Prequalification documents downloaded from the website are free of charge. Printed Prequalification documents collected in hard copy will attract a non-refundable tender fee of Kshs. 1, All payments shall be made to the Judiciary Nairobi Court fees Account at KCB, Moi Avenue Branch, Account No Upon payment of the tender fee, tenderers are required to obtain an official receipt from the Cash Office at Milimani Law Courts before collecting Prequalification documents from the Supply Chain Management Office, 7 th Floor, Rahimtulla Towers, Upper Hill Road, Nairobi during normal working hours. Women, Youth and people with disabilities are encouraged to apply for the reserved categories. Duly completed Prequalification Documents in plain sealed envelopes clearly marked CATEGORY NO... 6 1. INTRODUCTION SECTION 1 INFORMATION TO TENDERERS 1.1. The Judiciary will prequalify and enlist prospective bidders for the supply / provision of goods and services from among those who will have submitted applications, in accordance with the registration requirements to undertake the assignments described herein for a period ending 30 th June, Applicants are invited to submit a registration tender for supply / Provision of goods and service as listed in the schedule of goods and services Section The Prequalification document and the Tenderers response thereof shall be the basis for Registration. Tenderers must familiarize themselves with the requirements described in this document including all attachments and take them into account while preparing the response The Judiciary does not bind itself to assign supply / provision of the goods and services but shall endeavor to ensure tenders for specific goods and services will be treated equitably Applicants will be informed in writing of the results of the application, without assigning any reason for The Judiciary s decision thereof Tenderers will meet all costs associated with preparation and submission of their applications It is The Judiciary's policy to require that Tenderers observe the highest standard of ethics during the selection and execution of such contracts. In pursuance of this policy, The Judiciary: a) defines, for the purpose of this provision, the terms set forth below as follows: (i) (ii) "Corrupt practice" means the offering, giving, receiving or soliciting of anything of value to influence the action of an officer of the Judiciary in the Registration process; and Fraudulent practice means a misrepresentation of facts in order to influence the Registration process to the detriment of the Judiciary, and includes collusive practices among Tenderers (prior to or after submission of Tenders) designed to establish prices at 4

7 artificial, non-competitive levels and to deprive the Judiciary of the benefits of free and open competition. (b) (c) (d) (e) Will reject a Tender for Registration if it determines that a Tenderer has engaged in corrupt or fraudulent activities in competing for the contract in question; Will declare a Tender ineligible, for registration if at any time it determines that the Tenderer has engaged in corrupt or fraudulent practices in competing for, or in executing, a similar contract; and Will have the right to examine financial records relating to the performance of such services to determine capability. Will have the right to inspect the business premises of the tenderer. 1.8 Tenderers shall furnish information as described in the registration tender document. 2. DOCUMENTS COMPRISING THE REQUEST FOR REGISTRATION 2.1 Tenderers may request a clarification on the Prequalification document up to four (4) days before the Tender submission date. Any request for clarification must be sent in writing by mail, fascimile, or electronic mail to the Judiciary s address. The Judiciary will respond in writing by normal postal mail, facsimile, or electronic mail to such requests and will send copies of the response to all Tenderers who intend to submit tenders. 3 PREPARATION OF TENDER DOCUMENTS 3.1 Tenderers are requested to submit a Tender written in English language. 3.2 Tenderers are expected to examine the documents comprising this request for registration in detail. Material deficiencies in providing the information requested may result in rejection of a Tender. 3.3 Tenderers are required to meet the qualification criteria stipulated in paragraph 5 below and where applicable the specific requirements in Section 3. Those who do not meet the requirements need not submit tenders. Only tenders, which fulfill these requirements, will be considered for registration. 3.4 The registration documents shall not include any financial proposal information other than audited accounts for the last 2 years. 5

