1 REGULATIONS FOR THE USE OF SECURE PUBLIC CAR PARKS AT NICE CÔTE D AZUR AIRPORT Article 1 - DEFINITION The following car parks, which are open 24 hours a day with controlled access and parking fees, are designated as public car parks: Car Park P1: Drop-off/pick-up Parking: Very short stay "drop-off/pick-up" car park, maximum stay 2 hours. Car Park P2: Short-stay "contact" car park, hourly rate. Car Park P3: Short-stay "contact" car park, hourly rate. Car Park P4: "Long-stay" car park, online reservations only, minimum 96-hour stay (rates for 4 days or more). Car Park P5: Short-stay "contact" car park, hourly rate. Car Park P7: "Long-stay" car park, minimum 96-hour stay (rates for 4 days or more). Car Park P8: "Long-stay" car park, minimum 96-hour stay (rates for 4 days or more). Car Park P9: "Low-cost" car park, minimum 24-hour stay (rates for 1 day or more). Car Park G1: "Secure" short-stay car park, hourly rate. Car Park G2: "Secure" short-stay car park, hourly rate. Article 2 - GENERAL All parking in the public car parks mentioned in article 1 is governed by these usage regulations, in application of the 21 July 2008 prefectural order covering police measures applicable to Nice Côte d'azur airport, except in case of a formal and express exception made by Société des Aéroports de la Côte d'azur. Any parking request, demonstrated by the act of bringing a vehicle in and immobilising it in a public car park, even if only temporarily, implies acceptance of these regulations without limitation or qualification. Article 3 - DRIVING AND MANOEUVRING ON ROADS AND LANES IN THE CAR PARKS Access and Parking Department 08/06/2010 1
2 3.1. The driving, manoeuvring and parking of vehicles in the car parks is subject to the provisions of the Code de la Route (French highway code). Consequently, the speed limit is 15 km/h and users must observe the directions indicated by traffic flow arrows and the rules established by vertical and horizontal signs and markings. Users are entirely responsible for the risks involved in setting down and picking up passengers Public car park users are responsible for personal accidents and all damage to fixed or moveable property that they cause in the public car parks. Users must use the pedestrian walkways and respect the floor markings put in place by Société des Aéroports de la Côte d'azur in the car parks Any incident involving a vehicle within the car parks (see conditions in article 8 below) must be recorded by an Access and Parking Department staff member, and give rise to an accident report established jointly between the Access and Parking Department and the user. Complaints lodged with Société des Aéroports de la Côte d'azur at a later date by users will be admissible only if a joint accident report or other report has been written and signed by both parties. Should damage be caused to the fabric of the car parks, a report (vehicle accident report or other) must be written jointly by the user and Société des Aéroports de la Côte d'azur, represented by a member of the Access and Parking Department working under oath ( ). Should the user be at fault, Société des Aéroports de la Côte d'azur reserves the right to bring proceedings against the person responsible, for the reimbursement of repair costs Users are exclusively responsible for all manoeuvres during entry and exit which could cause damage to the vehicle or to the fabric of the car park. Should the access barrier be broken, the user will be responsible for the cost of repairs or a replacement barrier under the conditions stated in paragraph A computer and video system is in use to record the number plates of vehicles parked in all the public car parks. In accordance with Article 34 of Law of 6 January 1978 concerning data protection, users have the right to access, correct or remove any personal data about them. Users can exercise this right by writing to: superviseursaccesetstationnement@cote-azur.aeroport.fr. Article 4 - PARKING 4.1. Parking procedures: Vehicles must be parked correctly in one of the parking bays designated for this purpose, as marked on the ground. Vehicles must be locked. Should a vehicle be incorrectly parked in the designated parking bays, the vehicle will be reported by Société des Aéroports de la Côte d'azur Access and Parking Department staff working under oath. Any vehicle which is parked in such a way as to obstruct, misuse or create a danger in the traffic lanes which provide free movement within these car parks (Articles R417-9 to R and R421-5 and R421-7 of the French highway code) or any vehicle which hampers or disrupts traffic flow (Articles L and R of the French highway code) may be removed to the car pound at the owner's own expense, risks and perils Procedure for moving vehicles: Should this be rendered necessary by work of which advance notice has been given, cleaning or an incident which makes it necessary for Société des Aéroports de la Côte d'azur to move vehicles, vehicles will be moved at the owners' risks and perils. Société des Aéroports de la Côte d'azur and its staff shall not be held responsible. In such a case, a vehicle inspection will be carried out by a Société Aéroports de la Côte d Azur staff member working under oath before and after the vehicle is moved. Users shall have no claim against Société Aéroports de la Côte d Azur in the event of damage found on the vehicle. Access and Parking Department 08/06/2010 2
