1 APPLICABILITY DATES OF ICAO ANNEX PROVISIONS The Secretariat in the ICAO European/ North Atlantic Regional Office has listed Annex provisions having a specific applicability differing from that of the overall Annex amendment. This list is in Appendix B. However, as some of the topics may be addressed in several Annexes, Appendix A provides a summary of those provisions, grouped by topics. 2 APPENDIX A DETAIL OF ANNEX PROVISIONS WITH SPECIFIC APPLICABILITY DATES = OR > 2005 Annex/Chapter Paragraph Provision text Applicability Aeroplane and helicopter pilots and those flight navigators who are required to use the radio telephone aboard an aircraft shall demonstrate the ability to speak and understand the language used for radiotelephony communications. 5 March 2008 Annex 1/Chapter 1 Note. Pursuant to Article 42 of the Convention on International Civil Aviation, paragraph does not apply to personnel whose licences are originally issued prior to 5 March 2004 but, in any case, does apply to personnel whose licences remain valid after 5 March 2008.

3 Annex/Chapter Paragraph Provision text Applicability As of 5 March 2008, aeroplane and helicopter pilots, air traffic controllers and aeronautical station operators shall demonstrate the ability to speak and understand the language used for radiotelephony communications to the level specified in the language proficiency requirements in the Appendix. 5 March As of 5 March 2008, the language proficiency of aeroplane and helicopter pilots, air traffic controllers and aeronautical station operators who demonstrate proficiency below the Expert Level (Level 6) shall be formally evaluated at intervals in accordance with an individual s demonstrated proficiency level. 5 March 2008 Annex 1/Chapter Detail The following details shall appear on the licence: [ ] I) Name of State (in bold type); 5 March 2008 XIII) Remarks, i.e. special endorsements relating to limitations and endorsements for privileges, including from 5 March 2008 an endorsement of language proficiency; Annex 6, Part 1 Chapter 3 Annex 6, Part I Chapter From, an operator of an aeroplane of a maximum certificated take-off mass in excess of kg shall establish and maintain a flight data analysis programme as part of its accident prevention and flight safety programme From, all aeroplanes which utilize data link communications and are required to carry a CVR shall record on a flight recorder, all data link communications to and from the aeroplane. The minimum recording duration shall be equal to the duration of the CVR, and shall be correlated to the recorded cockpit audio. Annex 6, Part I Chapter From, all turbine-engined aeroplanes of a maximum certificated take-off mass in excess of kg or authorized to carry more than nine passengers, shall be equipped with a ground proximity warning system which has a forward looking terrain avoidance function.

4 Annex/Chapter Paragraph Provision text Applicability From all piston-engined aeroplanes of a maximum certificated take-off mass in excess of kg or authorized to carry more than nine passengers shall be equipped with a ground proximity warning system which provides the warnings in a) and c), warning of unsafe terrain clearance and a forward looking terrain avoidance function From, all aeroplanes operated on long-range over-water flights as described in shall be equipped with at least two ELTs, one of which shall be automatic From, all turbine-engined aeroplanes of a maximum certificated take-off mass in excess of kg or authorized to carry more than 19 passengers shall be equipped with an airborne collision avoidance system (ACAS II). Annex 6, Part II Chapter From, all turbine-engined aeroplanes of a maximum certificated take-off mass in excess of kg or authorized to carry more than nine passengers, shall be equipped with a ground proximity warning system which has a forward looking terrain avoidance function From, all aeroplanes which utilize data link communications and are required to carry a CVR, shall record on a flight recorder, all data link communications to and from the aeroplane. The minimum recording duration shall be equal to the duration of the CVR, and shall be correlated to the recorded cockpit audio From, all aeroplanes operated on extended flights over water as described in b) and when operated on flights over designated land areas as described in 6.4 shall be equipped with one automatic ELT. Annex 6, Part III Section II, From, all helicopters which utilize data link communications and are required to carry a CVR, shall record on a flight recorder, all data link communications to and from the helicopter. The minimum recording duration shall be equal to the duration of the CVR, and shall be correlated to the recorded cockpit audio From, all Performance Class 1 and 2 helicopters operating on flights over water as described in a) and Performance Class 3 helicopters operating as described in b) shall be equipped with at least one automatic ELT and at least one ELT(S) in a raft From, helicopters on flights over designated land areas as described in 4.6 shall be equipped with at least one automatic ELT.
