5 The Legislation Safety, Health and Welfare at Work Act 2005 Came into effect on 1 September generally sets out duties of employers, employees and those who commission or procure a project for construction work. Safety, Health and Welfare at Work (Construction) Regulations 2006 Came into Effect on 6 November 2006 generally sets out duties of Client, PSDP, PSCS, Designers and Contractors etc. Definitions PSDP Project Supervisor for the Design Process, not necessarily the Designer (or during construction, the Contractor), may be independent individual or body corporate, appointed by Client PSDP Coordinator Health and Safety co-ordinator for the design process, may be appointed by the PSDP to assist in the undertaking of the duties of the PSDP, not necessarily an individual, may be a incorporated body Designer means a person engaged in work related to the design of a project. Under the regulations, a designer is anyone engaged in preparing drawings, particulars, specifications, calculations and bills of quantities in relation to a project. 4

6 Definitions (continued ) PSCS Project Supervisor for the Construction Stage, not necessarily the Contractor, may be an individual or a body corporate, appointed by Client PSCS Coordinator Health and Safety co-ordinator for the construction stage, may be appointed by the PSCS to assist in the undertaking of the duties of the PSCS, not necessarily an individual, may be a incorporated body PSCS Safety Adviser May be appointed by the PSCS to manage day to day Health and Safety on a construction site. If there are normally more than 100 persons on a construction site at any one time engaged in construction work, the project supervisor for the construction stage shall appoint in writing a full-time competent safety adviser. Definitions (continued ) Contractor (a) a contractor or an employer whose employees undertake, carry out or manage construction work, or (b) a person who (i) carries out or manages construction work for a fixed or other sum, and (ii) supplies materials, labour or both, whether the contractor s own labour or that of another, to carry out the work Safety Officer Every contractor who normally has under direct control at any one time more than 20 persons on a construction site, or 30 persons engaged in construction work, shall appoint in writing a Safety Officer Safety Representative Employees have the right to select and appoint one of themselves as a safety representative to represent them in consultation with the contractor. A safety representative is required where more than 20 persons are employed on a site. 5

7 Definitions (continued ) Project An activity which includes or is intended to include construction work Construction work Construction work means the carrying out of any building, civil engineering or engineering work Safety and Health Plan The Safety and Health Plan documents how health and safety on the project will be managed up to project completion Safety File The Safety File contains information on the completed structure that will be required for future maintenance or renovation Director, Manager and Supervisor Liability 2005 Act significantly increased the potential liability of those occupying directorial or managerial positions. Sec. 80 If an offence committed by an undertaking was authorised, or consented to by or attributable to the connivance or neglect of a director, manager or similar officer, or person purporting to act in any of those capacities, that person, alongside the undertaking, is guilty of an offence and proceedings may be taken against them in their personal capacity. Onus on Director or Senior Manager to prove otherwise. Focus appears to be on upper levels of management. N.B: A person may be guilty of an offence where they have breached a duty while acting in their personal capacity, but they may also be found guilty of an offence where they are a director or manager of an undertaking. 6

8 Director, Manager and Supervisor Liability (continued ) A breach of duty under the 2005 Act or the 2006 Regulations is an offence under the 2005 Act. An offence may be committed either by an undertaking or a person. Undertaking found guilty fine of up to 3,000 on summary conviction or a fine of up to 3 million on conviction on indictment. A person found guilty - fine of up to 3,000 or prison term of up to 6 months or both on summary conviction, or a fine of up to 3 million or prison term of up to 2 years or both on conviction on indictment. Health and Safety Co-Ordinator s Liability Under Regulations 11 (2) and 17 (2) of the 2006 Regs. - project supervisors can appoint a competent person as H&S Coordinator to assist them in the undertaking of their duties. The Regulations do not set out specific duties and obligations for the H&S Coordinator. Therefore, their duties would include complying with the general duties of all employees on a construction site under Reg. 29 of the 2006 Regs. and Sec. 13 of the 2005 Act etc. 7