3 4.3. Parking period: Except with the express agreement of Société des Aéroports de la Côte d'azur, the parking period may not exceed 40 days, or two hours in the P1 "pick-up/drop-off" car park. Beyond this period, the vehicle may be removed at the expense, risks and perils of the offender and placed in the car pound, in accordance with the 21 July 2008 prefectural order. Removal fees are fully and entirely the user's responsibility. Articles L325-1 and following of the French highway code, relative to the impounding and immobilisation of land vehicles will be applied in accordance with reports made by Société des Aéroports de la Côte d'azur staff working under oath, following the procedures provided for by the law Users wishing to prolong their parking period should contact the Access and Parking Department by calling Two-wheeled and comparable vehicles must be parked in the spaces reserved for them only. Article 5 PEDESTRIANS 5.1 Pedestrian access to car parks is exclusively restricted to users who are parked in the car park and who hold an access ticket It is essential that users follow pedestrian walkways marked on the ground in order to guard against tripping and accidents Users are not authorised to picnic in the car parks or landscaped areas nor to sleep in the car parks (either in or outside vehicles). Article 6 HEALTH & SAFETY AND THE ENVIRONMENT 6.1. Refuelling and all maintenance work or operations are forbidden within the car parks Spreading or spilling of any inflammable fatty liquid or corrosive substance is forbidden within the car parks. In the event of accidental spillage, the cost of any cleaning and damage repair will be charged to the user concerned, after an incident report has been drawn up by Société Aéroports de la Côte d Azur Access and Parking Department staff working under oath Disposal of any waste or rubbish of any kind whatsoever is also forbidden within the car parks. In the event of a breach of rules, as reported by Société Aéroports de la Côte d Azur Access and Parking Department staff working under oath, the cost of cleaning and repairs will be charged to the user concerned The use of vehicle horns is forbidden within the car parks, except in the event of immediate and unforeseeable danger Users are not permitted to leave vehicle engines running for air conditioning or heating system purposes, particularly in underground or covered car parks The car parks are subject to regulations covering buildings open to the public, 9 May 2006 order. Any vehicles which use liquefied petroleum gas in their propulsion system are forbidden to enter the car parks, unless the LPG tank is fitted with a safety valve We also remind users that, in accordance with the prefectural police order, the following are forbidden: - smoking in the secure car parks and the underground and covered car parks. - the storage inside vehicles of oil, fuel (except in the fuel tank) or rags soaked with grease, inflammable or explosive substances. 4 6.8. The electrical system in place in areas accessible to the public is used for lighting only. Power sockets of any type whatsoever are for the exclusive use of Société des Aéroports de la Côte d'azur, and car park users are strictly forbidden to utilize them. Article 7 - ENTRANCES AND EXITS 7.1. Entrances: Entrances are designed with an "entry bay" configuration equipped with 2 barriers (one heavy and one light) or retractable security columns. Entry to car parks is controlled automatically and is activated by: - the vehicle for the opening of the "entry bay". - the driver taking an time- and date-stamped entry ticket from the entry station when approaching in the vehicle, - the user inserting an access card issued under certain conditions by Société des Aéroports de la Côte d'azur. Carrying out one of these actions will cause the entry barrier to open, allowing access to the car park Exits: Exits are designed with an "exit bay" configuration equipped with 2 barriers (one heavy and one light) or retractable security columns. Exits from the public and secure car parks is controlled automatically and is subject to payment of the parking fee when recovering the vehicle. Exit from the car parks is subject to: - the presentation of an access pass (parking ticket) at the automatic payment machines, with a view to payment in cash or by credit/debit