Click the Link To Firm button. The information listed in the Case Contacts section will reflect the contact information your firm has: 2015 ImageSoft, Inc. 174

183 Your Firm s TrueFiling Members Editing a Member s Information Contact information and the role assigned to a member can be edited. If you re an administrator, you can also edit login rights and reset a Login User s password. NOTE: Changes made here are not propagated to other cases this person is associated with. You must explicitly remove and re-add this person to the other cases. 1. Select Settings >> Contacts & Attorneys in the navigation pane. 2. Locate the member on the Contacts and Attorneys page and click their placard. The Edit dialog is displayed. 3. Make any required changes to the Contact Information. NOTE: You can t change a user s address once the user has been created. 4. If required, you can change a user s role. If you change an attorney to another role type, the Attorney Number / State Issued information associated with the attorney is removed. A confirmation dialog is displayed to confirm the change ImageSoft, Inc. 175

184 Your Firm s TrueFiling Members For Administrators Only To reset a Login User s password, click Reset Password to send the user an that contains a new system generated password. This process is detailed in the TrueFiling Administrator Guide. This option is not visible to non-administrative users. Indicate if TrueFiling login rights should be granted by selecting (grant) or de-selecting (deny) the box beside the Allow this person to login and submit filings option. Indicate if administrator rights should be granted by selecting (grant) or de-selecting (deny) the box beside the Allow this person to be a firm administrator option. This option cannot be selected unless the user has been granted login rights. If you are not an administrator, these options are disabled. 5. Click OK to close the dialog and save any edits made. Click Cancel to leave the dialog and not save the changes. Removing a Member from a Case This process will remove a member as a case contact but will not remove them as a firm member: 1. Perform a case search and select the appropriate case from the results returned. The Case Detail page is displayed. 2. Locate the member in the Case Contacts section. 3. Click the Remove from Case link. No confirmation dialog is displayed ImageSoft, Inc. 176

185 Your Firm s TrueFiling Members Removing a Member from the Firm Only an administrator can remove a member from the firm. 1. Select Settings >> Contacts & Attorneys in the navigation pane. The Contacts and Attorneys page is displayed. 2. Click the X in the upper-right corner of the appropriate placard to remove the member. For non-administrative users, the X in the upper-right corner of the placard isn t visible. A confirmation dialog is displayed. 3. Click Remove. The Contacts and Attorneys page is re-displayed; the member is removed. This process will not remove the member from a case as a contact. However, when the Case Detail page is displayed, they are identified in the Case Contacts section as Removed from Firm : See also Removing a Member from a Case ImageSoft, Inc. 177

186 Payment Accounts Payment Accounts Although non-administrative login users can create payment accounts for the firm, it s recommended that administrators maintain the payment accounts for the firm s site. You can manage the credit card accounts used for payment when your firm submits a bundle to the Court. You can also track your firm s payment history. The Payment Accounts page is used to create and manage the payment accounts your firm will use to submit filings to the Court. This page is arranged by payment processor type. Not all courts use the same payment processor. As a result, you must create payment accounts for each processor used by the courts you will file in. Click Settings >> Payment Accounts in the navigation pane to access the Payment Accounts page. This page is arranged based on payment processor type, and the courts that use the processor are listed. Payment accounts are added based on payment processor type requirements. For example, if you file in Court A and Court B, and both courts use the same processor, one payment account will be created for that payment processor. This account can then be used for payment in both courts. However, if Court A and Court B use different processors, you must add an account for each processor type so you can file in both courts. When you submit your bundle and select the payment account on the Bundle Detail page, the accounts available in that court are listed in the Payment Account field drop-down list ImageSoft, Inc. 178

187 Payment Accounts Payment accounts can be shared by a firm s Login Users, or each user must use their own account. A firm administrator will specify this setting on the Firm Settings page. Refer to the TrueFiling Administrator Guide for details. Filtering Payment Accounts You can filter the page to display payment accounts only for courts you have identified as Favorites or for all the courts TrueFiling serves. Creating a New Account TrueFiling supports Visa, MasterCard, and American Express as valid types of payment accounts. To create a new account: 1. Select Settings >> Payment Accounts in the navigation pane. The Payment Accounts page is displayed. 2. Locate the processor section that lists the court(s) your firm files in. 3. Click Create New Account in the appropriate section ImageSoft, Inc. 179