9 Health and Safety Co-Ordinator s Liability (continued ) Current position different to that under the Regulations. PSDP and PSCS cannot appoint a H&S Coordinator to undertake duties on their behalf. PSDP/PSCS are still liable! Where a health and safety co-ordinator fails to carry out its duties under the 2005 Act or the 2006 Regulations it will be guilty of an offence. In the case of an individual, they will be liable in their personal capacity. In the case of an undertaking, the undertaking itself and its directors or managers may be liable.* * NB general duties of employer and employee Is there a duty on the Project Supervisor Construction Stage to keep informed of design variations to the Works? Co-ordination and ensuring co-operation between the various entities. Guidelines talk of proactively manage interaction..between parties who have an impact on the construction process. Reg. 16(b) - obligation to update Safety Plan if there are design changes or alterations. 8

10 Is there a duty on the Project Supervisor Construction Stage to keep informed of design variations to the Works? (continued ) However - primary duties as regards provision of or obtaining information are assigned to the client, designer and contractor. PSCS should use power under Reg. 20 of 2006 Regulations and/or identify the risks presented by alteration of the designs and set out procedures under the H&S Plan to address these risks, including requiring notification of design changes to the PSCS. Control / Approval of Persons coming On-Site PSCS duty to co-ordinate measures to permit authorised persons only onto the construction site. PSCS can use its power to issue directions under Reg. 20 to require the contractor and designer etc. to notify him of all personnel coming on site and/or build requirement into H&S Plan. 9

11 Control / Approval of Persons coming On-Site (continued ) Guidelines state that - the PSCS should take reasonable measures to ensure that no unauthorised person enters the site - authorised persons should have the relevant site rules explained to them - they should undergo any necessary induction training - some authorised persons may need to be supervised while on site or visiting specific areas. Guidelines are not legally binding, however, they might be regarded as setting the standard of care required of a PSCS. Sec general duty - anyone who exerts control over a place of work to exert that control in such a way as to ensure, so far as is reasonably practicable, the safety, health and welfare of workers at the place of work and those affected by the work being carried out at the place of work. 10

12 Duties of the Client / Employer under the 2005 Act (continued ) Sec. 17(1) of the 2005 Act requires any person (which includes a company) who commissions or procures a project for construction work to appoint in writing a competent person or persons for the purpose of ensuring, so far as reasonably practicable, that the project: 1. is designed and is capable of being constructed to be safe and without risk to health 2. is constructed to be safe and without risk to health 3. can be maintained safely and without risk to health during subsequent use 4. complies, in all respects, as appropriate, with the 2005 Act and the regulations made under it Duties of the Client under the 2006 Regulations Client in 2006 Regs defined as a person for whom a project is carried out, in the course of or in furtherance of a trade, business or undertaking, or who undertakes a project directly in the course of such trade, business or undertaking. Appoint a competent PSDP with adequate resources at or before the start of the design process - get written confirmation of acceptance Appoint a competent PSCS with adequate resources before commencement of the construction work - get written confirmation of acceptance 11

13 Duties of the Client under the 2006 Regulations Be satisfied that the designer is competent Retain and make available the Safety File for the completed structure Co-operate with the PSDP and PSCS and supply necessary information in order to enable them to comply with their obligations under the 2006 Regulations Provide a copy of the Safety and Health Plan to every person being considered for the role of PSCS or tendering the role. Notify the Authority of the details of the PSDP and PSCS, when required. Duties of the PSDP under the 2006 Regulations Take account of the General Principles of Prevention during the design and preparation of the project Take account of any existing Safety and Health Plan or Safety File Organise co-operation between designers to protect the safety, health and welfare of those involved in construction work Where construction work is to last longer than 30 days or the volume of work is to exceed 500 person days or where the work involves a particular risk, to prepare a written Safety and Health Plan Prepare a Safety File containing relevant health and safety information to be taken into account during any construction and maintenance subsequent to the completion of the project Notify the HSA, the Client and the person to whom the direction was given of any non-compliance with directions issued by the PSDP 12