8 3.5 Period of Validity The request for prequalification must remain valid for not less than 120 days from the date of submission. The Judiciary will make the best effort to complete the evaluation and communicate within this period. 4 SUBMISSION, RECEIPT, AND OPENING OF PREQUALIFICATION DOCUMENTS 4.1 The original Prequalification Document shall be prepared in indelible ink. It shall contain no interlineations or overwriting, except as necessary to correct errors made by the Tenderer. Any such corrections must be initialed by the person or persons who sign(s) the Prequalification Document. 4.2 An authorized representative of the Tenderer should initial all pages of the tender document. 4.3 The Tenderer should submit an original and one (1) copy of the tender in a plain sealed envelope clearly marking each ORIGINAL and COPY as appropriate. The envelopes shall then be sealed in an outer envelope which should be clearly marked CATEGORY NO... FOR THE SUPPLY / PROVISION OF.. BOX NAIROBI Completed Prequalification Document shall be deposited in the Tender Box provided at the 7 th Floor, Rahimtulla Towers, Upper Hill Road, Nairobi 4.4 Deadline for Submission The closing time for the Tender shall be 4 th July, 2014 at 1000 hours and shall be sent to the above address. Tenders shall also be marked on top "DO NOT OPEN BEFORE 4 th July, 2014 AT 1000 hours. 4.5 Late Tender Any Tender received after the deadline pursuant to clause 4.4 shall be rejected as a late tender and shall not be considered. 6

9 4.6 Tender Opening A committee of officials shall open the Tender immediately after the closing time for submission of the Tender The Judiciary will prepare a record of the Tender opening. 5 TENDER EVALUATION (a) Mandatory Requirements for People living with Disabilities,Youth and Women Enterprises are encouraged to apply and to:- (i) Attach copy of Business Registration Certificate, (ii) Attach copy of PIN certificate and VAT Certificate (iii) (iv) Registration certificate from Ministry of Finance Duly filled and completed Tender submission document, Supplier Registration Questionnaire and Declaration Form N/B Previous Experience is NOT a requirement for the special groups (b) Mandatory Requirements for Prequalification of All other categories: (i) (ii) A copy of Certificate of Registration/Incorporation. Three (3) letters of recommendation from your corporate clients for similar goods and services. List of clients and evidence of supply to at least three (3) corporate clients in each of the following years: 2014, 2013, 2012 (attach copies of three (3) Purchase orders and/or contracts as evidence for each category(s) applied for) A copy of Valid Tax compliance certificate, A copy PIN and VAT Certificate (vi) Evidence of physical address and premises. Attach copies of utility bills i.e. electricity/water (in owner(s) / Director(s) or Company name) or lease agreement. The Judiciary may visit suppliers premises to ascertain physical address and stock of items. (iii) (iv) (v) (vii) Audited accounts for the last 2 years. (viii) Duly filled and completed Tender submission, Supplier Registration Questionnaire and Declaration Form (ix) A signed statement that the bidder doesn t have conflict of interest in relation to the procurement. (x) A signed statement that the bidder or any of its Directors or Officers, have not been convicted of any criminal offence relating to professional conduct or the making of false statements or 7

10 (xi) misrepresentations as to its qualifications to enter into a procurement contract within a period of three years preceding the commencement of procurement proceedings. A signed statement that the bidder is not debarred from participating in Public Procurement. (c) General Requirements i. The Judiciary will examine the tenders to determine completeness, general orderliness and sufficiency in responsiveness. ii. iii. iv. Tenderers shall not contact The Judiciary on the matter relating to their tender from the time of opening to the time the evaluation is finalized and official communication is sent to them. Any effort by the Tenderer to influence The Judiciary in the Tender evaluation shall result in the rejection of their tender. Registration will be based on meeting the set minimum criteria regarding the Applicant s legal status, general and particular experience, personnel and financial position as demonstrated by the responses in the attached forms. The applicants should have registered offices and The Judiciary reserves the discretion of visiting physical premises from which the applicant conducts business if so desired to confirm existence and capability to deliver the said goods/services. v. Tenderers who qualify according to the selection criteria will be invited to submit their quotations for the supply of goods/services as and when required. vi. The Judiciary reserves the right to accept or reject any or all Tenders without the obligation to assign any reason (s) for its decision thereof. (d) Additional Requirements a) Agents shall provide copies of Letters of appointment by the manufacturers to be dealers. b) Attach catalogues and brochures for the items you wish to supply. c) Kenya Bureau of Standards certificate where applicable. 6 CONFIDENTIALITY 6.1 Information relating to evaluation of Tenders and recommendations concerning registration shall not be disclosed to the Tenderers until the registered firms have been advised accordingly. 8