188 Payment Accounts 4. Input the Account Information and Card Information. 5. Click OK to complete and close the dialog. The credit card will be validated for accuracy before being added as an account. A placard for the new account is added to the Payment Accounts page. 6. Continue to add payment accounts as required for each payment processor used ImageSoft, Inc. 180

189 Payment Accounts Modifying a Payment Account You can edit payment account information. Be aware that changes made to an account used by one payment processor don t propagate to other processors. For example, if an address change must be made to an account, the change must be made to each instance of the account among the payment processors. To modify an existing credit card payment account: 1. Select Settings >> Payment Accounts in the navigation pane. The Payment Accounts page is displayed. 2. Locate the account to edit in the appropriate processor section. 3. Click on the account s placard. The Account Information dialog is displayed. 4. Make any required changes. NOTE: The Account Name and Card Number are read only and cannot be changed. If you want to change the Card Number, you must delete the account and create a new one with the correct number. 5. Click OK to complete and close the dialog. The Payment Accounts page is re-displayed ImageSoft, Inc. 181

190 Payment Accounts Deleting a Payment Account If payment accounts are shared among a firm s Login Users, any user can delete an account. If payment accounts aren t shared, only the user that added the account can delete it. Payment account sharing preferences are set by administrative users on the Firm Settings page. Refer to the TrueFiling Administrator Guide for details. Be aware that deleting a payment account from one processor will not delete it from the other processors. Perform the delete operation for each instance of the account you want to delete. 1. Select Settings >> Payment Accounts in the navigation to access the Payment Accounts page. 2. Locate the account to remove and click the X in the upper-right corner of the account placard. A confirmation dialog is displayed. NOTE: As noted in the confirmation dialog, if you have any unpaid filings that were submitted with this credit card, the filings may be rejected if you delete the payment account. 3. Click OK to delete the account; click Cancel to cancel the operation. If payment accounts are shared, firm administrators will receive an notifying them that account has been deleted. If accounts aren t shared, the will be sent only to the Login User that deleted the account ImageSoft, Inc. 182

191 Payment Accounts Viewing Payment History You can view a comprehensive payment history for your firm for a specified time period, as well as print out receipts for selected transactions. 1. Select Settings >> Payment Accounts in the navigation pane to access the Payment Accounts page. 2. Click View Payment Information. The Payment History Report page is displayed. 3. Input both the start date (Payment on or after) and end date (Payment on or before). You can filter the payments that will be displayed based on Matter Number (optional). 4. Click View Activity on the Payment History Report page. The payment history is displayed. 5. You can select payment information for a specific case by selecting a case number from the Case(s) drop-down list ImageSoft, Inc. 183

192 Payment Accounts Creating a Receipt PDF To create a PDF file of selected transaction receipts. 1. After the Payment History Report is generated, select the checkbox in the Receipt column to print a receipt for a transaction. 2. Click Create Receipt PDF. A dialog prompts you to open or save the document. Open the document is opened in a separate window. Save: Save the document is saved in the Downloads folder; a default file name is created. Save As a Save As dialog is displayed where you can specify the file name and location. Save and open the document is saved in the Downloads folder and is opened in a separate window. Cancel cancel the operation. 3. Specify how you want to access the PDF file. Creating a CSV File You can generate a csv file that contains the transaction data. 1. After the Payment History Report has generated, click Create csv file on the Payment History Report page. A dialog prompts you to open or save the file. Open the document launches in Microsoft Excel in a separate window. Save the file is saved to the local system s Downloads folder; a default file name is created. Save as a Save As dialog is displayed where you can specify the file name and location. 2. Specify how you want to access the file; click Cancel to cancel the operation ImageSoft, Inc. 184