14 Duties of the Designer under the 2006 Regulations Take account of the General Principles of Prevention Take account of the relevant safety and health plan and safety file Provide all relevant information necessary for the PSDP to carry out duties Co-operate with all parties Comply with all directions from the PSDP and PSCS Note: if no PSDP or PSCS is known to the designer to have been appointed for the project, the information shall be supplied to the contractor Duties of the PSCS under the 2006 Regulations Further develop the Safety and Health Plan prepared by the PSDP before construction commences Co-ordinate the implementation during construction of the General Principles of Prevention Co-ordinate and monitor the implementation of any relevant requirements of the 2006 Regulations Organise co-operation between contractors and others Organise the co-operation of employers Co-ordinate the provision by contractors of information in relation to fatal accidents, injuries, conditions or dangerous occurrences 13

21 Issues Identified Phase 1 Q A At what point in the project is a PSDP required to be appointed? The Client shall appoint in writing for every design and construction project a competent PSDP, before design work starts. (* exceptions on next slide) The client shall obtain written confirmation of acceptance of each of the appointments. A PSDP should be appointed after feasibility and following allocation of funding and identification of a project. Phases 2, 3 & 4 Projects where the appointment of a PSDP and PSCS are not required are listed as follows: 1) Routine maintenance, cleaning, decoration and repair within or to a structure unless - (a) the work involves a particular risk (b) more than one contractor is involved, or (c) construction work is planned to last longer than 30 working days or the volume of work is scheduled to exceed 500 person days 2) Where a person commissions or procures the project in relation to the person s domestic dwelling, and the project is not for the purpose or furtherance of a trade, business or undertaking after the completion of construction work. 19

A person or organisation is deemed to be competent where they possess sufficient training, experience and knowledge appropriate to the nature of the work to be undertaken and have the necessary available resources. In practice this means: Access to Health and Safety Professionals, relevant experience in the roads industry and health and safety training. Issues Identified Phases 2, 3 & 4 Q A Can Regional Design Offices (RDO) be appointed to the role of PSDP or PSDP Coordinator? The role of PSDP must be assumed by either an individual or a corporate body, however it is generally assumed by a corporate body. As RDO s are not corporate bodies, RDO s cannot assume the role of PSDP. The PSDP coordinator (health and safety co-ordinator for the design process) should be a competent person or organisation, therefore RDO s can be appointed as PSDP coordinators. 23

The Client or other person will make reasonable enquires to check that the company or person to be appointed is able to fulfill the responsibilities of the position (e.g. current PSDP Questionnaire). The client may need to seek professional advice from industry bodies depending on the scale, complexity and the hazards of the project. No Yes x Comments: 1.1 A Health and Safety Plan is in place as part of an integrated Quality, Safety and Environmental Management Plan. The plan is currently at Revision 1 status, it is reviewed bi-monthly, with hard copies at each site. The plan and system were certified in December A site induction programme is in place, with inductions conducted by nominated persons at each of the compounds. Over 100 inductions have been conducted at the main compound. 1.3 The Contractor implements own SSWP incorporating Method Statements and Risk Assessments, which are all reviewed by Health and Safety Advisor. 1.4 Toolbox Talks are held regularly, usually once a fortnight, to discuss various issues, e.g. machinary - pins etc 1.5 AF2 on display at each compound. 1.6 Emergency procedures are posted around site, however no trial runs are planned at present. 1.7 A training matrix exists for employees, detailing the training relevant to each operative. [Refer to Photo 1.6] 1.8 Accident and Incident Reporting is set out in the Contractors SPD document. Accidents are reporting directly to the Site Safety Officer. To date there have been 2 incidents, 1 accident resulting in less than 3 days absence and 1 accident resulting in 3 days absence from work. 1.9 Weekly internal and external inspections are carried out by the Contractor.
