2 Page 2 Planning Services: Tree Removal Policy and Tree Fund and Tree Removal Bonds Revised 2/13/97, 1/1/02, 4/24,06 Purpose: To establish a uniform interpretation of the tree replacement criteria and procedures for the issuance of tree removal permits, collection of tree removal bonds and collections of contributions to the tree fund as provided for in Ordinance No. 124, the Charter Township of Canton Forest Preservation Ordinance. Background: Article 5A of the Zoning Ordinance establishes standards for tree replacement and requires guarantees for the replacement trees, requires that the replacement trees to be of the same species, or at a minimum, the same type of tree (shade, evergreen, ornamental). If physical constraints inhibit the ability to replace all or a portion of the required replacement trees on the property from which they were removed, the project sponsor may elect to pay monies into the Township tree fund. The ordinance also states that the amount for each tree shall be based on current market value. (see schedule below). Policy: Tree Removal Bonds - Prior to issuance of a tree removal permit where replacement trees are required to be planted, a cash bond or letter of credit shall be submitted to the Planning Services Division for 110% of the cost of the replacement trees. This cost shall be based on a 2 year guarantee from the nursery or landscape contractor, the cost of planting, and the cost of labor to remove, dispose and replace any dead material throughout the 2 year guarantee period. Tree Fund - Prior to issuance of a tree removal permit where the project sponsor opts to pay into the tree fund for all or a portion of the required tree replacement, the tree removal bond (as required above) and/or cash payment into the tree fund shall be submitted to the Planning Services Division. The payment shall be based on the following schedule: 2 DBH (regular) Replacement Tree: $ DBH (landmark) Replacement Tree: $ Procedure: The Planning Services Division will evaluate tree removal permits based on the guidelines set forth in the Forest Preservation Ordinance and the information required to be submitted with the attached application for tree removal permit. Effective Date: May 1, 2006

3 Page 3 THE FOLLOWING INFORMATION MUST ACCOMPANY THIS APPLICATION IN ORDER TO FACILITATE AN ADEQUATE REVIEW 1. Submit 4* copies of the tree survey indicating species, size and location of all trees 6 or greater in diameter measured 4 1/2 above existing grade. Label all trees that are to be removed. 2. Identify all landmark trees. 3. Tree replacement calculations including species type, size and proposed location of all required replacement trees. 4. Indicate method of protection for all trees to be preserved. *Revised 8/5/99

4 Page 4 FOREST PRESERVATION SUMMARY Permit Exemptions: 1. All agricultural / farming operations (including production of fruit and timber) and commercial nursery / tree farm operations (land cleared must be farmed for at least one season after the clearing is completed) 2. Occupied lots of less than 2 acres in size 3. Tree clearing by Public Utilities (as defined n the Zoning Ordinance) 4. Removal of trees which have become a danger to human life or property Permit is Required to: 1. Remove or relocate any tree with 6 Diameter at Breast Height (DBH) - 4 1/2 above grade DBH minimum. 2. Remove or damage any landmark tree (see attached list) 3. Remove or damage any tree (3 DBH min.) located within a forest (an area of 1/2 acre or more with at least 28 trees 6 DBH min.) 4. Clear cut or grub (removal of under canopy vegetation from a site) within the drip line of a forest (an area of 1/2 acre or more with at least 28 trees 6 DBH min.) Permit Applications: Permits are obtained by submitting a permit application with sections I, II, IIIa, & V, completed and 3 sets of tree removal and replacement plans. An application form can be obtained from Planning Services. The tree removal and replacement plans must include the location, species, size and procedure for removing, relocating, or saving each tree of 6 DBH or larger on the site except Box Elder, Ash and Poplar. Landmark trees (24 DBH or larger or on the landmark tree list) must also be noted. How remaining trees will be protected during construction / clearing activities must also be indicated. The tree replacement plan must include the location, species, and size of each of the replacement trees to be provided. Applications received by noon on any Thursday will be reviewed in accordance with Development Review Committee Procedures.

5 Page 5 FOREST PRESERVATION SUMMARY (cont.) Replacements: Up to 25% of the total trees on a site may be removed (with a tree removal permit) without replacement except for landmark trees. Landmark trees must be replaced. Landmark Tree Replacement: Every landmark tree removed must be replaced by 3 trees of a 4 caliper. (Regular) Tree Replacement: Each tree removed beyond the allowed 25% of the total trees on the site shall be replace by: One 2 1/2 caliper deciduous or one 8-9 foot evergreen replacement tree OR One 3 to 3 1/2 caliper replacemtn deciduous or one 9-10 foot evergreen tree for each 1 1/2 trees removed OR One 4 caliper replacement tree or 10 foot evergreen for each two trees removed Replacement Tree Standards: The replacement trees are to be guaranteed for 2 years. The replacement trees should be of a similar species as the original tree if possible. If you have any questions please check with the Township Landscape Inspector. The replacement trees shall be located on the same site as those removed if possible. Where tree replacemtn is not possible on the same site, the permit grantee shall pay monies equal to the per tree amount representing the current market value for the tree replacement that would otherwise have been required into the Township tree fund for tree replacement within the Township or provide an offsite replacement plan as specified in the Canton Township Zoning Ordinance. Miscellaneous Information: Tree removal shall not commence prior to approval of a site plan, final site plan for site condominiums or final preliminary plat for the subject property. Applications for tree removal beyond that required for surveying and staking will not be accepted until the applicable approval had been granted. The Township should receive notice of tree removal activity at least 10 days prior to commencement of such activity, either by receipt of a tree removal permit application or letter of notification prior to application. Upon approval of the tree removal permit application and issuance of a tree removal permit, the tree removal activity described upon that permit may be undertaken. No changes can be made without approval of the Township. (Revised 10/02/06)