card, or, at the manual cash tills, with a view to payment in cash or by cheque or credit/debit card. - the insertion of a credit/debit card directly in the exit machine. - the insertion by the user of an access card issued under certain conditions by Société des Aéroports de la Côte d'azur. Carrying out one of these actions will cause the exit barrier to open, allowing the vehicle to exit the car park. Article 8 - USAGE FEES In application of Articles R 213-3, R and R of the French Civil Aviation Code and Article 44 of the prefectural order of 21 July 2008, parking in car parks and additional services give rise to the collection of usage fees in accordance with the tariffs in force. These tariffs are set in accordance with the regulations in force. They are revised annually. Fees must be paid before leaving the car park and no exceptions will be made to this rule. Usage fees are posted at the entrances to car parks. Access and Parking Department 08/06/2010 4
5 Article 9 - LIMITATION OF RESPONSIBILITIES - EXCLUSIONS 9.1. Non-secure public car parks: Société Aéroports de la Côte d Azur shall not be held responsible in the event of damage, accident, fire or theft within the non-secure car parks. Parking in these car parks is at the expense, risks and perils of the vehicle owner, as the fees collected are simple parking fees which do not include security and surveillance. Pedestrians must respect signs and floor markings, and move around within the car parks at their own risk Secure car parks G1 and G2: When vehicles are parked in secure car parks G1 and G2, Société des Aéroports de la Côte d'azur can only be held responsible for: The theft of vehicles, limited to the monetary value of the vehicle as evaluated by experts, and only if Société des Aéroports de la Côte d'azur is responsible and under the condition that the vehicle doors were locked and a forced entry statement is made (with a complaint lodged) within 3 days of the day that the theft is discovered. Société des Aéroports de la Côte d'azur shall not under any circumstances be held responsible for: - the theft of accessories or other articles fixed or left inside the vehicle, whatever their value or size (radios, cassette players, compact disc players, roof racks, car telephones, satellite navigation systems etc.) - any indemnity for loss of use or registration document fees, - any elements which can be taken off of the vehicle, - material damage caused to the vehicle within the secure car parks (dents, scratches, fire etc.). Société des Aéroports de la Côte d'azur will in no case take out any insurance on behalf and in the name of users to cover risks for which the company is not responsible. Société des Aéroports de la Côte d'azur is not answerable for unexpected circumstances, natural phenomena or cases of force majeure, such as but not limited to armed robbery, fire, freezing, flood, storm, strikes, rioting etc. Article 10 - LOST TICKETS AND CARDS Should the entry ticket be lost, the car registration document and a form of identification must be presented in order to remove the vehicle from the car park. On presentation of these official documents, a lost ticket declaration will be recorded. Users who are unable to present their entry tickets must go to the manual cash tills and present proof of their date and time of arrival in the car park. Should the user be unable to provide such proof, the list of vehicle registration numbers created by the computer and video system will make it possible to calculate the fee to be paid. This parking fee will not be inferior to the fee for 24 hours' parking, according to tariffs applicable in the car park concerned. The fee paid will not be refunded under any circumstances. Article 11 - MANAGEMENT OF DISPUTES CONCERNING CREDIT/DEBIT CARDS Should the fee paid by credit or debit card be incorrect, the user must make a written request for reimbursement to Nice Côte d'azur Airport Customer Service Department. The request must be accompanied by proof of payment and the original of the bank statement showing the incorrect debit. Access and Parking Department 08/06/2010 5
6 Article 12 - PENALTIES In application of article 26 of the prefectural order of 21 July 2008, vehicles parked in breach of articles 4.1 and 4.2 of these regulations may be removed at the risks and perils of offenders. Article 13 - APPLICABLE LAW - JURISDICTION Any dispute relating to the use of car parks shall, by express agreement of the parties, be subject to French law and the exclusive jurisdiction of the Courts of Nice, place of performance, irrespective of the introduction of multiple defendants or third parties. This provision also applies in the event of emergency proceedings. Article 14 - NOTICES These rules can be consulted on the website and are made available to users at the Access and Parking Department office at the Terminal 1 coach station.
