1 Jinjiang Proposal: To develop cross-border E-Commerce and promote inclusive trade The 6 th APEC E-Commerce Business Alliance 29 Jun 2016, Jinjiang China We, the representatives of APEC E-Commerce Business Alliance Members, gathered together in Jinjiang, China, on the occasion of "The 6 th APEC E-Commerce Business Alliance Forum" on the theme of "Promoting inclusive trade through cross-border E-Commerce " have explored recent developments in cross-border E-Commerce and their impact on the ability of SMEs to participate in international trade. We have looked at these developments deeply and comprehensively from the perspective of opportunities and challenges, ensuring data privacy and security in the era of big data. In addition, we have examined how developments in these areas could best benefit SMEs and realize the potential of E-Commerce to: drive a new round of global economic development; deepen Asia-Pacific regional economic cooperation; and, as a result, promote stability, development and prosperity in the Asia-Pacific region. We have recognized the profound changes in international trade patterns which will result from cross-border E-Commerce and which have the potential to promote the development of inclusive trade.
2 And, in support of the aims and objectives of the APEC E-Commerce Business Alliance, we are committed to building a barrier-free, efficient and convenient platform for E-Commerce exchanges and cooperation between business and government, between businesses and between businesses and consumers in the Asia-Pacific region. In addition, we recognize that, in order to accomplish this objective the Alliance should commit to: Analyzing and researching the current E-Commerce situation and identifying those problems faced by enterprises in the Asia-Pacific region Realizing fully the potential of regional alliances to provide advice and recommendations to those bodies in APEC economies which are tasked with making comprehensive plans on e-commerce development, laws and regulations, policies and measures, Creating more business opportunities for enterprises, and especially MSMEs (micro, small, medium enterprises) in order to have a positive impact on sustainable and stable economic growth for each APEC economy. For these purposes, our suggestions are as follows; 1. To implement policy and business research, taking full advantage of the specialized knowledge of Alliance members, in order to, actively explore
3 how E-Commerce can be developed in order to support and promote the participation of MSMEs in international trade and their integration into international value chains, including: a) the identification of existing best practices and existing barriers to participation; b) possible actions to promote best practices and address the barriers; c) future prospects; d) cross-border E-Commerce platforms and environments; e) the contributions that the Internet and E-Commerce make to stimulating innovation and entrepreneurship by MSMEs; f) the improvements needed in Member s innovation frameworks (policies, laws, regulations, available services, etc.) in order to support their aspirations for E-Commerce related innovation, economic diversification and development. 2. To actively promote and undertake activities to strengthen members government agencies and private-sector E-Commerce organizations., 3. To actively encourage and contribute to the development and implementation of the regulations, standards and technical service infrastructure needed to support participation in international
4 cross-border Electronic Commerce and, in particular, participation by MSMEs by: a) encouraging the provision of an enabling legal environment based on international and regional law and other legal instruments that support cross-border e-commerce and paperless trade b) supporting the establishment of cross-border E-Commerce credit verification systems for MSMEs in the APEC region; c) encouraging cooperation and collaboration modes such as Public Private Partnerships (PPPs) d) promoting the development of standards and agreements supporting platform to platform information exchanges and interoperability e) Encourage the implementation by E-Commerce platforms of best practices in their rules with regard to data privacy, consumer protection, intellectual property rights, etc. f) encouraging the reform of international logistics practices; g) and also encouraging the development of new international payment systems and credit rules which take into account the needs of MSMEs in cross-border E-Commerce.

To recommend that all APEC governments and regulatory bodies support and contribute to the development and implementation of harmonized standards for information technology and E-Commerce that can be used across the APEC region. This includes the APEC Cross-Border Privacy Rules (CBPR) that have been developed by the APEC Economies to support e-commerce in the APEC region. 5. We also request that governments encourage and support input to related standards development processes from the business community and, particularly, MSMEs. 6. Member economies should encourage development and implementation of a network of e-commerce platforms and infrastructures that provide E-Commerce access to MSMEs in any APEC economy. 7. Suggested actions: a) To promote and encourage the provision of an enabling legislative environment for cross-border electronic commerce and, relevant regional and international agreements. b) To promote trade facilitation measures, which are important for facilitating the movement of physical goods purchased via E-Commerce and, in particular, to call for the swift ratification and implementation of the WTO Trade Facilitation Agreement (WTO TFA) by APEC members; and especially those measures related to expedited shipments,
6 pre-arrival processing, the introduction of full paperless, electronic formats and a commercially meaningful de minimis threshold for low-value shipments. c) To work to ensure adequate input from the E-Commerce business sector into the National Trade Facilitation Committees that all WTO Members must establish under the WTO TFA (article 23). d) To further call for Members to establish, within the information portals called for under article 01 of the WTO TFA, sections dedicated to the policies and regulations specifically relevant to E-Commerce e) To set up a system of designated contacts and an information-sharing network within the APEC region, which would: Publish updates from each economic entity on its E-Commerce relevant policy; Publish information on cooperation projects and development opportunities in the field of E-Commerce, Promote information exchange between all members; Share E-Commerce development results and achievements; Provide capacity-building opportunities f) To identify and publish APEC region cross-border E-Commerce best practices focusing, in particular, on the following areas: exchange visits between enterprises; business cooperation; the development of service sectors that support MSME s using E-Commerce; technical
7 support to MSMEs; investment in E-Commerce; g) To reduce the digital E-Commerce divide between Member economies by emphasizing and strengthening capacity-building in the field of E-Commerce and encouraging capacity-building training activities, and h) To identify gaps in the standards framework required to support the use of E-Commerce by MSMEs in the region and actively encourage governments and private sector organizations to develop and finance projects in appropriate fora to address these gaps. i) To encourage APEC economies to undertake reviews of their national E-Commerce environments and policies 8. We are committed to continuing to strengthen coordination and cooperation with other relevant international, regional cooperation organizations and forums, so that the APEC E-Commerce Business Alliance can play a more important role at regional and global level.
